City Attorney Jeff Jorgensen stated that Council had met in Closed Session regarding existing
litigation (City vs. Miller, Walter et al.)

The Council welcomes your input. You may address the Council by completing a speakers
slip and giving it to the City Clerk prior to the meeting. At this time, you may address the
Council on items that are not on the agenda or items on the Consent Agenda Time limit
is three minutes. State law does not allow Council to take action on issues not on the
agenda. Staff may be asked to follow-up on such items.

► 1. TREE APPEAL - JAYCEE DRIVE (McCLUSKEY/407 - 20 min.)
Public hearing to consider an appeal by Liz Gladwill of a Tree Commission decision to deny tree
removal request at 382 Jaycee Drive.
* RECOMMENDATION: Adopt resolution upholding the Tree Committee's decision to deny the
removal request

► 2. TENTATIVE TRACT MAP - PISMO STREET (JONAS/410 - 20 min.)
Public hearing to consider a tentative tract map to create 9 air-space residential condominiums
at 533 Pismo Street; Derek Eastwood, subdivider. (City File No. TR 139-93)
4 RECOMMENDATION: Adopt resolution approving the vesting tentative map for Tract 2139.
Jonas* FINAL ACTION. Resolution No. 8244 adopted (5-0).
► 3. AIRPORT AREA ANNEXATION (JONAS/441 - 1 hr.)
Public hearing to consider the revised schedule for analyzing and pursuing the Airport Area
Annexation, including the Margarita Expansion Area, and protection of open space south of the
Airport Area.
+ RECOMMENDATION: 1) By motion, approve the revised schedule; 2) Adopt resolution to
initiate the annexation process; 3) Direct staff to submit application materials to the Local Agency
Formation Commission (LAFCo); 4) Receive information regarding alternatives for protection of
open space and direct staff to work with the County to develop a policy program and to adopt
a joint policy of non-annexation, non-urban development and retention of agricultural and open
space uses for the area within the City's greenbelt south of the Airport Area.

Jonas* FINAL ACTION. 1) Revised schedule approved (4-1, AS-no); 2) Resolution No. 8245 adopted
as amended to add Section 6: City retains the right to revoke application if environmental and
fiscal impacts are not beneficial to the community, or if an equitable tax allocation exchange
cannot be reached(4-1,AS-no); 3) Direct staff to submit application materials to LAFCo (4-1,AS-
no); and, 4) Direct staff to work with the County and other agencies to develop policies and
programs regarding greenbelt areas within areas south of the airport (5-0).

Consideration of plans and specifications for"Bridge Replacement Project: Nipomo Street at San
Luis Creek,° City Plan No. J-12H, estimated total cost: $602,500 (State Share: $440,000; City
Share: $162,500). (Plans and specifications are available in the Council Office for review.)
♦ RECOMMENDATION: By motion: 1) approve plans and specifications; 2) Authorize staff to
solicit bids; 3) Authorize CAO to award a contract to the lowest responsible bidder within
engineer's estimate; and, 4) Authorize allocation of up to $7,500 to BIA/Merchant Association
for promotion and advertising to mitigate economic effects of the project.
McCluskey* FINALACTION: Approved bid solicitation and CAO award of contract;authorized allocation of
up to $7,500 for mitigation of effects of the project (5-0).
COMMUNICATIONS (not to exceed 15 minutes).
At this time, any Council Member or the City Administrative Officer may informally:update'
the"City Council on communications and ask for comment and/or discussion. 'Due to State'
law, formal action or approval may not betaken. Action on items maybe scheduled at the
next Regular Meeting.
Council Members Rappa and Romero asked to schedule the Madonna/Costco request for a
study session on December 16th (5-0).

Properties) and existing litigation (Boles vs. City and Gove vs. City).
B. RECONVENED IN OPEN SESSION TO REPORT NO ACTION TAKEN.
