SUBJECT: Determination of the Need for a Second Taxicab Company in San Luis Obispo, and
Issuance of Certificate of Public Convenience and Necessity.
CAO RECOMMENDATION:
Adopt a resolution to issue Certificate of Convenience to Central Coast Taxi Trust of Santa Maria to
operate taxicabs in San Luis Obispo and authorize Clerk to issue Taxi Cab Permits when appropriate.
DISCUSSION:
Background
The City has had two taxicab companies operating within the City for several years. They were Laidlaw
Yellow Cab and Mr. Limo Inc. dba Yellow Cab of Five - Cities. On January 1, 1993, the City was
informed that Yellow Cab of Five - Cities was acquired by Central Coast Taxi Trust (CCT Trust), of Santa
Maria. CCT Trust has made application for a new Certificate of Public Convenience and Necessity.
Process
Municipal Code 5.20.050 requires the City Council to hold a public hearing to "determine whether the
public convenience and necessity require the operation of a taxicab, or taxicabs, for which application
is made... ". The determination is to be made based on seven points.
Staff FindinCs relative to the 7 points are as follows:
A. Public demand for additional service: In the past three years, two taxicab firms were operating.
This request is from a successor of one of the firms. No requests have been received for
additional service.
B. The adequacy of existing mass transportation and taxicab service: Having received no requests
for additional taxicab service, current service levels appear to be adequate.
C. Financial responsibility and experience of the applicant: CCT Trust has provided service in Santa
Barbara County for the past five years. They have provided the required insurance certificates to
operate in San Luis Obispo.
D. The number, kind and type of equipment and the color scheme to be used:
The two vehicles are a 1982 Ford sedan, and a 1987 Aerostar van.
The color scheme is yellow with the 5 cities logo on the door in black and white.

Effects of taxicab service on traffic congestion. It is anticipated that there would be no
measurable effect on traffic congestion.
Taxicab service resulting in a greater hazard to public. It is anticipated that there would be no
increased hazard created by the taxicab service.
G. Other relevant facts:
No other relevant facts have been recognized from this request for the provision of taxicab
service. Two drivers, along with a copy of the taxi driver permit for each (obtained through SLO
Police Department), have been provided by C.C.T.
Municipal Code states that the Police Department will inspect cabs prior to issuance of taxi permits. In
practice, this activity was delegated to the Transit Manager in previous years. As the Transit Manager
is not qualified to perform safety inspections, the applicant has secured safety inspections on the proposed
vehicles from a certified independent local ASE service garage. At this time, required documentation
has been provided on two cabs, a 1982 Ford sedan and a 1987 Aerostar van.
STAFF EVALUATION OF REOUEST:
Staff has some concern that the proposed cabs look much like the cabs operated by Yellow Cab of San
Luis Obispo, with only the name being different. This has led to some confusion by the public and a few"
complaints by the cab companies about pirated pick -ups. However, the color and logo are unchanged
from that of the previous operators of 5 Cities Yellow Cab, and the problem of like color did not
generate significant problems.
On two occasions, under the previous operator, the City was required to issue letters of cancellation for
failure to supply insurance in a timely fashion. This has not been repeated with CCT Trust in the short
time they have been operating 5 Cities Yellow Cab. Since the existing two companies are providing
existing acceptable service, staff recommends no changes and therefore recommends that CCT Trust be
allowed to continue operating 5 Cities Yellow Cab.
TAXICAB PERMITS:
In addition to the requirement for a Certificate of Public Convenience to operate a taxicab, the Municipal
Code 5.04.040 also requires that each cab have a permit for each vehicle. On August 24, 1993, the
Clerk received a check to cover Business Tax Certificates for four cabs. The vehicles were 1974, 1981,
1982 and 1983 vehicles.
FISCAL IMPACT:
Denial of the request would result in negligible fiscal impact to City government in lost city license fees.

RESOLUTION NO. (1994 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LIIIS OBISPO
GRANTING CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY TO
CENTRAL COAST TAXI TRUST FOR THE PURPOSE OF PERMITTING
TAXICAB SERVICE IN THE CITY OF SAN LIIIS OBISPO
WHEREAS, Central Coast Taxi Trust (CCTT) desires to provide
taxicab service in the City of San Luis Obispo; and
. WHEREAS, CCTT has filed an application for Certificate of
Public Convenience and Necessity with the City Clerk's Office
pursuant to Municipal Code Section 5.20.030 (Exhibit "A" attached);
and
WHEREAS, the public convenience and necessity require the
granting of a Certificate of Public Convenience and Necessity,
NOW THEREFORE, BE IT RESOLVED that the City Council of the
City of San Luis Obispo hereby grants a Certificate of Public
Convenience and Necessity to CCTT (dba Yellow Cab of Five Cities)
for the purpose of permitting taxicab service in the City of San
Luis Obispo pursuant to and contingent upon compliance with
Municipal Code Chapter 5.20, and authorizes the City Clerk to issue
a taxicab permit for each taxicab now complying with Municipal Code
Chapter 5.20 within the City.
