AGENDA REPORT ITEM NUMBER: FROM: Lynn Block, Administrator, Business Improvement Association SUBJECT: Revisions to the Thursday Night Activities /Farmers' Market Rules and Regulations.. The new regulations reflect needed changes in the management of the event to continue the BIA policy of running a self- supporting market. CAO RECOMMENDATION: Adopt a resolution approving the Business Improvement Association's Thursday Night Activities /TNA Rules and Regulations. DISCUSSION: Background: The Business Improvement Association works . to maintain the original purpose of TNA /Farmers' Market, promoting downtown San Luis Obispo. Through the Thursday Night Activities Committee and Board of Directors, the rules governing the event are reviewed annually to ensure that each application and participant in the event is treated in a fair and equitable manner. The TNA Committee deals each week with the operational issues involved in running the event. The Board of Directors makes policy decisions about the event based on the recommendations of the committee and the effect of the event on.the BIA. Several major changes to the rules are underlined in the attached copy for City Council review. These changes are as follows: * clarification of the Fire Lane. (See Section 2). * re- emphasis that merchandise sold by BIA members must be part of an established inventory. (Section 3). * merchandise that non - profit groups sell for fund raising events should be displayed at the booth on the approved date only. (Section 5). * non - profit groups must supply the BIA with documentation of their non - profit status. (Section 5). * clarification in the distance LPG containers can be from each.other barbecues. (Section 13). * requirement of proof of insurance for BIA member participant booths, not non - profit groups. (Section 17). * limitation on vehicles as part of the event.(Section 17). Conclusion: The rule revisions are fair and applicable to participants in the event and do not adversely affect any particular group. The revisions are simple modifications noted by the BIA throughout the past year. CONCURRENCES: The revised regulations have been approved by the City Attorney and BIA Board of Directors. FISCAL.IMPACTS: TNA /Farmers' Market operates as a totally self supporting event and has no fiscal impact to the City. Resolution 8061 (1993 Series) is hereby rescinded. SECTION 2." That the BIA Rules and Regulations for Thursday Night Activities, attached hereto marked Exhibit "A" and incorporated herein by reference, have been reviewed and are accepted. Recommended changes shall be made from time to time by the BIA Board of Directors for subsequent Council approval.
