Stewart (left meeting at 7:15 PM) Council Members Absent: Council Member Jan Marx City Staff Present: City Manager Whitney McDonald, Christine Dietrick, City Attorney, Teresa Purrington, City Clerk _____________________________________________________________________ 1. CLOSED SESSION (4:15 PM START) 1.a CALL TO ORDER Mayor Stewart called the Closed Session to order at 4:17 PM in the Council Hearing Room of City Hall. 1.b CONFERENCE WITH LABOR NEGOTIATORS ACTION: City Attorney Christine Dietrick indicated the Council met in Closed Session with the agency negotiator Nickole Domini. City Attorney Dietrick and City Manager McDonald were not in the Closed Session. Nickole Domini told her that there was no reportable action taken. 1.c CONFERENCE WITH LEGAL COUNSEL—ANTICIPATED LITIGATION ACTION: City Attorney Christine Dietrick indicated there was no reportable action taken. 1.d ADJOURNMENT Closed Session adjourned at 5:30 PM to the Regular City Council meeting. 2. CALL TO ORDER Page 11 of 412 2 A Regular Meeting of the San Luis Obispo City Council was called to order on April 21, 2026 at 5:35 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart, with Council Member Marx absent. 3. PLEDGE OF ALLEGIANCE Mayor Stewart led the Council in the Pledge of Allegiance. Mayor Stewart announced that Item 7b would be moved to after Item 8a as she would be recusing herself from Item 7b as she is waiting for a determination on if she has a conflict on Item 7b due to her husband occupation as a realtor. 4. PRESENTATIONS 4.a CALIFORNIA CITIES WEEK Mayor Stewart accepted the Proclamation on behalf of the League of California Cities Board. 4.b VOLUNTEER APPRECIATION WEEK Mayor Stewart presented the Volunteer App reciation Proclamation to Kiersten Anderson, Volunteer Coordinator for the City of San Luis Obispo. 4.c BIKE MONTH Mayor Stewart presented a Proclamation to Hannah Heavenrich on behalf of SLO County Rideshare declaring May 2026 as Bike Month. 4.d CITY MANAGER REPORT City Manager Whitney McDonald provided a report on upcoming projects. 5. Ayes (4): Council Member Boswell, Council Member Shoresman, Vice Mayor Francis, and Mayor Stewart Absent (1): Council Member Marx CARRIED (4 to 0) 6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 6.b MINUTES REVIEW - APRIL 7, 2026 COUNCIL MINUTES Approve the minutes of the City Council meeting held on April 7, 2026 6.c COMMUNITY PARTNERSHIP AGREEMENT AND GRANT AGREEMENT FOR RIGHETTI FISCALINI RANCH CONSERVATION EASEMENT WITH THE LAND CONSERVANCY OF SAN LUIS OBISPO COUNTY 1. Approve a Community Partnership Agreement with The Land Conservancy of San Luis Obispo County; and 2. Approve a Grant Agreement for the Righetti Fiscalini Ranch conservation easement project; and 3. Authorize the City Manager to sign the Community Partnership Agreement and the Grant Agreement in a final form satisfactory to the City Attorney. 6.d APPROVE A MILLS ACT CONTRACT FOR LANDMARK PROPERTY AT 1421 GARDEN STREET Adopt Resolution No. 11639 (2026 Series) entitled “Resolution of the City Council of the City of San Luis Obispo, California, approving a Historic Property Preservation Agreement between the City and the Owners of the Meredith House at 1421 Garden Street (Application No. HIST-0681- 2025),” as recommended by the Cultural Heritage Committee. 6.e REVIEW OF APPLICATION TO DESIGNATE 571 PISMO STREET AS A HISTORIC LANDMARK Adopt Resolution No. 11640 (2026 Series) entitled “Resolution by the City Council of the City of San Luis Obispo, California, designating the Property Located at 571 Pismo Street as a Landmark Historic Resource, called the George and Cordelia McCabe House (Application No. HIST - 0944-2025),” as recommended by the Cultural Heritage Committee. Page 13 of 412 4 6.f AUTHORIZATION TO AWARD TRANSIT OPERATION AND MAINTENANCE SERVICES CONTRACT 1. Authorize the City Manager to award a contract to MV Transportation, Inc. for Transit Operation and Maintenance Services in a form approved by the City Attorney’s Office; and 2. Authorize the City Manager to approve contract amendments, provided that the cumulative value of all such amendments does not exceed 10 percent of the total contract amount, inclusive of all base term years. 7. PUBLIC HEARING AND BUSINESS ITEMS 7.a OVERVIEW OF VACANCIES AND RECRUITMENT AND RETENTION EFFORTS Human Resources Director Nickole Domini and Human Resources Manager Jeff Andrew provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- ACTON: By consensus the Council directed staff to receive and file the report. 8. STUDY SESSION 8.a 2026 WATER AND SEWER RATE STRUCTURE STUDY (60 MINUTES) Public Works and Utilities Director Aaron Floyd and Utilities Business Manager Shane Whitington provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- ACTION: By consensus the Council confirmed the City's prioritization of rate design attributes and directed staff to proceed with a four-year rate adoption period. Mayor Stewart left the meeting at 7:15 PM Page 14 of 412 5 7.b ORDINANCE AMENDING TITLE 13 OF THE MUNICIPAL CODE REGARDING PRIVATE SEWER LATERAL INSPECTIONS, REPLACEMENTS, AND DISSOLUTION OF THE MANDATORY WASTEWATER FLOW OFFSET PROGRAM (60 MINUTES) Mayor Stewart declared a conflict on this item. Out of an abundance of caution is waiting for determination from the FPPC regarding if she has a conflict on this item due to her husband’s occupation as a realtor. Utilities Branch Assistant Director Shawna Scott and Wastewater Deputy Director Chris Lehman provided an in-depth staff report and responded to Council questions. Introduce Ordinance No. 1756 (2026 Series) entitled “An Ordinance of the City Council of the City of San Luis Obispo, California, Amending Section 13.08.395 (Private Sewer Laterals/Systems) and Section 13.08.396 (Wastewater Flow Offset) of the City of San Luis Obispo Municipal Code.” 2. Adopt Resolution No. 11641 (2026 Series) entitled “A Resolution of the City Council of the City of San Luis Obispo, California, Authorizing the Discretion of the Public Works and Utilities Director to Waive Wastewater Flow Offset Program Requirements and Resolution and Determination of Satisfaction of Conditions of Approval Related to Wastewater Flow Offsets.” 3. Find the actions exempt from the California Environmental Quality Act (CEQA).
