DISCUSSION: The Memorandum of Agreement (MOA) between the City of San Luis Obispo and the San Luis Obispo's Mid - Management /Confidential Employees' Association (SLOMM /CEA) expired on December 31, 1993 after a one year term. As provided for in that agreement, the City entered into negotiations with SLOMM /CEA in November 1993 to develop a successor agreement. The City Council in closed session was briefed on November 23, 1993 on the various issues of mutual concern and economic considerations. The City's chief negotiator, Personnel Director Ann Slate and ACAO Ken Hampian, the City's negotiating team, then met with the Association's negotiating team led by Dennis Cox, Parks and Streets Manager. The agreement was ratified by a majority of the Association members on January 5, 1994. The agreement reflects and strengthens the continued cooperation between the Association and the City to address issues of mutual concern in a productive manner. Following is a summary of the significant changes and cost items included in the agreement. The agreement is within the economic guidelines previously discussed with Council. The Significant Issues: ■ TERM - Two years ■ SALARY - Year 1: One per cent (1 %), payable in a lump sum in January 1994. Year 2: One and one half per cent (1 172 %), payable in a lump sum but related to a Pay- for - Performance Program to be developed on or before July 1, 1994 by a committee comprised of two (2) City representatives and two (2) Association representatives. �l�h��ibhi�►11111111P�' ��lllll city of san LJ S 061 Spo Nii% COUNCIL AGENDA REPORT Page 2 MOA between the City of San Luis Obispo and the SLOMM /CEA. Page 2 ■ HEALTH INSURANCE PREMIUM CONTRIBUTIONS The City's monthly health insurance contribution shall be increased to $400 effective January 1, 1994. ■ ADMINISTRATIVE LEAVE Mid - managers shall receive an additional day of Administrative Leave, increasing their annual amount to 48 hours. ■ CONFIDENTIAL EMPLOYEES Confidential employees shall receive the same salary and insurance contribution increases and one day of Administrative Leave. FISCAL IMPACT: For FY 93 -94, the cost of this agreement is estimated to be $38,760. For FY 94 -95 they are estimated to be $52,204. Projected fund balances at the end of 1993 -95 are adequate to support these costs. ALTERNATIVE: (1) Do not approve the resolution and direct staff to negotiate a different successor agreement. This is not recommended as the agreement as presented is consistent with the Council's previous direction and the City's employer - employee relations policies. (1994 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO MID - MANAGEMENT /CONFIDENTIAL EMPLOYEES' ASSOCIATION FOR THE PERIOD OF JANUARY 1, 1994 - DECEMBER 31, 1995. BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: Section 1. The Memorandum of Agreement between the City of San Luis Obispo and the San Luis Obispo Mid- Management/Confidential Employees' Association, attached hereto as Exhibit "A" and incorporated herein by this reference, is hereby adopted and ratified. Section 2. The Finance Director shall increase the Personnel Services appropriation accounts to reflect the negotiated compensation changes. Section 3. The City Clerk shall furnish a copy of this resolution and a copy of the executed Memorandum of Agreement approved by it to: Dennis Cox, President SLOMM /CEA; Ann Slate, Personnel Director; William Statler, Finance Director. DISCUSSION: A vacancy exists on the Parks & Recreation Commission due to the resignation of Roger Picquet. The vacancy was advertised in the Tribune. After review of all new and existing applications and interviewing applicants, the Council Subcommittee is pleased to recommend Sally Stoner. Ms. Stoner's 'application is attached. All others are available in the Council Office for review.
