Subject: Appeal of an ARC decision to approve a residential development
project at 400 Brizzolara Street, between Stenner Creek and Highway
101, adjacent to the Promontory (ARC 90-141).
CAO RECOMMENDATION
Continue review until March 1, 1994 to allow the applicant and staff adequate preparation
time.
DISCUSSION:
This item has been placed on the February 15 agenda with a recommendation for
continuance in compliance with Section 1.20.040 of the Municipal Code, which requires that
all appeals to the Council be heard no later than 30 calendar days after the notice of appeal
is filed. Although the March 1 meeting is 32 days beyond the date the appeal was filed, it
is realistically the first available meeting for Council consideration of the appeal due to
notification requirements and staff report deadlines.
This appeal was filed at 4:45 p.m. on Friday, January 28. City Council processing deadlines
would require a staff report to have been completed by January 31, the following Monday,
in order to be considered at the Council meeting of February 15. The project representative
has requested additional time in order to submit the necessary sets of plans. The additional
time will also allow staff to review the appeal and prepare a report. The appellant, Mr. Phil
'Ashley, concurs with the recommendation for continuance until March 1.
On January 18, the Council approved an amendment to the Municipal Code to allow an
additional 15 days to schedule an appeal hearing. However, that amendment will not take
effect until February 18. All appeals filed before that time, including this one, are subject
to processing deadlines currently in effect.
