SUBJECT: Joint Powers Agreement for Crossing Guard Services
CAO RECOMMENDATION: Approve the Joint Powers Agreement and authorize the Mayor to
execute the agreement on behalf of the City.
DISCUSSION:
As part of on-going budget concerns, the Police Department has been working with the San Luis
Coastal Unified School District (SLCUSD) to ensure crossing guard services for our school age children.
After much discussion, the attached Joint Powers Agreement has been drafted. The Police Department
and the SLCUSD have developed the agreement to share the responsibility for this service by off-setting
City costs with a flat fee of $20,000 for the remainder of the 1993-94 budget year. In the 1994-95
budget year, the Police Department will continue to operate the program with the SLCUSD paying all
related costs plus a 20% administration fee. Based on current costs this will result in revenue into the
City of approximately $45,000 in 1994-95. It was agreed that the program and the agreement will be
reevaluated as the City begins drafting the 1995-97 financial plan. On January 4, 1994 the SLCUSD
Board of Education approved the JPA.
FISCAL IMPACT:
The agreement will return $20,000 to the General Fund for 1993-94 and approximately $45,000
for the 1994-95. This offsets current City costs of approximately $32,000 for crossing guard salaries and
will cover costs of program administration in the Police, Personnel, and Finance Departments.
ALTERNATIVE:
■ Have the SLCUSD take over crossing guard program entirely.
While a topic of discussion, the SLCUSD indicated that they needed time to review the personnel,
training, and related issues. Since the City and the SLCUSD have built a strong bond of cooperation in
these difficult budget times and since they fully cover program costs in 1994-95, it is not recommended
that the program be transferred at this time.

Joint Powers Agreement
Regarding Crossing Guard Services
between
San Luis Coastal Unified School District
and
City of San Luis Obispo
WHEREAS San Luis Coastal Unified School District (hereafter "School District" has authority over
students and their educational endeavors; and
WHEREAS The City of San Luis Obispo (hereafter "City") provides for the safety of the public,
including K-12 students, and has the necessary knowledge and powers of enforcement; and
WHEREAS it is the desire of both agencies and it is in their best interests and that of the general public
to provide for the safety of K-12 students who are on their way to and from school, consequently crossing the
streets in the community.
NOW, THEREFORE, the School District and the City agree as follows:
1. Both agencies agree to enter into a joint powers agreement for the provision of crossing guard
services.
2. For the 1993-94 school year, School District agrees to contribute to City $20,000 for the
operation of crossing guard services within the City of San Luis Obispo.
3. For the 1994-95 school year, School District agrees to contribute to City a sum equal to the City's
costs of providing crossing guard services within the City of San Luis Obispo. Such costs include,
but are not limited to, salaries, benefits, equipment, uniforms, and training. Additionally, School
District agrees to pay 20% of the direct costs as a management fee to the City for the
maintenance and supervision of the program.
4. City agrees to operate the program for crossing guard services at the same scope and size
existing in the 1993-94 school year. Any increase in hours and the number of crossing guards
must first be agreed upon mutually by both parties.
5. City agrees to operate the crossing guard program under the general guidelines contained in this
Joint Powers Agreement. If such approval is not obtained by February 15, 1994, then either
party may terminate this Agreement at its sole discretion upon giving sixty days' advance written
notice.
6. Subsequent to approval of the Joint Powers Agreement by both parties, the program for crossing
guard services shall be ongoing, and shall remain in force until terminated by either party. Either
party may terminate this Agreement by notifying the other party in writing one hundred twenty
(120) days prior to June 30 of the then current fiscal year.

DESCRIPTION OF AGENDA ITEM:
As part of the State's budget adoption, local governments were relieved from responsibility for
funding crossing guard services. The administration was asked to pursue agreements with the
various agencies to continue crossing guard services within district boundaries. This agenda item
is presented to formalize an agreement with the City of San Luis Obispo.
With the early agenda deadline because of the holidays, confirmation has not yet been received
from the City. The agreement is being reviewed as to form and content by the city attorney.
Once that approval has been given, the City will ratify the agreement. It is anticipated this will
occur prior to the Board of Education's meeting and review of this agreement.
Copies of the tentative agreement are attached. Should the City request any appropriate
changes, these will be incorporated and revised documents presented to the Board of Education
for consideration.
FISCAL IMPACT:
The tentative agreement provides that the District will reimburse the City the actual cost plus 20%
for administrative overhead to operate the program. This is estimated to be $55,000.
RECOMMENDATION:
Contingent upon approval by the San Luis Obispo City Attorney, it is recommended that the
Board of Education approve the agreement for crossing guard services with the City of San Luis
Obispo.

School District Board of Education on January 4, 1994. At that meeting, the Board approved
the joint powers agreement with the City of San Luis Obispo. We are awaiting a signature
