CAO RECOMMENDATION: By Motion, approve Amendment No. 3 to the contract with Woodward-Clyde Consultants for the Salinas Reservoir Expansion Project increasing the maximum compensation by $13,600. DISCUSSION: The City Council approved the contract with Woodward-Clyde Consultants on March 3, 1992 for the preparation of the environmental impact report for the Salinas Reservoir Expansion Project. Following certification of the environmental impact report by Council, there are a number of issues which must be addressed prior to implementation of the project. The next milestone for the project involves the transfer of ownership from the U.S. Army Corps of Engineers (ACOS) to the San Luis Obispo Flood Control and Water Conservation District. This amendment to the existing contract with Woodward-Clyde will define the scope of work for the next phase (Phase In of the Salinas Reservoir Expansion Project. Woodward-Clyde, City and County staff have met with the ACOE in an effort to clarify the studies and other requirements which are necessary to accomplish the property transfer. The ACOE has been unable to adequately define the scope of work which will be required. Therefore, the approach recommended at this point is for Woodward-Clyde to prepare a detailed scope of work that is intended to comply with the general requirements outlined by the ACOE in previous meetings. This detailed work scope will be presented to the ACOS for their approval so that accurate cost estimates based on a well defined work scope can be provided by Woodward-Clyde Consultants for the Phase II portion of the project. The additional items to be included as part of this amendment are outlined below. Amendment No. 3 - Scope of Work: ■ Develop preliminary Phase II strategy and meet with City staff to discuss work scope and approach for Phase H work ■ Prepare preliminary draft work scope for NEPA Compliance and associated ACOE required property transfer studies ■ Incorporate City's comments on preliminary draft work scope and send draft work scope to ACOE ���H�i�►►►�IIIII��Ii�°'�����III city of San lues OBIspo COUNCIL AGENDA REPORT ■ Meet with the ACOS in Los Angeles to discuss the proposed work scope and to solicit ACOE changes/refinements/agreements ■ Follow-up with ACOE staff to incorporate their comments and to prepare final work scope in format required by the ACOE ■ Refine and reformat final work scope and package together with other required Phase II work effort scopes (e.g., agency consultation and coordination) into contract amendment for consideration by Council ■ Attend meeting, if necessary, with State Water Resources Control Board to ascertain if the environmental impact report provides sufficient information relative to their pending decision concerning the time extension request for the Salinas Reservoir Water Rights Permit No. 5882 The current strategy for proceeding to the construction phase of the project involves two phases of work as outlined below: Phase II - This phase. involves National Environmental Policy Act (NEPA) compliance and additional studies associated with the property transfer. The additional studies include hazardous material evaluation and clearances, cultural resource evaluation and compliance, and may involve additional biological surveys. Consultation and coordination with California Department of Fish and Game, the U.S. Fish and Wildlife Service, and the ACOS will occur to identify these agencies concerns and requirements, particularly with respect to sensitive biological resources. Phase III - This phase would occur once the ownership transfer and environmental issues have been resolved and project implementation is not obstructed by these obstacles. Included in this phase are acquiring permits from regulatory agencies, detailed mitigation monitoring plans, preparation of detailed plans and specifications for both the dam and recreational facilities, and mitigation implementation plans. FISCAL EMPACT: Approval of the recommended amendment will increase the existing contract with Woodward- Clyde Consultants from $315,800 to $329,400. A total of$52,000 remains in available budget which has not been encumbered for studies related to the Salinas Reservoir Wansion Project, so the additional $13,600 will be taken from existing budget with no additional appropriation necessary at this time. d Attachment: A. Amendment No. 3 AMENDMENT NO. 3 CONSULTANT SERVICE CONTRACT BETWEEN CITY OF SAN LUIS OBISPO AND WOODWARD-CLYDE CONSULTANTS THIS AMENDMENT NO. 3, made in duplicate and entered into this day of March, 1994, by and between the City of San Luis Obispo (herein referred to as City) and Woodward-Clyde Consultant (herein referred to as Consultant), provides for changes to the Consultant Service Contract dated March 4, 1992, as follows: WITNESSETH: WHEREAS, City and Consultant completed and issued the Draft Environmental Impact Report for the Salinas.Reservoir Expansion Project, and conducted Public Hearings in San Luis Obispo and Paso Robles; WHEREAS, the U.S. Army Corps of Engineers (ACOE) owns Salinas Reservoir/Dam and the surrounding property and has stipulated that the property must be transferred to local control prior to project approval and implementation; WHEREAS, a number of studies and surveys must be completed to allow the ACOE to transfer the property; WHEREAS, the ACOS have not provided information and detail sufficient to define the scope of work for the studies necessary to allow the transfer to occur; WHEREAS, Consultant has offered to provide the required services to prepare a detailed scope of work for Phase II of the Salinas Reservoir Expansion Project on the terms and conditions set forth in the AGREEMENT and as modified by this AMENDMENT; NOW, THEREFORE, in consideration of their mutual covenants the parties hereto agree as follows: 1. Description of Project. The basic description of the Project, as provided in Exhibit A to the Agreement remains unchanged. 2. Scone of Services. The Scope of Services, as set forth in Exhibit A to the Agreement is modified to add the following (refer to Attachment I of this Amendment No. 3 for more information): -A. Develop preliminary Phase 11 strategy and meet with City staff to discuss work scope and approach for Phase 11 work 1 B. Prepare preliminary draft work scope for NEPA Compliance and associated ACOE required property transfer studies C. Incorporate City's comments on preliminary draft work scope and send draft work scope to ACOE D. Meet with the ACOE in Los Angeles to discuss the proposed work scope and to solicit ACOE changes/refinements/agreements E. Follow-up with ACOE staff to incorporate their comments and to prepare final work scope in format required by the ACOE F. Refine and reformat final work scope and package together with other required Phase II work effort scopes (e.g., agency consultation and coordination) into contract amendment for consideration by Council G. Compensation. The cost estimate in Exhibit A of the AGREEMENT shall be changed to increase the maximum compensation by $13,600 to $329,400. All other terms for compensation remain unchanged. ACOE COORDINATION The overall purpose of this add-on assignment is to more clearly ascertain the ACOE's requirements for NEPA compliance and related studies associated with Phase II, the property transfer. Woodward-Clyde plans to use the information gained from this work to help develop a detailed strategy and scope of services for the next phase of the project, and to establish mutual understandings regarding ACOE/City of San Luis Obispo/County of San Luis Obispo/Woodward-Clyde responsibilities and interactions in completing the property transfer process. Woodward-Clyde recommends on-going coordination and consultation with the California Department of Fish and Game (CDF&G), the U.S. Fish and Wildlife Service (USFWS), and the ACOE so that we can solicit these agencies concerns and requirements, particularly with respect to sensitive biological resources (i.e., T and E plants/ animals, wetlands, and riparian habitat). If required, additional biological surveys could potentially be performed in the spring of 1994 to meet agencies' requirements. Woodward-Clyde assumes that project design, permitting, and the Mitigation Monitoring Plan development and implementation efforts would not be performed until after completion of Phase II services. Please note that our proposed approach to working with the ACOE and for scoping the NEPA compliance effort is based on the assumption that the City will receive full cooperation and support of ACOE staff and the County; unless this support is received in a timely manner, the cost and effort to achieve the property transfer and NEPA compliance may need to be increased. Proposed Scope and Cost Estimate for Ascertaining ACOE NEPA Requirements Woodward-Clyde estimates our costs at $11,475 to prepare for and to complete the ACOS consultation and to develop a strategy and work plan for Phase II NEPA Compliance and other key property-transfer related services. Ray, K. Julian) • Task 2 = 28 hours (based on previous discussions with the ACOE staff) • Task 3 = 6 hours (limited to one iteration of revisions) • Task 4 = 24 hours (R. Ray, K. Julian, and S. Glass; limited to one meeting) • Task 5 = 18 hours (limited to one iteration of revisions) • Task 6 = 6 hours (assumes Woodward-Clyde services are limited to preparing Contract Amendment Work Scope and Cost Estimate) B1916B131BXRR-PRO keb February 4. 1994 J Woodward-Clyde Consultants Woodward-Ch ; Mr. Gary Henderson City of San Luis Obispo February 4, 1994 Page 4 SWRCB COORDINATION The purpose of this work effort is to ascertain if the SWRCB-Division of Water Rights has any additional CEQA compliance-related requirements or concerns relative to their pending decision on whether to grant the City's request for a time extension for the existing Water Rights Permit (Number 5882). It is expected that this work effort will require one trip (with City representatives) to Sacramento and a limited amount of follow up to address any additional data requests that the SWRCB may have related to downstream water rights issues. Woodward-Clyde estimates that our level of effort to perform this task will require about 14 hours of senior personnel time, plus expenses (round trip airfare, rental car, etc.). We estimate our total costs for this task at $2,125, based on the aforementioned assumptions regarding the level of effort required. SUMMARY Woodward-Clyde estimates that our total cost to perform the specified ACOE and SWRCB coordination and Phase 11 scope development services at $13,600. Woodward-Clyde assumes that these services would be performed as an amendment to and in accordance with the terms of our existing contractual agreement with the City. We are prepared to initiate Tasks 2 through 6 of the subject services as soon as written authorization is received from the City (note: Task 1 was completed on February 3, 1994). Please return a signed copy of the authorization at the end of this letter to us as soon as possible in order to avoid further delay.
