FRATERNITY ORGANIZATION AT 280 CALIFORNIA BLVD (MOD-0036-
2026, APPL-0174-2026)
RECOMMENDATION
Adopt a Draft Resolution entitled, “Resolution of the City Council of the City of San Luis
Obispo, California, denying an appeal and upholding the Planning Commission’s decision
to revoke the Conditional Use Permit for a fraternity located at 280 California Boulevard.
The project is exempt from environmental review under Section 15061(b)(3) (Common
Sense Exemption) and Section 15270 (Projects which a Public Agency Rejects or
Disapproves) of the California Environmental Quality Act (CEQA) Guidelines as
represented in the council agenda report and attachments dated May 19, 2026 (MOD -
0036-2026, APPL-0174-2026).”
REPORT-IN-BRIEF
On August 2, 1983, City Council approved a Use Permit (U1099) to allow Alpha Epsilon
Pi (Appellant) to operate as a fraternity at 280 California Boulevard . On November 13,
2024, the Planning Commission re-reviewed the Use Permit due to confirmed code and
Use Permit violations and approved a modification (USE-0625-2024) to allow continued
operations with revised Conditions of Approval. Since the approval and modification of
this Conditional Use Permit (CUP), the Appellant has resided at and utilized the property
for fraternity activities. In 2026, the Community Development Director (Director) referred
the Conditional Use Permit to the Planning Commission for a second re-review based on
several recent violations of the permit conditions.
On March 11, 2026, the Planning Commission conducted a public hearing for the re -
review of the CUP for the fraternity. The Planning Commission voted 7-0 to revoke the
CUP because they could not make the required findings to approve a CUP enumerated
in San Luis Obispo Municipal Code (SLOMC) §17.110.070 (March 11, 2026 Planning
Commission Minutes). Specifically, the Planning Commission found that the design,
location, size, and operating characteristics of the use was not compatible with residential
uses in the vicinity (§17.110.070(A)(3)), and that continued use of the property as a
fraternity under the Use Permit was not appropriate for the subject location, was
incompatible with the neighborhood, and would be detrimental to the health, safety, and

welfare of persons living or working at the site or in the vicinity (§17.110.070(A)(5) and
§17.86.130(B)(1)). The Planning Commission was not satisfied that any set of conditions
would secure these purposes (Resolution No. PC-1117-2026). This decision does not
prevent the Appellant from re-applying for a new use permit if they choose.
On March 23, 2026, Joshua Pinksy, on behalf of the Sigma Omega Chapter of Alpha
Epsilon Pi, filed a timely appeal of the Planning Commission’s decision to revoke the CUP
(APPL-0174-2025) (Attachments B – Appeal Submittal and C - Appellant’s 3-11-26
Planning Commission Hearing Agenda Correspondence ). As described in the Appeal
Submittal, the Appellant does not concur with the findings that form the basis of the
Planning Commission’s decision. The Appellant requests that City Council grant the
appeal, reverse the Planning Commission’s decision to revoke the Use Permit, and adopt
a modified Conditional Use Permit with clear and enforceable conditions that ensure long-
term compliance and accountability.
POLICY CONTEXT
General Plan
Within the General Plan, Land Use Element (LUE) Policy 2.2.6 (Neighborhood
Characteristics) directs the City to promote livability, quiet enjoyment, and safety for all
residents, and highlights that one characteristic of a quality neighborhood includes a
sense of personal safety. LUE Policy 2.2.1 (Neighborhood Identity) encourages the City
to work with residents to address neighborhood specific issues. Additionally, Goal 7 of
the Housing Element (Neighborhood Quality) is to maintain, preserve, and enhance the
quality and livability of neighborhoods.
Major City Goals
One of the 2025-2027 Major City Goals is “Housing and Neighborhood Livability –
Healthy, Safe, and Affordable,” which specifically includes a focus on fostering diverse,
connected, and safe neighborhoods that are livable for all.
Zoning Regulations (SLOMC Chapter 17)
Per Table 2-1 of SLOMC (Uses Allowed by Zone), the establishment of a fraternity in the
R-4 zone requires approval of a Conditional Use Permit. Approval of a Conditional Use
Permit for a fraternity is subject to the requirements listed below to ensure its consistency
with the General Plan and Zoning Regulations and its compatibility with existing and
future land uses in the vicinity:

Per SLOMC §17.102.020(C)(7), revocation of a Conditional Use Permit is a quasi-judicial
process providing for the review of potential violations of conditions of approval for an
authorized use, and for the revocation of such approval based upon findings set forth in
Chapter 17.110. Per SLOMC §17.126.040(B), decisions of the Planning Commission
shall be appealed to City Council.

BACKGROUND
On August 2, 1983, the City Council denied an appeal and upheld the Planning
Commission’s approval of a Use Permit, U1099, to establish the fraternity for Alpha
Epsilon Pi at 280 California Boulevard (Attachment D – Resolution No. 5189 [1983
Series]). Approval of the Use Permit included a residential addition/remodel and various
site improvements. Since the approval of this Use Permit, the Appellant has improved
and used the project site as their residence and for their fraternity activities.
In 2024, based on confirmed code and Use Permit violations, the Community
Development Director (Director) forwarded the Use Permit for re -review to the Planning
Commission in accordance with Condition No. 131 of U1099. On November 13, 2024, the

Planning Commission approved a modification (USE -0625-2024) to allow continued
operations as a fraternity with revised Conditions of Approval (Attachment E – Resolution
No. PC-1092- 24). Modification of the Conditional Use Permit (CUP) included a 25-person
maximum for routine meetings, gatherings, or events; provisions for special events w ith
more than 25 people through Director approval; provision for re -review if conduct on the
permitted premises results in three (3) citations within any 12-month period for a violation
of law or permit condition; and grounds for the revocation of the perm it based on failure
to comply with Conditions or code requirements, violations of Federal, State, or local law,
conduct that constitutes a public nuisance or that causes adverse impacts on the health,
safety, or welfare of persons in the vicinity of the use.
In April 2025, while operating under the modified CUP, the Police Department issued two
citations to the fraternity for noise violations, the first on April 16, 2025, at approximately
10:00 PM with approximately 150 people present, and the second on April 18, 2025, at
approximately 10:00 PM with approximately 100 people present. On July 15, 2025, Code
Enforcement issued a Notice of Violations (NOV; Attachment F) related to the citations
issued in April, which resulted in a violation of the CUP, specifically Conditions No. 4, 9,
10, and 12 (Attachment E – Resolution No. PC-1092-2024 (USE-0625-2024)). The NOV
included a warning that issuance of one more citation before April 16, 2026, would result
in a re-review of the CUP, in accordance with Condition No. 2 of USE -0625-2024
(Attachment E – Resolution No. PC-1092-2024 (USE-0625-2024)).
The Police issued a third citation for a noise violation on October 29, 2025, at
approximately 9:30 PM with approximately 100 people present . Issuance of the citation
resulted in violations of CUP Conditions No. 4, 9, 10, and 12. As this citation was the third
issued within a 12-month period2, staff notified the fraternity and property owner on
January 29, 2026, that the CUP would be re -reviewed by the Planning Commission, in
accordance with Condition No. 2 of USE-0625-2024.
Planning Commission Action
On March 11, 2026, the Planning Commission conducted a public hearing for the re -
review of the CUP, USE-0625-2024, to consider the continuation of the fraternity use at
280 California Boulevard under MOD-0036-2026 (3-11-26 PC Agenda Report). In
evaluating whether to revoke, modify, or continue the CUP, the Planning Commission
considered the findings outlined in SLOMC §17.110.070(A) and §17.86.130(B), listed
below, which are required to approve a Use Permit for a fraternity or sorority use:
17.110.070(A)
1. The proposed use is consistent with the general plan and any applicable specific
plan;
2 The fraternity organization appealed all three citations. One citation appeal was dismissed due to the appeal being
filed after 10 calendar days from citation issuance. The other two citations went to an Administrative Citation Appeal
Hearing and both citations were upheld by the Hearing Officer.

2. The proposed use is allowed or conditionally allowed within the applica ble zone
and complies with all other applicable provisions of these zoning regulations and
the municipal code;
3. The design, location, size, and operating characteristics of the proposed activity
will be compatible with the existing and future land uses i n the vicinity;
4. The site is physically suitable in terms of:
a. Its design, location, shape, size, and operating characteristics of the
proposed use;
b. Traffic generation and the provision of public and emergency vehicle
(e.g., fire and medical) access;
c. Public protection services (e.g., fire protection, police protection, etc.);
and
d. The provision of utilities (e.g., potable water, schools, solid waste
collection and disposal, storm drainage, wastewater collection, treatment,
and disposal, etc.).
5. The establishment and subsequent operation or conduct of the use will not,
because of the circumstances and conditions applied in the particular case, be
detrimental to the health, safety or welfare of the general public or persons residing
or working in the neighborhood of the use, or be detrimental or injurious to property
or improvements in the vicinity of the use.
17.86.130(B)
1. As conditioned, the project will not be detrimental to the health, safety, and
welfare of persons living or working at the site or in the vicinity because conditions
have been included that place limits on the number of persons allowed on site,
restrict activities, provide adequate parking, and limit potential disturbances to
neighboring properties. The project will be compa tible with site constraints and the
character of the neighborhood.
2. The proposed project is consistent with General Plan Land Use Policy 2.6.5
and Housing Element Policy 8.6 to locate student housing projects, fraternities,
and sororities in close proximity to the Cal Poly campus and other student-oriented
uses and housing.
3. As conditioned, the proposed use is consistent with the zoning regulations
because the number of residents is consistent with the group housing maximum
occupancy limits and the parking configuration is consistent with neighboring
properties and results in an adequate number of parking spaces for residents.
The Planning Commission received and considered agenda correspondence (3-11-26
Agenda Correspondence) and public testimony. In summary, the applicant's testimony
acknowledged past violations but highlighted reduced citations in the past year,
improvements to fraternity organizational safety, and increased neighborhood outreach
efforts. The applicant and other members of the public emphasized the fraternity’s role as
a Jewish student community organization and space. One commenter opposed renewal,
citing ongoing noise, disruptive behavior, and neighborhood impacts.
The Planning Commission considered all evidence, including staff’s evaluation and
recommendation, and the applicant and public testimony. Due to the organization’s

repeated citations for noise violations, repeated exceedance of the event gathering
capacity, and failure to apply for permits or provide required parking and transportation
plans for special events, the Planning Commission determined the design, location, size,
and operating characteristics of the site as a fraternity were not compatible with residential
uses in the vicinity. The Planning Commission also found that continued use as a
fraternity was not appropriate for the subject location, incompatible with the
neighborhood, and detrimental to the health, safety, and welfare of persons living or
working at the site or in the vicinity. As such, the required findings enumerated in SLOMC
§17.110.070(A)(3), §17.110.070(A)(5), and §17.86.130(B)(1), could not be made by the
Planning Commission.
The Planning Commission voted 7-0 to revoke the Use Permit, based on the findings
specified in Resolution No. PC-1117-2026. This decision does not prevent the Appellant
from re-applying for a new use permit if they choose.
APPEAL
On March 23, 2025, Joshua Pinksy, on behalf of Alpha Epsilon Pi - Sigma Omega
Chapter, filed a timely appeal of the Planning Commission’s decision to revoke the CUP
(APPL-0174-2025) (Attachment B – Appeal Submittal). Within the arguments made in the
Appeal Submittal, the Appellant references their Agenda Correspondence from the March
11, 2026 Planning Commission Hearing (Attachment C). As described in Attachments B
and C, Alpha Epsilon Pi disagrees with the Planning Commission’s findings that continued
use of the property as a fraternity would harm the health, safety, and welfare of the nearby
community and is incompatible with the neighborhood characteristics. The Appellant
requests that the City Council uphold the appeal, reverse the Planning Commission’s
decision to revoke the Use Permit, and amend the existing permit conditions to ensure
long-term compliance and accountability.
The Appeal Submittal can be distilled into two issues, which are summarized and
discussed in the following analysis. Appeal arguments are provided for each issue within
subsections, with staff response included directly below (indented) to address each
argument.
Appeal Issue No. 1
The Appellant provides that continued use of the site as a fraternity with revised conditions
(discussed in Appeal Issue No. 2, below) would be compatible with the neighborhood and
not be detrimental to the health, safety, and welfare of the nearby community. The
Appellant includes three main reasons to support their argument, provided below with
staff response (indented) directly following.
Appeal Issue No. 1 – Reason No. 1
The Appellant states that with the property located in the R-4 zone, it is the most
appropriate zone for higher-intensity residential uses, such as fraternity operations. The
Appellant includes that revocation of the CUP could lead to spreading similar activities

into lower-density, R-1 or R-2 neighborhoods, rather than concentrating activity in areas
zoned for it.
Staff Response to Appeal Issue No. 1 – Reason No .1
Operation of a fraternity (as defined in SLOMC §17.156.014) is conditionally
allowed in the R-3 and R-4 zones, both intended for high-density residential use.
While high-density residential uses may be compatible with fraternity or sorority
uses, fraternity or sorority uses are not allowed by right in these zones. Instead,
fraternity or sorority uses require approval of a CUP so the City can determine
whether the use is compatible with existing or desired conditions in their
neighborhoods. This provides an opportunity to evaluate site-specific conditions,
adequate support facilities, and potential neighborhood impacts such as noise,
parking, and property maintenance.
Additionally, revocation of a CUP requires fraternity operations to cease at the
subject location but does not authorize or direct fraternity activity to relocate into
other residential zones. Fraternity-related activities, including but not limited to
hosting special events, are not permitted in the R-1 and R-2 zones, which are
intended for single-family and medium-density residential uses. Any fraternity
operation without an approved CUP, in any zone, would constitute a land use
violation subject to Code Enforcement or other legal actions. All properties and
residents are subject to the Noise Ordinance and all applicable City regulations.
Appeal Issue No. 1 – Reason No. 2
The Appellant states that they have shown measurable organizational improvement. They
provide that the organization has seen an approximately 85% decrease in violations over
the last two years, from receiving 13 citations in the 2023-2024 academic year, to 2
citations in the 2024-2025 academic year, and only 1 citation in the current, 2025-2026,
academic year, demonstrating a long-term commitment to compliance that was not
adequately considered in the Planning Commission’s decision.
The Appellant includes that while the existing condition measures compliance on a rolling
calendar-year basis, the organization operates under Cal Poly’s academic calendar. The
two April citations and the October citation which led to the March 2026 re-review pertain
to different academic years. The Appellant argues that the 12 -month framework included
in Condition No. 2 of USE-0625-2024 obscures a more accurate view of the organization’s
behavior and improvement, which they believe deserves more consideration.
Staff Response to Appeal Issue No. 1 – Reason No. 2
Several complaints and Use Permit violations triggered the Planning Commission
to re-review the original Use Permit and the modified Conditional Use Permit.
First Re-Review – In the 2023-2024 Cal Poly academic year, during which the
Appellant received 13 citations, Code Enforcement issued two Notices of
Violations related to those confirmed code and Use Permit violations, in March
2024 and June 2024. Based on these violations, the original Use Permit, U1099,
was re-reviewed by the Planning Commission, in accordance with Condition No.
13 of U1099 (Attachment D). On November 13, 2024, the Planning Commission

approved a modification to allow the fraternity to continue operations with revised
Conditions of Approval. One of these revised conditions established a requirement
for re-review if conduct on the premises results in three citations within any 12 -
month period for a violation of law or permit condition. This specific condition
language was first drafted during the October 15, 2024, City Council Meeting as
part of the review of an appeal of Planning Commission’s decision to approve a
fraternity CUP. The rolling 12-month review timeline was adopted for alignment
with existing Code Enforcement procedures and the desire for ongoing
accountability while considering tenant turnover from academic year to year. In the
effort to standardize conditions across use permits, and the reasons stated above,
Planning Commission adopted the same condition language.
Second Re-Review – While operating under the modified CUP, the Police
Department issued three citations for noise violations on A pril 16, April 18, and
October 29, 2025; Police noted approximately 100 to 150 people on site during
these incidents. In July 2025, Code Enforcement issued a Notice of Violations
relating to the citations issued in April 2025 for violation of the CUP. Specifically,
the citations and related incidents resulted in violations of Conditions No. 4, 9, 10,
and 12, provided below. Code Enforcement provided warning in the Notice of
Violations that issuance of one more citation before April 16, 2026, would result in
a re-review of the CUP by the Planning Commission.
The above-mentioned conditions are as follows:
4. Routine meetings and gatherings for the fraternity shall be limited to a
maximum of 25 people, except as otherwise approved by the Community
Development Director for special events. If the fraternity hosts special
events involving more than 25 people, a transportation management plan
to reduce impacts to the surrounding neighborhood shall be submitted to
the Community Development Department, at least 30 days prior to the event
taking place, for review and approval. No exception from the Noise
Ordinance shall be approved by the Director as part of the special event.
9. The fraternity use shall comply with Table 1 (Exterior Noise Limits) of
Section 9.12.060 (Exterior Noise Limits) between the extended hours of
10:00 p.m. and 9:00 a.m.
10. Prior to a special event approved by the Community Development
Director pursuant to Condition No. 4, the fraternity shall provide written
notification of the event to occupants within 300 feet of the site. The written
notification shall include the date, hours, and contact information for the
responsible party for the special event. No exception from the Noise
Ordinance shall be approved by the Director as part of the special event.
12. Failure to comply with any of the above conditions or code requirements,
or the conduct of the use so as to constitute a violation of Federal, State, or
local law, or so as to constitute a public nuisance or so as to cause adverse
impacts on the health, safety, or welfare of persons in the vicinity of this use
is prohibited and may constitute grounds for the revocation of this permit.

Additionally, while the information presented to and relied upon by the Planning
Commission was sufficient to revoke the use permit, after the March 11th Planning
Commission hearing, staff also received records of event registration forms
submitted by Interfraternity Council organizations to the Cal Poly Fraternity and
Sorority Life (FSL) office. This additional information is relevant to staff’s response
to the arguments made in Appeal Issue No. 1 – Reason No. 2. These records are
self-reported, but do not include confirmation if the events occurred. Records
indicate that 30 events were registered with FSL at 280 California Boulevard since
the modification of the CUP (from November 13, 2024, to April 10, 2026) (see
Attachment G – event registration list). In 2024, event registration forms did not
require an expected attendance count; in 2025, this requirement applied only to
events involving alcohol; and in 2026, it applied to all events, therefore, not all
records include an expected attendance count. Of the 30 registered events, 16
included an expected attendance count that ranges from 65 to 160 individuals, all
exceeding the limit of 25 individuals for gatherings without a special event permit
per Condition No. 4. No special event permits were applied for or issued for these
16 events as required by Condition No. 4.
One of the 30 FSL registered events was confirmed by the Police Department, as
it resulted in the issuance of a citation for a noise violation during the event on April
18, 2025 (Attachment G). It also appears that not all events hosted at 280
California Boulevard are registered events with the Cal Poly FSL office, as two of
the three citations received (April 16 and October 29, 2025) occurred on nights
where no event was registered to occur on site.
The organization has been aware of the conditions set forth in the November 2024
modification, which triggers a re-review if three citations are received during any
12-month period and still held events that resulted in citations and violations of the
CUP. The self-reported, registered events, though unconfirmed, show that the
organization has continuously and regularly planned to host events that surpass
the maximum gathering capacity without pursuing permits that allow staff to
evaluate the activities’ expected impacts and ensure that such activities are
compatible with their surroundings and the intent of the Zoning regulations.
Furthermore, during the March 11, 2026, Planning Commission hearing, the
fraternity representative presented information about their reduction in citations in
recent years. The Planning Commission considered this information, as well as the
information relating to the multiple confirmed use permit violations and previous
Planning Commission decisions for similar issues. Based on all the evidence
discussed, the Planning Commission was unable to make the required findings to
grant continuation of Conditional Use Permit USE-0625-2024, as required under
SLOMC §17.110 and revoked the Use Permit.
Appeal Issue No. 1 – Reason No. 3
The Appellant surveyed 14 residents that live within 200 feet of the property. The
Appellant argues that results from the survey of neighbors do not support claims of
ongoing harm, with 12 neighbors reporting no disturbances linked to the fraternity and 2

neighbors noting occasional noise that could not be directly linked to 280 California
Boulevard. The Appellant states that this direct input from their immediate community
contradicts the Planning Commission’s conclusion that their operations are detrimental to
the neighborhood.
Staff Response to Appeal Issue No. 1 – Reason No. 3
No evidence has been provided to support the claims relating to neighborhood
surveys. Staff did not receive a copy of the survey results or information related to
the manner of survey, the names, addresses, or length of tenancy of those
surveyed, or the dates, times, transcripts, or recordings of the surveys.
Additionally, while the Appellant states that some neighbors have not voiced
concerns with the fraternity, the citations received over the past few years provide
evidence that there have been instances of noise violations disrupting the
neighborhood.
Appeal Issue No. 2
The Appellant provides that revised conditions of approval would support the findings
required for continued use of the site as a fraternity. The Appellant has proposed revisions
to several of the existing conditions of approval of the CUP as well as new conditions that
they think would provide a clear and enforceable path forward (Attachments B and C).
They specifically propose changes and provide information about challenges relating to
Conditions No. 2, 4, 9, and 10, and suggested new conditions, as summarized below,
with staff response (indented) directly following.
Appeal Issue No. 2 – Condition No. 2
The Appellant requests that the CUP be re-reviewed after two citations are received within
one Cal Poly academic semester, an approximately 15 -16 week timeframe (as opposed
to existing condition threshold of three violations of law or permit condition within any
twelve-month period). The Appellant states that this threshold is stricter than the existing
threshold and would provide for quicker response times from the City without letting
violations accrue over a year’s time. They argue that this change would better align with
and provide more accountability for student organizations.
Staff Response to Appeal Issue No. 2 – Condition No. 2
While modifying Condition No. 2 to trigger a re-review after two citations are
received within one Cal Poly academic seme ster may be beneficial to both the
fraternity and the City, it could lead to increased Staff time and resources relating
to the frequency of required re-reviews. Additionally, as proposed, this does not
account for ongoing violations accruing over time. Though the organization
operates under the Cal Poly academic calendar, year-round residents in the
neighborhood may experience adverse effects of the organization overtime,
regardless of organizational executive board or resident turnover. The current
condition, which considers violations of law or permit conditions on a rolling, 12 -
month basis, provides more accountability because it requires coordination
between organizational executive board and residents as they change throughout
the school year and year after year. The actions of a specific year’s tenants,
executive board, or active members could affect the organization in the long term,

thus the 12-month rolling timeframe promotes good behavior within the
organization and accountability to their fellow members to ensure longevity of the
organization. Moreover, the Appellant’s actions thus far would be in violation of
their proposed modified condition, as they received two citations in April 2025
within the same academic quarter3.
If the Council is interested in modifying the condition, staff recommends combining
the two thresholds, such that a re-review would be required if two citations are
received in any one Cal Poly academic semester or if three citations are received
within any 12-month period to better align with the organization’s operational
calendar and to provide accountability in the short- and long-term.
Appeal Issue No. 2 – Conditions No. 4 and 10
The Appellant contends that Conditions No. 4 and 10, relating to the maximum gathering
capacity for events and the requirements for special event permitting for events that will
surpass this maximum, create practical challenges for the organization. They s tate that
the number of attendees at an event does not truly reflect whether an activity is disruptive.
The Appellant notes that given the size of the organization, events such as chapter
meetings, small philanthropic activities, or cultural or religious gatherings may exceed this
number even when they are structured, supervised, and do not disturb the neighborhood.
The Appellant suggests that a better approach would be to evaluate activities based on
their impacts, including noise levels, safety, and nuisance factors. The Appellant requests
clearer guidelines and a flexible approach to the special event permitting process. They
also note that the fees and process for special event permitting can be burdensome for
college students and create practical challenges for student organizations to comply with.
Staff Response to Appeal Issue No. 2 – Conditions No. 4 and 10
The Appellant has requested modifications to Conditions No. 4 and 10, regarding
maximum capacity for regular gatherings or events and the requirement and
process for special event permitting for events that will surpass this maximum limit.
Regarding Condition No. 4, the method used to calculate maximum capacity for
routine meetings and gatherings is 1.5 times the average population density (2 5
maximum individuals for this site). This calculation uses the residential population
assumptions set forth in the General Plan Land Use Element based on the land
use designation and zone and the site/lot area and constraints. This method is also
consistent with current practices used in recent fraternity and sorority use permit
approvals. The requirement of a special event permit for events including more
than the calculated maximum allows staff to evaluate the activities’ expected
impacts and to ensure that such activities are compatible with their surroundings
and the intent of the Zoning regulations.

Current standard CUP conditions for fraternities and sororities provide two
avenues to permit special events that include more individuals than the maximum
gathering limit. A fraternity could apply for a temporary and/or intermittent use
permit (SLOMC §17.113), which is a Director level review. Temporary use permits
are the appropriate avenue to permit a singular event, while intermittent use
permits are more suited to recurring or regularly scheduled events of similar nature
(for example, a regularly held chapter meeting). A fraternity also could apply to
modify their CUP to include all anticipated events throughout the year that would
surpass the gathering capacity as part of their project description. Both options
offer the ability to permit recurring events, such as weekly meetings or annual
events, and provide the review authority with the ability to review those events for
compatibility with the neighborhood and compliance with the intent of Zoning
Regulations and other applicable regulatory documents. However, in no case will
events permitted under either avenue be allowed to violate the Noise Ordinance.
The request by the Appellant to allow flexibility in the special event permitting
process outside of these two avenues is vague and it is unclear how review,
processing, implementation, and enforcement might be accomplished. Staff does
not recommend adopting these proposed amendments because they are
inconsistent with Zoning Regulation’s Processes and Procedures, the Land Use
Element, and site considerations and constraints.
Furthermore, as noted above, the Appellant has expressed concern with the
current fees for a temporary or intermittent use permit or amendment of the
Conditional Use Permit4. Fees for either of these options are provided in the
Comprehensive Fee Schedule, and can only be amended through a fee schedule
update. Additionally, permitting recurring events or a year’s worth of activities
under one of the above-mentioned permit avenues would minimize the fees
associated with obtaining a temporary use permit for each individual event that will
exceed 25 people.
Appeal Issue No. 2 – Condition No. 9
Condition No. 9 states that the fraternity shall comply with SLOMC §9.12.060 (Exterior
Noise Limits) between the extended hours of 10 PM and 9 AM. T he Appellant requests
that noise be measured using objective decibel levels at the property line.
Staff Response to Appeal Issue No. 2 – Condition No. 9
Noise is regulated by SLOMC Chapter 9.12 Noise Control (commonly referred to
as the Noise Ordinance). SLOMC §9.12.050 prohibits noise disturbances in such
a manner as to be plainly audible at a distance of fifty feet from the noisemaker;
the use or operation of loudspeakers or similar devices between the hours of 10
PM and 7 AM such that the sound creates a noise disturbance across a residential

real property line; and noise that at any time violates the provisions of §9.12.060.
Table 2 below provides the exterior noise limits set forth in §9.12.060 for adjacent
zones to 280 California Boulevard. As noise is objectively regulated under the
Noise Ordinance, Staff does not recommend modifying Condition No. 9.
Modification to the condition would result in a requirement to implement the noise
regulation standards for this property differently than the entirety of the City, which
would be very difficult to implement, and could contradict the existing noise
regulations.

Appeal Issue No. 2 – New Conditions
The Appellant suggests that for gatherings below the current special event threshold, a
formalized event notification and coordination protocol with the Police Department would
be useful. Additionally, they request to add a condition for a mandatory annual compliance
meeting with Code Enforcement and City staff for all chapter leadership.
Staff Response to Appeal Issue No. 2 – New Conditions
The intent of a request for a condition for a formalized event notification and
coordination protocol with the Police Department for gatherings with 25 people or
fewer is vague given that such events are currently allowed and no exceptions to
the Noise Ordinance have been granted under the CUP. Requiring further
coordination with the Police Department would require add itional Staff time and
resources. It is unclear how the review, processing, implementation, and
enforcement of such a program would be accomplished.
Regarding the request for a mandatory annual compliance meeting with Code
Enforcement and City staff for all chapter leadership, Code Enforcement already
has established communications with fraternity and sorority organizations. Since
2024, Code Enforcement annually participates in the Greek Leadership Institute,
a retreat hosted by Cal Poly’s Fraternity & Sorority Life office, where all chapter
presidents and council officers are required to attend . At this event, Code
Enforcement provides information about zoning regulations and how fraternity use
is defined and regulated. Additionally, Code Enforcement participates in the Fire
Department’s annual inspections of fraternity and sorority houses for substandard
living conditions and provides information regarding applicable zoning regulations
and any active CUP requirements.

The request for a condition for a mandatory annual compliance meeting regarding
CUP requirements and ongoing compliance appears redundant to actions that are
already taken, and it is not clear how this condition would address the
neighborhood conflicts that arise from fraternity operations. It is an applicant’s
responsibility to understand and uphold the requirements of their CUP. The
organization should conduct annual, internal meetings for review of the CUP and
their ongoing compliance as a regular best practice so that the fraternity does not
receive any citations. The fraternity may always reach out to City staff with specific
questions as issues arise, and staff is always open to meeting with members of
the community and permit holders.
City Council Consideration
Per SLOMC §17.126.040(B), decisions of the Planning Commission shall be appealed to
City Council. Alpha Epsilon Pi filed a timely appeal of the Planning Commission’s decision
to revoke CUP USE-0625-2024 resulting in this review (Application No. APPL-0174-2026)
being brought before City Council.
Actions on appeals are “de novo” review per SLOMC §17.126.050(A). De novo review
means that the City Council must exercise its independent judgment to determine if the
Applicant/Appellant’s Conditional Use Permit should be modified, revoked, or remain in
effect as it was prior to the Planning Commission’s action to revoke the permit. The City
Council is not bound by the Planning Commission’s findings or conclusions.
The decision made by City Council shall be made based on the required findings in
SLOMC §17.110.070 and listed above under the “Planning Commission Action” section
of this report. Because this is a “de novo” hearing, the City Council can take any of the
actions outlined in the alternatives section below other than staff’s recommendation.
Public Engagement
The project has been noticed in compliance with the City’s notification requirements for
each public hearing associated with the project. Newspaper legal adve rtisements were
posted in the New Times ten (10) days prior to the Planning Commission and City Council
hearings. Additionally, postcards were sent to both owners and occupants of properties,
located within 300 feet of the project site, ten (10) days prior to each hearing.
CONCURRENCE
The Council Agenda Report was reviewed by the Planning Division, and the City
Attorney’s Office for concurrence.
ENVIRONMENTAL REVIEW
The project is exempt from environmental review under Section 15061(b)(3) (Common
Sense Exemption) of the CEQA Guidelines because it can be seen with certainty that
there is no possibility that the revocation of the Conditional Use Permit may have a

significant effect on the environment. Additionally, CEQA does not apply to projects which
a public agency rejects or disapproves. (CEQA Guidelines Section 15270.).

Consideration by the City Council of an appeal of a decision made by the Planning
Commission does not directly result in expenditure of funds and thus has no fiscal impact
to the City. The appeal fee, which covers a portion of the staff time required to bring this
item forward, per City policy, was paid by the Appellant, and there is no upfront cost
resulting from the revocation of the Use Permit. If Council adopts the Resolution to deny
the appeal, subsequent review of a new use permit application, should the Appellant
reapply, would be subject to the appropriate permitting application fee, which is paid by
the applicant.
ALTERNATIVES
1. Continue review of the appeal. The City Council may continue the review of the
appeal with direction to staff regarding additional information or analysis required to
make a decision. Under this alternative, the hearing would be continued to a date
certain or continued off-calendar and then re-noticed as a new hearing in the future.
2. Grant the appeal and modify the Conditional Use Permit. The City Council may
uphold the appeal and modify the findings and/ or conditions of approval based on
consistency with the General Plan, Zoning Regulations, or other policy documents.
Under this alternative, a revised Resolution would need to be prepared to provide
findings to uphold the appeal and allow the Use Permit to continue, as well as adopt
any revised conditions of approval.
3. Grant the appeal and retain the existing Conditional Use Permit as is. The City
Council may uphold the appeal and retain the Conditional Use Permit as is. This draft
Resolution is included as Attachment H.

WHEREAS, the City received complaints, and, between November 2024 and
February 2026, the Police Department issued three citations , relating to noise violations
at the property, including at least three citations within a 12 -month period within these
dates; and
WHEREAS, Code Enforcement issued a Notice of Violation on July 15, 2025,
relating to the multiple, verified violations of the existing Use Permit; and
WHEREAS, the Planning Commission of the City of San Luis Obispo conducted a
public hearing in the Council Chamber of City Hall, 990 Palm Street, on March 11, 2026,
for the re-review of an existing Conditional Use Permit, USE-0625-2024 (“Conditional

including testimony of the applicant and general public and evaluation and
recommendations by staff presented at said hearing; and
WHEREAS, Joshua Pinsky, on behalf of Alpha Epsilon Pi, Sigma Omega Chapter,
filed a timely appeal of the Planning Commission’s decision to revoke the Conditional Use
Permit, APPL-0175-2026, on March 23, 2026; and,
WHEREAS, the City Council of the City of San Luis Obispo conducted a public
hearing in the Council Chamber of City Hall, 990 Palm Street, on May 19, 2026, for the
purpose of considering an appeal of the Planning Commission’s decision to revoke the
Conditional Use Permit, APPL-0174-2025, and has duly considered all evidence,
including the record of the Planning Commission hearing; testimony of the applicant,
appellant, and general public; and evaluation and recommendations by staff presented at
said hearing; and
WHEREAS, notices of said public hearings were made at the time and in the
manner required by law.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Findings. The City Council hereby denies the appeal and revokes the
Conditional Use Permit, USE-0625-2024, based on the following findings:
a) The current use is not consistent with both Conditional Use Permit regulations
of Municipal Code Section 17.110.070(A) and Fraternity regulations of
Municipal Code Section 17.86.130 because:
i) The fraternity has been repeatedly cited for violations of the City’s Noise
Ordinance.
ii) Since April 2025, the Police have issued three citations for noise
violations at the property.
iii) Code Enforcement issued a Notice of Violation of the Conditional Use
Permit on July 15, 2025, which provided warning that a third citation
before April 16, 2026, would result in a re-review by the Planning
Commission. Thereafter, the property received another noise citation in
October 2025.
iv) The fraternity organization appealed all three citations. One citation
appeal was dismissed due to the appeal being filed after 10 calendar
days from citation issuance. The other two citations went to an

Administrative Citation Appeal Hearing and both citations were upheld
by the Hearing Officer
v) The maximum number of people on site at each cited incident
exceeded the limit established by the Conditional Use Permit (25
people), as noted by the Police Officers that issued citations for a noise
violation on April 16, 2025, April 18, 2025, and October 29, 2025.
vi) The fraternity has failed to apply for special event permits or parking
and transportation plans as required by their Conditional Use Permit,
despite hosting events that exceeded the routine gathering capacity
limits of the Permit.
vii) Conduct of the fraternity has been detrimental to the health, safety, and
welfare of the neighborhood.
b) For the reasons stated above, the design, location, size, and operating
characteristics of the current use is not compatible with residential uses in the
vicinity. The City Council was not satisfied that any set of conditions would
secure these purposes. Therefore, the required finding in Municipal Code
Section 17.110.070(A)(3) cannot be made.
c) For the reasons stated above, the continued use of the property as a fraternity
under the Conditional Use Permit is not appropriate for the subject location, is
incompatible with the neighborhood, and will be detrimental to the health,
safety, and welfare of persons living or working at the site or in the vicinity. The
City Council found that no set of conditions would adequately secure these
purposes. Therefore, the required finding in Municipal Code Section
17.110.070(A)(5) and Section 17.86.130(B)(1), cannot be made.
SECTION 2. Environmental Review. The project is exempt from environmental
review under Section 15061(b)(3) (Common Sense Exemption) of the CEQA Guidelines
because it can be seen with certainty that there is no possibility that the revocation of the
Conditional Use Permit may have a significant effect on the environment. Addition ally,
CEQA does not apply to projects which a public agency rejects or disapproves (CEQA
Guidelines Section 15270.)

Good afternoon members of the City Council,
My name is Joshua Pinsky, and I am the President of the Sigma Omega Chapter of Alpha
Epsilon Pi, located at 280 California Boulevard. We are appealing the Planning Commission’s
decision to revoke our Conditional Use Permit.
We disagree with the commission's conclusion that no set of conditions could ensure
compatibility with the surrounding neighborhood or protect public health, safety, and welfare.
We believe the full record does not back this conclusion, is inconsistent with the clear
improvements our chapter has made, and overlooks practical changes that would help us comply.
We acknowledge that there were three violations and that occupancy limits were exceeded.
However, these incidents do not tell the whole story. When we look at the broader context,
● 13 citations in the previous academic year
● 2 citations in the following academic year (both in April)
● 1 citation in the current academic year (October)
This shows a roughly 85% decrease in violations over two years. Importantly, this improvement
happened despite significant turnover in our membership. This suggests that the changes we
made are structural and organizational, rather than dependent on individual members. This trend
illustrates a long-term and noticeable commitment to compliance that was not adequately
considered in the Commission’s decision.
Furthermore, while the City measures compliance on a calendar-year basis, we operate under Cal
Poly’s academic calendar. The two April citations and the October citation pertain to different
academic years, so only one violation has occurred during the current year. Although the
12-month framework is technically correct, it obscures a more accurate view of our behavioral
improvement, which we believe deserves attention.
The main issue in our appeal is the Commission’s finding under §17.110.070(A)(5), which states
that continued use of the property would harm the health, safety, and welfare of the nearby
community. We challenge this finding on three grounds.
First, the property is in an R4 high-density residential area, which is the right setting for this use.
This zoning is intended to support student housing and higher-intensity residential uses.
Revoking the permit and spreading similar activities into lower-density R1 or R2 neighborhoods
could impact the city more broadly, rather than concentrating activity in an area designed for it.
Second, our chapter has shown measurable improvement year after year under current conditions
by actively engaging with neighbors and working collaboratively with Code Enforcement, the
Residents for Quality Neighborhoods (RQN) group, and City staff. Our members undergo

numerous safety trainings, and we submitted proposed condition modifications in writing before
the hearing. While the Commission ultimately dismissed these efforts, the decision does not
explain why revised conditions would not work. This lack of reasoning is central to our appeal.
Third, feedback from nearby residents does not support claims of ongoing harm. Of 14 residents
surveyed within about 200 feet of our property, 12 reported no disturbances linked to the
fraternity. The other two noted occasional noise but could not pinpoint 280 California as the
source. This direct input from the community contradicts the Commission’s conclusion regarding
impacts on nearby residents.
The Commission’s finding under §17.110.070(A)(3) about compatibility with the neighborhood
stems from the same concerns. Given the zoning and our progress, it can work with the right
conditions.
To that end, we are not just asking for the permit to be reinstated as is. We propose a clear set of
modified conditions that provide an enforceable path forward, including:
● A mandatory annual compliance meeting with Code Enforcement and City staff for all
chapter leadership
● A formalized event notification and coordination protocol with the Police Department for
gatherings below the current special event threshold
● Continued proactive engagement with neighboring residents to ensure open
communication and responsiveness
We also want to note that while we understand the City’s processes, the fees associated with
them can be particularly burdensome for college students. We recognize this may not be within
the Commission’s control. Still, we feel it’s important to highlight the practical challenges and to
emphasize our ongoing good-faith efforts to engage constructively despite these obstacles.
During the Planning Commission hearing, especially during the discussion, the Commission
acknowledged the complexity of this issue. They recognized the broader structural challenges
related to enforcement, student housing, and the relevance of existing conditions. If members of
the Commission expressed uncertainty or acknowledged possible paths forward short of
revocation, we believe these considerations further support that modified conditions, rather than
complete revocation, are the more appropriate response.
Ultimately, the question before the City Council is not whether violations occurred, but whether
our chapter has shown the ability and willingness to comply in the future, and if revocation is a
fair response given our current progress. The evidence shows significant improvement,
meaningful engagement, and a clear path to full compliance under modified conditions.

revocation, and allow the implementation of revised conditions that support accountability and
long-term compliance.

Dear Members of the Planning Commission,
As we prepare for the upcoming review of our Conditional Use Permit, our chapter has taken
time to evaluate the current conditions that govern our property and how they work in practice.
We aim to provide recommendations that clarify what is expected of our chapter while protecting
the surrounding neighborhood.The recommendations below aim to improve the clarity and
practicality of several existing conditions while ensuring accountability for our organization.
Condition #4
The current condition that limits routine meetings and gatherings to twenty-five people creates
practical challenges for us. Our organization has many members, and even standard internal
meetings can involve more than 25 people. For instance, events like chapter meetings, small
philanthropic activities, or cultural gatherings may exceed this number even when they are
structured, supervised, and do not disturb the neighborhood. As a Jewish fraternity, we host
occasional religious events like Havdalah gatherings with Hillel or Passover Seders, where
students meet to observe traditions and share a meal. These events are typically quiet and
organized, but they may involve more than twenty-five participants. Because of this, a strict
numerical limit does not truly reflect whether an activity is disruptive. A better approach would
be to evaluate activities based on their actual impacts, including noise levels, safety, and
nuisance factors, instead of relying solely on a fixed attendance number.
Condition #9
Another recommendation involves how we evaluate noise concerns. Right now, noise
enforcement often depends on personal opinion. We suggest requiring that noise be measured
using objective decibel levels at the property line. This would provide a clearer and more
consistent standard for both residents and our chapter. Using measurable noise levels would
ensure that concerns are assessed based on clear criteria and documented evidence, not just
personal perception.
Condition #2
The current condition triggers a Conditional Use Permit review if three citations occur within a
twelve-month period. We recommend changing this standard to evaluate citations within an
academic semester instead. Beginning in Fall 2026, Cal Poly will move from the quarter system
to a semester system. Since our chapter ’s activities align closely with the university’s academic
calendar, matching the citation review period with academic semesters would create a clearer and
more relevant framework for accountability. Under this new approach, we could trigger a review
after two citations within a single academic semester. This would actually be a stricter standard
than the current one, as it shortens the time frame for evaluating citations. Rather than letting

violations build up over an entire year, the City would be able to review conduct more quickly
during the period when student organizations are actively involved. Aligning the citation review
process with the academic calendar would also make it easier for both the City and our chapter to
track and understand, while still maintaining strong accountability for our organization.
Condition #10
Finally, the process for handling events that exceed the attendance limit can be complicated.
Currently, it requires submitting a special event request and transportation management plan up
to ninety days in advance. In many cases, student organizations confirm event dates much closer
to the actual dates. For example, recruitment events or philanthropic activities are often
scheduled just weeks in advance, making it hard to meet the ninety-day submission requirement.
Providing clearer guidelines or more flexible processes for these events could help ensure they
are carried out responsibly while still allowing the City to monitor potential impacts. Our
purpose in sharing these recommendations is not to evade responsibility or oversight. We hope to
constructively contribute to a framework that allows our chapter to operate responsibly while
remaining compatible with the surrounding neighborhood.

WHEREAS, the City Council of the City of San Luis Obispo conducted a public
hearing in the Council Chamber of City Hall, 990 Palm Street, on August 2, 1983, to
review an appeal of the Planning Commission’s approval of a Use Permit to allow a
fraternity at 280 California Boulevard, pursuant to a proceeding instituted under U1099;
Alpha Epsilon Pi, applicant; and
WHEREAS, the City Council of the City of San Luis Obispo denied the appeal and
upheld the Planning Commission’s approval of the Use Permit, U1099, on August 2,
1983, after duly considering all evidence, including testimony of the applicant and general
public and evaluation, and recommendations by staff presented at said hearing; and
WHEREAS, the City received complaints and issued citations for multiple, verified
noise violations in 2023 and 2024; and
WHEREAS, the Planning Commission of the City of San Luis Obispo conducted a
public hearing in the Council Chamber of City Hall, 990 Palm Street, on November 13,
2024, for a re-review of the existing Conditional Use Permit to allow the continuation of
the fraternity at 280 California Boulevard, pursuant to a proceeding instituted under USE-
0625-2024; Alpha Epsilon Pi, applicant; and
WHEREAS, the Planning Commission of the City of San Luis Obispo approved
modifications to the Conditional Use Permit, USE-0625-2024, after duly considering all
evidence, including the documented noise violations, testimony of the applicant and
general public, and evaluation and recommendations by staff presented at said hearing;
and
WHEREAS, notices of said public hearings were made at the time and in the
manner required by law; and
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of San Luis Obispo as follows:

SECTION 1. Findings. The Planning Commission hereby approves modifications
to the Conditional Use Permit to allow the continuation of the fraternity (USE-0625-2024),
based on the following revised findings:
Conditional Use Permit / Fraternity Use
1. The project is consistent with the General Plan because the proposed fraternity is
an allowable use as dense group housing in the High Density Residential (HDR)
land use designation. In addition, the project would facilitate Land Use Element
Policy 2.6.5 and Housing Element Policy 8.6 by locating a fraternity in proximity to
the Cal Poly SLO campus and other student-oriented uses and housing.
2. The proposed fraternity is conditionally allowed within the High-Density Residential
(R-4) zone. As conditioned, the project complies with applicable provisions of the
Zoning Regulations because (a) the maximum number of 19 residents complies
with the group housing maximum occupancy limits and (b) the revised parking
configuration would provide 19 required spaces for 19 residents and comply with
the City’s Parking and Driveway Standards to improve the property.
3. The design, location, size, and operating characteristics of the project will be
compatible with the existing and future land uses in the vicinity because the
proposed fraternity would (a) be established in proximity to other dense group
housing (i.e., other fraternities, sororities, multi-family, etc.), (b) located within
walking distance (i.e., within 0.3-mile) of the Cal Poly campus, and (c) utilize an
existing developed property with minor site improvements (i.e., parking and
landscaping improvements).
4. The site is physically suitable in terms of (a) its design, location, shape, size, and
operating characteristics of the project; (b) traffic generation and the provision of
public and emergency vehicle (e.g., fire and medical) access; (c) public protection
services (e.g., fire protection, police protection, etc.); and (d) the provision of
utilities (e.g., potable water, schools, solid waste collection and disposal, storm
drainage, wastewater collection, treatment, and disposal, etc.). The project is
surrounded by other developed properties with compatible dense housing uses,
has access to the City’s circulation system, and would be served by City utilities.
The project utilizes an existing developed property and does not include activities
that would generate service or utility demands beyond those anticipated with uses
permitted in the vicinity.
5. As conditioned, the project will not be detrimental to the health, safety, and welfare
of persons living or working at the site or in the vicinity because conditions have
been included that place limits on the number of persons allowed on site, restrict
activities, provide adequate parking, and limit potential disturbances to neighboring
properties. The project will be compatible with the existing site constraints and the
character of the neighborhood.

6. As conditioned, the establishment and subsequent operation or conduct of the
project will not, because of the circumstances and conditions applied in the
particular case, be detrimental to the health, safety or welfare of the general public
or persons residing or working in the neighborhood of the use, or be detrimental
or injurious to property or improvements in the vicinity of the use because the
project includes conditions that (a) place limits on the number of persons allowed
on site, (b) restrict activities, (c) provide adequate parking, and (d) limit potential
disturbances to neighboring properties. The project would be compatible with the
existing site constraints and the character of the neighborhood.
SECTION 2. Environmental Review. The project is exempt from environmental
review under Section 15301 (Existing Facilities) of the CEQA Guidelines because it
includes the continued operation and permitting of an existing residential use (i.e.,
fraternity) with revised findings and conditions of approval. The project does not include
construction of a new building or additional building square footage. Therefore, the project
involves no expansion of the existing residential use.
SECTION 3. Action. The Planning Commission hereby approves modifications to
the Conditional Use Permit to allow the continuation of the fraternity (USE-0625-2024),
based on the following revised conditions:
Planning Division – Community Development Department
1. The Conditional Use Permit shall be reviewed by the Community Development
Director for compliance with the conditions of approval, or to determine whether a
modification of the Conditional Use Permit is necessary upon significant change
to the project as represented in the Staff Report dated November 13, 2024, or in
the event of a change in ownership which may result in deviation from the project
description or approved plans.
2. The Conditional Use Permit shall be reviewed by the Planning Commission as
soon as practical if: 1) conduct on the permitted premises results in three (3)
citations within any 12-month period for a violation of law or permit condition, 2)
that citation is not contested or is upheld on appeal, and 3) the conduct for which
the citation was issued resulted in adverse impacts to, or complaints from,
residents or occupants of the surrounding neighborhood. At the time of the
Conditional Use Permit review, to ensure ongoing compatibility with nearby uses,
the conditions of approval may be added, modified, and/or removed, or the
Conditional Use Permit may be revoked. The City shall notify Cal Poly if the Use
Permit is revoked. A re-review by the Planning Commission shall be accompanied
by the appropriate fee.
3. The fraternity shall be limited to a maximum of 19 residents for the property. The
property owner shall allow the City to verify the maximum occupancy by allowing
an inspection of records or visual inspection of the premises. Any inspection shall
be scheduled at a reasonable time with at least 24-hour notice to the residents.

4. Routine meetings and gatherings for the fraternity shall be limited to a maximum
of 25 people (rounded up from 24.75 = 16.5 people x 1.5), except as otherwise
approved by the Community Development Director for special events. If the
fraternity hosts special events involving more than 25 people, a transportation
management plan to reduce impacts to the surrounding neighborhood shall be
submitted to the Community Development Department, at least 30 days prior to
the event taking place, for review and approval. No exception from the Noise
Ordinance shall be approved by the Director as part of the special event.
5. For the life of the organization, the fraternity shall remain affiliated and in good
standing with the Interfraternity Council of Student Life and Leadership at
California Polytechnic University, San Luis Obispo. If the fraternity becomes
unaffiliated or is no longer in good standing, the Conditional Use Permit shall be
revoked.
6. For the life of the organization, the fraternity shall provide the name and contact
information (i.e., phone number and email address) of all responsible parties to
the Community Development Department and Neighborhood Services Manager
of the Police Department on an annual basis. If there is a change to the name
and/or contact information of any responsible parties, the Community
Development Department and Neighborhood Services Manager shall be notified
immediately.
7. For the life of the organization, the property shall be maintained in a clean and
orderly manner. All landscaping shall be replaced as necessary and maintained
(e.g., trimmed, pruned, etc.) to the satisfaction of the Community Development
Director.
8. A minimum of 19 parking spaces shall be provided and maintained at all times.
These spaces shall remain available to residents of the fraternity and not
designated for any individuals not residing on the property.
9. The fraternity use shall comply with Table 1 (Exterior Noise Limits) of Section
9.12.060 (Exterior Noise Limits) between the extended hours of 10:00 p.m. and
9:00 a.m.
10. Prior to a special event approved by the Community Development Director
pursuant to Condition No. 4, the fraternity shall provide written notification of the
event to occupants within 300 feet of the site. The written notification shall include
the date, hours, and contact information for the responsible party for the special
event. No exception from the Noise Ordinance shall be approved by the Director
as part of the special event.
11. Live entertainment, bands, and/or amplified sounds are prohibited, unless
otherwise approved through a special event by the Community Development
Department. No exception from the Noise Ordinance shall be approved by the

Director as part of the special event.
12. Failure to comply with any of the above conditions or code requirements, or the
conduct of the use so as to constitute a violation of Federal, State, or local law, or
so as to constitute a public nuisance or so as to cause adverse impacts on the
health, safety, or welfare of persons in the vicinity of this use is prohibited and may
constitute grounds for the revocation of this permit.
13. Within 60 days of the re-review hearing with the Planning Commission on
November 13, 2024, the fraternity shall install a minimum of 19 bicycle spaces
(one space for each resident) and contact the City for a follow-up inspection to
verify that all required bicycle spaces have been installed.
Indemnification
14. The applicant shall defend, indemnify, and hold harmless the City and/or its
agents, officers and employees from any claim, action or proceeding against the
City and/or its agents, officers, or employees to attack, set aside, void or annul,
the approval by the City of this project, and all actions relating thereto, including
but not limited to environmental review (“Indemnified Claims”). The City shall
promptly notify the applicant of any Indemnified Claim upon being presented with
the Indemnified Claim and the City shall fully cooperate in the defense against an
Indemnified Claim.

the Community Development Director for special events. If the fraternity hosts special events
involving more than 25 people, a transportation management plan to reduce impacts to the
surrounding neighborhood shall be submitted to the Community Development Department, at
least 30 days prior to the event taking place, for review and approval. No exception from the
Noise Ordinance shall be approved by the Director as part of the special event.” Police
Department records indicate that two citations regarding violations of the city’s noise regulations
were issued after 10:00 p.m. on April 16th and April 18th, 2025. Both incidents were reported as
having 100 people or more.
Condition Two (2) of the use permit states that if conduct on the permitted premises results in
three (3) citations within any 12-month period for a violation of law or permit condition the
Conditional Use Permit shall be reviewed by the Planning Commission as soon as practical. As
two citations have already been issued, one more citation before April 16, 2026 will result in a
recommendation for review of the use permit.
We request that you voluntarily take immediate action to correct the above noted violation(s). These
violations constitute a public nuisance and must be abated. Failure to correct the violation(s) by the

specified date will result in the issuance of an Administrative Citation requiring payment of FINES in
accordance with SLOMC Chapter 1.24. For Municipal Code violations that remain uncorrected after

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS
OBISPO, CALIFORNIA, UPHOLDING AN APPEAL AND CONTINUING
THE CONDITIONAL USE PERMIT FOR A FRATERNITY LOCATED AT
280 CALIFORNIA BOULEVARD. THE PROJECT IS EXEMPT FROM
ENVIRONMENTAL REVIEW UNDER SECTION 15301 (EXISTING
FACILITIES) OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
(CEQA) GUIDELINES AS REPRESENTED IN THE COUNCIL AGENDA
REPORT AND ATTACHMENTS DATED MAY 19, 2026 (MOD-0036-2026,
APPL-0174-2026).
WHEREAS, the City Council of the City of San Luis Obispo denied the appeal and
upheld the Planning Commission’s approval of the Use Permit, U1099, on August 2,
1983, after duly considering all evidence, including testimony of the applicant and general
public and evaluation, and recommendations by staff presented at said hearing; and
WHEREAS, the City received complaints and issued citations for multiple, verified
noise violations in 2023 and 2024; and
WHEREAS, the Planning Commission of the City of San Luis Obispo conducted a
public hearing in the Council Chamber of City Hall, 990 Palm Street, on November 13,
2024, for a re-review of the existing Conditional Use Permit, pursuant to a proceeding
instituted under USE-0625-2024; Alpha Epsilon Pi, applicant; and
WHEREAS, the Planning Commission of the City of San Luis Obispo approved
modifications to the Conditional Use Permit, USE-0625-2024, to allow the continuation of
the fraternity at 280 California Boulevard, after duly considering all evidence, including
the documented noise violations, testimony of the applicant and general publ ic, and
evaluation and recommendations by staff presented at said hearing; and
WHEREAS, the City received complaints, and, between November 2024 and
February 2026, the Police Department issued three citations , relating to noise violations
at the property, including at least three citations within a 12-month period within these
dates; and
WHEREAS, Code Enforcement issued a Notice of Violation on July 15, 2025,
relating to the multiple, verified violations of the existing Use Permit; and
WHEREAS, the Planning Commission of the City of San Luis Obispo conducted a
public hearing in the Council Chamber of City Hall, 990 Palm Street, on March 11, 2026,
for the re-review of an existing Conditional Use Permit, USE -0625-2024 (“Conditional
Use Permit”), for fraternity use at 280 California Boulevard, pursuant to a proceeding
instituted under MOD-0036-2026; and

WHEREAS, the Planning Commission of the City of San Luis Obispo voted 7-0 to
revoke Conditional Use Permit USE-0625-2024, after duly considering all evidence,
including testimony of the applicant and general public and evaluation and
recommendations by staff presented at said hearing; and
WHEREAS, Joshua Pinsky, on behalf of Alpha Epsilon Pi, Sigma Omega Chapter,
filed a timely appeal of the Planning Commission’s decision to revoke the Conditional Use
Permit, APPL-0175-2026, on March 23, 2026; and,
WHEREAS, the City Council of the City of San Luis Obispo conducted a public
hearing in the Council Chamber of City Hall, 990 Palm Street, on May 19, 2026, for the
purpose of considering an appeal of the Planning Commission’s decision to revoke the
Conditional Use Permit, APPL-0174-2025, and has duly considered all evidence,
including the record of the Planning Commission hearing; testimony of the applicant,
appellant, and general public; and evaluation and recommendations by staff presented at
said hearing; and
WHEREAS, notices of said public hearings were made at the time and in the
manner required by law.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. Findings. The City Council hereby upholds the appeal and continues
the Conditional Use Permit, USE-0625-2024, based on the following findings:
1. The project is consistent with the General Plan because the proposed fraternity
is an allowable use as dense group housing in the High Density Residential
(HDR) land use designation. In addition, the project would facilitate Land Use
Element Policy 2.6.5 and Housing Element Policy 8.6 by locating a fraternity in
proximity to the Cal Poly SLO campus and other student-oriented uses and
housing.
2. The proposed fraternity is conditionally allowed within the High -Density
Residential (R-4) zone. As conditioned, the project complies with applicable
provisions of the Zoning Regulations because (a) the maximum number of 19
residents complies with the group housing maximum occupancy limits and (b)
the revised parking configuration would provide 19 required spaces for 19
residents and comply with the City’s Parking and Driveway Standards to
improve the property.
3. The design, location, size, and operating characteristics of the project will be
compatible with the existing and future land uses in the vicinity because the
proposed fraternity would (a) be established in proximity to other dense group
housing (i.e., other fraternities, sororities, multi-family, etc.), (b) located within
walking distance (i.e., within 0.3-mile) of the Cal Poly campus, and (c) utilize
an existing developed property with minor site improvements (i.e., parking and
landscaping improvements).

4. The site is physically suitable in terms of (a) its design, location, shape, size,
and operating characteristics of the project; (b) traffic generation and the
provision of public and emergency vehicle (e.g., fire and medical) access; (c)
public protection services (e.g., fire protection, police protection, etc.); and (d)
the provision of utilities (e.g., potable water, schools, solid waste collection and
disposal, storm drainage, wastewater collection, treatment, and disposal, etc.).
The project is surrounded by other developed properties with compatible dense
housing uses, has access to the City’s circulation system, and would be served
by City utilities. The project utilizes an existing developed property and does
not include activities that would generate service or utility demands beyond
those anticipated with uses permitted in the vicinity.
5. As conditioned, the project will not be detrimental to the health, safety, and
welfare of persons living or working at the site or in the vicinity because
conditions have been included that place limits on the number of persons
allowed on site, restrict activities, provide adequate parking, and limit potential
disturbances to neighboring properties. The project will be compatible with the
existing site constraints and the character of the neighborhood.
6. As conditioned, the establishment and subsequent operation or conduct of the
project will not, because of the circumstances and conditions applied in the
particular case, be detrimental to the health, safety or welfare of the general
public or persons residing or working in the neighborhood of the use, or be
detrimental or injurious to property or improvements in the vicinity of the use
because the project includes conditions that (a) place limits on the number of
persons allowed on site, (b) restrict activities, (c) provide adequate parking, and
(d) limit potential disturbances to neighboring properties. The project would be
compatible with the existing site constraints and the character of the
neighborhood made.
SECTION 2. Environmental Review. The project is exempt from environmental
review under Section 15301 (Existing Facilities) of the CEQA Guidelines because it
includes the continued operation and permitting of an existing residential use (i.e.,
fraternity) with revised findings and conditions of approval. The project does not include
construction of a new building or additional building square footage. Therefore, the project
involves no expansion of the existing residential use.
SECTION 3. Action. The City Council hereby approves modifications to the
Conditional Use Permit to allow the continuation of the fraternity (USE-0625-2024), based
on the following conditions:
Planning Division – Community Development Department.
1. The Conditional Use Permit shall be reviewed by the Community Development
Director for compliance with the conditions of approval, or to determine whether
a modification of the Conditional Use Permit is necessary upon significant
change to the project as represented in the Staff Report dated November 13,

2024, or in the event of a change in ownership which may result in deviation
from the project description or approved plans.
2. The Conditional Use Permit shall be reviewed by the Planning Commission as
soon as practical if: 1) conduct on the permitted premises results in three (3)
citations within any 12-month period for a violation of law or permit condition,
2) that citation is not contested or is upheld on appeal, and 3) the conduct for
which the citation was issued resulted in adverse impacts to, or complaints
from, residents or occupants of the surrounding neighborhood. At the time of
the Conditional Use Permit review, to ensure ongoing compatibility with nearby
uses, the conditions of approval may be added, modified, and/or removed, or
the Conditional Use Permit may be revoked. The City shall notify Cal Poly if the
Use Permit is revoked. A re-review by the Planning Commission shall be
accompanied by the appropriate fee.
3. The fraternity shall be limited to a maximum of 19 residents for the property.
The property owner shall allow the City to verify the maximum occupancy by
allowing an inspection of records or visual inspection of the premises. Any
inspection shall be scheduled at a reasonable time with at least 24-hour notice
to the residents.
4. Routine meetings and gatherings for the fraternity shall be limited to a
maximum of 25 people (rounded up from 24.75 = 16.5 people x 1.5), except as
otherwise approved by the Community Development Director for special
events. If the fraternity hosts special events involving more than 25 people, a
transportation management plan to reduce impacts to the surrounding
neighborhood shall be submitted to the Community Development Department,
at least 30 days prior to the event t aking place, for review and approval. No
exception from the Noise Ordinance shall be approved by the Director as part
of the special event.
5. For the life of the organization, the fraternity shall remain affiliated and in good
standing with the Interfraternity Council of Student Life and Leadership at
California Polytechnic University, San Luis Obispo. If the fraternity becomes
unaffiliated or is no longer in good standing, the Conditional Use Permit shall
be revoked.
6. For the life of the organization, the fraternity shall provide the name and contact
information (i.e., phone number and email address) of all responsible parties to
the Community Development Department and Neighborhood Services
Manager of the Police Department on an annual basis. If there is a ch ange to
the name and/or contact information of any responsible parties, the Community
Development Department and Neighborhood Services Manager shall be
notified immediately.
7. For the life of the organization, the property shall be maintained in a clean and
orderly manner. All landscaping shall be replaced as necessary and maintained
(e.g., trimmed, pruned, etc.) to the satisfaction of the Community Development
Director.

8. A minimum of 19 parking spaces shall be provided and maintained at all times.
These spaces shall remain available to residents of the fraternity and not
designated for any individuals not residing on the property.
9. The fraternity use shall comply with Table 1 (Exterior Noise Limits) of Section
9.12.060 (Exterior Noise Limits) between the extended hours of 10:00 p.m. and
9:00 a.m.
10. Prior to a special event approved by the Community Development Director
pursuant to Condition No. 4, the fraternity shall provide written notification of
the event to occupants within 300 feet of the site. The written n otification shall
include the date, hours, and contact information for the responsible party for
the special event. No exception from the Noise Ordinance shall be approved
by the Director as part of the special event.
11. Live entertainment, bands, and/or amplified sounds are prohibited, unless
otherwise approved through a special event by the Community Development
Department. No exception from the Noise Ordinance shall be approved by the
Director as part of the special event.
12. Failure to comply with any of the above conditions or code requirements, or the
conduct of the use so as to constitute a violation of Federal, State, or local law,
or so as to constitute a public nuisance or so as to cause adverse impacts on
the health, safety, or welfare of persons in the vicinity of this use is prohibited
and may constitute grounds for the revocation of this permit.
13. Within 60 days of the re-review hearing with the Planning Commission on
November 13, 2024, the fraternity shall install a minimum of 19 bicycle spaces
(one space for each resident) and contact the City for a follow-up inspection to
verify that all required bicycle spaces have been installed.
Indemnification
14. The applicant shall defend, indemnify, and hold harmless the City and/or its
agents, officers and employees from any claim, action or proceeding against
the City and/or its agents, officers, or employees to attack, set aside, void or
annul, the approval by the City of this project, and all actions relating thereto,
including but not limited to environmental review (“Indemnified Claims”). The
City shall promptly notify the applicant of any Indemnified Claim upon being
presented with the Indemnified Claim and the City shall fully cooperate in the
defense against an Indemnified Claim.
