CAO RECOMMENDATION:
By motion, approve and authorize the Mayor to execute an agreement with Burke
Corporation in the amount of $25,425 for bike lanes on Madonna Road.
DISCUSSION:
A grant for up to $27,000 has been secured by the City through the "Local Agency - State
Agreement, Bike Lane Account Project", Agreement No. BLA No. 4-93. On February 15, 1994,
Council authorized the City Administrative Officer to award the contract to the lowest responsible
bidder if that bid was within the engineer's estimate. The lowest responsible bid was greater than
the engineer's estimate.
The need to widen Madonna Road to accommodate eastbound bicyclists is significant. Regardless
of funding source, this project should be given a high priority for completion so that Council
mandated trip reduction goals can be achieved.
With the contract award of $25,425, the City's total out-of-pocket expense will be $2,543.
FISCAL IMPACT:
This grant requires a 10% local agency share of the total project cost. The adjusted project cost with
the lowest responsible bidder is as follows:

AGREEMENT
THIS AGREEMENT, made on this day of 19 , by and between the City of San Luis
Obispo, San Luis Obispo County, California, hereinafter called the Owner, and R. Burke Cornontion,
hereinafter called the Contractor.
WITNESSETH:
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1, SCOPE OF WORK: The Contractor shall perform everything required to be performed, shall
provide and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and
transportation services required to complete all the work of construction of
Bike Lane Widening Proiect - Madonna Road. Specification No. 93-53
in strict accordance with the plans and specifications therefor, including any and all Addenda, adopted by the
Owner, in strict compliance with the Contract Documents hereinafter enumerated.
It is agreed that said labor, materials, tools, equipment, and services shall be furnished and said work performed
and completed under the direction and supervision and subject to the approval of the Owner or its authorized
representatives.
ARTICLE II, CONTRACT PRICE: The owner shall pay the Contractor as full consideration for the faithful
performance of this Contract,subject to any additions or deductions as provided in the Contract Documents, the
contract prices as follows:

Payments are to be made to the Contractor in accordance with and subject to the provisions embodied in the
documents made a part of this Contract:
Should any dispute arise respecting the true value of any work omitted, or of any extra work which the
Contractor may be required to do, or respecting the size of any payment to the Contractor, during the
performance of this Contract, said dispute shall be decided by the Owner and its decision shall be final, and
conclusive.
ARTICLE III, COMPONENT PARTS OF THIS CONTRACT: The Contract consists of the following
documents, all of which are as fully a part thereof as if herein set out in full, if not attached, as if hereto
attached:
1. Notice to Contractors and Information for Bidders.
2. Standard Specifications, Special Provisions and Engineering Standards.
3. Accepted Proposal.
4. Public Contract Code Section 10285.1 Statement and 10162 Questionnaire.
5. Noncollusion Declaration.
6. Plans.
7. List of Subcontractors.
8. Agreement and Bonds.
9. Insurance Requirements and Forms.
ARTICLE IV. It is further expressly agreed by and between the parties hereto that should there be any conflict
between the terms of this instrument and the bid or proposal of said Contractor, then this instrument shall
control and nothing herein shall be considered as an acceptance of the said terms of said proposal conflicting
herewith.
IN WITNESS WHEREOF, the parties to these presents have hereunto set their hands this year and date first
above written.

SUBJECT:
Submittal of Plans and Specifications for Bike Lane Widening Project - Madonna Road,
Specification No. 93-53.
RECOMMENDATION:
Approve plans and specifications, authorize staff to advertise for bids, and authorize CAO to
award the contract if lowest responsible bid is within the engineer's estimate.
_ DISCUSSION:
The Bicycle Plan adopted by Council on October 27, 1993 identifies the need to construct a Class
II bike lane on the east side of Madonna Road north of Oceanaire Drive. An open ditch exists
along the easterly right-of-way line of Madonna Road between Dalidio to the north and Oceanaire
Drive to the south. The presence of this ditch causes a narrowing of Madonna Road, which results
in loss of the bike lane. Northbound cyclists must merge with high speed northbound Madonna
Road traffic..
The proposed project widens the paving to provide enough room so that all vehicles, including
bicycles, will have designated lanes, thus improving the overall safety of this roadway section.
FISCAL IMPACT: "
A state grant for up to $27,000 has been secured through the "Local Agency- State Agreement, Bike
Lane Account Project," Agreement No. B.L.A. No. 4-93. This grant requires a 10% local agency
share of the total project cost,which will come from the Bikeway Improvement Project budget which
has a balance of $166,100. The Local Agency must pay the entire balance should the total project
cost exceed $30,000. A project account in the amount of $30,000 has been set up.

Total: $237500

CONCURRENCE:
Resolution No. 8088 (1992 Series) approved application for the "Local-State Agreement, Bike Lane
Account Project". The project has been reviewed by Caltrans and approved for advertising, and by
the Community Development Department,who has given it a categorical exemption. This exemption
is in the process of being recorded with the County.

RESOLUTION OF THE COUNCIL OF THE CITY OF SAM LUIS OBISPO
AUTHORIZING THE SUBMITTAL
OF A BICYCLE LANE ACCOUNT APPLICATION TO CALTRANS
FOR BICYCLE LANE IMPROVEMENTS ON MADONINTA ROAD
WHEREAS, the City of San Luis Obispo ("City") supports bicycling as a form of
transportation that decreases congestion, air pollution and energy consumption; and
WHEREAS, the City has identified a project on Madonna Road that would improve
safety and fill an existing gap in the City's bike lane network;
NOW,THEREFORE,be it resolved that the Council of the City of San Luis Obispo
hereby authorizes the submittal of a Bicycle Lane Account application to Caltrans for the
amount of $27,000 for bicycle lane improvements on Madonna Road.

Member Pinard, and on the following roll call vote:
