CAO RECOMMENDATION:
A. By Motion, adopt Negative Declaration on Environmental Impacts and pass ordinance to
print, adopting a revised setback line for Orcutt Road, between Broad Street and the
Southern Pacific Railroad, per staff recommendation.
B. Pass ordinance to print, limiting vehicular access to 2 locations on the south side of Orcutt
Road, between Broad Street and the Southern Pacific Railroad per staff recommendation.
ADVISORY BODY RECOMMENDATION:
The Planning Commision(on February 23, 1994)voted to recommend the City Council adopt
an ultimate 93 ft. right of way width for Orcutt Road. (This is not the CAO
recommended action)
BACKGROUND:
A. SETBACK LINE AMENDMENT
The Council, since 1991, has considered various design alternatives for the widening of Orcutt Rd.,
between Broad St. and Laurel Lane. On August 3, 1993 the Council directed staff to process an
ordinance amendment to the existing setback line to provide an additional 26 ft. of right of way
(R/W) on the south side of Orcutt Rd., between Broad St. and about Duncan Lane. Additionally,
the Council directed that only two access points southerly of Orcutt Rd. be allowed: 1) at Duncan
Lane, and 2) McMillan Avenue. (See attached minutes)
Staff was directed to also include in the ordinance an 8 ft. R/W widening adjacent to the Henderson
Petroleum property to allow for a 4 ft. wide detached sidewalk and parkway landscaping, similar to
the design chosen by the Council for the south side of the street. The R/W width as envisioned-by
the City Council on August 3, 1993 is shown in Exhibit C. The three existing structures on the
Henderson property are impacted by this alignment, as the structures are on or within the existing
R/W line.
Based on the direction by Council to provide for widening adjacent to the Henderson property, staff
reconsidered the interim "at-grade" street design and felt that it would be better to provide for a

"straighter" alignment, between Duncan Ln. and Laurel Ln., rather than a "jog" around the
Henderson property. As it may be many years before funds are available to construct an overpass
and the "at grade" design would be feasible within the near future with a fraction of the cost of an
overpass, staff feels the overall long term interests of the City would best be served with the revised
alignment. This modification requires total acquisition of R/W which varies in width between 22
and 19 ft.,from Duncan to the SPRR,respectively. Therefore,staff recommends an alignment which
requires slightly more R/W from the Henderson property, but better serves the long term needs of
the City. [See attached Exhibit A]
The Planning Commission considered the revised setback line and held a public hearing on February
23, 1994. During the hearing, Rob Strong, acting on behalf of property owners, Henderson
Petroleum and Marilyn Stickler (owners of the property south of Orcutt), was generally opposed to
further R/W widening and such a wide landscaped median, stating there are other more logical
corridors to enhance at the "gateways" to the City. He recommended a "reverse curve" alignment
(jog) in front of the Henderson property, which would not impact any of the Henderson property.
Jerry Ahrens spoke and said his wife owns the property at 810 and 830 Orcutt Rd. and they were
concerned how their property might be affected and whether the City would condemn their land for
widening.
The Planning Commission, by a 5/2 vote, did not agree with the staff recommendation, nor the
Council's choice as discussed above. They instead chose "Alternate 1", which was considered by the
Council on August 27, 1991. That design provides only 93 ft. of R/W which includes a 15 ft. wide
median, 10 ft. wide parkways, 5 ft. bike lanes and a jog in the traveled way "around" the Henderson
property. (See attached Exhibit G]
The Planning Commission was particularly concerned with safety if 8 ft. wide bike lanes are used.
However, the Council considered the various bike lane alternatives (as described in the August 21,
1991 staff report) and determined that an 8 ft. wide bike lane may actually be "safer" than the
narrower widths established in the current Bicycle Transportation Plan (Bike Plan). Eight (8) ft.
wide bike lanes were in fact recommended by the Bicycle Committee.
The eight (8) ft.wide lane would accommodate a bus "stopping" lane on the south side of Orcutt Rd.
and any vehicle 'breakdowns", as discussed in previous agenda reports. Additionally, one of the
Council's earlier discussions revolved around the potential for a Class I bikepath from Broad St. to
Bullock Lane. Although not chosen, the eight (8) ft. bike lane provides a width which would
approximate the feel of a Class I bikepath.
The Bike Plan requires 6 ft. wide Class II-B bike lanes for streets (such as this) with 10,000 ADT
or more, but states that ..."all bicycle lanes should meet OR EXCEED (emphasis added) minimum
standards, ... etc. If 6 ft. bike lanes are desired, 95 ft. of R/W would be needed to accommodate

the Planning Commission's recommended design and meet the Bike Plan requirements. (See
attached PC minutes)
B. LIMITED ACCESS
Staff was asked by the Council to bring back an ordinance that establishes only two points of access
for vehicles along the south side of Orcutt Road. One is at the Sacramento Dr./Duncan Rd.
intersection and the other is at McMillan Avenue.
At the Planning Commission hearing, Mr. Strong objected to the proposed vehicular access control,
which would affect development of the Stickler properties. He argued in favor of additional "right
turn only" access to allow greater flexibility in site design of the Stickler properties.
The attached draft ordinance not only provides for limiting "left turn movements" to the two points
chosen by the Council, but also allows one additional driveway for "right turns only". Staff feels the
requested "right turn only" access point is justified and will not significantly affect traffic, bicycle or
pedestrian movements.
ENVIRONMENTAL REVIEW
On January 25, 1994,the Community Development Director granted a mitigated negative declaration
regarding effects on the environment due to amending of the Official Orcutt Road Setback Line.
A copy of the initial study has been provided for review in the Council's reading file. The mitigation
is specific as to replacement of trees and other riparian areas associated with actual widening
projects. The Council should concur with the determination as noted in the ordinance and
recommended action.
FISCAL IMPACT.-
The
MPACT:The estimated additional costs, over the current plan cost, is $ 600,000 for the portion of Orcutt Rd.,
between Broad St. and Laurel Lane. (See prior staff reports)
Should a landscaped median be installed with the future bridge overpass project, staff estimates an
additional $ 50,000 cost for retaining walls. Of the $ 600,000, the City's share would be about
$ 500,000 (1993 dollars); the remainder being developers' responsibility.

AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING (1) THE OFFICIAL
BUILDING SETBACK LINE FOR ORCUTT ROAD BETWEEN BROAD STREET AND
JOHNSON AVENUE AND, (2) SECTION 17.74.140 OF THE SAN LUIS OBISPO
MUNICIPAL CODE TO REFLECT THE AMENDMENT OF THE MAP.
WHEREAS,the City Council has considered an environmental initial study,staff reports and
recommendations,Planning Commission recommendations and public testimony regarding a proposal
to amend the Official Orcutt Road Building Setback Line, between Broad Street and the Southern
Pacific Railroad Right of Way (SPRR); and
WHEREAS, the City Council concurs with the Community Development Director that
amending the existing setback line will cause no significant adverse impacts on the environment
subject to certain mitigation measures, as shown on the attached Exhibit 2, per ER 144-93; and
WHEREAS, the City Council has determined that the existing setback line should be
amended to accommodate a wider landscaped median and wider parkways (110 ft. wide R/W, as
shown on the attached Exhibit 1, to provide an enhanced scenic corridor.
NOW THEREFORE BE IT ORDAINED by the Council of the City of san Luis Obispo as
follows:
SECTION 1. The "Official Building Setback Line for Orcutt Road between Broad Street
and Johnson Avenue" is hereby amended as delineated on Exhibit 1, attached hereto and
incorporated herein by this reference.
SECTION 2. Municipal Code Section 17.74.140 is hereby amended to read as follows:

Broad Street and Johnson Avenue, in accordance with the official map designated "Official

November 4, 1963, as amended by the City Council by ordinance on February 16, 1982 and
as amended by the City Council by ordinance on , 1994, on file in the office of
the City Clerk. Provided that the setback line may be amended in the event that the City,
in its sole discretion, chooses to construct, or cause to be constructed, improvements which
require a reduced area."

Adjustment to the Street Setback Line
Orcutt Road between Broad Street and the Southern Pacific Railroad
In conformance with AB 3180, the following mitigation measures will be monitored as
indicated below. Please sign the original and return to my office as soon as possible.
A. Surface Water Flow and Quality. The design for widening Orcutt Road should
include a method for bridging the waterways which feed into the Acacia Creek
drainage system that nu*m* »es disruption to water flow and flooding and erosion
impacts, subject to approval by the City Engineer, the Community Development
Director, and the State Department of Fish and Game.
B. Plant and Animal Life. To ensure no net loss of the extent or quality of riparian
habitat, the remaining riparian habitat on parcels adjoining the road widening
project should be expanded and enhanced according to a plan prepared by a
professional landscaper or biologist with experience in riparian habitat restoration
and revegetation. The plan should be subject to approval by the State
Department of Fish and Game and the Community development Director, and
modelled after the one specified for the Parkside Research Center project at 953
Orcutt Road (ER 220-92). Planting should occur at the time of site development
or actual road widening, whichever comes first. Plan preparation and installation
shall be the responsibility of the applicant if site development triggers this
mitigation, or shall be the responsibility of the City if road widening precedes site
development.
C. Archaeolo,ical. Construction activities related to the widening of Orcutt Road
shall comply with the City's Interim Archaeological Procedures (attached).
D. Other Short-term Construction Impacts. A plan for dust control during
construction activities related to the widening of Orcutt Road shall be approved
by the Community Development Director prior to commencing construction, and
implemented during actual construction.

On January 18, 1994, I reviewed your project's potential effect on the environment. My
action was to file a mitigated negative declaration. That means that I determined the
project will cause no significant harm to the environment, and no further environmental
study will be required because of the changes you have agreed to make in your original
proposal. The declaration is issued.for the amended project. The changes are listed on
the attached sheet. Please sign the original and return to my office as soon as possible.
Please contact me immediately if this doesn't coincide with your understanding of the
changes.
A negative declaration could be reversed later, either on appeal or by automatic review
by a decision-making body. Appeals may be filed by anyone, either now or shortly
before your project is reviewed by the Architectural Review Commission, Planning

Item 3. Revised Setback Line for Orcutt Road. A proposed expansion of the
Orcutt Road right-of-way, intended to correct the existing offset in right-of-
way alignment and accommodate landscaped medians, four traffic lanes,
bike lanes, wider parkways, and detached sidewalks;. City of San Luis
Obispo, applicant. (Continued from February 9, 1994)
Jerry Kenny presented the staff report and provided a history of the changes proposed
for Orcutt Road. He explained that the City Council had requested Orcutt Road be
widened 26 feet on the south side and 8 feet on the north side between Duncan Lane and
the Railroad to provide for additional landscaping and a detached sidewalk. He said staff
was recommending the north side of Orcutt Road between Duncan Lane and the Railroad
be widened 19 to 22 feet providing a straight alignment of the road. He said the railroad
overpass would not be completed in the near future. He discussed three diagram options
on the wall and on overhead diagrams. He recommended that the Planning Commission
recommend approval of Option 1 to the City Council and that the negative declaration be
approved.
Commr. Hoffman said in the adopted bicycle transportation plan, bike lanes were defined
as being five feet wide. He asked why staffs proposal was recommending 8-foot bike

Commr. Hoffman felt the bike lane width should be consistent with the adopted Bicycle
Plan. He said bike riders have indicated wide bike lanes give a false sense of security.
He asked the width of typical medians.
Jerry Kenny said usually medians are 16 feet wide, but that width would not allow the
planting of large trees.
Commr. Hoffman expressed concern that a 22-foot wide median would make turning
more hazardous because vision would be obstructed.

Commr. Sigurdson believed Wayne Peterson was sensitive to complying with industry
standards to reduce City liability and she could accept his recommendation.
Commr. Senn asked how much the additional 26-feet of right of way would cost.
Jerry Kenny broke down the various costs and said the additional right of way would cost
around $150,000.
Commr. Whittlesey asked approximately how long it would be before widening began,
and how much longer than that it would be before the railroad crossing was elevated.
Jerry Kenny estimated it would be 15 to 25 years before the railroad crossing was
elevated. He said the City did not have plans to begin widening Orcutt Road at this time,
but the Parkside Research Center had been proposed on the south side of the road.
Commr. Williams said she agreed with Commr. Hoffman about 5-foot wide bike lanes.
Chairman Karleskint opened the public hearing.
Rob Strong, 1 Buena Vista, representing Henderson Petroleum and the Stickler property,
said he did not oppose aesthetics, but felt it would be more appropriate to enhance
gateways to the City rather than this three�block area. He expressed concern that an 8-
foot bike lane would tend to be interpreted as available parking. He said 6-foot lanes were
adequate for emergency vehicle parking. He said the City was proposing to widen the
entire 26 feet on the south side of the street for City economy reasons, but it affected
development potential of property he represented. He used the map on the wall to
explain access points on the south side of the street the City was proposing to restrict on
Mrs. Stickler's property. He said access was not being proposed to be restricted on the
north side. He explained the effect of the wide median, which he opposed, on the
development of Mrs. Stickler's property. He said Mrs. Stickler preferred to donate land
rather than pay a fee. He explained that the City would have to compensate Henderson
Petroleum because the proposal might affect a garage, a warehouse and an office
building on the property. He said the City could save a substantial amount of money, if
the road was widened on the south side of the street where the City already owned 150
feet. He asked that the widening of Orcutt Road be placed higher on the capital
improvement plan list.
Jerry Ahrens said his wife owned the property at 810 and 830 Orcutt Road, which was
on the north side of the road. He expressed concern that he and his wife had not been

approached by the City in any way regarding the acquisition of the property. He
expressed concern about whether driveways accesses, two for each property, would be
allowed to remain. He said he was concerned about how the City was planning to
acquire the property.
Chairman Karleskint closed the public hearing.
Jerry Kenny said the Henderson property was not being treated any different than other
properties had been treated for many years. He said the City had not ruled out
negotiating with the Sticklers about donating land with the City paying for the project, but
that was not a current issue. He said the City Council had directed staff to provide only
two access points on the south side of Orcutt Road to eliminate breaks in the median
landscaping. He said properties on the north side would also be restricted because of
the median. In response to a question by Commr. Hoffman, Jerry Kenny said the two
access points were McMillan and Sacramento Drive.
Commr. Sigurdson asked if the property owners were aware about the City considering
this right of way.
Jerry Kenny said the current setback line was adopted by ordinance in 1964 and modified
in 1981.
Commr. Sigurdson asked what the problem was with curving the road across from the
Henderson property on land the City alre@dy owns.
Jerry Kenny said a curvilinear design had the potential to be a liability issue. He explained
the Ahrens had not been contacted by the City regarding this proposed setback line
because widening is not being proposed at this time, only an establishment of setbacks
and that there is no proposed change to the current setback line affecting their property.
In answer to a question by Commr. Hoffman, Jerry Kenny said the driveways would only
provide right turn access. In answer to a question by Commr. Senn, Jerry Kenny
explained previous dedications of the Stickler properties.
Commr. Cross asked how the overpass would be affected if a curvelinear design was
used.
Jerry Kenny said the City might end up owning more right of way than it would need. He
said the overpass would probably be proposed as a curvelinear design to achieve the
desired height above the tracks.

Commr. Hoffman felt it didn't make a lot of sense to take out about half of the
landscaping that was being proposed to be put in. He expressed concern about the
overpass being substantially narrower than the street.
Commr. Whittlesey expressed concern about the cost, especially because the distance
was so short. She felt there were other streets that were more appropriate to be
aesthetically improved, such as gateways to the City.
Commr. Cross felt that timing was not an issue because which projects were done before
others was not being determined.
Ron Whisenand said that the Commission was only being asked to recommend a right
of way plan line. He said the City would chose priorities in the future. He said economics
was not an issue that the Commission should consider.
Commr. Senn disagreed. He said if a plan line was established, it indicated that the City
was going to pay for the property. He said the City already owned the land on the south
side of the street and Orcutt Road could be widened without acquiring more property.
Jerry Kenny said that was true.
Commr. Senn felt it was not a good use of money. He also mentioned that putting a
median in front of the homeless shelter might not be a good idea. He said he agreed
with Commr. Whittlesey's comments.
Commr. Sigurdson said she could support a reduced bike lane width and a curvelinear
design. She felt the street could become a more intricate part of the City in the future.
She said she felt it was appropriate to have a wide median on this street.
Commr. Cross said he agreed with Commr. Sigurdson.
Commr. Williams said she agreed with Commrs. Whittlesey and Hoffman.
In answer to a question by Commr. Hoffman, Jerry Kenny said there was a 76-foot right
of way for Orcutt Road past Laurel Lane.
Commr. Hoffman felt the wide median was not appropriate when considering the available
right of way on the other side of Laurel Lane. He said he could support a 93-foot right
of way with a curvelinear design that curved around the Henderson Petroleum property.

Jerry Kenny said the City Council was expecting to see landscaping and sidewalks as
part of the proposal.
Commr. Hoffman said the design could include landscaping, but he did not feel additional
width was necessary.
Commr. Cross said walking along Los Osos Valley would be more pleasant if the
sidewalk was separated from the road by a planted median and concurred with the need
for detached sidewalks along Orcutt Road.
Commr. Whittlesey said a separated sidewalk would be provided for on the south side
of Orcutt Road.

Rob Strong said he had asked staff to provide an alignment alternative using the right of
way the City already owned on the south side of the street. He said all the landscaping
proposed by staff would fit into the existing City-owned right of way on the south side of
the street if a curvelinier design was used. He questioned why a straight alignment for
Orcutt Road was important, if the proposed overpass would be curvelinear. He added
that if the City proposed a plan line that affected Henderson Petroleum, his client was
asking that the road be widened soon. He said he had not seen the alignment he
requested from staff.
Jerry Kenny passed out an alignment proposal utilizing the land already owned by the
City and said it did not provide for any landscaping. ( �
Rob Strong discussed the proposal and said landscaping could be included by offsetting
the street more to the south.
Chairman Karleskint closed the public hearing.
Commr. Sigurdson moved to approve staff's recommendation for option 1 with a
modification to provide 6-foot bike lanes.

Commr. Hoffman said he could not support the motion because of the safety concerns
of a wide median.

Commr. Whittlesey said it was unnecessary for the street to be 110 feet wide and for
parkways to be on both sides of the street. She said she could support 5-foot bike lanes
and a parkway on one side of the street. She said curving around a property owner was
not excessive because the City owned the land on the other side of the street.
Commr. Williams said she could not support the motion because she believed the City
should use the land it already owned on the south side of the street instead of buying
more land. She said the road did not need to be as wide as was being proposed.
Commr. Karleskint said the project was over designed and a straight design might need
to be replaced in the future with a curvelinear design when the overpass was built. He
agreed with Commrs. Whittlesey and Williams about the City using land it already owned.

Commr. Hoffman moved to recommend to the City Council an option that would have a

staff report, and that the right of way approximate expected, future alignment of the
overpass and curve around to minimize the impact on Henderson Petroleum with a 15-
foot median.
Commr. Senn seconded the motion.
Commr. Cross said it was a bleak looking road and a parkway would be desirable.
Commr. Williams said she traveled the road frequently and she saw walkers and runners
that did not appear to be uncomfortable with the road in its present condition. She said
a 93-foot width would be sufficient.
Commr. Whittlesey said she was still not real supportive of the project at all, but she felt
she would be most comfortable with alternative 4 because it would allow a parkway on
one side of the road.
Commr. Hoffman explained that he believed his motion could accommodate a parkway
on the south side of the road or other design options within 93 feet
