SUBJECT: ITEM # 5g - AUTHORIZE ACQUISITION OF REAL PROPERTY LOCATED
AT 975 BROAD STREET, SAN LUIS OBISPO, CA, IDENTIFIED AS
ASSESSOR PARCEL NO. 002-412-010
On May 13, 2026, at its regularly scheduled meeting, the Planning Commission approved
a Resolution determining General Plan Conformance for the acquisition of property
located at 975 Broad Street (GENP-0248-2026). This action was taken pursuant to
California Government Code § 65402, wherein the Planning Commission is required to
make a determination regarding the consistency of the proposed acquisition of 975 Broad
Street with the City’s General Plan. Specifically, Section 65402 requires that the location,
purpose, and extent of real property acquisition (and disposition) be submit ted to and
reported upon by the planning agency having jurisdiction as to conformity with the City’s
adopted General Plan (Cal. Govt Code § 65402(c)). This item was on the Planning
Commission’s consent agenda and there was no Commissioner or public comment.
As noted in the Council Agenda Report for this item on the City Council’s agenda for the
meeting on May 19, 2026, due to the timing of the escrow established for this transaction,
the Planning Commission’s review could not occur until after the publication of the City
Council Agenda on May 12th for the meeting occurring on May 19th. Staff are, therefore,
providing this separate Council Agenda Correspondence as notification of the outcome
of the Planning Commission determination.
