Based upon a review of the medical file, the disability factors contained therein, and the reasons for settlement set forth in the agreement, the Compromise and Release is deemed adequate. In determining the adequacy of the Agreement, the following has been considered: { X ) The Court has considered release of applicant's dependents' rights to death benefits in determining the adequacy of the Compromise and Release. The settlement of the Applicant's dependents' potential rights to claim death benefits is hereby approved. ( ) In the light of the above issues and the substantial possibility that adverse findings as set forth in the offer of proof could totally bar the applicant's entitlement to any benefits, the inclusion of release of rehabilitation claim's is also reasonable and appropriate. Thomas v. Sports Chalet, Inc., 42 CCC 625 , ( ). The release of benefits as enunciated under the principles of Rodgers v. WCAB, 50 CCC 299, has been considered in determining the adequacy of the Compromise and Release. The settlement of those potential benefits is hereby approved.
