Good afternoon Mattie,
Thank you for speaking with me. Thank you for understanding the secure nature of the ESA facilities; as we participate in
confidential and classified government projects. And an NDA from a visitor, in many cases, is a requirement of our customer
contracts.
I do understand you would like the City Attorney to review the NDA prior to signing. For any organization, it is our Legal Officer’s
preferencial practice to request a manager sign the NDA, as it would therefore then apply to employees for future visits. For
your City Department, I expect that would be the Fire Chief, City Manager, City Attorney or the like.
I’m pleased to present to you the attached Nondisclosure Agreement (NDA) for the review, completion and signature within the
yellow sections, in support of facility inspections as a representative from the San Luis Obispo Fire Department.

Our new facility at Higuera has office space and warehouse space. We will be doing the same processes over there.
Manufacturing the same items. I don’t know if there are drains inside the warehouse, I will have to look. We s Ɵll would not be
using them for anything, as all our equipment and machines are self-contained. The only Hazardous waste we have would be
coolant and we take that to the Hazmat drop off on a regular basis.

THE CITY OF SAN LUIS OBISPO’S
ENVIRONMENTAL COMPLIANCE PROGRAM
The City of San Luis Obispo’s Pretreatment Program
was established in 1983 to provide protection to the
Water Resource Recovery Facility (WRRF) and the
sewer collection system by controlling the discharge of
non-domestic wastes into the City’s sewer system. The
program is mandated by the Environmental Protection
Agency and the State Water Resources Control Board.
The function of the program is to protect the WRRF
from discharges that could upset or inhibit the plant’s
processes, or pass through the process untreated and
then be discharged into San Luis Creek. An illicit
discharge to the WRRF can also result in a reduction of
waste treatment, possibly contaminating biosolids or
recycled water, resulting in expensive handling and
disposal costs or degradation of the creek’s
environment.
HOW THE PROGRAM WORKS
Inspection, sampling, documentation, and public
education are the fundamental components of the
Environmental Compliance Program. Inspections and
sampling ensure that wastes are properly managed by
the Industrial User (IU) and are discharged in
compliance with the City’s sewer use ordinance.
Documentation gives the City a record of sampling,
inspections, and any other event that may have
occurred at the facility. Public education offers the City
the opportunity to give the public and industry an
overview of the Environmental Compliance Program,
provide assistance in program compliance, and answer
questions.
WHO GETS INSPECTED?
All permitted industries get inspected. Permitted
industries include, but are not limited to: electroplaters,
restaurants, automotive repair shops, photofinishers,
laundries, carwashes, dry cleaners, and radiator shops.
Depending on the permit issued, a facility may be
inspected up to four times a year.
HOW IS THE PROGRAM FUNDED?
The program receives approximately 35% of its
revenues from industrial users fees while the other
65% comes from the sewer fund. Industrial users fees
are classified into three classes: Significant industrial
users, Class I Industrial Users, and Class II industrial
users. Users may determine their classification by
looking at their permit number. A I or II follows the
permit number. Significant permits are stated as such
on the permit. The fees are assessed annually and the
City Finance Department sends out the invoices.
HOW ARE THE FACILITIES CLASSIFIED?
All facilities are evaluated by the information provided
on the commercial user survey application and
inspection form before being classified. Facilities are
classified as significant industrial users if they fall under
the federal definition of a significant or categorical
industry. Class I industrial users are defined as facilities
that have materials or wastes on site that if discharged
to the sewer may impact City facilities in a negative
manner. These wastes include, but are not limited to,
hazardous wastes and materials, pH, and other non-
conventional pollutants. Facilities that may discharge
conventional pollutants, such as animal or vegetable
grease, non-hazardous solids, or laundry discharges are
classified as Class II users. Conventional pollutants are
pollutants usually found in domestic discharges,
characteristic of the sewer discharge from a regular
household.
Examples of Industrial User Classifications:
Restaurant
Class II Permit
Restaurants discharge oil and grease in quantities
greater than a normal household.
Automotive Repair
Class I Permit
These facilities generate hazardous wastes, which if
discharged to the sewer, may cause considerable
damage to the collection system and treatment
process.
Dry Cleaner
Class I Permit
Dry cleaners generate hazardous waste and may
release small quantities of solvents to the sewer.
Metal Finishing Shop
Significant Permit
Metal finishers fall under the federal definition of a
significant industrial user, discharge non-conventional
pollutants to the sewer, and may generate hazardous
waste.
Car Wash/Automotive Detail
Class I or Class II Permit
Car washes primarily discharge conventional pollutants
to the sewer, but if engines are being pressure washed,
the oil and grease from the washing may be hazardous.
It is the owner’s responsibility to demonstrate that the
waste is non-hazardous.
COMMON QUESTIONS
Q. I don’t put hazardous waste down the
sewer. Why should I be on permit?
A. Although almost everyone in the City is in
compliance, the City still needs to perform
inspections to verify compliance. Without an
inspection, the City does not know if a facility
is in compliance. One goal of the program is
to ensure that hazardous wastes are not
discharged.
Q. Why do I have to open a grease
interceptor or clarifier? Why can’t the
inspector do this?
A. An inspector can’t do this because of liability
questions and risk of injury. The City does not
work on any private facility or device for this
reason. The owner of the business is
responsible for maintaining the grease
interceptor or clarifier and is also required to
open it for inspection.
Q. Where can I get a copy of the sewer use
ordinance?
A. From the City Clerk’s office @ 990 Palm Street,
(805)781-7100
Q. Why do I need a grease interceptor and
how is sizing determined?
A. All restaurants, commercial kitchens, food
processing, etc., are required to have a grease
interceptor. Because of the larger than normal
amount of grease that may come from a
facility, (as compared to a household), an
interceptor is required to remove the grease
before it reaches the sewer. Sizing is
determined using the Uniform Plumbing Code
(UPC).
Q. What happens if I’m out of compliance?
Will I be fined?
A. Not at first. The City is interested in
compliance rather than collecting fines. If a
violation is noted then a Notice of Violation
(NOV) is issued. The NOV will clearly state the
violation, what needs to be done to correct the
problem, and a completion date when the
violation must be corrected. If not enough
time is given to correct the violation, the
facility may request more time to come into
compliance. Enforcement actions including
fines, civil or criminal lawsuits, or
water/wastewater service shut off are only
enacted if the facility has shown little or no
effort to correct the violation or the violation is
significant and/or intentional.
Q. Can I contest my classification or being
required to have a permit?
A. Yes. A facility must submit a letter to request
being taken off permit or a change in
classification. After that, the City will evaluate
your facility using inspections or inspection
records and any information provided.
Q. What if I know of an illegal discharge or
violation of the sewer use ordinance?
Who can I call and can I remain
anonymous?
A. Any suspected illegal discharge or activity
should be reported. The pretreatment
program confidentially investigates reports and
complaints form all sources, identified or
anonymous. Please use the numbers provided

Hello!
I’m writing as owner of 2058 Fixlini St in San Luis Obispo and noticed the September water reading was 25 units. This is roughly
15-20 units above normal. Nothing in particular happened onsite that could point to this usage level therefore 1) it was an
incorrect reading or 2) a significant leak exists. Could a service member conduct another reading to eliminate or confirm item
1? Depending on this result, I’ll have to do some serious digging to find a leak since nothing on the surface or in the house is
noticeable and nothing around the property has changed.

If you are receiving this email, you are currently enrolled in autopayment to the City of SLO for your monthly water and
sewer bills. We want to let you know that we are updating our system to use a new payment processor on April 12,
2022. Your login and account information will remain the same, but the payment website will look a little different.
The biggest impact to you as a customer on autopayment is that you will need to update your saved payment
information and re-establish autopayment. Please note, you will not want to do this until after April 12th when we
have switched over systems.
You will receive an email like the one below from noreply@merchanttransact.com to prompt you to login and update
your autopayment information after our update on the 12th. We wanted to reach out before you get this email as it

If you are receiving this email, your autopayment that was attempted today was part of a batch that was declined in
error with the code “Decline: Merchant Inactive.” You likely received an email notification stating that your payment
was declined, your recurring payments were disabled, and that you needed to re-establish your recurring payment

This is the second attempt to get your business to return your Wastewater Permit Application. If this is not received in
the next 30 days, the City will start issuing fines for noncompliance. The first attempt was sent by mail to the business
address listed with the City on February 17, 2021 with a due date of March 20, 2021.
Attached you will find the permit application.
The City of San Luis Obispo’s Environmental Compliance Program is currently reviewing all businesses located within
the city to ensure all applicable facilities are properly permitted. It has come to our attention that you may fall within ou r
guidelines of being an Industrial User.
The City of San Luis Obispo is mandated to review Industrial Users by the National Pollutant Discharge Elimination
System (NPDES) permit and the Clean Water Act. Part of this compliance is gathering surveys from businesses that
discharge to our wastewater system and the potential to violate our local ordinances.
All industrial dischargers of nondomestic wastewater are required to complete the enclosed Permit Application and
Industrial User Survey under section 13.08.150 of the City’s Sewer Use Ordinance.
Permit Application Steps and Requirements
1. Users required to obtain a wastewater discharge permit shall complete and file an industrial wastewater discharge
permit application with the City within thirty days of receiving a notice to apply. The permit application shall:
a. Include all attachments such as a site plan, spill prevention plan, all pretreatment device information,
grease interceptor details (where applicable).
b. Be submitted by May 1, 2021.
c. Must be signed by an authorized representative and have a wet ink signature. The original must be returned
by mail.
2. The director will evaluate the data furnished by the applicant and may require additional information. Incomplete
or inaccurate applications will not be processed and will be returned to the applicant for revision. Upon review
you may or may not be granted a permit.
3. Issuance or denial of permit.
a. If denied, an appeal may be sought out according to Section 13.08.480
Failure to Successfully Complete and Return Application
1. A Notice of Violation will be issued if the attached application is not returned within the allotted thirty-day time
frame this is outlined in municipal code 13.08.470.
2. According to municipal code 1.24.050 an administrative fine will be issued for non-compliance within the
specified timeline.
Completion of the permit application and survey will assist the Environmental Compliance Program in determining if a
permit is required for your business. Please complete the Industrial Wastewater Survey and Permit Application and
return to the City within thirty days to the following address:

Hi Brenda: Thanks for checking in. Two requirements would kick in...one would be to add any compressed gas cylinders to the
Chemical Inventory of the HazMat Business Plan if they exceed 200 cubic feet per gas. That is a CUPA requirement for state
mandated HazMat programs. The second requirement would be a CA Fire Code permit to conduct welding or cutting
operations. That permit is about $300.00 per year. If you would like to pursue this further I would be be your point of contact

Hi Brenda: Nice to hear from you. I would recommend that you contact a State Licensed Fire Extinguisher Service
company to provide the training. You could have the company go over the mechanics of activating an extinguisher
but not spraying powder all over the parking lot and you wouldn’t have to pay to re-certify the fire extinguisher/s you
used to demonstrate. If you do choose to activate the fire ext., you would have the technician right there after the
demonstration to empty, clean, re-fill, pressurize, and then apply a new tag. There is also a link ono the Fire Dept web
page for fire prevention tips which includes fire ext. use. Hope this is helpful, Kerry
