RECOMMENDATION:
By motion,
1) Award the "Agreement to Design a Recreation Office Building, Specification No. 94-
13A" to The Architectural Office of Bruce Douglas Fraser, AIA
2) Authorize the Mayor to execute the agreement documents
DISCUSSION:
In January of 1994, the City Council established a goal of relocating the existing Parks &
Recreation administration staff from 860 Pacific Street to a new site at the corner of Pacific
and Nipomo (old Emerson School). The Recreation Administration Facility Committee was
created and Mayor Pinard and Councilmember Rappa were appointed as Council representa-
tives. Other members of the committee were to be the City Adminsitrative Officer, the
Director of Public Works, the Parks and Recreation Director and a representative from the
Parks and Recreation Commission. The tasks assigned to the committee were as follows:
1) Sizing the facility for current and future needs
2) Establishing cost estimates for design administration
3) Determining funding and a construction process
4) Identifying the quickest means possible to achieve the new facility
The committee resolved all issues during January, February and March and returned to the
City Council in April seeking approval to request proposals from pre-qualified architects for
design services_ The Council approved that request and requests for proposals were mailed
to eight pre-qualified firms. Four firms responded and were interviewed on May 11, 1994.
The four firms were:

Courtney Architects
The Architectural Office of Bruce Douglas Fraser
RRM Design Group
The submitted designs comprised a wide range of creative solutions. After careful review
and discussion, the building committee concluded that the design submitted by Bruce Fraser
best fulfilled the project objectives, particularly the objective of enhancing the architectural
character of the surrounding neighborhood.

A.I .c Per the Preproposal Meeting, the scope of services will not address
the future improvement of the surrounding park site.
A.3 Space Needs; accessibility and plumbing codes require toilet rooms
of approximately 123 minimum square feet each.
B.l.c Per the Preproposal Meeting, we will not provide soils engineering,
surveying, or related services.
C.7 In order for our Errors—and—Omissions insurance to be in full effect,
our insurance carrier will need to review the agreement prior to our
execution; this may require more than ten days.
F Minimum Limits of Insurance, Item 4; our current Errors—and—Omissions
insurance has a liability limit of. $250,000.00. This is typically
considered more than adequate for a project of this size and we
recommend against increasing the limit for the Recreation Office
agreement. We can, however, obtain a rider increasing our limit or
a team cover policy at additional cost to the City if requested.

AGREEMENT
TO DESIGN A RECREATION OFFICE BUILDIM
THIS AGREEMENT is made and entered into in the City of San Luis Obispo on this day of
by and between the CITY OF SAN LUIS OBISPO, a municipal corporation,
hereinafter referred to as the City, and The Architectural Office of Bruce Douglas Fraser, AIA, hereinafter
referred to as the Architect.
WITNESSETH:
WHEREAS, on April 11, 1994, the City requested proposals to design a recreation office building per
Specification No. 94-13A; and
WHEREAS, pursuant to said request, the Architect submitted a proposal which was accepted by the
City for furnishing said design services;
NOW THEREFORE, in consideration of their mutual promises, obligations, and covenants hereinafter
contained, the parties hereto agree as follows:
1. TERM. The term of this agreement shall be from the date this Agreement is made and
entered, as first written above, until construction of the project is completed and accepted.
2. INCORPORATION BY REFERENCE. City Specification No. 94-13A and the Architect's
proposal presented on May 11, 1994 are hereby incorporated in and made a part of this agreement.
3. SPECIFICATION DEVIATIONS. The following deviations from Specification No. 94-13A
shall be acceptable to the City:
a. The general project scope shall not include improvement of the surrounding site.
b. The area standard for a toilet room shall be minimum 125 square feet.
C. The City shall provide all special services (e.g., soils testing, surveying) needed
throughout design and construction.
d. After award, the Architect shall have up to 20 days to execute the agreement docu-
ments.
e. The minimum limits of insurance for errors and omissions liability shall be $250,000
per occurrence.
4. THE CITY'S OBLIGATIONS. For performing the work described in Section B of
Specification 94-13A, the City will pay and the Architect shall receive therefor the following payments:
$ 5,550 for Schematic Design Preparation
23,250 for Construction Documents Preparation
500 for Bid Assistance
9,930 for Construction Assistance
$39,230 TOTAL COMPENSATION

5. THE ARCHITECT'S OBLIGATIONS. For and in consideration of the payments and
agreements hereinbefore mentioned to be made and performed by the City, the Architect agrees with the City to
do everything required by this agreement and the said specificatiodfi
6. AMENDMENTS. Any amendment, modification, or variation from the terms of this
agreement shall be in writing and shall be effective only upon approval by the Council of the City.
7. COMPLETE AGREEMENT. This written agreement, including all writings specifically
incorporated herein by reference, shall constitute the complete agreement between the parties hereto. No oral
agreement, understanding, or representation not reduced to writing and specifically incorporated herein shall be
of any force or effect, nor shall any such oral agreement, understanding, or representation be binding upon the
parties hereto.
8. NOTICE. All written notices to the parties hereto shall be sent by United States mail, postage

9. AUTHORITY TO EXECUTE AGREEMENT. Both the City and the Architect do covenant
that each individual executing this agreement on behalf of each party is a person duly authorized and empowered
to execute agreements for such party.
