Settle and Mayor Peg Pinard Absent: None City Staff Present: John Dunn, City Administrative Officer; Diane Gladwell, City Clerk; Ken Hampian,Assistant City Administrative Officer; Bill Statler, Finance Director; Ann Slate, Personnel Director; Paul LeSage,Recreation Director,John Moss, Utilities Director, Cindy Clemens, Assistant City Attorney PUBLIC COMMENT PERIOD There were no public comments. STUDY SESSION 1. SOLID WASTE POLICIES (File No. 524) Council considered a report on solid waste rate objectives,proposed modifications to current system of determining revenue adequacy and rate setting, interest in pursuing alternative rate structure and collection system options; and public review and input strategy and schedule. John Moss, Utilities Director, Sue Baasch,Administrative Analyst,and Ed Kampf of Ernst and Young, reviewed the objective to achieve an equitable rate structure. The rate setting process and methodology were reviewed, expenses, and past studies were discussed. 2:30 PM Mayor Pinard declared a recess. 2:35 PM Council reconvened in the Council Chambers; all Council Members present. COUNCIL LIAISON REPORTS There were no Council Liaison Reports. PUBLIC HEARINGS 3:15 PM Mayor Pinard lett the Chambers;Vice-Mayor Settle conducted the remainder of the meeting. TENTATIVE MAP -TRACT 2154 (File No. 410) A public hearing was scheduled to consider amendments to the Zoning Regulations to simplify processing, add and change definitions, clarify wording and format, and make minor changes to the development standards; City of San Luis Obispo, applicant (continued from 3/8/94 and 4/5/94). The applicant requested a continuance to April 19, 1994. Moved by Rapp@/Romero to continue this item to April 19, 1994 at applicant's request; motion carried (4-0-1, Mayor Pinard absent). 3. ZONING TEXT AMENDMENTS ORDINANCE (File No. 463) Council held a public hearing to consider amendments to the Zoning Regulations to simplify processing, add and change definitions, clarify wording and format, and make minor changes to the development standards; City of San Luis Obispo, applicant (continued from 3/8/94 and 4/5/94). Arnold Jonas, Community Development Director, reviewed the proposal. Vice Mayor Settle declared the public hearing open. No one spoke for or against the item. Vice Mayor Softie declared the public hearing closed. Council discussed notification and public participation, impacts on various land uses, and administrative hearing procedures. Moved by Rappa/Romero to introduce to print Ordinance No. 1260 amending page 2-20 to add clause "on business tax certificates" in Section 17.08.090 (B); motion carried (4-0-1, Mayor Pinard absent). COMMUNICATIONS COMMA. Council Member Roalman requested staff bring Ramona Drive traffic calming back to Council on May 24, 1994 (consensus). COMM.2 council Member Roalman requested reimbursement for Library volunteers parking int he City's parking structure (consensus not reached). COMM.3. Council Member Roalman requested a resolution be brought to Council opposing the Mobile Home rent initiative (consensus). COMM.4. Council Member Rappa requested selection of Air Pollution Control District Board by July 1, 1994 (consensus). COMM.S. Council Member Rappa requested staff investigate County's actions relating to Sunny Acres (consensus). City Council Meeting Monday, April 11, 1994- 1:00 PM Page 3 BUSINESS ITEMS 4. RECREATION OFFICE BUILDING AT EMERSON SCHOOL SITE (File No. 94-13A) Council considered a °Project Plan for Development of a Recreation Office Building" at the Emerson School site and a Request for Proposals, Specification No. 94-13A, to design the building. Mike McCluskey, Public Works Director, described the citizen input process. Moved by Romero/Roalman to 1) approve the project plan, and 2) authorize staff to distribute the Request for Proposals, Specification No. 94-13A; motion carried (4-0-1, Mayor Pinard absent). 5. TROLLEY POLICY EXCEPTION (File No. 549) Council considered trolley policy exception requests from the La Fiesta Parade and the Train Centennial. Mike McCluskey, Public Works Director, reviewed the various requests for use of the trolley. Loren Nicholson, 156 Del Norte,described the proposed utilization of the trolley during the Centennial Railroad Celebration. Moved by Roalman/Romero to modify the policy to allow trolley use for the Centennial Railroad Celebration (no fee, and sponsor must provide insurance); motion carried (4-0-1, Mayor Pinard absent). Moved by Romero/Settle to modify the policy to allow trolley use for the La Fiesta Parade (no fee,and sponsor must provide insurance); motion carried (3-1-1, Council Member Roalman voting no and Mayor Pinard absent). Council discussed the Elks Lodge request for the use of the trolley; no consensus was reached. S. LOCAL AREA FORMATION COMMISSION (LAFCo MEETING) Council considered a presentation to be made at the April 20, 1994 Local Area Formation Commission (LAFCo) Meeting. John Dunn, City Administrative Officer, reviewed the forthcoming LAFCo meeting. Keith Gurnee, San Luis Obispo, stated LAFCo needed to hear something different than previous meetings. Council discussed the recommendations of Angus McDonald, and reached consensus to place the item on the agenda for 4/19 (general consent). 7. COUNCIL COMPENSATION (File No. 313) Council considered amending the Council Compensation Policy. �-�-3 City Council Meeting Monday, April 11, 1994- 1:00 PM Page 4 (Note: Item #7 was taken out of order with all Council Members present) Ann Slate, Personnel Director, reviewed the process of the Council Compensation Committee. Lynn Cooper, Vice-Chair of the Council Compensation Committee, discussed the committees recommendations. Council discussed inequities in the recommendation and benefit option, reimbursable expenses,and the ability for low-income persons to serve on the Council. Moved by Pinard/Roalmen to leave the current Council compensation as it is, reduce reimbursable expenses at the Council Compensation Committee's recommendations, and allow any Council Member to donate or not utilize portions of the package; motion carried (3-2, Council Member Rappa and Romero voting no). Moved by Roalman/Raona to direct staff to set policy so that Council Members can choose to not be compensated; motion carried (5-0). Council discussed reimbursement for childcare expenses. 4:40 PM there being no further business to come before the City Council,Vice-Mayor Settle adjourned the meeting. APPROVED BY COUNCIL- Diane R. Marauam Piros. President of Associated Students, Inc. (ASI) at Cal Poly, reviewed plans for the Cal Poly Open House. P.C.2. Patti Brown. Promotional Coordinating Committee, and Maggie Cox reviewed a promotional program developed for the City. P.C.3. Don Shallenberger, principal of C.L.Smith, thanked Council for funding the Students Taking Active Responsibility (STAR) program. P.C.4. Kathy Settle. 1244 Drake Circle, also thanked Council for funding the STAR program. P.C.S. Sheila Baker, 310 Calle Lupita, reviewed plans for Earth Day on April 24th. COUNCIL LIAISON REPORTS There were no Council Liaison Reports. PUBLIC HEARINGS 1. CDBG COMMUNITY DEVELOPMENT PLAN (File No. 427) Council held a public hearing to consider the CDBG Community Development Plan for grant year 1994-95. Arnold Jonas, Community Development Director, and Jeff Hook, Associate Planner reviewed the six criteria utilized to evaluate proposed projects, and the recommended funding levels. Council discussed the Women's Shelter, the downtown housing study, seismic retrofit program, and administrative expenses. City Council Meeting Tuesday, April 12, 1994- 7:00 PM Page 2 Vice-Mayor Settle opened the public hearing. Howard Carroll, 2175 Biddle Ranch Rd., representing the Chamber of Commerce Earthquake Task Force, stated the cost to retrofit was between $25 to $34 a square foot. Leonard Grant. 106 Joyce Way, stated the site of Emerson School would be ideal for high-density housing. Don Shalienberoerprinciple of C.L Smith school, urged the continued funding of at-risk youth programs. Christine Peralta. San Luis Obispo, advocated for children's programs. Jonni Evlarrepresenting the Visitors and Conference Bureau, requested inclusion of the tourism development plan that had been proposed, but not included in the recommendations. Jose Gomez 611 Briaolara St., requested support for low-income housing and land allocations. Jorge Alvarado, 480 High St. #A, requested programs for low-income housing. Dana Lilly. County Planning Department, spoke about the Homeless and Womens' Shelters. Miguel Donoso, 857 Ridgeway Ave., asked for more money for low-income families. Vice-Mayor Settle declared the public hearing closed. Council discussed funding for the homeless shelter, historic renovation money, housing and economic development programs. Moved by Rappa/Romero to approve plans as listed including an alternate down payment assistance program; motion carried (4-0-1, Mayor Pinard absent). Moved by Rappa/Romero to recommend the County Board of Supervisors allocate$106,103 from the Special Urban Projects Fund to the Women's Shelter; motion carried (4-0-1, Mayor Pinard absent). Moved by Rappa/Romero to work with the Visitors and Conference Bureau to develop a tourist development program in an approximate amount of$5,000 (to come back to Council); motion carried (44)-1, Mayor Pinard absent.) Moved by Rappa/Romero to forward the revised Plan and funding allocations to the County Board of Supervisors; motion carried (44-1, Mayor Pinard absent). Moved by Rappa/Romero to work with the Visitor's Conference Bureau to develop a tourism development plan; motion carried (4-0-1, Mayor Pinard absent). 8:45 PM Vice-Mayor Settle declared a recess. 9:02 PM Council reconvened; Mayor Pinard absent. PEOPLE'S KITCHEN LUNCH TIME FEEDING PROGRAM RELOCATION (File No. 1046) Council considered relocating the People's Kitchen Lunch Time Feeding Program from Mission Church to city-owned property located on Prado Road. Jim Gardiner. Police Chief, reviewed the history of the effort to find a more permanent and better facility for the People's Kitchen. Toni Flynn, representing the Salvation Army, supported the coordination of the move and the work of the People's Kitchen. Betty Nielsen. San Luis Obispo, stated the homeless made many contributions to San Luis Obispo, and that the tourists appreciated their services. She stated that transportation would be required,and that she did not know how to coordinate with the Interfaith Coalition on the proposed day resource center. Susie Steiner. 232 Ramona Dr., stated she was impressed with the behavior of the homeless and that it was too windy at Prado Road. Lila Rosengreen, Arroyo Grande, asked that the harassment of the homeless be stopped. Dick Waren. President of the Interfaith Coalition, stated their desire to provide a day center to coordinate information and counseling services and wanted to be part of a collaborative effort with the People's Kitchen. Craig Nelson. San Luis Obispo, urged the Council to look at the problem and be concerned with fulfilling the needs of the homeless. Came Pardo. 1415 13th SL, stated it would be difficult to recruit volunteers to feed the homeless at the Prado Road site. Maury Rosengren. Arroyo Grande, stated there had only been two incidents in ten years caused by the homeless. Marion Wolff.San Luis Obispo,spoke against moving the People's Kitchen and°hiding°the homeless. Lori LaPensee. San Luis Obispo, stated she had observed several fights among the homeless, and that they carried weapons. Captain Noreen French, Salvation Army, stated their desire to be a catalyst in moving the People's Kitchen to a site that could be incorporated with the day center and other services. Council discussed the proposed day center and other services. City Council Meeting Tuesday, April 12, 1994 - 7:00 PM Page 4 Moved by Roalman/Raooa to conceptually approve the use of City-owned property located on Prado Road for the People's Kitchen homeless lunch time feeding program (final proposal to return to Council at a later date); motion carried (4-0-1, Mayor Pinard absent). 10:00 PM there being no further business to come before the City Council, Vice-Mayor Settle adjourned the meeting.
