SUBJECT: Memorandum of Agreement between the City of San Luis
Obispo and the SLO City Employees' Association for the
period 7/1/94 - 12/31/96.
CAO RECOMMENDATION:
Adopt resolution approving the Memorandum of Agreement
BACKGROUND:
The Memorandum of Agreement (MOA) between the City of San Luis Obispo and
the San Luis Obispo City Employees' Association (SLOCEA) will expire on July 1,
1994 after a term of two years. As provided for in that agreement, the City
entered into negotiations with SLOCEA in April of this year to develop a successor
agreement. The City Council in closed session was briefed on May 19, 1994 on
the various issues of mutual concern and economic considerations. Bill Avery, the
City's chief negotiator, Deb Hossli and the Personnel Director then met with the
Association's negotiating team led by Paul Bechely, of Bechely, Palica and
Associates, Inc., a professional labor relations representative.
A tentative agreement has been reached which was ratified by a majority of the
Association membership. The agreement reflects and strengthens the continued
cooperation between the Association and the City to address issues of mutual
concern in a productive manner. Following is a summary of the significant
changes and cost items included in the agreement. The agreement is well within
the economic guidelines previously discussed with Council.
ECONOMIC ISSUES:
Term: 30 months
Salary: 1 January 95 - 2% salary increase for all employees in the unit.
1 January 96 - 3% salary increase.
Health Insurance:
1 August 95 - City's contribution toward employees' health insurance
increased from $395 to $400 per month and by an additional $20 per
month to $420 effective 1 August 96.

Vacation Sell-back:
1 December 94 - Vacation sell back - Employees with 80 hours of
accrued vacation may request payment for up to 30 hours of unused .
vacation leave provided an employee's overall performance and
attendance practices are satisfactory subject to the availability of
budgeted funds.
Other Issues:

There are no significant new operational or non-economic issues
included as part of this agreement. However, in compliance with
state and federal laws regarding Family Medical Leave, language in the
MOA will be modified to meet the provisions of the law. Contract
language will also be updated to reflect the City's current health
insurance program and Cafeteria Plan as well as changes to stand-by
pay for the Water Reclamation Plant.
FISCAL IMPACT:
Citywide estimated increased costs in this agreement are approximately $54,800
for year 1 , $146,400 for year 2 and $98,000 for the final six months of the
contract. These are total compensation costs which include benefit costs.
Funding is available in the existing fund balances for FY 94-95. Funds will be
appropriated in FY 95-96 and FY 96-97 as part of the next two year financial
planning process in accordance with this agreement.
ALTERNATIVES:
(1) Do not approve the resolution and direct staff to negotiate a different
successor agreement. This is not recommended as the agreement as
presented is consistent with the Council's previous direction and the City's i
employer-employee relations policies.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT
BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO
CITY EMPLOYEES' ASSOCIATION FOR THE PERIOD OF JULY 1, 1994 -
DECEMBER 31, 1996
BE IT RESOLVED by the Council of the City of san Luis Obispo as follows:
Section 1. The Memorandum of agreement between the City of San Luis
Obispo and the San Luis Obispo City Employees' association, attached hereto as ,
exhibit "A" and incorporated herein by this reference, is hereby adopted and
ratified.
Section 2. The Finance Director shall adjust the Personnel services
appropriation accounts to reflect the negotiated compensation changes.
Section 3. The City Clerk shall furnish a copy of this resolution and a copy
of the executed Memorandum of Agreement approved by Tim Girvin, SLOCEA
President; Ann Slate, Personnel Director; William Statler, Finance Director.
