RECOMMENDATIO N As recommended by the Human Relations Commission (HRC): 1) Adopt a resolution to approve funding recommendations for $573,125 in CDBG fund s for the 2012 Program Year ; and 2)Reallocate $212,901 of unexpended 2008, 2009 and 2010 CDBG funds from Curb Ram p ADA Street Improvements, Santa Rosa Park ADA Improvements, City of San Lui s Obispo Housing Element Implementation and ROEM Corporation Property Acquisitio n for Affordable Housing (2201 Emily Street). DISCUSSION Backgroun d The City's annual CDBG review process provides Council and the public with an opportunity t o provide early input in the grant award process and assists Council with prioritizing communit y needs . The focus is on maintaining an open, inclusive and fair grant application process . The HR C is the appointed advisor to the Council on community needs and funding recommendations . Th e four major steps in the CDBG review process are as follows : 1.HRC hosts a "Needs Workshop":The HRC hosted a public hearing on September 7, 2011, t o inform the public about upcoming funding amounts and how to apply for grants, and to receiv e community input on grant funding needs . As part of this hearing, the HRC developed recommended priorities for funding considerations . 2.Council priority-setting hearing :On October 4, 2011, the Council held a public hearing t o consider the HRC's recommendation, and adopted funding priorities for 2012 . 3.CDBG applications hearing :On December 7, 2011, the HRC held a public hearing to revie w the 2012 CDBG applications in light of the Council's adopted funding priorities, and forwarde d its funding recommendations to the County for inclusion in the 2012 Draft Action Plan . 4.CDBG Program hearing :On February 21, 2012, the City Council will hold a public hearin g to consider the projects shown in the Draft Action Plan and adopt funding recommendations fo r the 2012 CDBG Program Year . This action will be submitted to the County Board o f PHI -1 Meeting Date 2-21-1 2 Item Numbe r PH1 2012 CDBG Funding Recommendations Page 2 Supervisors for inclusion in the final 2012 CDBG Action Plan for the San Luis Obispo Urba n County . Action by the Board of Supervisors is anticipated in April 2012 . On October 4, 2011, the City Council adopted the following priorities for allocating CDBG fund s during the 2012 CDBG Program Year : 1.Emergency and transitional shelter, homelessness prevention and services . 2.Develop and enhance affordable housing for low and very-low income persons . 3.Economic development (to include seismic retrofit, economic stability, low and moderat e income jobs). 4.Promote accessibility and/or removal of architectural barriers for the disabled and elderly . These priorities were used by staff and the HRC to develop their funding recommendations for th e 2012 CDBG applications . HRC Recommended 2012 CDBG Fundin g The table below lists the projects recommended for funding and the funding amounts . Th e recommendation reflects the grant fund restrictions of 15% for public services and 20% for progra m administration . Attachment 1 includes a list of the applications submitted to the City for CDBG funding and the recommended fundin g amounts . Attachment 2 includes the December 7, 2011, HRC staff report with a description of eac h funding request, followed by the meeting minutes as Attachment 3 . The CAPSLO request for the Maxine Lewis Homeless Shelter is for a total of $144,753, which i s slightly more than requested for the past several years . In the past, the City has chosen to provid e 100% of the CDBG public services allowance to the shelter to maximize the benefit of these funds . This year, the total is anticipated to be $85,969 (15% of the City's CDBG allocation). The City ca n PHI-2 2012 CDBG Funding Recommendations Page 3 augment this with $45,000 budgeted from the General Fund for the shelter during the 2012-201 3 fiscal year, which leaves a $13,784 funding gap . CAPSLO has been advised that CDBG an d General Fund sources will not completely meet their request of $144,753 . Staff recommended tha t they complete a Grants-in-Aid request or seek outside funding to make up the difference . 2012 Federal Budget Reduction s Preliminary CDBG funding estimates are provided by the County based on available informatio n from the U .S . Department of Housing and Urban Development (HUD) during 2011 . The recentl y adopted 2012 Federal budget includes a 12% reduction in CDBG funding from the 2011 Progra m Year . This 12% reduction is not likely to be an across the board reduction and it is not known at thi s time what impact this will have on the City's 2012 Program Year allocation . Due to the uncertaint y of HUD's final funding allocation amount to the County, funding could increase or decrease onc e HUD releases its allocations in the spring . Staff will keep Council up to date when mor e information is known about the impact of budget reduction on the City's allocation . Reallocation of Prior Year CDBG Fund s In 2008, the City was awarded $403,112 in CDBG funds for Curb Ramp ADA Stree t Improvements . This project is complete and staff and the HRC recommend reallocating th e remaining $7,979 of the award to the property acquisition project for affordable housing at 31 3 South Street . In 2009, the City was awarded $264,246 for Santa Rosa Park ADA Improvements . This project i s also complete and staff and the HRC also recommend reallocating the remaining $34,882 of th e award to the property acquisition project for affordable housing at 313 South Street . In 2010, the City was awarded $81,790 for Housing Element Implementation . Due to th e temporary vacancy of the Housing Programs Manager position during this program year, a balanc e of $20,040 remains . Staff and the HRC recommend reallocating the remaining $20,040 of th e award to the property acquisition project for affordable housing at 313 South Street . In 2010, ROEM Corporation was awarded $150,000 for Property Acquisition for Affordabl e Housing at 2201 Emily Street . The 2201 Emily Street project is under construction and nearin g completion . Funding allocated to this project was not needed for property acquisition . Staff and th e HRC recommend reallocating the remaining $150,000 of the award to the property acquisitio n project for affordable housing at 313 South Street . In addition, the project would involv e implementation of Housing Element Program 6 .12, which specifically identifies the site as a location that should be considered for rezoning to allow infill housing . The project includes 42 for-rent apartment units 100% affordable to extremely-low, very-low, an d low income households earning 30% to 60% of area median income within the County . The project has received all necessary entitlements, including a General Plan Amendment, Rezoning an d Architectural Review . This project has received multi-year CDBG funding in order to acquir e enough money for acquisition . The applicants are proposing to apply in March 2012 to th e California Tax Credit Allocation Committee for 9% tax credits to help fund the project . The fundin g reallocations will assist the project's score on the competitive application . Property acquisitio n could occur in fall 2012, after 2012 CDBG Program Year funds become available . Next Step s The 2012 CDBG funding recommendations adopted by the City Council will be forwarded to th e County Board of Supervisors for inclusion in the 2012 Urban County Action Plan, which include s funding allocations for all of the participating jurisdictions . Although the CDBG fiscal year begin s on July 1, 2012, funds for projects awarded by the City Council are not expected to be availabl e until October 2012 . FISCAL IMPAC T Decisions made regarding CDBG funding determine how the limited pool of funds the City receive s through the Urban County allocation process is spent . To the extent that projects are funde d through CDBG, the burden on the City's General Fund to pay for those projects is reduced . As a result, projects that receive CDBG funding have a positive fiscal impact on the City if the y otherwise would have been paid for out of the General Fund . The amount of funding available fo r 2012 is an estimate based on current year funding . If the amount awarded to the City is differen t than the amounts shown, staff will recommend adjustments to the allocations . ALTERNATIVE S 1. The Council may modify the proposed funding amounts . 2. The Council may choose to fund a CDBG application not recommended by the HRC o r staff. PHI -4 2012 CDBG Funding Recommendations Page 5 3 . The Council may continue consideration of funding for the 2012 CDBG program year . Direction should be given to staff regarding additional information needed to make a decision on funding amounts . Situation On October 4, 2011, the City Council endorsed the HRC's recommended Communit y Development Block Grant (CDBG) funding priorities for 2012 . The priorities established by th e HRC and City Council are listed below : 1.Emergency and transitional shelter, homelessness prevention and services . 2.Develop and enhance affordable housing for low and very-low income persons . 3.Economic development (to include seismic retrofit, economic stability, low and moderat e income jobs). 4.Promote accessibility and/or removal of architectural barriers for the disabled and elderly . 2012 CDBG Application s The above priorities are used as the basis for making recommendations regarding the 201 2 CDBG applications . The City received a total of 12 CDBG funding applications requestin g $917,285 . Expected funding for the 2012 Program Year is $573,124 . The following discussion provides a brief overview of each funding request and evaluates the proposals for consistenc y with funding priorities . This recommendation is also summarized in a spreadsheet, which is included as Attachment 1 . A copy of each of the 2012 CDBG applications is provided for HR C review . Those applications not recommended for funding also have the opportunity to apply fo r the City's Grants-In-Aid funds . Project Overview and Preliminary Funding Recommendation s 1 . Maxine Lewis Homeless Shelter (CAPSLO):The CAPSLO request for the homeles s shelter is for $144,753 . The City is limited to using 15% of its allocation for public service s uses . In the past, the City has chosen to provide 100% of this allowance to the shelter t o maximize the benefit of these funds . This year, the total is anticipated to be $85,969 (15% of PHI-7 Attachment 2 HRC Memorandum, 2012 CDBG Applications Worksho p Page 2 the City's CDBG allocation). The City has budgeted $45,000 from the General Fund for th e shelter during the 2011-2012 fiscal year . In order to fully fund CAPSLO's request, th e Council would have to authorize $58,784 from the General Fund in fiscal year 2012-2013 , which is $13,784 more than the current General Fund support . 2.Prado Day Center (CAPSLO):The CAPSLO request for $59,907 cannot be met by CDB G funding if the City allocates all of the Public Services allowance to the homeless shelter, a s proposed . The City normally supports operations at the Prado Day Center through a contribution from the General Fund . In the 2011-2012 financial plan, the City allocate d $60,000 to the Prado Day Center from the General Fund, which would fully fund the 201 2 CAPSLO request. 3.Transitional Food and Shelter :Transitional Food and Shelter has requested $1,000 t o support their operations of providing emergency shelter for the medically fragile an d homeless . These funds would come from the limited pool of funds available to suppor t public services . Although this request meets Council adopted priority one, City staff does no t support using CDBG funds to support this activity because it would reduce the amount o f funding available for the homeless shelter, which matches the City's funding priorities mor e closely. It should be noted that this activity has been successful in receiving grant fundin g from the City's Grants-In-Aid program for the past several years . 4.Alliance for Pharmaceutical Access : Alliance for Pharmaceutical Access has requeste d $7,000 to support their operations of providing access to prescription medications for chroni c medical conditions to targeted populations . These funds would come from the limited pool o f funds available to support public services . The preliminary recommendation from staff doe s not allocate CDBG funds to this project because it would reduce the amount of funding available for the homeless shelter, which matches the City's funding priorities more closely . It should be noted that this activity has been successful in receiving grant funding from th e City's Grants-In-Aid program for the past several years . 5.Transitional Food and Shelter (Property Acquisition ; 7860 Sinaloa, Atascadero): Transitional Food and Shelter has requested $70,000 for the acquisition of property located i n the City of Atascadero for transitional housing for the medically fragile and homeless . City staff does not support using CDBG funds to support this activity because the property is no t located within or adjacent to the City of San Luis Obispo, and these funds would come fro m the pool of funds available to support housing, public facilities and economic development , thereby precluding other high-priority projects within City limits from receiving funding . 6.Tri-Counties Housing Corporation (Property Acquisition and Rehabilitation ; 542 Hathway):Tri-Counties Housing Corporation has requested $95,000 for the acquisition an d rehabilitation of a three-unit apartment project consisting of two one (1) bedroom units and one (1) studio unit . These units have been utilized as affordable housing for extremely-lo w income individuals with developmental disabilities for the past seven years . The project PHI-8 Attachment 2 HRC Memorandum, 2012 CDBG Applications Worksho p Page 3 meets the second priority for use of CDBG funds and staff is recommending funding of thi s proposal in the amount of $95,000 . 7.Habitat for Humanity for SLO County (Site Clearance and Remediation ; 321 2 Rockview):Habitat for Humanity (HFH) has requested $30,000 to clear and remediat e property located on 3212 Rockview in preparation for the construction of three single-famil y homes for very-low income families . HFH received $211,217 in CDBG funds from the 201 1 Program Year to acquire the property. The project meets the City's second priority for use o f CDBG funds and staff is recommending funding of this proposal in the amount of $30,000 . 8.ROEM Development Corporation (Property Acquisition ; 313 South Street): ROEM Development Corporation has requested $300,000 to acquire property for the construction o f a 43-unit (42 affordable housing rental units and 1 manager unit) apartment complex withi n four three-story buildings . The units would be available for rent to extremely-low, very-lo w and low-income households earning 30% to 60% of the AMI within the County . ROEM Corporation will be applying to the State of California for tax credits during 2012 an d CDBG funding will assist the developer's tax credit application . The project has receive d public assistance commitments from a variety of sources including CDBG, HOME, Cit y Affordable Housing Fund and development review and impact fee waivers for a combine d total of committed funding of $2,293,729 . Local support is necessary for the project to b e competitive on a State-wide basis . The project meets the second priority for use of CDB G funds and staff is recommending funding of this proposal in the amount of $270,04 8 ($82,531 from Program Year 2012 and $187,517 from previous year reallocations). Fully funding the request would use most of the funds available for housing, public facilities an d economic development and preclude other high-priority projects with impending timeline s from receiving funding . 9.City of SLO (Curb Ramps):The City of San Luis Obispo, Public Works Department, i s requesting $105,000 for curb ramp projects to remove architectural barriers for disabled an d elderly persons . As the Public Works Department moves through various neighborhoods an d re-paves streets, the City is required to upgrade each curb ramp to current ADA standards . The project is consistent with the Council adopted priority four and staff is recommendin g funding of this program in the amount of $105,000 . 10.CAPSLO Homeless Services Campus :CAPSLO is requesting $50,000 to help fund pre- develppment costs for the design and construction of a new homeless services campus to b e located adjacent to the Department of Social Services on 3451 South Higuera Street . Th e campus would combine services currently provided at the Maxine Lewis Homeless Shelte r and the Prado Day Center, consistent with the concepts of the 10-Year Plan to End Chroni c Homelessness . CAPSLO received $25,000 in CDBG funds from the 2011 Program Year t o assist with pre-development costs . The project is consistent with Council's top priority fo r CDBG funding and staff is recommending funding of this proposal in the amount of $50,000 . PHI -9 Attachment 2 HRC Memorandum, 2012 CDBG Applications Worksho p Page 4 11.MCSC : Mission Community Services Corporation is requesting $10,000 in CDBG fundin g for the Women's Business Center Program . The project would fall under the economi c development category, which corresponds to the third funding priority adopted by the City Council . Although the program will have a focus on women-owned business and wome n entrepreneurs, the program would provide training for any income-eligible client, consisten t with the Small Business Administration program guidelines . The proposed training woul d occur within the City of San Luis Obispo, in offices located at 71 Zaca Lane, Suite 130 . MCSC received $10,000 in CDBG funds for the Women's Business Center Program from th e 2010 Program Year . Staff is recommending funding of this proposal in the amount o f $10,000 . 12.City of SLO (Program Administration, Implementation of Housing Element): HUD allows up to 20% of the City's CDBG allocation ($114,625) to be used for progra m administration . CDBG administration and Housing Element implementation are both eligibl e activities . Activities accomplished with this funding include processing CDBG applications , completing environmental clearances, preparing contracts, preparing quarterly reports an d monitoring projects as they progress . Implementation of the Housing Element is anothe r function that is proposed to be funded through the CDBG administration program . These activities include administration of the Affordable Housing Fund, administration of the City's affordable housing stock, implementation of the Inclusionary Housing Ordinance an d implementation of various Housing Element programs . These activities are consistent with the Council's first two priorities because they further affordable housing opportunities in th e City. All of these functions are carried out by the City's Housing Programs Manage r position. The preliminary staff recommendation is to continue funding this position wit h CDBG funds . HRC Rol e These preliminary recommendations are provided for the benefit of the HRC . The HRC's role i s to consider these recommendations and either (1) accept the allocations proposed if the HR C concurs, or (2) make changes so that the recommendation reflects the views of a majority of th e Commission . The adopted priorities should guide the Commission throughout the discussion . The November 16 `h HRC meeting is scheduled as a workshop to provide the HRC with an opportunity to discuss these applications and ask questions of staff. A public hearing i s scheduled on December 7 `h for the HRC to receive public testimony and finalize thei r recommendation . The HRC's recommended allocations will be forwarded to the County for incorporation into th e Draft Action Plan for the 2012 CDBG program year . The entire Draft Action Plan will b e considered by the Council in February, 2012 . XXXX-1 2 A RESOLUTION OF THE CITY COUNCI L OF THE CITY OF SAN LUIS OBISPO APPROVING THE 2012 CDB G PROGRAM AND REALLOCATING $212,901 OF FUNDING FRO M PREVIOUS CDBG PROGRAM YEAR S WHEREAS, the City of San Luis Obispo is a participating jurisdiction in the San Lui s Obispo Urban County, along with the cities of Arroyo Grande, Atascadero, Morro Bay, and Paso Robles and the County of San Luis Obispo ; an d WHEREAS, said cities and County cooperatively administer several federal gran t programs under the provisions of the Cooperative Agreement approved by the San Luis Obisp o City Council on June 21, 2005, and under applicable U .S . Department of Housing and Urba n Development Department (HUD) rules ; an d WHEREAS, pursuant to said agreement, the Urban County Public Participation Plan an d HUD rules, the City Council held a public hearing on February 21, 2012, to consider fundin g recommendations by the Human Relations Commission (HRC), to review applications fo r federal grant funding, and to consider public comments on community needs and the use of suc h funds ; and WHEREAS, The Council has considered applications for Community Developmen t Block Grant (CDBG) funds, public testimony, the Urban County's proposed One-Year Actio n Plan and the HRC and staff recommendations included in the agenda report ; and WHEREAS, the Council has also considered previous years' CDBG funding allocation s and determined that amendments are necessary to re-allocate unused funds from complete d projects to other eligible uses . Th e City's 2012 Community Development Block Grant Program is hereby approved, as shown i n Exhibit A .
