SUBJECT:
Orcutt Road Setback Line, Broad Street to SPRR.
CAO RECOMMENDATION:
Pass ordinance to print, approving a Negative Declaration on Environmental Impacts and
adopting a revised setback line for Orcutt Road, between Broad Street and the Southern
Pacific Railroad R/W, per staff recommendation.
ADVISORY BODY RECOMMENDATION:
The Planning Commission (on February 23, 1994) voted to recommend the City Council
adopt an ultimate 93 ft. right of way width for Orcutt Road.
BACKGROUND:
The Council held a public hearing on May 31, 1994 to consider a revised setback line for Orcutt
Road. After receiving testimony and considering the Planning Commission's recommendation, the
Council directed staff to bring back an ordinance which provides for a 16 ft. wide median, four 11
ft travel lanes, two 6 ft bike lanes and 10 ft. and 11 ft parkway areas (on the north and south sides,
respectively), within a 93 ft. right of way (R/W).
The Council also determined there would be no widening along the frontage of the Henderson
Petroleum property. A "jog" in the street alignment would be acceptable (with or without the
overpass) to eliminate the need for widening on the north side of Orcutt Rd., east of Duncan Rd.
However, there is still a need for a small triangular portion of R/W at the northeast corner of
Duncan Rd. and Orcutt Rd. to accommodate the proposed slope necessary to accommodate the
future grade separation and a 5 ft widening along the Duncan Rd. frontage to provide for the
present street design. There are no buildings affected by this and it wasn't an issue opposed by the
property owner. The owner's representative (Rob Strong) is satisfied with the recommended design.
SIDEWALK ALTERNATIVES
At the May 31st meeting, the Council asked staff to evaluate sidewalk alternatives within an 11 ft.
parkway on the south side of Orcutt Rd. The staff recommended parkway design provides for a 5
ft.wide detached sidewalk, except at creek crossings where a 6 ft. integral sidewalk is recommended.
This will reduce the length and costs of the culverts and would disturb less riparian habitat areas
within the creek areas. The pros and cons of both sidewalk designs are as follows:

INTEGRAL SIDEWALKS -
Advantages-Integral sidewalks are advantageous when parking is permitted, to accommodate access
to and from vehicles where vegetation, irrigation systems and/or muddy conditions could be
hazardous or inconvenient to pedestrians. This also provides for integrating property owners'
landscaping with the parkway planting strip which now abuts and is contiguous with property owner
landscaping. Integral sidewalks are currently the City's "standard", except where more than half of
a block has existing detached sidewalks.
Disadvantages - Sidewalks immediately adjacent to streets may be considered or perceived as being
more hazardous to pedestrians, streets appear even wider and the overall quality of the pedestrian
environment may be perceived as diminished.
DETACHED SIDEWALKS -
Advantages - Detached sidewalks are advantageous because they do separate pedestrians from the
vehicles along with the fact that trees can span further out over the street, giving a more aesthetic
feel to the corridor.
Disadvantages-Parkway landscaping areas are usually relatively narrow and therefore don't support
large trees due to impervious surfaces on at least 2 sides. Sometimes parkway strips are poorly
maintained by property owners when it is not integral with their on-site landscaping.
CONCLUSION:
Since this is a wide street and parking will not be allowed, the advantages of detached sidewalks will
be realized without some of the typical disadvantages. The issue regarding maintenance could still
exist. Staff therefore recommends detached sidewalks.
ENVIRONMENTAL REVIEW
On January 25, 1994,the Community Development Director granted a mitigated negative declaration
regarding effects on the environment due to amending of the Official Orcutt Road Setback Line.
A copy of the initial study has been provided for review in the Council's reading file. The required
mitigation is specific as to replacement of trees and enhancement of riparian habitat and
revegetation associated with actual widening projects. The Council should concur with the
determination as noted in the ordinance and recommended action.
FISCAL UV)IPACT:
The estimated additional costs attributed to the wider landscaped median and parkway (including
R/W) implied by the revised setback line, over and above the "current"setback line, is $ 209,000 for

the portion of Orcutt Rd., between Broad St. and Laurel Lane. Of the $ 209,000, the City's share
would be about $ 200,000 (1993 dollars).
(Note: when the overpass is constructed, the R/W as proposed implies either: no median between
Duncan Rd. and Laurel Ln. or steepening the fill banks by some method and/or constructing
retaining walls, which would add about $ 50,000 to the cost of that project.)
ALTERNATIVES:
Alternate 1. Adopt ordinance amending the Orcutt Road Setback Line between
Broad Street and the SPRR R/W (93 ft. R/W); street cross-section to show 5 ft.
detached sidewalks on the south side and 6 ft. integral.sidewalks on the north side.
Alternate 2. Same as Alternate 1, except with 6 ft. integral sidewalks on both sides
of the street.
CONCURRENCES:
The Community Development Director and City Attorney concur with the recommended action.

ORDINANCE NO. (1994 SERIES)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING (1) PORTIONS OF
THE OFFICIAL BUILDING SETBACK LINE FOR ORCUTT ROAD BETWEEN BROAD
STREET AND JOHNSON AVENUE AND, (2) SECTION 17.74.140 OF THE SAN LUIS
OBISPO MUNICIPAL CODE TO REFLECT THE AMENDING MAP.
WHEREAS,the City Council has considered an environmental initial study, staff reports and
recommendations,Planning Commission recommendations and public testimony regarding a proposal
to amend the Official Orcutt Road Building Setback Line, between Broad Street and the Southern
Pacific Railroad Right of Way (SPRR); and
WHEREAS, the City Council concurs with the Community Development Director that
amending the existing setback line will cause no significant adverse impacts on the environment
subject to certain mitigation measures, as shown on the attached Exhibit 2, per ER 144-93; and
WHEREAS, the City Council has determined that the existing setback line should be
amended between Broad Street and the SPRR to accommodate a wider landscaped median and
wider parkways (93 ft. wide R/W), as shown on the attached Exhibit 1, to provide an enhanced
scenic corridor.
NOW THEREFORE BE IT ORDAINED by the Council of the City of san Luis Obispo as
follows:
SECTION 1. The Council hereby adopts a mitigated negative declaration of environmental
impact pursuant to the above-mentioned environmental review.
SECTION 2. The "Official Building Setback Line for Orcutt Road between Broad Street
and Johnson Avenue" is hereby amended as delineated on Exhibit 1, attached hereto and
incorporated herein by this reference.

SECTION 2. Municipal Code Section 17.74.140 is hereby amended to read as follows:
SECTION 17.74.140
"An Official Building Setback Line is established on both sides of Orcutt Road, between
Broad Street and Johnson Avenue, in accordance with the official map designated "Official
Building Setback Line for Orcutt Road between Broad Street and Johnson Avenue" dated
November 4, 1963, as amended by the City Council by ordinance on February 16, 1982 and
as amended by the City Council by ordinance on P1994, on file in the office of
the City Clerk. Provided that the setback line may be amended in the event that the City,
in its sole discretion, chooses to construct, or cause to be constructed, improvements which
require a reduced area."
SECTION 3. This ordinance, together with the ayes and noyes, shall be published once in
full,at least three (3) days prior to its final passage, in the Telegram-Tribune, a newspaper published
and circulated in this City. This ordinance shall go into effect at the expiration of thirty (30) days
after its final passage.

Adjustment to the Street Setback Line
Orcutt Road between Broad Street and the Southern Pacific Railroad
In conformance with AB 3180, the following mitigation measures will be monitored as
indicated below. Please sign the original and return to my office as soon as possible.
A. Surface Water Flow and Oualitvv. The design for widening Orcutt Road should
include a method for bridging the waterways which feed into the Acacia Creek
drainage system that minim±yes disruption to water flow and flooding and erosion
impacts, subject to approval by the City Engineer, the Community Development
Director, and the State Department of Fish and Game.
B. Plant and Animal life. To ensure no net loss of the extent or quality of riparian
habitat, the remaining riparian habitat on parcels adjoining the road widening
project should be expanded and enhanced according to a plan prepared by a
professional landscaper or biologist with experience in riparian habitat restoration
and revegetation. The plan should be subject to approval by the State
Department of Fish and Game and the Community development Director, and
modelled after the one specified for the Parkside Research Center project at 953
Orcutt Road (ER 220-92). Planting should occur at the time of site development
or actual road widening, whichever comes first. Plan preparation and installation
shall be the responsibility of the applicant if site development triggers this
mitigation, or shall be the responsibility of the City if road widening precedes site
development
C. Archaeological. Construction activities related to the widening of Orcutt Road
shall comply with the City's Interim Archaeological Procedures (attached). .
D. Other. Short-term Construction Impacts. A plan for dust control during
construction activities related to the widening of Orcutt Road shall be approved '
by the Community Development Director prior to commencing construction, and
implemented during actual construction.
