SUBJECT: Purchase of Tax-Defaulted Land J
Via a recent e-mail to you and Paul LeSage, I informed you both
that I had been given one day's notice to review properties listed
as being in default of taxes and available for purchase by the
City. I quickly reviewed all of the properties and identified a
number of properties that the City would be interested in
purchasing and returned that letter directly to the Tax Collector's
Office of San Luis Obispo County. I had the help in doing this of
Roger with the Community Development Department. Actually Allen
Hopkins of the Community Development Department gave me the
information, and without his submittal I would not have been able
to make the response to the Tax Collector.
As a result of that letter to the Tax Collector, I was informed
that two of the properties that we had designated are actually
available for our purchase. They will cost the City $150.00 a
piece, plus publication costs. The two properties are located on
Calle Joaquin adjacent to open space and have a current assessed
value in total of $239,800. With City ownership, the City would be
able to keep the entire property in open space or develop a part of
it and use the proceeds from that partial development to acquire
other properties for open space. However prior to acquiring the
property for open space, the two following actions must occur: 1)
City Council must hold a special meeting and pass a resolution
agreeing to purchase the property and authorize the Mayor to sign
the attached copies of the purchase agreement; and 2) the Board of
Supervisors must meet and declare the property surplus and allow
the City to purchase it via the attached agreement.
The Board of Supervisors, due to the total valuation of the
property, may decide to hold a public auction of the property
rather than to allow the City to purchase the two properties for a
total of $300.00. However, at this time we must go on the
assumption that the tax defaulted properties are available to the
City for that amount of money.
I therefore ask for your cooperation in arranging at least three of
the Council members to meet, and that of the City Clerk to call a
special meeting for a very quick consent item to purchase the two
properties. The meeting must take place and the agreements must be
signed and to the Tax Collector's Office by August 8. All the
information needed is attached to this memo.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
TO AUTHORIZE PURCHASE OF TAX DEFAULTED PROPERTY AND
AUTHORIZE THE MAYOR TO SIGN THE PURCHASE AGREEMENT
WHEREAS, the City Council of the City of San Luis Obispo places great emphasis on the
acquisition of open space, and
WHEREAS, the County of San Luis Obispo has made available tax defaulted properties for
government purchase, and
WHEREAS, two properties have been identified on Calle Joaquin Road as available, and
WHEREAS, those two properties are advantageous for open space acquisition.
NOW, THEREFORE, BE IT RESOLVED, the City of San Luis Obispo does hereby wish
to purchase said two properties and authorize the Mayor to sign a purchase agreement with the
County of San Luis Obispo on behalf of the City of San Luis Obispo towards the purchase of the
two properties.

Dear Mr. McCluskey,
Enclosed are the requests to purchase tax-defaulted land thru the
Chapter 8 Sale process.
Prior to obtaining approval for the sale from the Board of
Supervisors and the State Controller it is necessary that we
receive from your office (6) six copies of the "Agreement to
Purchase" with original signatures by the Mayor, and (6) six copies
of the Resolution or Consent Agenda with original seals and
signatures approving the purchase of the parcels you are interested
in. Please return the requested Agreement and Resolutions to our
office by August 8, 1994 .
The purchase price for each parcel has previously been established
at $150. 00 plus publication cost.
