CAO RECOMWENDATION: Give final passage to Ordinance No. 1269 (1994 Series) amending the Orcutt Road Setback Line, between Broad Street and the Southern Pacific Railroad R/W. BACKGROUND: On July 19th, the Council held a public hearing and passed to print Ordinance No. 1269 (1994 Series) which amends the official Orcutt Road setback line between Broad Street and the SPRR to provide for 93 ft. of R/W. The Council must now consider final passage. ALTERNATIVES: The Council has already determined the geometrics of the ultimate street section and respective design features. (1994 SERIES) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING (1) PORTIONS OF THE OFFICIAL BUILDING SETBACK LINE FOR ORCUTT ROAD BETWEEN BROAD STREET AND JOHNSON AVENUE AND, (2) SECTION 17.74.140 OF THE SAN LUIS OBISPO MUNICIPAL CODE TO REFLECT THE AMENDING MAP. WHEREAS,the City Council has considered an environmental initial study,staff reports and recommendations,Planning Commission recommendations and public testimony regarding a proposal to amend the Official Orcutt Road Building Setback Line, between Broad Street and the Southern Pacific Railroad Right of Way (SPRR); and WHEREAS, the City Council concurs with the Community Development Director that amending the existing setback line will cause no significant adverse impacts on the environment subject to certain mitigation measures, as shown on the attached Exhibit 2, per ER 144-93; and WHEREAS, the City Council has determined that the existing setback line should be amended between Broad Street and the SPRR to accommodate a wider landscaped median and wider parkways (93 ft. wide R/W), as shown on the attached Exhibit 1, to provide an enhanced scenic corridor. NOW THEREFORE BE IT ORDAINED by the Council of the City of san Luis Obispo as follows: SECTION 1. The Council hereby adopts a mitigated negative declaration of environmental impact pursuant to the above-mentioned environmental review. SECTION 2. The "Official Building Setback Line for Orcutt Road between Broad Street and Johnson Avenue" is hereby amended as delineated on Exhibit 1, attached hereto and incorporated herein by this reference. Municipal Code Section 17.74.140 is hereby amended to read as follows: SECTION 17.74.140 "An Official Building Setback Line is established on both sides of Orcutt Road, between Broad Street and Johnson Avenue, in accordance with the oMcial map designated "Official Building Setback Line for Orcutt Road between Broad Street and Johnson Avenue" dated November 4, 1963, as amended by the City Council by ordinance on February 16, 1982 and as amended by the City Council by ordinance on , 1994, on file in the office of the City Clerk. Provided that the setback line may be amended in the event that the City, in its sole discretion, chooses to construct, or cause to be constructed, improvements which require a reduced area" SECTION 3. This ordinance, together with the ayes and noyes, shall be published once in full, at least three (3) days prior to its final passage, in the Telegram-Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect at the expiration of thirty (30) days after its final passage. I Q c 1 � Ap 6 Q e 0 0 EF. 144-93 Adjustment to the Street Setback Line Orcutt Road between Broad Street and the Southern Pacific Railroad In conformance with AB 3180, the following mitigation measures will be monitored as indicated below. Please sign the original and return to my office as soon as possible. A. Surface Water Flow and Quality. The design for widening Orcutt Road should include a method for bridging the waterways which feed into the Acacia Creek drainage system that m+ininuzes disruption to water flow and flooding and erosion impacts, subject to approval by the City Engineer, the Community Development Director, and the State Department of Fish and Game. B. Plant and Animal Life. To ensure no net loss of the extent or quality of riparian habitat, the remaining riparian habitat on parcels adjoining the road widening project should be expanded and enhanced according to a plan prepared by a professional landscaper or biologist with experience in riparian habitat restoration and revegetation: The plan should be subject to approval by the State Department of Fish and Game and the Community development Director, and modelled after the one specified for the Parkside Research Center project at 953 Orcutt Road (ER 220-92). Planting should occur at the time of site development or actual road widening, whichever comes first. Plan preparation and installation shall be the responsibility of the applicant if site development triggers this mitigation, or shall be the responsibility of the City if road widening precedes site development. C. Archaeological. Construction activities related to the widening of Orcutt Road shall comply with the City's Interim Archaeological Procedures (attached). D. Other. Short-term Construction Impacts. A plan for dust control during construction activities related to the widening of Orcutt Road shall be approved by the Community Development Director prior to commencing construction, and implemented during actual construction.
