SUBJECT: Revoke Certificate of Convenience to Yellow Cab of San Luis
Obispo for Taxi Service.
CAO RECOMMENDATION: Adopt Resolution to revoke Resolution No.5810 (1985
Series) dated October 15, 1985 "Granting of Certificate of
Convenience to Cal Coast Charter Inc.

On October 15, 1985, Cal Coast Charter Inc., the former owner of Yellow Cab of San Luis
Obispo was granted a Certificate of Convenience to perform taxi service. Cal Coast Charter
Inc. was later purchased by Laidlaw Transit Inc. and they assumed the taxi service.
On May 2, 1994, Laidlaw Transit Inc., dba Yellow Cab of San Luis Obispo gave thirty days
notice that they would cease operations of June 1, 1994. Municipal Code Section 5.20.130
entitled Certificate of Public Convenience and Necessity—Revocation,suspension,paragraph
(C) lists as a basis to revoke a Certificate of Public Convenience " The company shall
abandon its operation of all vehicles for a period of thirty days." The service provided by
Yellow Cab of San Luis Obispo did cease on June 1 and has been abandoned for over. 30
days.
Conclusion
As it has been over thirty days since Laidlaw Transit Inc. dba Yellow Cab of San Luis
Obispo has supplied taxi service, it iS appropriate that the Certificate of Convenience be
revoked.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
REVOKING THE APPROVAL OF CERTIFICATE OF CONVENIENCE
FOR CAL COAST CHARTER INC.(RESOLUTION NO. 5810
DATED OCTOBER 15, 1985
WHEREAS, Cal Coast Charter Inc. previously had applied for a Certificate
of Convenience with which to provide taxicab service in the City of San Luis
Obispo; and
WHEREAS, the Certificate of Convenience was approved by Resolution
No. 5810; and
WHEREAS, Cal Coast Charter Inc.was purchased by Laidlaw Transit Inc; and
WHEREAS, Laidlaw Transit Inc. gave on May 2, 1994 thirty day notice to cease
providing taxicab service; and
WHEREAS, taxicab service provided by Laidlaw Transit Inc. has not been provided
for more then thirty days,
WHEREAS,Municipal Code 5.20.130 provides revocation if service is abandoned for
thirty days, and
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of San
Luis Obispo hereby Rescinds Resolution 5810,dated October 15, 1995 thereby revoking the
approved Certificate of Convenience for Cal Coast Charter Inc./Laidlaw Transit Inc (dba
Yellow Cab of San Luis Obispo).

RESOLUTION NO.5810 (1985 Series)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO GRANTING CERTIFICATE OF PUBLIC CONVENIENCE
AND NECESSITY TO CAL COAST CHARTER, INC. , FOR THE
PURPOSE OF PERMITTING TAXICAB SERVICE IN THE CITY
OF SAN LUIS OBISPO
WHEREAS, Cal Coast Charter, Inc. , desires to provide taxicab service
in the City of San Luis Obispo; and
WHEREAS, Cal Coast Charter, Inc. , has filed an application for
Certificate of Public Convenience and Necessity with the City Clerk's
Office pursuant to Municipal Code Section 5.20.030 (Exhibit "A" attached) ;
and
WHEREAS, the public convenience and necessity require the granting
of a Certificate of Public Convenience and Necessity.
NOW, THEREFORE, BE RESOLVED that the City Council of the City of San
Luis Obispo hereby grants a Certificate of Public Convenience and
Necessity to Cal Coast Charter, Inc. , for the purpose of permitting
taxicab service in the City of San Luis Obispo pursuant to Municipal Code
Section 5.20.020; and authorizes the City Clerk to issue a taxicab permit
for each taxicab now operated by Cal Coast Charter, Inc. , within the city.
On motion of Councilwoman Dovey, seconded by Councilman Settle
and on the following roll call vote:
AYES: Councilmembers Dovey, Settle, Dunin, Griffin and Mayor Billig
NOES: None
ABSENT: None
the foregoing Resolution was passed adopted this 15th day of October
