DISCUSSION: Background: With the continuous inquires as to participation in Farmers' Market, the BIA must maintain rules which maintain the event as a promotion for downtown businesses. The original purpose of the event was to promote downtown San Luis Obispo businesses. This purpose must constantly be re-inforced through the application of the TNA Rules and Regulations. Due to a recent appeal to the City Council regarding the allowance of downtown vending machines as participants in Farmers' Market, the BIA is submitting the following rule change: SECTION 2, Definitions: Retail Business: a retail business which occupies an approved retail space within the boundaries of the BIA district. Retail businesses must operate during normal business hours on a year round basis with its primary place of business within the BIA boundaries and hold all required BIA, City and State permits. Vending machines, newspaper/magazine racks, P.O. Boxes, snack boxes, and businesses which are machine or non-personal in contact are excluded from this definition. The BIA feels that the current rules clearly exclude vending machines, however the City Council recently ruled on an appeal for a vending machine application. The BIA is simply further clarifying the rules to assure that no misunderstandings occur. CONCURRENCE: The revised regulations have been approved by the City Attorney and BIA Board of Directors. Resolution 8282 (1994 Series) is hereby rescinded. SECTION 2. That the BIA Rules and Regulations for Thursday Night Activities, attached hereto marked exhibit "A" and incorporated herein by reference, have been reviewed and are accepted.
