BACKGROUND: The 1990 census classified the City of San Luis Obispo an urbanized area making it eligible for Federal grants for mass transportation systems under Section 9 of the Urban Mass Transportation Act of 1964. $615,385 was apportioned to San Luis Obispo in FY 1994. Future apportionments are announced in the Federal Register. These funds remain available to be obligated for three fiscal years following the fiscal year apportioned. At the end of the three years, any unobligated funds revert to the Federal Transit Administration (FTA) for reapportionment. Each year, the City must apply for the following year's appropriation. This agenda item is a near duplicate of last year's, which was the City's first year of eligibility. . I The annual FTA application process requires a resolution of the governing body of the applicant ' authorizing the filing of the application. Suggested wording is contained in UMTA Circular 9030.1A, page V-14. The contract for Federal financial assistance does impose certain.obligations upon the applicant, including the certification of compliance with numerous Federal programs in such areas as civil rights and minority business. The City must also provide a local share of project costs in the program (50% of funds to cover operating costs and 20% of capital costs). FTA will fund 90% of the cost of capital projects which improve bicycle access to mass transit, meet the requirements of the Clean Air Act, or the Americans with Disabilities Act. The City proposes to use State Transportation Development Act (TDA) funds and fare revenues tocover the local match requirement. Significant reporting requirements,as contained in Section 15 of the Urban Mass Transportation Act, are tied to the Section 9 funds. Failure to adhere to Section 15 requirements result in no further Federal funding at a minimum and the potential demand to return the grant funds at the maximum The resolution authorizes the Public Works Director to act on the City's behalf in matters relating to the FTA grant process. ^��N�� ��NIIIII�p� l�Illl city of San Luis OBISPO no ilia COUNCIL AGENDA REPORT UMTA Application Page Two FISCAL IMPACl': The total funds available through Section 9 are $615,385. The grant application totals $615,385. Sufficient funds will exist in the form of Transportation Development Act allocations for FY 1994-95 to service the match requirement. The FY 1994-95 budget programs the capital projects and the operating budget. (See attached Program of Projects and Budget). FINAL APPLICATION: The actual grant application,with all of its certifications, Disadvantaged Business Enterprise (DBE) Plan,and submissions,will be available for review in the City Clerk's office. The capital components in the grant include an external bus wash/water recycle facility and bus stop improvements. Attachment: Program of Projects & Budget umtmpp/hw1 RESOLUTION NO. (1994 Series) A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO AUTHORIZING THE FILING OF APPLICATION WITH THE DEPARTMENT OF TRANSPORTATION, UNITED STATES OF AMERICA, FOR A GRANT UNDER THE URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED, AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE AND FILE APPLICATIONS ON BEHALF OF THE CITY WHEREAS, the Secretary of Transportation is authorized to make grants for a mass transportation program of projects and budget; WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provision by it of the local share of the project costs in the program and substantial reporting requirements; WHEREAS, it . is required by the U.S. Department of Transportation, in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance under the Urban Mass Transportation Act of 1964, as amended, the applicant give an assurance that it will comply with Title VI of he Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and WHEREAS, it is the goal of the applicant that minority business enterprise be utilized to the fullest extent possible in connection with these projects, and that definite procedures shall be established and administered to ensure that minority business shall have the maximum construction contracts, supplies, equipment contracts, or consultant and other services; NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of San Luis Obispo: SECTION 1. That the Director of Public Works is authorized to execute and file applications on behalf of the City of San Luis Obispo with the U.S. Department of Transportation to aid in the financing of planning, capital, and operating assistance projects pursuant to Section 9 of the Urban Mass Transportation Act of 1964, as amended. SECTION 2. That the Director of Public Works is authorized to furnish such additional information as the U.S. Department of Transportation may require in connection with the application for the program of projects and budget. SECTION 3. That the Public Works Director is authorized to furnish such additional information as the U.S. Department of Transportation may require in connection with the application for the program of projects and budget. That the Public Works Director is authorized to set forth and execute affirmative minority business policies in connection with the program of projects and budgets procurement needs. SECTION 5. That the Public Works Director is authorized to execute grant agreements on behalf of the City of San Luis Obispo with the U.S. Department of transportation for aid in the financing of the planning, capital, and operating assistance program of projects and budgets.
