CAO RECOMMENDATION: Adopt a resolution establishing the days and hours of operations, setting the boundaries of the district, and time of permit renewal for the preferential parking district for the Greater Alta Vista neighborhood and rescinding Resolution 8314. DISCUSSION: At the July 5th City Council meeting, a public hearing was held to consider the adoption of new district boundaries and changes to the hours of operations for the preferential parking district adjacent to the Cal Poly campus. Council adopted the recommended district boundaries and modified the recommended hours of operations from Sam to 5pm, M-F, to 2am to Spm, M-F based upon the input of district residents in attendance at the council meeting. There was also discussion about district parking problems in the evening hours (5pm to lOpm), especially for the residences that directly border the campus. Because of this new concern for evening parking restrictions, council directed staff to survey outlying residents to determine if there was the need for evening parking restrictions on specific parking district streets. Staff surveyed 46 residences (Exhibit A), on Foothill, Hathaway, Slack, and Longview, to ascertain if additional parking restrictions were needed or wanted, and if so, what would be their optimal time preference for extending the parking restriction. Forty-one responses were received, with 33 indicating additional restrictions were needed and 8 responding that no further restrictions were necessary at this time (Exhibit A). Although not all residents supported additional parking restrictions, 37 out of the 41 respondents did indicate their time preference if permit hours were to be extended. The survey gave residents hourly choices for evening parking restrictions ranging from 9pm until midnight. The results of the time preferences were evenly split between the hours of 9pm-1lpm, with 9pm, lOpm and l 1pm all getting (11 votes). Midnight received (4 votes). Based upon the survey results, 80% feel additional restrictions are necessary and 90% of the surveyed residents would prefer evening parking restrictions until at least 9pm or later if the permit hours were to be extended. Staff would concur with the need for evening parking restrictions, particularly in light of on- campus enforcement running until lOpm and the Cal Poly Rec Center being open until midnight on most evenings. Since there is strong support for late evening parking restrictions (26 supported lOpm or later), and since restrictions now begin at 2am, staff would recommend that parking permits be required 24 hours a day, Monday to Friday, for the streets that border the campus proper. The 24 hour restriction simplifies signing and the public's understanding about when permits are required and eliminates the very short time period when permits would not be �I���»rH►►viIIII�IIP° llUlh city of san pais osispo COUNCIL AGENDA REPORT Council genReport Page Two required if parking restrictions stopped at lOpm or later. However, it should be noted that this new time restriction would create two different permit time periods within the same neighborhood. This could create a spill over problem into adjoining blocks which do not have the 24 hour restriction. Also, as with the current early morning (2am) restrictions, evening (after 5pm) enforcement would have to be the responsibility of the Police Department, and enforcement would occur only when staff was available to respond to parking complaints. CONCURRENCES: I The Police Department concurs that it can only provide limited enforcement of the parking district. I FISCAL 11%4PACT: The direct fiscal impact for extending parking restrictions 24 hours a day for the specific streets would be the materials (decals) to change the district signs, which is estimated at $120. Ongoing maintenance costs would continue to be about the same as they have been in the past. (1994 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBI8PO ESTABLISHING THE GREATER ALTA VISTA AREA OF THE CITY AS A RESIDENTIAL PARKING PERMIT AREA AND ESTABLISHING DAYS AND HOURS OF OPERATIONS OF SAID AREA AND TIME OF RENEWAL FOR A PARKING PERMIT AND RESCINDING RESOLUTION NO. 8314 WHEREAS, the Council of the City of San Luis Obispo has received a petition from a majority of the residents living within the Greater Alta Vista neighborhood as shown on Attachment 1 and, WHEREAS, the Council of the City of San Luis Obispo has determined that the quality of life for the residents of this area has been adversely affected by nonresidents using the neighborhood streets for excessive parking and, WHEREAS, the Council of the City of San Luis Obispo has determined that the restriction of nonresident parked vehicles on the neighborhood streets will improve pedestrian and vehicular safety and allow residents to gain proper access to their residences and, WHEREAS, the Council of the City of San Luis Obispo has held a public hearing to consider the changes to the parking district and permit distribution and has determined the changes will improve the qualify of life for the district residents. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Resolution No. 8314 (1994 Series) is hereby rescinded. SECTION 2. Pursuant to Section 10.36.170 et seq. of the San Luis Obispo Municipal Code the residential parking permit area is hereby established as shown on Attachment 1. SECTION 3. No vehicle other than vehicles providing services to the area or having a permit clearly displayed on the dashboard on the drivers side of the vehicle may park on any street within the hashed area 24 hours a day, Monday through Friday, and the remaining district boundaries shall restrict parking from 2am to 5pm, Monday through Friday except for holidays honored by the City of San Luis Obispo. SECTION 4. The Public Works Department shall be directed to post the area with signs that clearly indicate these restrictions. SECTION 5. The Parking Division shall issue residential parking permits on demand as permitted in Section 10.36.220 of the Municipal Code. Permits shall be issued for a year effective September 15. My previous letter of May 22, 1994 is enclosed. Those thoughts stand. Congratulations ! You have "fixed" what was not broken. The result is the nonsensical parking restriction, 2:00 a.m. to 5:00 p.m. Monday thru Friday. My advice to you is undo what you have done. Return the parking to the 8:00 a.m. to 5:00 p.m. Monday thru Friday. When the Preforming Arts Center opens extend the hours to 8:00 a.m. until 9:00 p.m. Monday thru Saturday. This serves the needs of our neighborhood, when others are in the area, and returns autonomy to the residents of Alta Vista at night, when we are at home. While I am unable to attend your meeting , I know that you will give my letter your thoughtful attention. As the owner and resident of my home on Slack Street I have a personal concern for the quality of life and safety in our neighborhood . I also have a concern for fair and equable treatment for each person who is a resident of our neighborhood, those of us now here and those who will be our neighbors in the future . I want you to know that the preferential parking regulation , as it now exists , serves our needs very well . This plan recognizes that between 8 AM and 5 PM on Monday thru Friday there are non-residents who would take parking away from the residents of our neighborhood . After 5 PM on weekdays and on most weekends there is very seldom a parking problem , nor is there a safety problem . There is an old American axiom that goes , "If it ' s not broke , don ' t fix it . " . I think it fits here . Before the Council takes any action you should personally do a reality check , during the night hours proposed , to be certain that such a law is truly needed to govern the night time parking of residents in Alta Vista. I oppose unnecessary and frivolous restrictions , especially as a "fix" for what may be an occasional nuisance situation. That can be worked out by neighbors . When unnecessary laws plague us , they diminish the value and enforceability of necessary law, and burden us all . Is this the American way ? Let ' s get back to,, the work of creating a quality city. We do not accomplish that by taking responsibility away from the residents of a neighborhood , and placing it in the hands of the police . We do accomplish it by recognizing the unique nature of each neighborhood , and allowing us to work out the wrinkles for ourselves .
