SUBJECT: Establishment of preferential parking permit district.
CAO RECOMMENDATION:
Adopt a resolution establishing a residential parking permit district and days and hours of
operations for the 100 block of South Tassajara Street.
DISCUSSION:
In late July of this year, the City Council received a petition (Exhibit A) from residents of 100
South Tassajara Street requesting the establishment of a preferential parking permit district. As
stated in the petition, the residents living in this area are experiencing a serious parking problem
from nonresidents parking on their block for convenient access to San Luis Mountain.
According to the residents, this particular block is impacted on a regular basis at all hours of
the day, and especially on the weekend when more nonresidents are accessing the mountain area.
As a result of the petition, staff initiated a neighborhood survey to determine if other adjoining
blocks were experiencing a similar parking problem, and if so, would they be interested in
becoming part of the proposed district. Staff surveyed 37 residences, on Luneta, Rafael, and
Tassajara (Exhibit B), to ascertain if the parking problem is more wide spread and to help
determine the size of the proposed parking district. Only 18 residents responded, with 13
indicating no parking problem and NO they would not want to be part of the proposed district.
Five residents, four on Luneta and one on Rafael, felt there was a need for parking restrictions
on their particular blocks. One of the YES Luneta residents, 413 Luneta, faces 100 S. Tassajara
and was part of the original petition for the proposed district.
It should be noted that although adjoining blocks may not be experiencing a parking problem at
the present time, establishing a one block district on 100 S. Tassajara may just move the
problem to adjoining blocks. A block-by-block expansion of the proposed parking district is a
distinct possibility if the problem migrates into adjoining blocks.
Because of the impacted parking problem caused by nonresidents, staff would concur with the
establishment of a parking permit district for those properties that completely or partially front
100 S. Tassajara with the hours of 6am to lOpm, 7 days a week. However, enforcement during
the early morning and late evening and all day Sundays, would have to be the responsibility of
the Police Department. Since the weekend is a critical time for police personnel, district
residents would be subject to staff availability to respond to parking complaints. Enforcement
during remaining periods (9am-5pm, Monday to Saturday) could also be a problem because
parking enforcement staff may not be readily available as well.

CONCURRENCES:
The Police Department concurs that it does not have sufficient manpower to regularly enforce
the parking district, especially on the weekend and late evening hours.
FISCAL IMPACT:
The direct fiscal impact would be for materials and labor to install poles and signs on the block
which is estimated at $300. Ongoing maintenance would be minor due to the single block j
designation. Any reduction in downtown parking enforcement due to requests for enforcement
of this neighborhood district could reduce income to the Parking Fund.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ESTABLISHING THE SOUTH TASSAJARA STREET AREA OF THE CITY AS A
RESIDENTIAL PARKING PERMIT AREA AND ESTABLISHING DAYS AND HOURS OF
OPERATIONS OF SAID AREA AND TIME OF RENEWAL FOR A PARKING PERMIT
WHEREAS, the Council of the City of San Luis Obispo has received a petition from a
majority of the residents living on 100 South Tassajara Street as shown on Attachment 1 and,
WHEREAS, the Council of the City of San Luis Obispo has determined that the quality
of life for the residents of this area has been adversely affected by nonresidents using the
neighborhood street for excessive parking and,
WHEREAS, the Council of the City of San Luis Obispo has determined that the
restriction of nonresident parked vehicles on the neighborhood street will improve pedestrian and
vehicular safety and allow residents to gain proper access to their residences and,
WHEREAS, the Council of the City of San Luis Obispo has held.a public hearing to
consider the establishment of a parking permit district and has determined the parking permit
district will improve the qualify of life for the district residents.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. Pursuant to Section 10.36.170 et seq. of the San Luis Obispo Municipal
Code the residential parking permit area is hereby established as shown on Attachment 1.
SECTION 2. No vehicle other than vehicles providing services to the area or having a
permit clearly displayed on the dashboard on the drivers side of the vehicle may park on any
street within the district boundaries from 6am to lOpm, 7 days a week, except for holidays
honored by the City of San Luis Obispo.
SECTION 3. The Public Works Department shall be directed to post the area with signs
that clearly indicate these restrictions.
SECTION 4. The Parking Division shall issue residential parking permits on demand as
permitted in Section 10.36.220 of the Municipal Code. Permits shall be issued for a year
effective September 15.

PETITION TO THE MAYOR AND COUNCIL OF SAN LUIS OBISPO, CA.
We, the residents, of South Tassajara Street living in the area
south of Luneta Street are beset by nonresident parking of
vehicles in our block. These people that park here are those
climbing San Luis Obispo Mountain. Frequently these people park
without regard to the law by partially blocking driveways or
other illegal placement of vehicles. It has been necessary for
one resident to call the police on two occasions this month as
automobiles partially blocked the driveway entrance. This is not
unusual.
Clearly this is a typical case for application of the Residential
Parking Ordinance. Section 1 of Section 10.36.170 would seem to
be specifically designed to meet this condition. The mountain
climbers start parking in this area as early as 6:00 AM and on
occasion continue until 10:00 or 11:00 PM. Weekends are the
worst with frequently a steady stream of cars coming and going
occurs.
We, the undersigned residents, do respectfully request that the
above mentioned ordinance be applied and that parking by permit
from 6:00 AM to 10:00 PM be required in this block on.all days of
the year.
