Hi Timmi,
I'm following up on the email I sent on 4/17/2025 regarding Alpha Epsilon Pi's CUP.
On Wednesday, 4/16/2025, a noise citation was issued at 10:55 PM with 150 people listed at the fraternity
event. This event violates multiple conditions of the fraternity's CUP at 280 California Blvd and constitutes a
public nuisance, per the SLOMC. It is especially egregious because there were 150 people, six times the
maximum occupancy of 25 people legally allowed by the fraternity's CUP.

On Friday, 4/18/2025, a noise citation was issued at 10:11 PM with 100 people listed at the fraternity event. This
event violates multiple conditions of the fraternity's CUP at 280 California Blvd. and exceeds the maximum
occupancy limit of 25 by 75 people, or four times the limit.
Condition 4 states that the maximum occupancy cannot exceed 25 people. It also states that a
transportation management plan is required for events that exceed 25 people.
Condition 9 states that the fraternity shall comply with the City's noise ordinance.
Condition 12 says that the permit may be revoked if the fraternity fails to comply with any of the conditions or
code requirements, or the conduct is a violation of the law, or constitutes a public nuisance or causes adverse
impacts on the health, safety, or welfare of persons in the vicinity.
During the Planning Commission hearing on 11/13/2024, there was significant discussion about Condition
12. Commissioners confirmed that a noise violation is a "public nuisance" according to the city's municipal
code. 9.12.010 defines a noise violation as a "public nuisance".

At the conclusion of the hearing, it was the understanding of the Commissioners that the fraternity would
return to the Planning Commission if there was a single violation of the noise ordinance.
Commissioner Tolle made the following comment:
At 1:17:24: Commissioner Tolle: "Yeah, I just wanted to make sure that the Applicant is aware that if another violation
occurs, you’re going to be right back in here and we’re going to have to do this all over again. I get it. I understand frat life.
But you’re in a neighborhood. You’re not out in a Greek Row. That’s what’s before us today. So I just want to make that
clear because I feel that the conditions aren’t that strict, as far as repercussions are concerned, so the only thing that we
can lean on is that you will be back here if it happens again."
In my email on 4/17/2025, I said that during the hearing on 11/13/2024, the Commissioners discussed the
terms of the CUP, and they warned the fraternity members that if the fraternity gets a single citation, the
Commissioners wanted the CUP to be revisited. I asked what action you would take regarding the matter.
You responded that you would review with Code Enforcement, look at the CUP, and the hearing record from
11/13/2024.
At the time of my email, the fraternity had only received one citation with 150 people. That event violated
multiple conditions of the CUP. After my email, the fraternity received the second citation with 100 people,
which also violated multiple conditions of the CUP.
I have not heard back from you.
Based on the multiple violations of the conditions of the CUP, I believe the fraternity should go back to the
Planning Commission, as was stated by the Commissioners on 11/13/2024. Would you please let me know
what actions have or are going to be taken to resolve this issue?

Hello Mayor and Councilmembers,
I wanted to let you know that the Planning Commission voted unanimously to revoke CUPs for two fraternities ( Delta
Chi at 1236 Monte Vista Place and Sigma Nu at 1304 Foothill/190 Crandall Way) this evening. The resolutions for
denial will return for adoption at the June 11 Planning Commission meeting, as time is needed to prepare revocation
resolutions (the staff recommendation and resolutions provided to the Commission in the packet were for CUPs with
modified conditions, not for revocation of the CUPs). After approval of the resolutions, the fraternities do have the
opportunity to appeal the revocations to the City Council. I will keep everyone updated if an appeal is received.
I do not normally provide up-to-the minute Planning Commission news, but given the attention on Greek life and
neighborhood wellness issues, I wanted to make sure that you are all aware in case you receive questions or inquiries
from the public about this action.

Per the investigatory meeting on March 20, 2025, and based on the evidence gathered to date, Student Rights & Responsibilities has reached a
decision about the outcome of the case. This meeting concerned an incident report detailing an event that took place on March 15, 2025
involving potential violations of the Recognized Student Organization Code of Conduct (RSOCC).
The investigation yielded that:
On Saturday, March 15, 2025 at approximately 4AM, residents of 1236 Monte Vista Place were cited by the San Luis Obispo Police
Department (SLOPD) for noise, initially reported as a “large party.” Additionally, videos posted to social media (TikTok) appear to show
a large gathering at the property with a banner seen in the background with the fraternity, Delta Chi’s, letters are clearly visible,
including a banner that reads "Get Lucky" behind a large crowd. A separate video shows two women, each holding a "BORG," in front
of the fraternity's letters.
During the initial Intake meeting with the chapter, the President and Risk Manager presented information that demonstrated th is was not a
sanctioned event by the fraternity and further, their property was overrun by unaffiliated individuals as a result of the St. Patrick’s weekend.
Historically, thousands of people travel into San Luis Obispo for what has been termed “St. Fratty’s Day,” despite the university’s attempts to
deter people from this unsanctioned “event.”
Specifically on March 15, 2025, the President of Delta Chi shared that the residents of 1236 Monte Vista Place, as tenants of the property,
chose to hold a private celebration in their courtyard for themselves and their partners prior to attending the on-c ampus event, Morning on the
Green. One resident’s partner who was visiting from out of town designed the flyer that was ultimately seen in a TikTok video. The chapter
initially opposed the request to display the banner, but ultimately decided to allow it for the weekend.
The residents of the property did have music playing, which attracted crowds who were walking along California Blvd on their way to the on-
campus concert (Morning on the Green). Due to the fraternity’s proactive risk-management, they had locked all access points to their property
prior to this morning, including removing any alcohol from their "bar” area, as they had no event planned. As a result, crowd s resorted to
scaling the property’s fence(s) and made unauthorized entry into the facility.
Chapter leadership, including the President, attempted to remove these unwanted individuals, but were quickly outnumbered. When Delta Chi
members requested assistance from law enforcement officials stationed along California Blvd, they were advised to open all their access points
in the hopes that the crowds would organically filter out. Following the direction of law enforcement, Delta Chi proceeded to open their gates,
however this attracted more unwanted attention and grew the size of the crowd.
Following the initial Intake meeting, the President and Risk Manager of Delta Chi shared security camera video from March 15, 2025 with the
Office of Student Rights & Responsibilities (OSRR) that corroborates their narrative. In the video, large groups of individuals are seen walking
from California Blvd, crossing through an adjacent parking lot, and climbing Delta Chi’s fence to enter the property. Further , these
individuals are seen entering the fraternity’s “bar” and leaving empty handed, as there was no alcohol present.
Security camera footage and audio recording indicate that residents of 1236 Monte Vista Place contacted these individuals, yelling at them in
attempts to stop their entry to the property. Photos provided to OSRR of later on March 15, 2025 show the damage these individuals did to the
property (fence), putting the safety and well-being of the residents at risk. Specifically, two areas along the fence line are structurally damaged
(bent), likely due to the crowds using them to climb and enter the property. The damaged areas are the same areas that were observed on the
provided security footage from March 15, 2025.
Further, had the fraternity held an event, attendees would not resort to climbing over a fence to enter. Rather, they would u tilize a common
entry point through the Monte Vista Place cul-de-sac. Additionally, in the audio from the security footage, one individual that jumped over the
fence can be heard stating, “SLO is so different from SMU though.” This statement further supports the narrative that these were unwanted
individuals and unaffiliated with Delta Chi or Cal Poly.
Based upon the information presented, Delta Chi has been found NOT RESPONSIBLE for the following subsections of the Recognized
Student Organization Code of Conduct (RSOCC):
4. Noise: a - Violation of municipal noise ordinances.
7. Health & Safety - Conduct that threatens or endangers the health or safety of any person within or related to the University community,
including physical abuse, threats, intimidation, harassment, sexual misconduct, throwing bottles or objects that could result in person al injury,
or where three or more members of a student organization engage in group violence or taunt others to engage in violence.
22. Student Organization Events: g - Failure to comply with event approval conditions imposed by the Clubs & Organizations office or other
University offices.

22. Student Organization Events: i - Failure by a fraternity or sorority to comply with the Party Registration Policy.
As a student organization, you are responsible for knowing and being in compliance with all Cal Poly Recognized Student Organization Code
of Conduct policies. You are a part of a community and student body that depends on everyone's contribution to create a learning environment
that is characterized as safe, responsible, and respectful.

behind a large crowd. A separate video shows two women, each holding a "BORG," in front of the fraternity's
letters.
During the initial Intake meeting with the chapter, the President and Risk Manager presented information that
demonstrated this was not a sanctioned event by the fraternity and further, their property was overrun by unaffiliated

against 281 Hathway on mere preponderance of evidence. I do not know beyond a reasonable doubt that the picture
in the Instagram post has been taken at 281 Hathway. I have not been granted legal entry into the property where I
was able to observe or identify evidence that would inform me beyond a reasonable doubt that the house has
operated out of its designated zoning regulations in hosting an unsanctioned event.

years. My documentation starts in Fall 2021, and the timeline continues to the present date.
I am curious about what the process is for the City to verify a violation when it is reported, and I don't
understand why the City was "unable to verify" this fraternity event.
The standard of proof for whether 281 Hathway Avenue is operating as a fraternity is a "preponderance of the
evidence," which means it is more likely than not. The documentation provided, including the documents
attached, far exceeds that burden.
I have also attached a video of a party at 281 Hathway on 4/12/2025. SLOPD cleared the party with a "Negative
Violation". After the party was shut down by SLOPD, fraternity members walked past our house. Some were so
intoxicated that they had difficulty walking. The conversation between two fraternity members references a "Big-
Little Night" which is an event hosted by fraternities.
I am requesting that the City prosecute the property owner of 281 Hathway Avenue, which is zoned R-1, for
ongoing illegal fraternity operation under SLOMC Code SLOMC 17.02.030 and SLOMC 17.16.010, consistent
with the case filed against the fraternity operating illegally in 1989. That case was previously provided to the
City, including the City Attorney, in January. The property at 281 Hathway Avenue has been a nuisance for a very
long time. The property owner and the fraternity members know that it is illegal to operate a fraternity at the
address, yet they continue to do so without consequence. It is time to start taking the matter seriously and
protect our neighborhood from the illegal fraternity operations.

An article in today's Tribune mentioned the cyberstalking case I filed with SLOPD, and your
comment said that I asked that the case not be investigated. The reporter asked me if that was
true and I told her it was not, then I obtained a copy of the SLOPD Report for the first time. It is not
consistent with what I asked and the other documentation, including emails, I sent to SLOPD. I
wanted to be sure that you are aware that I asked for the case to be investigated, and that was
communicated to Rick Scott and Fred Mickel, and Donald Peck. I also followed up with Donald
Peck to ask what was happening with the investigation and he told me that there was really
nothing SLOPD could do.
In order to be transparent, I am forwarding the information sent to the reporter, including
documentation that shows that I did ask that the case be investigated and yet it was not, which is
super disappointing.

First my apologies as you are having to wade through these emails among the many other pressing matters
underway. I do feel it is important that I attempt to clarify with you as we did with the newspaper regarding inaccurate
statements persons are attributing to myself and the department. There is no higher priority than to end St. Fratty’s
Day as soon and as safely as possible and this is the objective we are working toward. I fully appreciate the vocal
concern and anger of some of our community members, but we are working toward the best outcome and do not wish
for any members of our community to be injured, especially at the hands of police.
This was precisely what I was attempting to explain to I sought out and sat with her for 45 minutes
after SCLC believing she was upset and to reassure her we were working hard on the problem. There seems to be a
disconnect with how Mardi Gras and Poly Royal were ended and why that approach cannot be used for St. Fratty’s
Day. What I said was ‘those both ended in a riot and the extreme use of force by the PD was justified to end the riot
and keep people from further getting hurt or killed.’ I further said that approach was not appropriate for people
congregating in the street or for even minor vandalism. did not accept this explanation, and I further advised a
tragedy would end the event such as someone being severely hurt or massive property damage where cars were
burnt during Poly Royal. I was very clear however, that our goal was precisely to prevent a tragedy and avoid a riot
response by the police or partygoers alike.
Her request was to have officers exclusively stationed on her property during the event and I advise that was not
possible and that homeowners must take the necessary and reasonable precautions to prevent trespassing and
property damage. The PD sent a team to student leased property to see where the property could be
improved and easy access to the roof discontinued. She was appreciative and appeared to be agreeable to the
changes recommended to include fencing.
Lastly and to address the cyberstalking case mentioned by Ms. Walker,
Again, my apologies for having to provide this level of detail, but I think this cannot be ignored and is necessary to see
the level of the department’s investment and engagement over how it is being purported by those aggrieved and who
honestly just want the situation fixed, which we totally agree and support.

Since the article was published in The Tribune, several news organizations have contacted Steve by somehow
tracking down his cell phone number. A documentary filmmaker also contacted us through the Tribune reporter,
Sadie Dittenber, who investigated the situation for a few months and wrote the article. Also, some neighbors
were able to find Steve's number through software they use for their job, and have reached out to us because
they, too, are affected by what has happened in our neighborhood with the illegal fraternity houses. They have
been afraid to speak out, as many other neighbors, because they fear retaliation.
You may or may not know that there are some illegal fraternities on McCollum off of Albert, and, according to
the she and the other neighbors complained about the illegal fraternity, and
subsequently, their property was vandalized and their cat was killed. car windows were smashed and
the side mirror was left dangling by the wires. These are some of the reasons that my neighbors - and there are
several - are afraid to speak out.
It is not comfortable for Steve and me to speak out either, but someone has to. I have been cyberstalked and the
police did not investigate, despite their claims to the Tribune that they did. I sent information to reporter, Ms.
Dittenber, showing that I continually asked for an investigation, over the course of a month, and my case was
never forwarded to a detective. I recently forwarded that email (sent to the reporter, Ms. Dittenber, with my
documentation) to SLOPD and now, two years later, SLOPD is adding a "supplemental report" to my original
complaint because it originally said my complaint was "for documentation only" and was never investigated,
despite my repeated pleas that it be investigated.
I've also been documenting noisy fraternity parties at illegal fraternity houses with video since the fall of 2021
when our neighborhood noticed a substantial increase in noise, and sending them to SLOPD and the city
council. Large noisy fraternity parties were cleared by SLOPD as "unable to locate" or "negative violation" so I
felt I needed to document the parties to prove they were actually happening, even though the SLOPD dispatch
log shows there was no violation of the noise ordinance. To be clear, the enforcement of noise in our
neighborhood, and others now that frats have spread to other neighborhoods, is abysmal and has not changed
since 2021. The police chief told me to stop taking video of the parties, and told me that I should have the police
come to my house to make sure I can actually hear the noise so that my calls to SLOPD "are equitable." I believe
I forwarded his email to you with those statements when it was sent to me.
We can hear booming bass from blocks away and are mostly affected by the hordes of screaming sorority girls
that pass by our house, going from an illegal fraternity house to an illegal fraternity house. We can also hear
parties at the many illegal fraternity houses that surround us. Additionally, I have had meetings with the city
since 2023 and provided documentation of each illegal fraternity house, but nothing has been done to shut
down a single one. We are beyond frustrated at the situation!!!
This is NOT NORMAL, which is the reason that media outlets and filmmakers have reached out to us!

task force for St. Fratty's that has been formed to come up with ideas to present to the city and protect our
properties. Her tenants were terrorized during St. Fratty's Day 2024. After the last SCLC meeting, spoke
with Chief Scott, which I observed, and there was another witness to the conversation. He told her that it was
not the police's job to protect her property, and if something bad happened, she would bear the liability. He also
told her that St. Fratty's will not end until someone dies or there is extreme property damage.
called me after the meeting and I tried to console her and encouraged her that the city manager is going to
insist that St. Fratty's ends. Whitney McDonald said it was her number one goal at the first SCLC meeting of the
academic year. Ms. McDonald suggested that our St. Fratty's task force meet with RQN on 12/11/2024, when
SLOPD was presenting its plan for St. Fratty's this year, and held out hope that she would have some
reassurance during that meeting. Unfortunately, SLOPD's plans were not reassuring and began
interviewing Realtors and then put her house on the market a couple of weeks ago.
The reporter from the Daily Mail emailed me today and said that she hadn't had time to reach out to
but the story was published today, and she sent me a link. I was disappointed to see the story was
sensationalized and some of my statements were not accurate. The reporter must not have recorded the
conversation, as the Tribune reporter did. For example, she said "dayges" go on for four days straight, which is
not true. They are usually for several hours on Saturday or Sunday. However, I did say that parties start on
Thursday night and go through Sunday afternoon, which is close to four days straight. She said my husband was
in the Army at Sandhurst (Royal Military Academy) and Zimbabwe. He was not in the military in Zimbabwe and
fled the country with only a suitcase because it was unsafe as farms were being seized by the government. One
of his family members was murdered. He did go to the UK and attended Sandhurst. So some of the statements
are skewed. But the core of the problem surrounding the illegal frats and the retaliation since Sigma Pi received
a noise violation is true, and I feel that's what is important.
I will try to ensure that other State and National news stories accurately print my statements if we choose to
move forward with more publicity.
Hopefully, the city is committed to providing funding for combating this serious problem in the 2025 - 2027
budget cycle and this nightmare will end.

Regarding the fraternity enforcement last weekend, Timmi asked her staff to come out during the weekend to
investigate the information and reports that was sending in regarding rush events in order to help us confirm
the houses that may be operating as fraternity houses in improper areas. This will help Timmi’s team build the
enforcement cases they need to get a better handle on the situation. In order to do this work, we paid some overtime
to code enforcement staff and Timmi herself joined the efforts in the field. Typically, we would rely on PD to respond to
noise complaints over the weekend, and then try to use citation information to determine whether a zoning code issue
(i.e. a fraternity operating in a single family zoned neighborhood) might also be present; but a noise complaint does
not always yield what we need to confirm an unpermitted fraternity house. Using code enforcement staff on overtime
in this special situation was more effective because we knew it was rush weekend and we had a lot of information
about planned events, largely from lists. Hope that helps a bit.

I have a number of updates to share with you all at the conclusion of this busy week:
Weekend Fraternity/Sorority Rush Event Enforcement – Attached are two emails regarding our Community
Development team’s efforts to conduct enforcement work over the weekend related to fraternity and sorority
rush events. We confirmed a total of 13 illegal events and are in the process of issuing notices of violations or
citations to those locations. One of the emails I’ve attached is an exchange with Kathie Walker regarding one
location that was mistakenly entered into our system as “unable to verify.” That location is included in the 13
total that will be cited/noticed.
City Salary Request – The Tribune requested information regarding City employee salaries as part of a story
they are writing regarding County employee salaries. Nickole Domini will be interfacing with them on this effort.
County Superintendent of Schools update – Attached is an email from Dr. Brescia with information on a few
items that may be of interest, including links to information regarding immigration enforcement.
Uplift Grants – We received word that none of the grant applications that we submitted or were partner to have
been awarded funds from the Uplift Grant. We have not heard which applications are being funded. The City’s
applications included:
o Conference Center site plan
o DEI business grants
o Childcare business grants
o Collaborative project with Cal Poly, the County, the City, and San Luis Coastal on a joint child care
facility (application submitted by Cal Poly)
Major City Goal Update – Staff are working to update a comprehensive table showing the status of our current
Major City Goals and work plan items ahead of the February 8th goal setting meeting. We are also working to
include, to the extent possible, information about whether the items have been operationalized.
Righetti Park – Greg Avakian will send out an email to you all early next week with an update on the status of
this park project, including projected timelines.
St. Fratty’s Day – Cal Poly has activated their Emergency Operations Center (EOC) in preparation for this
event and has invited representatives of the City, including PD and Fire, to join their weekly meetings. We will
attend as many as possible. For the City, we have activated a Department Operations Center (DOC) at the
Police Department, with the Police Chief acting as Incident Commander, for the event. Our DOC meets weekly
in preparation for the event, as has been the practice for the past few years. We do not plan to activate a full
EOC, unless information we receive leading up to or during the event changes.
5th Fire Station – We have received confirmation from the Avila Ranch developer that they do not anticipate
reaching the trigger point for the 5th fire station (the 361st unit) until Spring 2028, more than one year later than

anticipated when we put the budget forecast together. This will push out the need for additional staffing until
the next financial plan. We are working on an email to you all to provide more information about this change
and how it will impact our financial plan.

audience to commemorate the amazing experience of talking with hundreds of community members on a Thursday
night about budget priorities. It was magical!

approach to the recent SLO editorial re “fraternities causing hell in communities” I was going to submit a
letter back to the Tribune but wanted a Dept Head opinion first. I am a CP graduate and a retired 30 year
employee of Marin Probation, the last 11 as Chief. Currently reside in Templeton
Viewpoint
The recent Editorial regarding Illegal Cal Poly frat housing
creating hell for neighbors caught my attention. I agree with the
Editor’s point that Cal Poly is failing to uphold their end to this
dangerous community issue.
The main point that stuck out for me was policy decisions versus
legislative mandates. As pointed out in the article, Sacramento,
Fresno and Chico State Universities supply the addresses of
these off-campus functions. I sincerely doubt that the legal
counsel for these universities would outwardly defy law and
subject the university to unnecessary litigation. It’s a policy
decision by Cal Poly and they are making the wrong choice. They
are not being team players for our community.
I shouldn’t have to remind Cal Poly that the behaviors of these
young partygoers directly affect children that must go to school
the next day and the parents needing to work. There is an old
saying that nothing good happens after 2 a.m. and this is when
sexual assaults occur, DUI’s (sometimes resulting in death or
great bodily injury), vandalism and all the other problems that
occur with public drunkenness.
Most city managers don’t have an extra $300K plus laying around
in ongoing funds to pay for two more code enforcement officers.
Asking Cal Poly to pony up is laughable.
The District Attorney, Chief of Police, City Manager, School
Superintendent and the public should demand that Cal Poly
supply the addresses of these off-campus functions. It’s a policy
decision. It needs to be reversed.
Here is a potential solution. Most law enforcement agencies give
their staff iPhones. If addresses were given in advance by Cal
Poly, local police and others could see and prepare to take a
proactive approach i.e. neighbors communicating, step up police
patrols.
This solution doesn’t cost us anything. Police investigators and
patrol officers use computers and iPhones all the time to track
and solve all kinds of other crimes and serious issues. This
community issue is worthy of their attention. I would think by
working smarter and getting ahead of a situation is better than
patrol getting called into a chaotic scene. This would be a good
start.
Cal Poly, come to the table and talk. Be a team player. Be a
concerned community member on behalf of families and victims
of crime.

Thank you for sharing! I have taken several road trips recently traveling to both UCSB and Chico State to name a few.
I have observed very closely the relationship between those schools, their leadership, and local law enforcement.
There are some fundamental issues that need to be overcome here locally with how we are or are not sharing

director’s review having passed, my supervisor Steven Sheats said it would be welcomed of you to submit it.
That said, the notice of violation was issued upon observing a rush event during rush week, on rush weekend. I
observed that the letters representing (ΣК= Sigma Kapa) were on the windowsill from the public right of way. I have
attached a pdf file containing the photo I took from the street while in my vehicle, of that specific instance, for
clarification purposes. The notice of violation is a courtesy warning prior to issuance of administrative citation(s),
should another unsanctioned event take place in that location. In which case, I also attached a copy of “Administrative
Citation Appeal Form” in the case an administrative citation is issued, should another unsanctioned event take place at
that location. Please feel free to look at it and get back to me, if you have any questions. I would be happy to answer
them for you.
The city’s goal is eliminating any fraternity/sorority activities (unsanctioned events presenting a fraternity or a sorority
paired up with public identifiers such as letters viewable from the public right of way) in non-permitted houses (satellite
houses) as designated per the residential zone where they are located. In the case of 395 Grand, I observed an
unsanctioned rush event at that location during rush week on rush weekend paired up with (ΣК= Sigma Kapa) letters
identifiable from the public right of way while displayed in the window. Thus, a notice of violation is issued to the
property owner, and a copy is sent to the tenants as well.

I am in receipt of a letter concerning my property at 395 Grand. Your original letter was addressed to my
daughter and used my home mailing address. Because she is not listed as a resident here my postal office was
not sure what to do with it and it apparently bounced around Atascadero for awhile.
In any case, I am completely confused by your accusation that this is a sorority house, as are my tenants whom
were quite disturbed when you started questioning them. The girls that reside in this home HAVE been in the
following sororities: Sigma Kappa, Alpha Chi Omega, Kappa Kappa Sigma, Delta Gamma & Sigma Kappa. The
ONLY gal living there that is even currently active in a sorority is the gal that lives in the front bedroom. She is in
Sigma Kappa. These gals work hard to gain admittance to their sororities. If they are able to get elected to a
prominent position such as head of finance etc, it can be very good experience for them and look great on their
resumes. They are proud of their achievement.
There has never been a sorority meeting or gathering held at this address.
I downloaded the code section SLO MC 17.10.020 you cited and it has nothing to do with my home.
I am attaching photos showing the Greek letters that apparently so offended you. They were small & inside her
bedroom window. They're almost impossible to see unless you're standing on our front porch. Because the gals
were disturbed by your questioning of them, they mentioned the incident to one of their dads who happens to be
an attorney and has now questioned if you making her remove them is not a violation of her First Amendment
Rights as freedom of expression.
To reiterate, your 2 Corrective Actions do not seem appropriate since there has never been a fraternal gathering
or meeting at this property, so there would be no need to stop them, and there are no fraternal identifying
markers ON the property. On the property would imply on the outside, not inside a girls bedroom window.
I would like you to consult your legal department and then respond to this letter so that I can circle back around
with their dad/attorney. For now, she has removed the letters from her window. We are hopeful she can put
them back up once this is cleared up. Also, if you choose to interrogate my residents again, please schedule it
through me so that I can be there.

San Luis Obispo Municipal Code Section 1.24.100(B)(2)(c).
All citations that include a violation of Title 15 of the San Luis Obispo Municipal Code (building and related
codes), even if other non-Title 15 code violations are also cited, must be appealed to the Construction Board of
Appeals. San Luis Obispo Municipal Code Section 1.24.100(B)(1).
For citations that do not include a violation of Title 15, you must make a choice between:
• Administrative Review Board: If you wish to retain your right to challenge the administrative
citation, or any final city action related to the citation, in court by any writ action, you must appeal
to the Administrative Review Board for a more formal, comprehensive hearing to ensure
preparation of an adequate administrative record. Should you wish to then challenge that board’s
decision in court, you will need to file a petition for writ with the Superior Court, which may require
the services of an attorney to prepare, and will require payment of the City’s costs to prepare the
administrative record. San Luis Obispo Municipal Code Section 1.24.100(B)(2)(b).
• Hearing Officer: An expedited, less formal appeal process to a city hearing officer, whose final
decision may be appealed directly to the superior court for de novo review pursuant to California
Government Code Section 53069.4. San Luis Obispo Municipal Code Section 1.24.100(B)(2)(a).
For citations that do not include a violation of Title 15, failure to request a hearing before the Administrative
Review Board within the time for the filing of an appeal will result in the appeal being assigned to a Hearing
Officer and will constitute a failure to exhaust administrative remedies for purposes of any subsequently filed
writ action. San Luis Obispo Municipal Code Section 1.24.100(C)(4).

7. Appeal Fee. Every path of appeal requires payment of a fee due at the time your appeal is submitted. Once
your appeal is determined to be complete, timely and valid, the fee is non-refundable as it is recovery of a
percentage of the cost to bring your appeal to hearing, regardless of the outcome. Fees are adopted by City

8. Hearing Procedure: It is your right under San Luis Obispo Municipal Code Section 1.24, no matter which
appeal process is chosen, to have an in-person hearing. However, you are under no obligation to appear. If
you choose, you may elect to have your appeal reviewed on the record (all documents, pictures, etc.
submitted by yourself or the City).San Luis Obispo Municipal Code 1.24.110(F).
9. Official Mailing Address: The Municipal Code requires certain notices be sent via U.S. Mail and so, while
courtesy notifications may be sent via email or to other addresses, you are required to provide one official
mailing address for your appeal. San Luis Obispo Municipal Code 1.24.100(C)(5).
10. Signature: The step most commonly missed in the appeal process (and the most common reason for rejection
of a timely appeal) is failure to sign the appeal and declare the facts stated in the appeal to be true. The form
provides a signature block for this purpose but if there are multiple appellants, all must sign a declaration. Any
additional declarations can be attached as additional pages. San Luis Obispo Municipal Code 1.24.100(C)(5).

levels were high. We don’t make a practice of looking for personal effects, such as the Greek letters displayed in your
tenant’s window, on a regular basis. Rather, we look at what is happening at the property as a whole. In this instance,
this is just something that caught Rami’s eye on this day of extra alertness. This is not something that will be
considered a continued violation.

Thank you for having the case closed. I am a bit concerned that if we had not had a Ring doorbell on the house
we would not have had the evidence needed to prove Mr. Salem invented a party at a house that was empty at
the time. I talked with Ella's parents because I wanted to be certain my girls were telling me the truth (prior to
seeing the ring footage). They arrived early on that Friday and picked Ella up. They went to lunch and then hiking
at Montana de Oro for hours and then Ella ran home to quickly shower so her dad could pick her up to go to
dinner.
Other than the small greek letters inside her bedroom window there are no markings, signs or anything on
that home. And it is clear from my original photo (showing the front circular garden and palm tree) that from
the street there is no way to see those letters without a telephoto lens.
Her Sorority is asking if it is a violation for a member to have even small letters inside their bedroom
window. Can you clarify this?

What is interesting about the timeline is that when I leave around 4:30, there's only a few minutes before Mr.
Salem says there's a party going on. The house was silent when I left and I've seen the house when the girls
decorate it for a birthday. There were no decorations anywhere. But I understand it is hard when you have 2

Noone has any idea who the guy walking down the sidewalk is. He's just a random college student walking
down Grand Ave. on a Friday afternoon. How that indicates a party I have no idea. Especially when the
Ring shows no one home.
I have attached the Ring photos showing the timeline on Jan 18. But I will do one better.
Steven, over the past 8 years you and I have had occasion to discuss things concerning my homes. As you
know, I rent to mostly sorority gals. But all my homes have a mix since by their 3rd or 4th year, most the
gals go inactive due to time constraints with jobs etc...Never once in all those years has anyone ever
accused any of my homes of holding an unsanctioned event. Because we are so confounded by why he
would fabricate an event at an empty house we are willing to come in and log into the Ring system to show
you all activity at the front of 395 Grand on the afternoon of Jan 18th. In the meantime, the girls are
keeping an eye open for the guy walking by since he might live in the area. We are hoping to get a letter
from him that he was simply walking to a friends' house when someone took his picture on our front
sidewalk.
I took a picture from my car to show how small Ella's bedroom window is from the street. My picture is
not taken with a telephoto lense. It is our hope that after you review all this evidence, that you rescind the
notice of violation.

Our neighborhood continues to suffer from noisy fraternity parties at illegal fraternity houses.
I've included some history below and information related to a large, noisy fraternity party at
Kappa Sigma's Main Chapter House at 281 Hathway Avenue last night, April 6, 2025. The
residents of our neighborhood need meaningful progress toward solving the ongoing problem
of illegal fraternity houses in our neighborhood by taking steps to hold the fraternities
responsible for their illegal actions. Let me know what information I need to complete a
complaint and forward it to Christine Dietrick for prosecution of SLOMC 17.02.030 and
17.16.010, and/or other applicable municipal codes.
History
In the fall of 2021, I began documenting the noisy parties at illegal fraternity houses in our
neighborhood and sending videos to the City, including SLOPD, because most of the time, the
parties were cleared as negative violations or unable to locate, and not cited. I also
corresponded with other neighbors in our Alta Vista neighborhood who had also noticed an
uptick in noise and fraternities moving in near their homes. Long-term residents moved away
to get relief from the unbearable living conditions.
On June 2, 2022, The New Times covered the problem, featuring one neighbor who moved
away shortly after the article was published. The problem was relatively new and has since
been linked to the exponential growth of illegal and unregulated fraternity houses in our
neighborhoods.
In the fall of 2022, Sigma Pi moved in next door to us, and Theta Chi moved in across the
street from us. Other fraternities were also operating near our home. It was absolute hell. This
is when I began being targeted by fraternity members, which continues to this date, including
yesterday afternoon when Steve and I returned from an errand, and someone yelled
something at me while I was getting out of our car.
In the spring of 2023, I communicated with Community Development and realized that
fraternities are not legally allowed to operate in R-1 and R-2 neighborhoods. I spoke with
Derek Johnson about the problem, and he encouraged me to document everything and work
with Community Development. It took several months for me to compile all the information in
a report, which was based on the fraternity's social media pages that advertised their events,
and information obtained from public records requests. The report was ready in September
2023, at the beginning of the 2023-2024 academic year.
On October 1, 2023, Cal Poly published its AB 524 Report, which listed the addresses of each
fraternity's events. These addresses coincided with the addresses listed in my report.
On November 8, 2023, I met with Timmi Tway and John Mezzapesa and provided the report,
with substantial documentation of the illegal fraternity houses in our neighborhoods. It was
not until the spring of 2024 that the City began sending out "courtesy" notices of illegal
fraternity operations to property owners.

Here we are one year since the City sent out notices, the 2024-2025 academic year is nearly
over, and the illegal fraternity houses, including ALL of the Main Chapter Houses for 13
fraternities, and most of the satellite fraternity houses for 19 fraternities, continue to operate
illegally in our neighborhoods. Nothing has changed. It is infuriating.
Kappa Sigma at 281 Hathway Avenue
On Saturday, April 5, 2025, Kappa Sigma held a large party at its Main Chapter House at
281 Hathway Avenue in a single-family residential R-1 zone, which violates the City's
municipal code 17.02.030 and 17.16.010. The fraternity had a party tent in its backyard with
colored disco-type lights and loud music. The backyard was full of people, and at least 30
females were lined up from the gate/tarp to the backyard, down the driveway to the sidewalk.
I could hear the party from our house and had to go down to the location to find the address.
It was Kappa Sigma at 281 Hathway Avenue, and I called SLOPD to report the party at around
10:25 p.m.
This address has been flagged in SLOPD's system as an illegal fraternity house and is not
allowed to register parties through SLOPD's Party Registration Program, however, instead of a
CSO or SLOPD officer, SNAP was dispatched to the fraternity party. I ask ed SLOPD to have the
officer call me, and SNAP Officer Ortiz called after she'd responded to the party.
The reason I wanted to speak with the SLOPD officer is that I wanted them to document their
observations and details of the fraternity party, the number of people (mostly females) lined
up to get into the party, the tarp installed across property to obscure anyone from seeing into
the backyard, and to note the fraternity members who claimed responsibility. Previously, the
City has prosecuted a fraternity for illegal fraternity operations based on a complaint filed with
SLOPD. I recently sent the previous case to Christine Dietrick, and she said prosecuting one-
off cases isn't off the table, but she was hoping to pursue a more sweeping solution with Cal
Poly. I haven't seen any progress since that correspondence.
In this case, the fraternity would be prosecuted for a violation of SLOMC 17.02.030 and
17.16.010. The previous case was illegal operations in an R-4 zone without a CUP, but this is
an R-1 zone; therefore is more egregious. SNAP Ofc. Ortiz did not know how to handle the
type of complaint I was asking for. She said she did not observe Greek letters or a table to
sign people in, but said "everything was in the backyard," and it was blocked from her view.
She said the guys were concerned about whether the DAC would be reported to Cal Poly,
presumably because Kappa Sigma is on probation until the end of the school year.
I have been extremely patient in working with the City to solve the illegal fraternity house
problem in our neighborhood. The situation is not normal! There have been news articles
published about it, Editorials by The Tribune Editorial Board, and various people have reached
out to Steve and me for further exposure, including a documentary for A24/HBO. No one
should have to live like this, and the City should not allow the situation to continue. It's time
to hold the illegal fraternity operations criminally responsible for their continued operations
because they know it is illegal, yet they don't care, and they continue to hold fraternity-related
events knowing they are violating the law. They don't respect the law, their neighbors, or their
neighborhood.
There is a lot of documentation showing that 281 Hathway Avenue is the Main Chapter House
for Kappa Sigma. The fraternity has held ongoing disruptive parties during the day and at
night at this location. I have attached some photos of some day parties, or dayges, at 281
Hathway Avenue, below. You can see how they pull a tarp across the two homes to obscure

the party in the top right (blue tarp) and lower right (black tarp). The fraternity emblem/seal
is mounted to the house and visible in the upper left photo, and is currently still on the house.
Kappa Sigma listed 281 Hathway in its Cal Poly's AB 524 Report as the address where most
events were held. Nine events are listed at 281 Hathway, and two are listed at 322 Hathway,
across the street.

In a recent article in The Tribune, Kappa Sigma acknowledged it has two fraternity locations
on Hathway Avenue. The locations are 281 and 322 Hathway. The fraternity has posted
various photos of its fraternity house at 281 Hathway Avenue on Instagram, including photos
of rush events as they were happening. The fraternity's Greek letters mounted to the
backyard fence, and the fraternity seal mounted to the house. My husband is a commercial
drone pilot and recently received a clearance from the FAA to fly his drone in restricted
airspace in our neighborhood on March 15, 2025. He was focused on the street, but the
footage shows Greek letters and the unmistakable fraternity seal in the backyard and on the
house at 281 Hathway Avenue.
John Mezzapesa and Rami Salem told me that the Kappa Sigma fraternity members at 281
Hathway Avenue refused to open the door when Code Enforcement responded to an illegal
rush event happening in the backyard in January 2025.
Coordination Between Code Enforcement and SLOPD
During a Planning Commission hearing over a year ago, the Commissioners told Community
Development staff that Community Development and SLOPD needed to get on the same page
as soon as possible and share a database so that SLOPD knows the locations of every
fraternity house, including those operating illegally. Using that database, SLOPD can enforce
standards consistent with the City's rules for fraternities, such as not being allowed to register
parties through SLOPD's Party Registration not being allowed to wipe their citation history
clean clean through SLOPD's Early Removal Program, and not being eligible for a Disturbance
Advisement Card (DAC). This was meant to be the first step in holding the illegal fraternity
operations responsible for their negative impact on our neighborhoods. The next step was for
the City to cite and stop their operations completely. It does not appear that step one has
even happened yet.
The vast majority of Cal Poly's fraternity houses in San Luis Obispo do not have conditional
use permits. Many of these illegal fraternities have openly operated as fraternity houses for
years, and the City, including SLOPD, has known they are fraternity houses. Some SLOPD
employees refer to these fraternity operations as "satellite houses," even though many are the
Main Chapter House for Cal Poly's many fraternities. They are not "satellite" houses. Most are
located illegally in R-1 and R-2 neighborhoods.
Thirteen of Cal Poly's fraternities' Main Chapter Houses are in R-1 and R-2 neighborhoods in
San Luis Obispo. Most of Cal Poly's 19 fraternities also have multiple satellite fraternity
houses, according to the City's definition of "a fraternity" because they are occupied by
fraternity members and hold fraternity-related events.
Over a year ago, SLOPD was provided with a list of Cal Poly's fraternities based on Cal Poly's
AB 524 Report. The list was used to flag those properties and not allow them to register
parties. However, it appears those addresses - known, documented fraternity houses - are still
being allowed to wipe their noise citation history clean through SLOPD's Early Removal
Program. The documented illegal fraternity operations should not be allowed to wipe their
citation history clean.
Also, SNAP officers are continuing to be sent to those known, documented fraternity houses to
respond to fraternity parties and issue DACs. SNAP does not respond to permitted fraternities
because fraternities are not eligible for a DAC; therefore, if a noise violation occurs, they
receive a citation. SNAP should not be dispatched to fraternity houses. I want to emphasize
that multiple SNAP officers have said they don't want to respond to fraternity parties, and

this information has been passed along to SLOPD leadership, yet SNAP is still responding to
noise complaints at documented fraternity houses.
We're now in "dayge" season, where fraternities will host huge raging daytime parties in their
backyards with DJs, inflatable waterslides, and hundreds of people. I'm hopeful that the City
will do something to stop the continued disruption from these crazy parties in our

understandably caused.
To address your questions directly:
Code Enforcement & SLOPD Communication:
There have been previous discussions regarding the locations Code Enforcement has identified as operating as
unpermitted fraternities, however this is a running list that only includes those that have operated within the last
12 months. Just to be sure, I have sent an updated list to PD today to verify they have the most accurate
information. SLOPD has also set up automatic updates for issued DACs & citations as discussed in response to
question #4.
Flagging of Addresses in SLOPD System:
This will have to be verified by Police Department staff. I have contacted Chritine Wallace in SLOPD regarding
which addresses are currently flagged. It appears that she is out of the office until next week so I am sure she
will respond when she returns.
SNAP Officer Deployment:
This also requires a response from SLOPD. I will let their staff provide a response.
Progress Toward Eliminating Illegal Fraternity Operations:
Code enforcement continues to respond to any reported issues regarding unpermitted fraternities/sororities. We
have also set up automatic weekly updates from PD providing a list of issued DACs and citations for the previous
week. Any citations for violation of the noise ordinance issued to known permitted or unpermitted locations are
investigated to attempt to determine if the noise violation was in connection to a sponsored fraternity/sorority
event. If the evidence supports that a sponsored event was held, we move forward with a Notice of Violation
(NOV) citing land use violations or, if an NOV was issued within the last 12 months, an administrative citation.
We also completed a focused effort to inspect all reported locations during RUSH weekend in Januar y by having
staff patrol outside of their normal working hours to document any potential violations.
I have also developed an internal database that organizes the enforcement efforts of the Code Enforcement
team and the noise citations issued by PD which has allowed us to reference past enforcement activities by both
PD and CDD by location or organization and determine how to best move forward with additional enforcement.
I recently completed this database and will be training pertinent staff on how to utilize it the near future. As a
quick summary, in the last six months Code enforcement staff has followed up on 62 investigation requests
regarding unpermitted fraternity locations, issued 20 NOVs as a result of confirmed land use violations or use
permit violations, issued 6 administrative citations for repeat violations within the last twelve months and
recommended three use permits for review before the planning commission for violations of their use permit
conditions.
In addition to the above enforcement efforts, we have participated in over 6 meetings with CalPoly staff and
fraternity leadership as well as provided a presentation to Greek life leadership during their Greek Life Institute.
I have also begun conversation with the Office of Student Rights and Responsibilities and am in the early phases
of creating a process to forward any verified violations to their office to investigate potential code of conduct
violations.

Filing a Complaint Regarding 281 Hathway:
I have already submitted an investigation request on your behalf to begin investigation into a possible
unpermitted fraternity at 281 Hathway. This location has been able to stay under our radar in the past. There just
hasn’t been enough direct evidence proving that events are connected to the fraternity (i.e.: available social
media posts, displayed letters, verbal statements, firsthand observation etc.). The request has been assigned to
Rami Salem who has worked to build a rapport with the fraternities during enforcement efforts. You should be
updated via AskSLO notifications after the investigation is complete. Feel free to reach out to myself or Rami

Our neighborhood continues to suffer from noisy fraternity parties at illegal fraternity houses.
I've included some history below and information related to a large, noisy fraternity party at
Kappa Sigma's Main Chapter House at 281 Hathway Avenue last night, April 6, 2025. The
residents of our neighborhood need meaningful progress toward solving the ongoing problem
of illegal fraternity houses in our neighborhood by taking steps to hold the fraternities
responsible for their illegal actions. Let me know what information I need to complete a
complaint and forward it to Christine Dietrick for prosecution of SLOMC 17.02.030 and
17.16.010, and/or other applicable municipal codes.
History
In the fall of 2021, I began documenting the noisy parties at illegal fraternity houses in our
neighborhood and sending videos to the City, including SLOPD, because most of the time, the

parties were cleared as negative violations or unable to locate, and not cited. I also
corresponded with other neighbors in our Alta Vista neighborhood who had also noticed an
uptick in noise and fraternities moving in near their homes. Long-term residents moved away
to get relief from the unbearable living conditions.
On June 2, 2022, The New Times covered the problem, featuring one neighbor who moved
away shortly after the article was published. The problem was relatively new and has since
been linked to the exponential growth of illegal and unregulated fraternity houses in our
neighborhoods.
In the fall of 2022, Sigma Pi moved in next door to us, and Theta Chi moved in across the
street from us. Other fraternities were also operating near our home. It was absolute hell. This
is when I began being targeted by fraternity members, which continues to this date, including
yesterday afternoon when Steve and I returned from an errand, and someone yelled
something at me while I was getting out of our car.
In the spring of 2023, I communicated with Community Development and realized that
fraternities are not legally allowed to operate in R-1 and R-2 neighborhoods. I spoke with
Derek Johnson about the problem, and he encouraged me to document everything and work
with Community Development. It took several months for me to compile all the information in
a report, which was based on the fraternity's social media pages that advertised their events,
and information obtained from public records requests. The report was ready in September
2023, at the beginning of the 2023-2024 academic year.
On October 1, 2023, Cal Poly published its AB 524 Report, which listed the addresses of each
fraternity's events. These addresses coincided with the addresses listed in my report.
On November 8, 2023, I met with Timmi Tway and John Mezzapesa and provided the report,
with substantial documentation of the illegal fraternity houses in our neighborhoods. It was
not until the spring of 2024 that the City began sending out "courtesy" notices of illegal
fraternity operations to property owners.
Here we are one year since the City sent out notices, the 2024-2025 academic year is nearly
over, and the illegal fraternity houses, including ALL of the Main Chapter Houses for 13
fraternities, and most of the satellite fraternity houses for 19 fraternities, continue to operate
illegally in our neighborhoods. Nothing has changed. It is infuriating.
Kappa Sigma at 281 Hathway Avenue
On Saturday, April 5, 2025, Kappa Sigma held a large party at its Main Chapter House at
281 Hathway Avenue in a single-family residential R-1 zone, which violates the City's
municipal code 17.02.030 and 17.16.010. The fraternity had a party tent in its backyard with
colored disco-type lights and loud music. The backyard was full of people, and at least 30
females were lined up from the gate/tarp to the backyard, down the driveway to the sidewalk.
I could hear the party from our house and had to go down to the location to find the address.
It was Kappa Sigma at 281 Hathway Avenue, and I called SLOPD to report the party at around
10:25 p.m.
This address has been flagged in SLOPD's system as an illegal fraternity house and is not
allowed to register parties through SLOPD's Party Registration Program, however, instead of a
CSO or SLOPD officer, SNAP was dispatched to the fraternity party. I ask ed SLOPD to have the
officer call me, and SNAP Officer Ortiz called after she'd responded to the party.

The reason I wanted to speak with the SLOPD officer is that I wanted them to document their
observations and details of the fraternity party, the number of people (mostly females) lined
up to get into the party, the tarp installed across property to obscure anyone from seeing into
the backyard, and to note the fraternity members who claimed responsibility. Previously, the
City has prosecuted a fraternity for illegal fraternity operations based on a complaint filed with
SLOPD. I recently sent the previous case to Christine Dietrick, and she said prosecuting one-
off cases isn't off the table, but she was hoping to pursue a more sweeping solution with Cal
Poly. I haven't seen any progress since that correspondence.
In this case, the fraternity would be prosecuted for a violation of SLOMC 17.02.030 and
17.16.010. The previous case was illegal operations in an R-4 zone without a CUP, but this is
an R-1 zone; therefore is more egregious. SNAP Ofc. Ortiz did not know how to handle the
type of complaint I was asking for. She said she did not observe Greek letters or a table to
sign people in, but said "everything was in the backyard," and it was blocked from her view.
She said the guys were concerned about whether the DAC would be reported to Cal Poly,
presumably because Kappa Sigma is on probation until the end of the school year.
I have been extremely patient in working with the City to solve the illegal fraternity house
problem in our neighborhood. The situation is not normal! There have been news articles
published about it, Editorials by The Tribune Editorial Board, and various people have reached
out to Steve and me for further exposure, including a documentary for A24/HBO. No one
should have to live like this, and the City should not allow the situation to continue. It's time
to hold the illegal fraternity operations criminally responsible for their continued operations
because they know it is illegal, yet they don't care, and they continue to hold fraternity-related
events knowing they are violating the law. They don't respect the law, their neighbors, or their
neighborhood.
There is a lot of documentation showing that 281 Hathway Avenue is the Main Chapter House
for Kappa Sigma. The fraternity has held ongoing disruptive parties during the day and at
night at this location. I have attached some photos of some day parties, or dayges, at 281
Hathway Avenue, below. You can see how they pull a tarp across the two homes to obscure
the party in the top right (blue tarp) and lower right (black tarp). The fraternity emblem/seal
is mounted to the house and visible in the upper left photo, and is currently still on the house.

Kappa Sigma listed 281 Hathway in its Cal Poly's AB 524 Report as the address where most
events were held. Nine events are listed at 281 Hathway, and two are listed at 322 Hathway,
across the street.
In a recent article in The Tribune, Kappa Sigma acknowledged it has two fraternity locations
on Hathway Avenue. The locations are 281 and 322 Hathway. The fraternity has posted
various photos of its fraternity house at 281 Hathway Avenue on Instagram, including photos

of rush events as they were happening. The fraternity's Greek letters mounted to the
backyard fence, and the fraternity seal mounted to the house. My husband is a commercial
drone pilot and recently received a clearance from the FAA to fly his drone in restricted
airspace in our neighborhood on March 15, 2025. He was focused on the street, but the
footage shows Greek letters and the unmistakable fraternity seal in the backyard and on the
house at 281 Hathway Avenue.
John Mezzapesa and Rami Salem told me that the Kappa Sigma fraternity members at 281
Hathway Avenue refused to open the door when Code Enforcement responded to an illegal
rush event happening in the backyard in January 2025.
Coordination Between Code Enforcement and SLOPD
During a Planning Commission hearing over a year ago, the Commissioners told Community
Development staff that Community Development and SLOPD needed to get on the same page
as soon as possible and share a database so that SLOPD knows the locations of every
fraternity house, including those operating illegally. Using that database, SLOPD can enforce
standards consistent with the City's rules for fraternities, such as not being allowed to register
parties through SLOPD's Party Registration not being allowed to wipe their citation history
clean clean through SLOPD's Early Removal Program, and not being eligible for a Disturbance
Advisement Card (DAC). This was meant to be the first step in holding the illegal fraternity
operations responsible for their negative impact on our neighborhoods. The next step was for
the City to cite and stop their operations completely. It does not appear that step one has
even happened yet.
The vast majority of Cal Poly's fraternity houses in San Luis Obispo do not have conditional
use permits. Many of these illegal fraternities have openly operated as fraternity houses for
years, and the City, including SLOPD, has known they are fraternity houses. Some SLOPD
employees refer to these fraternity operations as "satellite houses," even though many are the
Main Chapter House for Cal Poly's many fraternities. They are not "satellite" houses. Most are
located illegally in R-1 and R-2 neighborhoods.
Thirteen of Cal Poly's fraternities' Main Chapter Houses are in R-1 and R-2 neighborhoods in
San Luis Obispo. Most of Cal Poly's 19 fraternities also have multiple satellite fraternity

Thanks for passing along and for your insight. As much as we would like to take credit for Kathie’s praise for a quiet
weekend, the department did not do anything different other than respond to calls of complaints and proactive
enforcement. I am not aware of anything specifically happening with the Fraternities; however, they have been very
engaged at SCLC and appear to be committed to coexisting, so I am hopeful that is translating into better behavior.
We are currently on pace to again break our previous record for quietest year in 10 years and continuous decline in
noise every year. This September was the quietest year on record. The sats are showing improvement, hopefully that
is what the community is also experiencing.

I find this fascinating, as, I went running at Cal Poly Sunday morning and there was an EXTREMELY LOUD party on
Slack Street at (I’m told) 6am. I was there until around 10 and it was still going on at some level, although much
quieter by that point. Not a lot of cars/traffic, but plenty of very loud music that could be heard from the track. Yet, it
sounds like this escaped the part of the neighborhood that gets the most “traffic” where Kathie must live.
Anyway, just thought I’d share that…

Hello Councilmembers,
Something is happening and I'm not sure what it is. There were two calls at fraternities on Wednesday (which is
unusual because usually parties are Thursday - Sunday). And this past weekend was quiet, which is amazing.
There was one fraternity party on Hathway. It was cited with 60 people. And someone reported a party at a
fraternity on Bond on Sunday afternoon. There were no parades of people walking through our neighborhood
screaming. We got some quality sleep and it almost felt like we were on vacation.
The SLOPD log shows some noise calls in the lower Monterey Heights neighborhood that could possibly be
related to fraternities and I've noted those on the report, attached.
This is the first weekend since the fall of 2021 that we have not had noisy parties surrounding us all weekend
and college students screaming as they pass by late at night (except when Cal Poly is not in session during
summer and winter breaks, which we live for.) Something must be happening related to Cal
Poly's fraternity operations because the difference between this weekend and others during the academic year
was stark. Are you aware of anything that you can share?

Hi Council Member Shoresman,
Thank you for sending, I did respond to Kathie regarding her concerns. She appears to just be asking questions from
the public police log in reference to calls she is seeing and not incidents she personally reported. The PD had an
extensive response over Halloween to the north end to handle any complaints as well as aggressive proactive
enforcement.
Officers responded to 299 Albert as it was reported there were several vehicles parked/stopped in the street, those
people were contacted, warned, and moved along without issue. There were no complaints regarding any party
activities on this property other than vehicles in the narrow roadway and the issue was quickly resolved. Officers
responded to a party call at 281 Albert and the party was broken up and they were written a citation.
I wanted to ensure you had the information needed for your questions. If you do follow back up with Kathie, please
refer Kathie back to the police department so we can route her through the proper channels for obtaining public call
information or officer complaints.

It was a noisy weekend and I will send a report after the election. But I wanted to sum up the problem in this email.
Problem 1
SLO Code Enforcement has met with Cal Poly Greek life administration and advised that fraternity operations are illegal in lower-
density neighborhoods, including those near the campus.
Despite knowing that fraternity-related events are not permitted in lower-density neighborhoods, Cal Poly administration
continues to “approve” and “sanction” fraternity parties at documented fraternity houses in our neighborhood. This has
changed the fabric of the City’s neighborhoods and made them unlivable to the average, reasonable person who wants and
needs to have the quiet enjoyment of their property.
Problem 2
SLO Code Enforcement has contacted property owners of many illegal fraternity houses in the City’s neighborhoods and told
them that fraternity operations are against the law, and their property has held documented fraternity events.
Despite receiving a notice of violation or advisory letter, the properties continue to host fraternity-related illegal events,
including large fraternity parties. These investors are profiting from the rental income from a fraternity and have no stake in the
ruination of the quality of life of those who live near their investment properties/fraternity houses, because they -the investors-
live in quiet neighborhoods or on large estates. Some of the investors who own multiple properties with illegal fraternity houses
and are not personally affected by noise: David Scarry, Sanjay Ganpule, Jerry Lenthall.
Problem 3
Code Enforcement and SLOPD do not seem to be sharing information about documented illegal fraternity addresses. This has
allowed fraternities to hold disruptive parties without accountability. I've included some party addresses at known fraternity
houses from this weekend, below:

1. A legal fraternity is not allowed to register a party.
Documented illegal fraternity houses are registering parties with SLOPD to escape a response from SLOPD if someone
calls dispatch about a noisy party. (e.g. Delta Sigma Phi at 1684/1688 Mill Street)
2. A legal fraternity requires a response from SLOPD, not SNAP.
SNAP officers are responding to documented illegal fraternity houses in our neighborhoods. (e.g. Sigma Phi Epsilon at
2090 Hays, Theta Chi at 2149 Santa Ynez, Theta Chi at 250 Grand, Phi Kappa Psi at 1276 Bond, Delta Sigma Phi at 1688
Mill, etc.)
3. A legal fraternity is not eligible for a Disturbance Advisement Card (DAC) but is issued a citation when a noise violation is
found.
SNAP officers cannot issue citations. They are responding to documented fraternity locations and clearing parties with
negative violations or, in some cases, issuing DACs when there are 100 or more people at a party. (e.g. Theta Chi at 1820
Hope Street had 150 people)
4. A legal fraternity is not allowed to clear its citation history through SLOPD’s Early Removal Program.
Property owners of documented illegal fraternity houses with multiple citations, costing the landlord and tenants
thousands of dollars, have been allowed to clear their citation history to avoid the financial accountability of expensive
noise citations through SLOPD’s “Early Removal Program” (e.g. Phi Sigma Kappa at 348 Hathway Avenue) I'm unsure if
1820 Hope also cleared their history but it was historically the main chapter house for Theta Chi, has a history of noisy
parties and citations, but received a DAC this weekend with 150 people at the party.
Solution
Stop the illegal fraternity events in the city’s neighborhoods by holding Cal Poly and the investor property owners responsible.
Obtain the addresses of all fraternity events in our neighborhoods during the last academic year and this academic year from Cal
Poly and flag the properties in SLOPD’s system so they are accountable for their disruptive activities. I have already provided the
address locations, including social media posts for fraternity rush events this academic year.
Declare the properties a public nuisance if necessary, for continued fraternity operations that are making it impossible for
residents to rest or sleep.
Illegal fraternity properties should not be eligible for a DAC and should receive a citation for a noise violation which means
SLOPD responds.
Illegal fraternity properties not be eligible for Early Removal through SLOPD to wipe their citation history clean.
Illegal fraternity properties should not be eligible to register their parties through SLOPD.
Also, Alpha Sigma Phi had an enormous party at 299 Albert on 10/31 that completely blocked the streets. The
PD log shows the party as a traffic hazard and the party was not cited. I suggest it would be helpful for the city
manager and council to view SLOPD video footage from their vehicles and body cams to better understand the
disruption caused by fraternities in our neighborhood. Same goes for the Delta Upsilon party at 281 Albert on
11/1. Please watch video of the parties from SLOPD footage from vehicles and body cams.

current status of planning efforts for the on campus Greek village and should be getting more regular updates
on Cal Poly planning for St. Patrick’s Day (including any lessons learned from Halloween) with Chief Scott’s
participation in their working group.
I will follow up with Teresa on getting you on the calendar for another SCLC meeting. They are quite an
experience!

Thanks for these notes.
I know I am very curious about their planning for Greek village on campus beginning…they have seemed like that is
far off in all their other comms on this topic, so if it’s starting, I’d like to know in what way.
Also, I think the idea of communications to other universities about essentially, “don’t plan to come here for St. Fratty’s
day” would be amazing. I know Derek once joked (kinda?) about putting signage up at the on/off ramps to Cal Poly
warning people that “there will be no party here,” but not in those exact words, of course.
I’m sure they don’t have time to do something more event-like on campus for Halloween, but I mentioned that too…in
a separate email exchange I had with Joy and Courtney.
Since I did not get a chance to go to my assigned SCLC because I had jury duty, I would love to go to the next one, if
possible? Or maybe there is one the mayor can’t go to, so I can go with another councilmember. Just thinking out
loud, but I know since I missed my one, I might not get to go for the whole year, as a result. So, if something can work
out, I would love that.
