As a part of the invesgaon that led to the determinaon in the issued noce, a fraternity (Phi Gamma Delta (FIJI)) was verified to have adversed a fraternity sponsored event to take place on September 27, 2025, from 2PM-5PM (See aached). A subsequent inspecon performed on the day/me of the adversed event confirmed an event associated with a fraternity at the adversed me. I have aached the following documents for your records: Social media post from 9/25/25 adversing the mes of the events held by Phi Gamma Delta (FIJI) during their recruitment meframe. Social media post from 9/27/25 adversing the specific event on 9/27. The post shows an dye game occurring in the yard of 1229 Fredericks. Photos taken by city staff on 9/27 showing a booth set up in the front of the property during the me frame adversed. This booth is indicave of how fraternies typically meet prospecve pledges. The individuals at the booth are wearing shirts idenfying the fraternity, one of which displays the same graphic that is on the social media post from 9/25. It should be noted that we are sll working though some of the violaons idenfied as part of our enforcement efforts during the RUSH weekend. In looking at our records, we also verified that events took place on 9/28 and 10/3 at this locaon. We will be following up soon with administrave fines for repeat violaon of the same municipal code cited in the Noce of Violaon. Also, fraternies are required to register the locaon of any sponsored event with CalPoly’s Office of Fraternity & Sorority Life prior to the event occurring. If you can provide verificaon from this office that the event on September 27, 2025, from 2PM-5PM, sponsored by Phi Gamma Delta took place at a locaon other than the subject address, the violaon may be retracted. CalPoly may be hesitant to share this informaon with you for privacy reasons, however, you may be able to reach out to the fraternity members to ask them to provide proof of the event details from CalPoly. There is simply an accusation that the people living at 1229 Frederick are operating a fraternity. The burden of proof is not on my tenants or me the burden of proof is on the city. I have no more access to confidential records of Calpoly than the city does. The city has not provided any concrete proof. Can you please help us by providing the address that the fraternity in question held events ? We are taking the appropriate actions to prevent the tenants from operating a fraternity at 1229 Fredrick street The letter that you sent unfortunately does not provide sufficient evidence to prove that a fraternity is operating there. If I need to file an appeal, please consider this my appeal and understand that I have taken the appropriate actions to remind the tenants that having a fraternity operating at that address would be a violation of their lease and city ordinances and is not permissible. If you have further evidence that would conclude that they had a sponsored fraternity event on the dates you have cited please do share it with me and I will have my attorney take the appropriate actions. I have confirmed that your citaon appeal was received by the City Clerk and is currently processing. Our division has already made a determinaon that the evidence collected shows a fraternity held an event at 1229 Fredericks. We believe the photos and social media posts are enough to show a fraternity event occurred. The suggeson to reach out to CalPoly was made so that you could definively clear the use of the property as all fraternies are required to register event locaons with the Office of Fraternity & Sorority Life. If a member of the fraternity was a tenant at this locaon, you may be able to ask them to request this informaon to show where the event adversed on 9/27 from 12PM - 3PM occurred. If it is shown to have been registered at another locaon, the violaon may be cleared. The RUSH chairs were also named and phone numbers provided in a separate social media post. You may be able to reach out to them as well for this informaon. There is simply an accusation that the people living at 1229 Frederick are operating a fraternity. The burden of proof is not on my tenants or me the burden of proof is on the city. I have no more access to confidential records of Calpoly than the city does. The city has not provided any concrete proof. Can you please help us by providing the address that the fraternity in question held events ? We are taking the appropriate actions to prevent the tenants from operating a fraternity at 1229 Fredrick street The letter that you sent unfortunately does not provide sufficient evidence to prove that a fraternity is operating there. If I need to file an appeal, please consider this my appeal and understand that I have taken the appropriate actions to remind the tenants that having a fraternity operating at that address would be a violation of their lease and city ordinances and is not permissible. If you have further evidence that would conclude that they had a sponsored fraternity event on the dates you have cited please do share it with me and I will have my attorney take the appropriate actions. Have you notified the tenants at 1229 about your concerns? Have you contacted the fraternity in question? If so, have you gotten any kind of a response? The Activity log alone will most likely not be enough evidence for the hearing officer, especially since the activity for the inspections related to fraternities are more general in nature without specific reference to photos or social media posts.
