The project is consistent with the Final EIR adopted by City Council on July 17, 2018. Dear Kevin Harris: On September 16, 2022, I reviewed your application to modify the previously approved SLO Rep Theatre building (ARCH-0415-2019) that includes the removal of the basement, second floor, roof deck, and one tree and increases the first floor by approximately 940 square feet in the Downtown Commercial zone with a Historic District overlay. After reviewing the plans, I determined that the project is minor and will not require review by the Architectural Review Commission (ARC). Your plans are approved, based on findings and subject to the following conditions: Findings 1. The project will not be detrimental to the health, safety, or welfare of those working or residing in the vicinity since the proposed project is consistent with standards for development within the Downtown Commercial zone with a Historic District overlay and will be subject to conformance with all applicable building, fire, and safety codes. 2. The proposed modifications to the previously approved theatre building are consistent with Historic Preservation Program Guidelines Sections 3.2.1 and 5.2.2 because the modifications are designed to be architecturally compatible with Downtown Historic District structures. 3. The project design modifications maintain consistency with the Community Design Guidelines Chapter 4 (Downtown Design Guidelines), Sections 4.2 (A-D) by providing: human scale and proportion, various upper story setbacks, includes similar vertical elements that are found in the surrounding architecture of the existing buildings, an architectural design that complements the character of the surrounding neighborhood, transparency is included in the front façade with the inclusion of glass curtain walls and provides architectural interest on all four sides of the building. 4. The proposed modifications to height, massing and scale of the project will not negatively alter the overall character of the neighborhood or the streets appearance because the development ARCH-0221-2022 (609 Palm Street) Page 2 incorporates vertical and horizontal wall plan offsets that provide a high-quality and aesthetically pleasing architectural design. California Environmental Quality Act (CEQA) Finding 5. On July 17, 2018, the City Council certified the Final Environmental Impact Report (FEIR State Clearinghouse Number 2017051011), adopted a Mitigation Monitoring and Reporting Program, and adopted CEQA Findings and Mitigation Measures, including a Statement of Overriding Considerations, for the Project per Resolution No. 10923 (2018 Series). On November 5, 2019, the City Council adopted an Addendum to the certified FEIR for minor technical changes associated with the project that did not materially change the findings and conclusions of the certified FEIR. The proposed modifications are consistent with the adopted Final EIR, all mitigation measures adopted as part of the EIR applicable to the project shall be carried forward and applied to effectively mitigate the impacts that were previously identified. No Supplemental Environmental Impact Report is required pursuant to Public Resources Code §21166 and State CEQA Guidelines Section 15162 because: 1) the project does not include or require any revisions to the certified FEIR; 2) no substantial changes would occur with respect to the circumstances under which the project is being undertaken, and no revisions to the FEIR; and 3) no new information of substantial importance is available that was not already known at the time the FEIR was certified and adopted. Conditions 1. All conditions and mitigation measures related to applications ARCH-0415-2019 and EID- 0349-2017 (Council Resolutions No. 10923 (2018 Series) and No. 11059 (2019 Series) shall apply to this approval unless otherwise noted by a condition listed below. Planning 2. Final project design and construction drawings shall be in substantial compliance with the project plans as approved through this architectural review process. A separate, full-size sheet shall be included in working drawings submitted for a building permit that lists all conditions of project approval as Sheet No. 2. Reference should be made in the margin of listed items as to where in plans requirements are addressed. Any change to approved design, colors, materials, or other conditions of approval must be approved by the Community Development Director or reviewed by the Architectural Review Commission with a recommendation to the Community Development Director or Planning Commission, as deemed appropriate. 3. Plans submitted for a building permit shall clearly depict the location of all required short and long-term bicycle parking. Long-term bicycle parking spaces shall be located within interior spaces of the structure. Short-term bicycle racks shall be consistent with the City Active Transportation Plan Design Guidelines and feature “hi-low style” campus racks (such as “Peak Racks”) or City-approved equivalent (inverted “U” rack designs shall not be permitted) and shall be installed in close proximity to, and visible from, the main entries into ARCH-0221-2022 (609 Palm Street) Page 3 the buildings. Sufficient detail shall be provided about the placement and design of bike racks, and interior spaces to demonstrate compliance with relevant Engineering Standards and Community Design Guidelines, to the satisfaction of the Public Works and Community Development Directors.” Utilities Department 4. Resolution No. 11059 COA #93 shall be superseded by the following condition: Upon submittal of a building permit application, a written confirmation from the San Luis Garbage Company shall be included in the building permit plans for the proposed project. Plans submitted for a building permit shall show the following: the trash enclosure area shall have a maximum slope of two percent in a way that waste services will not interfere with vehicular or pedestrian traffic. During operation of the project, based on their location, after service waste wheelers shall be brought back into the trash enclosure by 10:00 AM on the day(s) of service. Indemnification 5. The applicant shall defend, indemnify, and hold harmless the City and/or its agents, officers, and employees from any claim, action, or proceeding against the City and/or its agents, officers, or employees to attack, set aside, void, or annul the approval by the City of this project, and all actions relating thereto, including, but not limited to, environmental review (“Indemnified Claims”). The City shall promptly notify the applicant of any Indemnified Claim upon being presented with the Indemnified Claim and the City shall fully cooperate in the defense against an Indemnified Claim. My action is final unless appealed within ten (10) calendar days of the date of this letter. Anyone may appeal the action by submitting a letter to the Community Development Department within the time specified. The appropriate appeal fee must accompany the appeal documentation. Appeals will be scheduled for the first available Planning Commission meeting date. If an appeal is filed, you will be notified by mail of the date and time of the hearing. The Community Development Director’s approval expires after one year if building permits are not issued for site development and the permit shall expire with the building permit application, unless otherwise extended by Council Resolution. On request, the Community Development Director may grant renewals for successive periods, in accordance with Section 17.104.070 (Expiration) of the Zoning Regulations, or as otherwise determined to be consistent with State Law. Included with this letter is an invoice for the Completion Fee for your application, which is now due. Completion Fees are to be paid within six (6) months of the final action taken on planning services provided or this entitlement shall be null and void.
