UNIFORM BUILDING CODE FEE SCHEDULE CORRECTIONS CAO RECOMMENDATION Adopt a resolution making corrections to the 1994 building permit fee schedule. DISCUSSION In accordance with City policy, the Council adopted the 1994 Uniform Building Code (UBC) permitt fee schedule on September 20, 1994. Since that time, the organization responsible for the UBC - the International Conference of Building Officials (ICBO) - has identified some minor mathematical errors in the UBC fee schedule and issued an "errata” sheet correcting them. As reflected in the fee schedule provided in Exhibit 1 of the proposed resolution, these changes are for internal consistency purposes only, and will not result in any material changes in the fees that would otherwise be due under the current schedule. Why is this dwW reeomnwnded by the ICBO? As reflected in the attached building permit fee schedule, charges are based on the estimated construction value of the project.. There are eight basic rate blocks in this schedule based on various value ranges. For internal consistency, the fixed rate component of each block should begin with the maximum cost of the prior block. For example, a project costing $2,000 (the highest value in the second block of the rate structure) would be charged a building permit fee of $62.25 under the new fee schedule. For consistency, this should be the minimum beginning. charge for the next rate block ($2,001.00 to $25,000.00). The current rate schedule does not reflect this level of internal consistency; the revised one does. The changes recommended by the ICBO will have no material impact on building permit fees. For example, for a project with -a construction value of $25,000, there will actually be a slight decrease in the building permit fee of $2.25 ($349.75 rather than $352.00) whereas a project with a construction cost of $1.0 million would see a slight increase in the building permit fee - $5,012.25 rather than $4,955.00. Under section 66017 of the state government code, revisions to development review fees can not be implemented any sooner than 60 days after their approval by the Council. Accordingly, the first working day that these changes can be formally effective is March 6, 1995. ATTACHMENTS Resolution correcting the building permit fee schedule RESOLUTION NO. (1995 Series RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO CORRECTING THE 1994 UNIFORM BUILDING CODE FEE SCHEDULE WHEREAS, in accordance with City policy, the Council adopted the 1994 Uniform Building Code fee schedule as prepared by the International Conference of Building Officials (ICBO) on September 20, 1994 pursuant to Resolution No. 8353; and WHEREAS, the ICBO subsequently identified minor internal consistency errors in this fee schedule and issued an "Errata to the 1994 Uniform Codes" in September of 1994 to correct these errors; and WHEREAS, the Director of Community Development has determined that the adoption of these corrected fees is exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15273 of the State CEQA Guidelines as the purpose of these charges is to meet operating expenses. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo that: SECTION 1. Effective March 6, 1995, Section A of Exhibit A of Resolution No. 8353 ("Building Permit Fees ") is hereby amended as set forth in Exhibit 1 attached hereto. SECTION 2. If any charge set forth in this resolution or the application thereof to any person or circumstance is held to be invalid, such invalidity shall not affect any other charge or application thereof, and to this end the charges established in this Resolution are declared to be severable. Accessibility Compliance Surcharge: A surcharge of 65% shall be added to the permit fees for projects required to comply with State of California Accessibility Standards. 11. Fire Safety Surcharge: A surcharge of 12.5% shall be added to the permit fees for projects that require review by the Fire Department. 12. Other Inspections and Fees: a. Inspections outside of normal business hours $55.00 per hour (minimum charge - two hours) b. Reinspection fees assessed under provision of UAC Section 305 (Minimum charge - one hour) $55.00 per hour C.
