The current request for a time extension is the first received for the above-referenced entitlements. On November 5, 2019, the City Council originally approved a new performing arts facility and use permit, with an addendum to a Certified Environmental Impact Report (Council Resolution No. 11059 (2019 Series)) for entitlements ARCH-0415-2019 and USE-0416-2019. On September 16, 2022, the Community Development Director reviewed and approved modifications to the previously approved SLO Rep Theatre building (ARCH-0415-2019) that include the removal of the basement, second floor, roof deck, and one tree and increased the first floor by approximately 940 square feet. Entitlements ARCH-0415-2019 / USE-0416-2019 were set to expire on November 5, 2020, and entitlement ARCH-0221-2022 was set to expire on September 16, 2023. However, on March 4, 2020, the Governor proclaimed a State of Emergency as a result of the threat of COVID-19. On March 17, 2020, the City Council adopted Resolution 11099 (2020 Series) proclaiming a local emergency and affirmed and continued its proclamation of local emergency to extend through the duration of the declared State of emergency. On June 16, 2020, Council adopted Resolution No. 11131 (2020 Series) that tolled the expiration of all discretionary approvals from the declaration of the pandemic emergency (beginning March 17, 2020). On July 6, 2021, Council adopted Resolution No. 11264 (2021 Series) that granted various enforcement moratoriums and permit extensions, including planning applications, for the purpose of economic recovery and the protection of the public health, safety, and welfare. Council adopted Resolution 11396 (2023 Series), effective on February 28, 2023, terminating the Declaration of a Local Emergency for the COVID-19 Pandemic that provided an 18-month time extension for discretionary approvals that ends on August 28, 2024. Based on your timely request for an extension, I hereby grant a one-year extension to your project, subject to the original findings and conditions as defined in Council Resolution No. TIME-0444-2024 / TIME-0477-2024 – (ARCH-0221-2022 / ARCH-0415-2019 / USE-0416-2019) 614 Monterey Street / 609 Palm Street Page 2 11059 (2019 Series) and the final approval letter from the Director dated September 16, 2022. The architectural review and use permit approvals will now expire on August 28, 2025. Pursuant to Zoning Regulations Section 17.104.070 (Expiration), the architectural review entitlement will expire if building permits are not issued prior to the expiration date identified above. Upon written request, received prior to expiration, the Community Development Director may grant renewals of an approval for successive periods of not more than one year each, up to a total of three years (this entitlement has two, one-year time extensions remaining). Requests beyond three years are subject to review by the Planning Commission. If you want to keep the project active after the entitlements expire, then you must start the process over by submitting a new application and plans and paying the required fee(s).
