I took photos and then threw the board in a dump trailer, on site, because I did not want to leave such a hazard in place. It's my belief that once called on safety, one has to be super careful. Since, even after being reported for it, no concern is being made about safety on the job site 2505 Johnson, and 2505 Johnson is used as a staging area for materials and debris for the work at 2525 Johnson, I now request that work be halted on both sites I also note that I've been told not to use the stairs I reported as missing in the original report, as replaced, because they're not structurally sound, as put back up, after being town down and discarded in a heap. I've demanded they be repaired and made usable, but I'm not optimistic this will happen, since my landlord doesn't believe he has any responsibility, at all, to provide me a safe and livable premise, and as he holds me here, against my will, after giving notice, because he does not allow me to do move easily, offers no assistance, but does only things which impede my move. I am a tenant here and in my landlords continued "why bother" attitude, I was not told the work would be done, nor was access to the property requested to do so. The fence was removed days ago and on Monday evening I took photos, with the intent to report the unsafe situation of sharp metal objects and a misstep involving a large drop. Then half the work on the fence was done yesterday. I also don't believe my landlord knows that it his responsibility to remove the weeds along the fence, which would have been easier before he constructed the fence, and that the city will only cite him to force him to remove them, and not do that for him. To enable that, the landlord of both properties removed railroad ties that were in place to prevent that, because he also may be the resident of 2525 Johnson. The railroad ties are shown in the first photo from January 17, 2023 and were along the entire driveway. I have told them repeatedly that this is a nuisance to me and that I believe it violates the SLO parking ordinance which disallows parking in front yards and on unpaved surfaces. For almost two months my landlord has been on the property doing work, almost every day without notifying me of what work will be done, when, or by who. In previous reports to you I've described how the work has been a nuisance and unsafe to me and because the job foreman, my landlord, does not appear to be trained in any way in job site safety. I also believe that for the extensive work being done that permits should have been sought for at least deckwork, electrical work, demolition work, grading, and paving, and had they been sought it would have required a plan in place for the work, and a plan that addressed tenant comfort and safety, for which no plan seems to exist and my landlord just does whatever he feels like, on any particular day. I ask that a STOP WORK be issued until it is determined if permits are needed, particularly for the grading, because the extensive grading has grossly changed the drainage pattern and is likely to create a problem for properties on Sydney street, below 2505 Johnson. There is a plan on file showing the drainage pattern of the property, before this work was done and represents work I did in 2012, when I was issued a stop work for doing grading without a permit, and in doing identical work to what was just done here, and then had to correct it. Days to Close Description The owner of 2505 Johnson Ave, Kyle Billingsley, cut down the bamboo on his property. Kyle then put dirt over where the bamboo had been but did not kill it. Now the bamboo is growing on our property and you can see it coming from under our shared fence. We have tried many ways to kill the bamboo as it grows on our property. We are not sure what we can do at this point as we have reached out to Kyle and his response indicates he doesn't care. In his response he also stated he over excavated the area- which he did not. Now all the dirt he put over where the bamboo was is harboring a lot of rodents. The rodents have decided to come go into that dirt and under our fence- so now we have a rodent problem. I reached out to Kyle about this issue. We, my spouse and I, have tried to work with Kyle and have shared information with him a few times about how to get rid of the bamboo from his side so it doesn't grow on our property but this seems to have fallen on deaf ears. Every time we have made a complaint to the city about possible code violations it seems that within less than 12 hours Kyle attempts to make the correction. Now we are curious as to who is the person that is reaching out to Kyle as soon as we file a complaint? So if you can help us as to our next steps to deal with Kyle, the bamboo, and the rodent issue we'd appreciate any assistance you can provide. The pictures I have uploaded only show a tiny bit of the bamboo issue- we have a video of the current problem. ps: we never had any of these issues prior to Kyle working on the property. We look to verify general conformity to plans, under a basic presumption that construction has been carried out according to approved plans, an obligation of everyone involved in the project. Also hydrostatic pressure is causing water to leak under and thru concrete block wall between properties. The outlet grate has been insstalled too high and is allowing the water to flow around the fence. Kyle Billingsley, owner 1495, submitted a plan that you, the city, that was approved for a water basin. The water runoff is still happening and it’s been 2 years. We last submitted runoff on 12/26/25, the reply from the city was that this is to be dealt with between the owners of the adjacent properties. (This was an idea that Kyle gave the city, specifically the planning engineer, Gabriel.). This isn’t so because all the prior reports of runoff the city has held Kyle accountable. See the city approved the plan, the plan isn’t working therefore the city needs to address Kyle and formulate a new plan that works. So if just floating an idea to the planning engineer is all it takes we suggest the city continue to hold Kyle accountable. Just ask the city attorney, the city can’t allow this failed plan to stay in place the city must work to protect our property, as city employees do work for the citizens in this city. Previously the city did hold Kyle responsible this doesn’t change for any reason whatsoever. We never had water runoff from that property until after Kyle’s plan for the basin and ADUs was approved and implemented. Yes changes have been made over the past two years but they aren’t working. There has been a significant reduction in runoff but runoff is still occurring. Water doesn’t stay still when it is absorbed in the ground it will moves in the direction of least resistance and therefore is running onto our property. Yes on 12/26 we thought finally everything is working, we were so excited, but no, it started raining again and we were getting storm water runoff from Kyle’s property. The state of California and our county also has very clear environmental standards for such an issue. We have been requesting, pleading and begging the city to have the owner fix this basin due to us being flooded several times over the course of 2 1/2 years. I understand that Gabriel Munoz-Morris responded to confirm there are no City engineering standards restricting the parking configuration. Regarding the applicable Zoning Regulations, Municipal Code Sections 17.72.090(B)(1), 17.16.020, and 17.70.170(C)(10) provide parking and driveway design and development standards for residential uses, or specifically the R-1 zone. The parking for 1495 Sydney was designed in compliance with these requirements. Additionally, Municipal Code Section 17.76.040 provides regulations that apply to vehicle parking within the front yard areas and how the cars are parked onsite. If you have concerns if vehicles parked onsite are not utilizing the parking in compliance with Section 17.76.040, you can follow up with Code Enforcement or submit a new AskSLO. I am away from my desk phone today so I can’t call you back there but I wanted to reply here since part of my answer is connecting you with some other folks that are likely better positioned to answer this question than the Engineering Review Division (my team). My understanding from the email below and your voicemail is that you have a concern about the vehicles being parked on Mr. Billingsley’s property in the approved parking area. Specifically your concern is about headlights shining towards your house/property and whether there is a code requirement restricting this or requiring something else. I didn’t think there was but I went ahead and double checked to be sure that there is no City engineering standard restricting this. It would be unusual for it to be included in an engineering standard as our standards are typically more focused on stall sizing, parking lot maneuverability and safety, and parking lot surfacing (e.g. the physical construction of the parking lot itself). This may be governed by a municipal code section that the Planning division checks during plan review although my quick search did not turn up anything specifically about this (I will let them review this inquiry and confirm though as this is their area of expertise and not mine). I included the planning division email here and someone from that team should reach out with more information soon for you.
