Jonas, Director of Community Development D Prepared By: Ronald Whisenand, Development Review nager SUBJECT: County Master Plan to Reduce Drug and Alcohol Abuse CAO RECOMMENDATION Receive comments and recommendations on the Master Plan by the Human Relations Commission and the Planning Commission and adopt the attached resolution endorsing the Master Plan with the exception of recommendations regarding additional land use controls for alcohol establishments. DISCUSSION The Council referred the County's Master Plan to Reduce Drug and Alcohol Abuse to the Planning Commission and Human Relations Commission on October 04, 1994 for review and comment. The Human Relations Commission reviewed the plan on November 02, 1994 and the Planning Commission on December 14, 1994. The purpose of this report is to forward the Commissions' recommendations to you and to formulate a City response to the County. The Human Relations Commission reviewed the plan in context of their area of expertise and endorsed the plan as written. In addition, the Commission recommended support for any further efforts in this direction. A copy of the November 07, 1994 memo outlining the Commission's recommendations is attached. Pertinent sections of the Master Plan dealing with land use regulations were reviewed by the Planning Commission. This year's Master Plan has established the task of researching "districts and cities within San Luis Obispo County to become thoroughly educated on what legislation and regulations currently exist in San Luis Obispo County regarding public policy on CUP's, zoning and alcohol outlet licensing and density, use of alcohol on city and county owned parks and at public events such as the Strawberry Festival, County Fair..." The Master Plan specifically identifies as a goal to "draft a resolution, developing model regulations for city governments within San Luis Obispo County, regarding the policy for zoning and distribution of Conditional Use Permits (CUP's), and to develop resolutions to assist City Planners on zoning and land use related to alcohol availability." A draft ordinance was circulated with the Master Plan which has the purpose of requiring a conditional use permit for any establishment that serves or sells alcohol. The Planning Commission felt that although establishments that sell and serve alcohol have the potential to contribute to the County-wide problem of drug and alcohol abuse, the land use controls recommended by the Master Plan would establish restrictions for operators rather than helping those with alcohol problems. The Master Plan calls for an ordinance that would require the City to establish separate use categories for all establishments that serve or sell alcohol. �un�►�►iuuIIIIIIIIIP ����lU city of San Luis OBIspo ONGs COUNCIL AGENDA REPORT County Drug and Alcohol Abuse Master Plan Page 2 Each of these categories would require a Planning Commission use permit. In addition, the proposal would require use permits for existing (non-conforming) establishments prior to expansion, modification, or change of ownership. Finally, establishments would be subject to dispersal requirements that would prohibit "over- concentration." The Commission felt the City's existing land use regulations provide sufficient control over these establishments. Providing an extra layer of use permit controls as is suggested in the master plan would not help solve the problem of drug and alcohol abuse. The permit requirement would also discourage minor changes and improvements in existing businesses, such as seismic retrofit or facade improvements, due to the fear of "after the fact" use permit conditions. In addition, the Commission felt that the findings required to enact such an ordinance would need to be closely linked to an identifiable problem that could be solved by a use permit and dispersal requirement. The Commission felt that such a finding would be difficult to make in San Luis Obispo. CONCURRENCES In addition to staff review by departments that support the Human Relations Commission and Planning Commission, the Master Plan was reviewed by the Police Department and City Attorney's office. The Police Department did not feel that there were any areas of the Master Plan that would negatively impact their department. The Attorney's office raised a concern about making the necessary findings to adopt an ordinance that would link additional use permit controls with the reduction in alcohol and drug abuse. ALTERNATIVES Should the Council desire to adopt more restrictive land use controls within the City that would regulate "alcohol establishments," the matter should be referred to the Planning Commission for inclusion in their ordinance update work program. (1995 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO SUPPORTING EFFORTS AND PROGRAMS OF THE SAN LUIS OBISPO MASTER PLAN TO REDUCE DRUG AND ALCOHOL ABUSE WHEREAS, the City Council of the City of San Luis Obispo recognizes that the abuse of alcohol and other drugs has the potential for far reaching effects on the citizens of San Luis Obispo County, possibly resulting in tremendous losses to our community and negatively impacting employers, employees and those they serve; and WHEREAS, the City Council has reviewed the San Luis Obispo County Master Plan to Reduce Drug and Alcohol Abuse and has received recommendations on it's implementation from the City's Human Resources and Planning Commissions; and WHEREAS, the Master Plan provides programs and policies that encourage clean and sober lifestyle and drug-free work environments including suggestions for certain local land use regulations; and WHEREAS, the City presently enforces land use controls regulating establishments that sell or serve alcohol in a manner which promotes the goals of the Master Plan. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of San Luis Obispo that the City supports the creation of programs County-wide that will reduce the adverse effects of drug and alcohol abuse on our community as outlined in the Master Plan, and will continue to enforce without change, the City program of use permit controls regulating the existing and proposed businesses that sell or serve alcohol within the City of San Luis Obispo. .�-3 Resolution No. (1995 Series) On motion of , seconded by and on the following roll call vote: AYES: NOES: ABSENT: the foregoing resolution was passed and adopted this _ day of 1995. During the November 2, 1994 HRC meeting the Commissioners discussed the contents of the Master Plan; no changes were recommended. A motion was made and passed to recommend to Council the San Luis Obispo County Master Plan to Reduce Drug & Alcohol Abuse be endorsed as written and to support any further efforts in this direction. MEMORANDUM DATE: December 7, 1994 TO: Planning Commission FROM: Ronald Whisenand, Development Review Manager /? SUBJECT: County Master Plan to Reduce Drug and Alcohol Abuse The City Council has referred the County's Master Plan to Reduce Drug and Alcohol Abuse to the Planning Commission for review and comment. The plan was initially developed by the County Drug and Alcohol Services Department in 1990 as a result of State legislation. The document is modified annually and establishes goals and objects covering various areas in the control of drug and alcohol abuse. This year, the Public Policy Task Group recommended several tasks and goals to be implemented, some of which impact local land use controls. Specifically, past master plans have identified "ineffective use of land use zoning policy" and "ineffective use of conditional use permit (CUP) policy" as problems that need to be addressed County-wide. Staff has attached an article that outlines the basis for these "problem statements." This year's Master Plan has established the task of researching "districts and cities within San Luis Obispo County to become thoroughly educated on what legislation and regulations currently exist in San Luis Obispo County regarding public policy on CUP's, zoning and alcohol outlet licensing and density, use of alcohol on city and county owned parks and at public events such as the Strawberry Festival, County Fair..." The Master plan specifically identifies as a goal to "draft a resolution, developing model regulations for city governments within San Luis Obispo County, regarding the policy for zoning and distribution of Conditional Use Permits (CUP's), and to develop resolutions to assist City Planners on zoning and land use related to alcohol availability." Implementation of an ordinance similar to the attached model would make it more difficult to locate bars, restaurants, and retail establishments that serve or sell alcohol within the City. The purpose is that a use permit will allow for a closer review of problems that may be associated with the sale of alcohol. In addition, use permits require a public hearing where neighbors could be consulted. Finally, the draft ordinance would establish dispersal requirements as well as permit requirements for existing establishments when the liquor license changes, structural changes are made to the building, or where ownership changes occur. Ll sy Memorandum - Planning Commission December 14, 1994 Page 2 The City currently requires an administrative use permit for "bars, taverns, etc" in 0 commercial zoning districts. "Retail sales of liquor" and "restaurants (where alcohol may be served)" however, are allowed without a use permit in all commercial districts except the Tourist-Commercial district where a Planning Commission Use Permit is required for retail sales and in the Service-Commercial district where an administrative use permit is required for retail sales and restaurants. Making the changes recommended in the Master Plan would require the City to establish separate use categories for establishments that serve or sell alcohol. Each of these categories would require a Planning Commission use permit. In addition., the proposal would require use permits for existing establishments prior to expansion, modification, or change of ownership. Finally, establishments would be subject to dispersal requirements that would prohibit "over- concentration." Staff recognizes the problem of drug and alcohol abuse. Implementing the recommended ordinance language could have an effect on the problem. However, the City has been in the mode of streamlining our development permit procedures. Implementing such an ordinance would increase the number of Planning Commission use permits and the time it takes for these establishments to receive City approvals. In addition, there may be a tendency for existing establishments to not upgrade their buildings for fear of new use permit conditions. The matter has been researched by the City Attorney's office and it has been determined that the changes would be legal provided that the proper link or nexus is made between the lessening of problems of alcohol abuse with more stringent land use controls. The Master Plan identifies assistance to cities in making these nexus findings. In addition, the sample ordinance contains this link in its purpose section (Sec. 1.00 et. seq.). RECOMMENDATION: The Commission should review the material provided and make a recommendation to the City Council on the impacts of implementing these Master Plan policies. ATTACHMENTS: a. The Planning Commission, or City Council on appeal , shall also consider whether the proposed use mill detrimentally affect nearby residentially zoned communities in the area, after giving considerati to the distance of the proposed use from the following: 1 . ) Residential buildings; - 2. ) Churches , schools , hospitals, public playgrounds and other similar uses ; and 3. ) Other establishments dispensing for sale r 28a 3�/ Pace Three or other consideration, alcoholic beverages includinc beer and wine . 2. 04 In• all determinations pursuant to this section, the applicant for the Conditional Use Permit shall have the burden of proving by clear and convincing evidence that the proposed use will not adversely affect the health, safety or welfare, result in undue concentration of alcoholic beverage outlets, or detrimentally affect nearby communities. 2.05 The Planning Commission, or City Council on appeal , may impose any conditions on the applicant or proposed location reasonably related to the health, safety or welfare of the community (f-or *an exemplar of conditions you might wish to consider, see the appendix) . 3 .00 ON-SALE LIQUOR ESTABLISHMENTS DEFINED. An on-sale liquor establishment shall mean any establishment wherein alcoholic beverages are sold, served or given away for consumption on the premises including but not limited to any. facility which has obtained a California Department of Alcoholic Beverage Control license types 41, 42, 471 48 , 51 , 52 and 63 . 4. 00 OFF—SALE LIQUOR ESTABLISHMENTS DEFINED. a 1 An off-sale liquor establishment shall mean any , establishment which is applying for or has obtained a liquor license from the California Department of Alcoholic Beverage Control, including types g 20 and 21. 5 . 00 MINIMUM CONDITIONS FOR OFF-SALE LIQUOR ESTABLISHMENTS . 5.01 Off sale liquor uor establishments shall not sell or store motor fuels on the same premises as alcoholic beverages , except upon condition of the following : 1 . ) No beer or wine shall be displayed within five feet of the cash register or the front door unless it is in a permanently affixed cooler as of January 1 , 1988. ) gb Face Four 2. ) No advertisement of alcoholic beveraces shall be displayed at motor fuel islands . 3 . ) No sale of alcoholic beverages shall be made from a drive-in window. 4. ) No disDlav or sale of beer or wine shall be made from an ice tub. 5. ) No beer or wine advertising shall be located on motor fuel islands and no self-illuminated advertising for beer or wine shall be located on buildings or windows. 6. ) Employees on duty between the hours of 10:00 p.m. and 2:00 a.m. shall be at least 21 years of age to sell beer and wine . 6 .00 EXISTING ESTABLISHMENTS SELLING ALCOHOLIC BEVERAGES (ON-SALE AND/OR OFF-SALE) . 6.01 Any establishment lawfully existing prior to the effective date of this section and licensed by the State of California for the retail sale of alcoholic beverages for on-site and/or off-site consumption shall obtain a Conditional Use Permit when (a) the establishment chances its type of licuor license within a license classification and/or (b) there is a substantial change in the mode or character of operation. For purposes of this ordinance "substantial chance of mode or character of operation" shall include, but not be limited to, structural chances , a transfer '- of ownership of the license, a pattern of conduct in violation of other laws or regulations , a period of closure, or increased square footage of alcoholic beverage sales or inventory. 6 .02 Any establishment which becomes lawfully established on or after effective date of this section and licensed by the State of California for the retail sale of alcoholic beverages for on-site and/or off-site consumption, shall obtain a modification of Conditional Use Permit when ( a) the establishment changes its type of liquor license within a license classification and/or (b) there is a substantial change in the mode or character of operations of the establishment. 28c a./_ A Page Five f 6 . 03 Revocation of CUP . A Conditional Use Permit Granted under this Ordinance shall be subject ` to revocation in the manner provided by Section of the Zoning Ordinance if any of the conditions imposed and accepted are not complied with . [ SECTION 2 . SEVERABILITY !I 2.00 If any 'section, subsection", subdivision, sentence, { clause, phrase, or portion of this ordinance , or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional[ by the decision of any court of competent jurisdiction, t such decision shall not affect the validity of the remaining portions of this ordinance or its t application to other persons or places . l • t C f 28d �-Gy APPENDIX Listed below are exemplars of conditions the local government may wish to impose as* appropriate . This list is not meant to be exhaustive; it is merely provided as a guide which may be helpful. Conditions for on-sale establishments : 1. No on-sale liquor establishments shall be maintained within (a distance appropriate in your community: 500 feet is reasonable ) of any other establishment wherein alcoholic beverages are sold , for on-site and/or off-site consumption, or from., any residential use or from such locations as schools (public and private) ; established churches or other places of worship; hospitals, clinics, or other healthcare facilities; public parks and playgrounds and other similar uses . 2. A masonry wall of six feet (6 ' ) in height shall be constructed around the parking area of such establishments when said area is adjacent to properties zoned or used for residential purposes or any of the above referenced consideration points . 3 . The noise levels generated by the operaticn of such establishment shall not exceed (a dba level as appropriate in the model noise ordinance) on adjoining properties zoned or used for residential purposes. 4. Exterior lighting of the parking area shall be kept at an intensity of between and foot candles, so as to provide adequate lighting for patrons while not disturbing surrounding residential or commercial area. 5. The sale of alcoholic beveraees for consumption off the premises shall be prohibited. 6. Food must be available at all hours that the establishmer is open for business. 7. Special security measures such as security guards and burglar alarm systems may be required. B. The applicant must bear cost of modifications or 28e I Pace Two cease operations if harm or retail related problems , are demonstrated to occur as a result of anti-social behavior, including but not limited to the conereeation of minors, violence on site , drunkenness , vandalism, solicitation or litter. 9. All establishments shall be required to have a public telephone listing. 10. It shall be the responsibility of the applicant licensee to provide all staff With the knowledge and skills that will enable them to comply with their responsibilities under state lay. t The knowledee and skill's deemep necessary for responsible alcoholic beverage service shall include, but not ._ t be limited to the following topics and skills development. a) State laws relating to alcoholic beverages , particularly ABC and penal provisions concerning sales to minors and intoxicated persons, driving under the influence, hours of legal operations, and penalties for violations of these laws. b) The potential legal liabilities of owners and employees of businesses dispensing alcoholic beverages to patrons who may subsequently injure, kill or harm themselves or innocent victims as a result of the excessive consumption of alcoholic beverages. c ) Alcohol as a drug and its effects on the body _ and behavior, including the operation of motcr vehicles. -4 45 d) Methods for preventing customers from becoming intoxicated, methods 'for dealing with intoxicated 3 customers and recognizing underaced customers . e ) Methods to appropriately pace customer drinking to reduce the risk that the customer will not . 4 leave the premises in an intoxicated manner. f ) Knowledge of mixology, including marketable - ' alternatives to alcoholic beverages. Conditions for off-sale establishments: ) Q 1 1 . No off-sale liquor establishment shall be maintained within of any other establishment Page Three wherein alcoholic beverages are sold for both off-site and on-site consumption or such consideration points as schools (public and private ) , established churches or other places of worship, hospitals, convalescent homes , public parks, and playgrounds and/or other similar uses. 2. A masonry wall of six feet (61 ) in height shall be constructed around the parking area of such establishments when said area is adjacent to properties zoned or .used for residential purposes , or any of the above referenced consideration points . 3. The noise level generated by the operation of such establishments shall not exceed dba on adjoining property zoned or used for residential purposes. 4. Exterior lighting of the parking area shall be kept at an intensity of between and foot candles, so as to provide adequate lighting for patrons while not disturbing surrounding residential or commercial areas. 5. The operation of video or any other electronic games shall be prohibited in conjunction with the sales of alcoholic beverages. 6. The sale of alcoholic beverages for consumption on premises shall be prohibited and appropriate posting of signs both inside and outside the establishment that drinking on the premises is prohibited by _ law. The premises shall include the establishment proper and/or the appurtenant common• areas if located in a commercial center. 7. Special security measures such as security guards and burglar alarm systems shall be required. 8 . It shall be the responsibility of the applicant licensee to provide all staff with the knowledge and skills that will enable them to comply with their responsibilities under state law. The knowledge and skills deemed necessary for responsible alcoholic beverage service shall include, but not be limited to the following topics and skills development: a. Exterior public telephones that permit incoming calls may not be located on premises. ll . No advertising of alcoholic beverages shall be visible from the exterior of the premises . - 12. Exterior -storage of any kind shall be prohibited. . l 13. Litter and trash receptacles shall be located at convenient locations inside and outside establishments, and operators of such establishments shall remove trash and debris on a daily basis . 14. Paper or plastic cups shall not be sold in quantities less than their usual and customary packaging . 15. Fortified or dessert vine sold may be requested to be in sizes containing no less than 750 milliliters (fifth of a gallon) . 16. Beer may not be sold in quantities less than one six-pack. : 8h Face Five 17 . All establishments shall be required to have a public telephone listing . 18 . Hours of sale may be restricted . 19. Except as provided herein, establishments not conforming to the spatial requirements between establishment and referenced consideration points, shall not be permitted to expand, rebuild or replace a structure or portion of structure as cetermined by the City ' s building and/or fire inspector. Ordinary repair and maintenance not exceeding 15€ of the property' s assessed valuation shall not be affected . i 281 . 9-10
