SUBJECT: Memorandum of Agreement with the San Luis Obispo Police Officers'
Association for the period July 1, 1994, through June 30, 1996.
CAO RECOMMENDATION:
Adopt resolution approving the Memorandum of Agreement
DISCUSSION:
Background:
The Memorandum of Agreement(MOA) between the City of San Luis Obispo and the San Luis
Obispo Police Officer's Association (POA) expired on June 30, 1993, after a period of 5 years.
The subsequent one-year agreement negotiated for the period July 1, 1993, through June 30,
1994, was essentially status-quo in nature and included no salary increase.
After receiving direction from the Council in May, the City entered into negotiations with the
Association to develop a successor agreement. The City's negotiators were Bill Avery of Bill
Avery & Associates, Inc., Ann Slate, Personnel Director and Debra Hossli, Assistant to the
CAO. The Association's negotiating team consisted of Paul Bechely of Bechely, Palica &
Associates, Inc.and Police Officers Dale Strobridge, John Caudill,Tom Depriest, Ian Parkinson
and Mike Brennler.
A tentative agreement has been reached which was ratified by the Association membership. The
agreement reflects and strengthens the continued cooperation between the Association and the
City to address issues of mutual concern in a productive manner. Following is a summary of
the significant changes and cost items included in the agreement:
Terms of the Agreement:
Length: 24 months
Year 1: • Salary increase effective September 15, 1994:
Sworn personnel 2.5%
Non-sworn personnel 2.5%
• Employees are eligible, once annually in December, to request
payment for up to twenty-four (24) hours of unused vacation
leave.

• Effective with the April, 1995, shift rotation, overall seniority in
a specific job classification will prevail as the standard for
determining vacation, holidays, shift selections and special
assignments rather than seniority within the department.
Year 2: • Salary increase effective July 1, 1995:
Sworn personnel 2.5%
Non-sworn personnel 2.5%
• Uniform Allowance increase to $750.00 effective July 1, 1995.
• City's Cafeteria Plan contribution will increase to $415.00 per
month effective August 15, 1995.
• Effective July 1, 1995, the rank of Master Police Officer III will
be added to the Master Police Officer program. Officers who
meet the requirements for Master Police Officer III will be eligible
for a 5.26% increase in compensation (8th Step).
FISCAL IMPACT:
The cost of this agreement is approximately $73,750 for Year 1. This increase is a total
compensation cost which includes salary and benefits. The cost of Year 2 is approximately
$184,600 which includes total compensation costs brought forward from Year 1 and additional
costs of Year 2.
ALTERNATIVES:
Do not approve the resolution and direct staff to negotiate a different successor agreement. This
alternative is not recommended as the agreement presented is close to Council's parameters and
has come as a result of a long process including mediation and impasse.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN
THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO POLICE
OFFICERS' ASSOCIATION FOR THE PERIOD OF JULY 1, 1994 - JUNE 309 1996
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
Section 1. The Memorandum of Agreement between the City of San Luis Obispo and
the San Luis Obispo Police Officers' Association, attached hereto as Exhibit "A" and
incorporated herein by this reference, is hereby adopted and ratified.
Section 2. The Finance Director shall adjust the Personnel Services appropriation
accounts to reflect the negotiated compensation changes.
Section 3. The City Clerk shall furnish a copy of this resolution and a copy of the
executed Memorandum of Agreement approved by Gary Nemeth, San Luis Obispo Police
Officers' Association President, and Wendy George, Acting Personnel Director.
