DISCUSSION: In response to all the flood related damage caused by winter rains, Senator Jack O'Connell has sponsored Senate Bill lx. This bill, as proposed, will require the State to pick up the local share of all the flood damage costs from this winter season. Currently, Federal Emergency Management Agency (FEMA) regulations require state and local governments to pay for 25% of the costs associated with a natural disaster. Of that 25%, the State is responsible for three- quarters (18.75%); local government is responsible for the remaining quarter (6.25%). Under Senator O'Connell's legislation, the State would pick up the City's 6.25% share for all flood damage to City infrastructure (e.g., streets, bridges, etc.) experienced this winter. Similar legislation was enacted after the Loma Prieta and Northridge earthquakes. Because Senator O'Connell anticipates that there will be opposition to Senate Bill lx, he has requested the City to adopt a resolution supporting the legislation. Clearly, this legislation would greatly benefit the City. As such, staff has prepared a resolution supporting Senate Bill Ix for the Council's approval, ATTACHIIENTS: Resolution RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO SUPPORTING SENATE BILL lx SPONSORED BY SENATOR O'CONNELL WHEREAS, the City of San Luis Obispo has experienced significant damage to public infrastructure caused by flooding during heavy storms in January and March of this year; and WHEREAS, the flooding that took place during the most recent storms in March was so damaging that on March 10, 1995, the Mayor of the City of San Luis Obispo, issued a declaration of local emergency; and WHEREAS, preliminary flood damage estimates for the January and March 1995 winter floods will likely total nearly $1 million to the City of San Luis Obispo; and WHEREAS, Senate Bill lx proposes to require the State to pick up the City's share of flood damage costs resulting from this winter season's harsh storms (which equates to 6.25% of the total costs under FEMA regulations); and WHEREAS, the City's ability to deliver essential services to our residents will be greatly impacted without increased State assistance for flood damage costs as provided for in Senate Bill lx. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Luis Obispo that it fully supports Senate Bill lx and urges the State Legislature to adopt the bill and forward it to the Governor for signature as soon as possible.
