Per 16.15.030(B), the requested exceptions are to be granted only if the director can affirmatively determine that the exceptions requested are “based on site development feasibility where there are no other options for other design alternatives such as modifying footprint, moving lot lines, adding stories, or reducing floor area (to minimum eight hundred square feet) and where the applicant has demonstrated it is physically not possible to redesign the project to avoid the necessity of exceptions.” The project narrative states that “[it] is physically not possible to redesign the project to avoid the necessity of the requested exceptions.” However, the submitted materials do not adequately show why modifying the footprint of the existing residence (to minimum eight hundred square feet) to allow the proposed Parcel 1 access to the public right-of-way of San Marcos Ct. is physically not possible. Keep in mind, 16.15.030(A) states that “[for] the purpose of these requirements, existing improvements or development is not considered a physical constraint.” 2. Provide the length of the portion of the north-westerly parcel line that runs adjacent to the access easement noted on the map. 3. Map indicates that a shed near the bottom left corner of the proposed Parcel 2 will be moved. Note where this shed will be moved to and provide distances to nearby parcel lines to ensure setbacks are met. 4. Note the name (500 year Flood Zone) and location of the nearby flood hazard zone area. Page 2 5. Note the location of the subdivision exceptions requested (as described in the project narrative) on the map. 6. The symbol legend on the map notes a preliminary title report dated “9-19-2024” regarding exceptions listed under said PTR. The PTR provided in your application is dated “October 25, 2024.” Ensure that the exceptions noted on the map are consistent with the exceptions listed in the PTR provided in your application. 7. Note the width of San Marcos Court and the centerline curve radius of the cul-de-sac on the map. The parcel map preparation and monumentation shall be in accordance with the City’s Subdivision Regulations, Engineering Standards, and the Subdivision Map Act. 2. Utility abandonments, utility relocations/alterations, and parking improvements shall be completed with the appropriate building permits to the satisfaction of the City. The required improvements may be deferred to after map recordation if terms under the Urban Lot Split code allow. 3. Any easements including but not limited to provisions for all overhead and underground private utilities, access, grading, drainage, slope banks, construction, common driveways, common areas, and the Page 3 maintenance of the same shall be shown on the final map and/or shall be recorded separately prior to map recordation if applicable. Said easements map be provided for in part of in total as blanket easements. 4. Separate utilities, including water, sewer, gas, electricity, telephone, and cable TV shall be served to each parcel/lot to the satisfaction of the Public Works Director and serving utility companies. A private common sewer main may be proposed to the satisfaction of the Building Official, Utilities Engineer, and Public Works Director. The building plan submittal shall show and label the location of all existing and proposed utility locations including any surface and/or sub-surface drainage improvements. Show the proposed water and sewer easement on Parcel 2 (front parcel). While the property is currently under sole ownership, there is a potential for sale of one or both of the lots to be sold without the established required easements. 2. The City’s records show that the existing lateral was inspected in September 2024. The report notes the condition as “poor” due to a break in the lateral. Pursuant to City Municipal Code Section 13.08.395: “h. For events identified in subsections (C)(1)(a) through (C)(1)(f) of this section [which include subdivision of a property], repair or replacement shall be made pursuant to subsection G of this section.” Replacement of the existing sewer lateral will be required prior to recordation of the final map.
