ARC 26-99; 3427 Roberto Court: Review of a new 5,000 square foot auto service building and environmental review; M zone; Leon and David Maksoudian, applicants. Peggy Mandeville, Associate Planner, presented the staff report recommending approval of a Negative Declaration with Mitigation Measures, and final approval to the project, with details to return to staff, based on findings, and with conditions and code requirements. Tim Ronda, project representative, described the project design. David and Leon Maksudian, applicants, explained the project and described the proposed use. The Public Hearing was opened. Paul Allen, Air Pollution Control District and neighbor, mentioned that the on -street parking was very restrictive and suggested that the design include adequate parking. The Public Hearing was closed. COMMISSION COMMENTS: Commissioner Howard stated that it was refreshing to see that the applicant has met all of the code regulations and the architecture is acceptable for the location. Commissioner Lopes said that the parking requirements were not fully explained in the staff report and agreed that the architecture is consistent with the surrounding uses and treatment throughout the site, but he can't support the project as it is. Commissioner Rawson agreed that the building was nice looking for the type of use and area. He also believed that the parking requirements have been met. Commissioner Stevenson liked the building design at the given location. He had some concern about parking, however, parking does meet the ordinance requirements. He also said that he would support omitting condition #4. Commissioner Metz concurred with everyone regarding the consistency of the architecture and felt the break area was a good idea, but perhaps in a different location. Commissioner Rawson stated that the parking was adequate if it met the parking regulations and he liked the building architecture. Minutes ARC Meeting April 19, 1999 Page 5 Commissioner Aiken said that he felt the building design was appropriate and parking is an issue, but it met the requirements. He would also like to see a picnic area included. Commissioner Stevenson would consider slump block at the building entry to protect building. Commissioner Stevenson moved to approve the Negative Declaration with mitigation measures and grant final approval of the project based on findings, conditions, and code requirements noted in the Meeting Update; the requirement for the applicant to be responsible for providing a running total of the site's parking requirements and allocations with the submittal of any Planning or Building permits for tenant improvements, and with Building Condition #4 amended to read as follows: 4. A 4 foot wide accessible path of travel from the public right of way to the building entrance to be provided as required. The motion was seconded by Commissioner Howard. Review of a new convenience store, car wash, and site changes to n existing gas station; C-N zone; Equilon Enterprises, applicant. Peggy Mandeville, Associate Pla' ner, presented the staff report recommending the continuation of the project to a date uncertain with specific direction on: building and canopy design, including building materials and color scheme; signage, including the number of signs, signage area and fhe, non -conforming pole sign; and screening of service station/car wash structure. Doug Massaro, applicant's representative, 'explained the changes in the pole sign replacement and described the project, including the brick work, planter box, and building location. The Public Hearing was opened. Randy Poltl, Poltl and Associates, 1328 Madonna Road, explained how he had worked with Shell in the past on tie previous design but this was the first time he had seen the present design. Dear Messrs. Maksoudian: The Architectural Review Commission, at its meeting of April 19, 1999, approved the Negative Declaration with mitigation measures, and granted final approval to your project, based on the following findings and subject to the following conditions and code requirements: Findings 1. The proposed building complies with property development standards for the M, Manufacturing, zone. 2. The proposed scale and design of the building will be compatible with surrounding service -commercial and manufacturing uses. Conditions 1. Final project design shall be in substantial compliance with the plans, as amended and approved by the ARC. 2. All of the mitigation measures listed below and contained in Initial Environmental Study, ER-20-99 shall be made conditions of approval. a) The applicant shall submit a detailed soils engineering report needs to be .submitted at the time of building permit application. The soils report shall consider special grading and construction techniques necessary to address the potential hazards associated with the underlying sub -strata. The report shall identify the soil profile on site and provide site preparation recommendations to ensure against unstable soil conditions. ARC 26-99 — Page 2 b) Oil/sand separators or other industrial waste pretreatment facilities shall be installed to the satisfaction of the City's Industrial Waste Coordinator. The separator must be regularly maintained to ensure efficient pollutant removal. c) Future site development shall incorporate, as feasible: • Skylights to maximize natural day lighting. • Operable windows to maximize natural ventilation. • Energy -efficient lighting systems for both interior and exterior use. d) The property owner shall grant an avigation easement to the County of San Luis Obispo via an avigation easement document prepared by the County. e) The new building shall incorporate facilities for interior and exterior on -site recycling. In addition, site development shall include a solid waste recycling plan for recycling discarded building materials, such as concrete, sheetrock, wood, and metals, from the construction site. The plan must be submitted for approval by the Community Development Director, prior to building permit issuance. 3. Final Landscape plans, signage and lighting details shall return to Planning staff for review and approval at the time that working drawings are submitted for a building permit. Building Conditions 4. A 4 foot wide accessible path of travel from the public right of way to the building entrance to be provided, as required. 5. Instead of using 3-3 inch cast iron drain pipes to convey runoff to the street, it would be more practical maintenance wise to use 1-6 inch drain pipe that transitions to a rectangular under sidewalk drain. Public Works Conditions 6. The Applicant shall provide bicycle parking consistent with provisions of Section 17.16.060 of the San Luis Obispo Zoning Regulations. Consistent with these regulations. 7. One inverted "U" bike rack shall be installed in close proximity to the project office space that is closest to Roberto Court. A location to the right of this space's entrance as you face the building from the parking lot is appropriate. A second inverted "U" rack is recommended for installation in the space marked "Bike Space" at the rear of the project site. ARC 26-99 -- Page 3 8. One bicycle locker capable of accommodating at least one bicycle shall be provided on site. A lockable room within the building that is accessible to employees that bicycle to work is an acceptable alternative to the bicycle locker. 9. All bicycle parking spaces that are provided in excess of what is required shall be apportioned between short-term and long-term bicycle spaces as stipulated by Table 6.5 of the Zoning Regulations. 10.As a trip reduction measure, the landscaped area at the rear corner of the project site should incorporate benches, a table and a trash container to allow its use as an employee lunch/break area. 11. The applicant shall be responsible for providing a running total of the site's parking requirements and allocations with the submittal of any planning or building permits for tenant improvements. Code Requirements A. Street trees are required to be planted per City Standards (the number of trees is determined by one tree per 35 linear feet of street frontage). B. Traffic impact fees are required to be paid prior to the issuance of a building permit. C. Water and wastewater impact fees are required to be paid prior to issuance of a building permit. Credit shall be given for any prior water acreage charges paid with the subdivision. D. Tank Farm Rd. Sewer Lift Station Fees are required as a condition of a building permit. E. A water allocation is required, due to the construction of a new building. Currently, a water allocation can only be obtained through the water retrofit program. The City's Water Conservation division can help in determining the needed allocation and the necessary number of retrofits. Water Conservation can be reached by calling 781- 7258. F. Water and Wastewater Impact Fees shall be paid at the time building permits are issued. Credit for prior water acreage fees paid under the subdivision shall be given, pursuant to City regulations. Both the Water and the Wastewater Impact Fees are based on the size of the water meter serving the project. The cost of developing an allocation through retrofit could offset a portion of the required Water Impact Fee according to appropriate City policies. G. The building may be required to have oil/sand separators or other industrial wastewater pretreatment facilities on the sewer lateral and/or the site drainage system. The developer shall coordinate with the City's Industrial Waste Coordinator, Dale Karnes, at 781-7425. ARC 26-99 -- Page 4 The decision of the Commission is final unless appealed to the City Council within 10 days of the action. While the City's water allocation regulations are in effect, the Architectural Review Commission's approval expires after three years if construction has not started, unless the Commission designated a different time period.
