Walter, Director of Public Work s Prepared By :Diane Dostalek/Hal Hannula, Development Revie w SUBJECT :FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR ORCUTT ROA D FRONTAGE AND SACRAMENTO DRIVE FOR TRACT 2707 –A RESIDENTIAL CONDOMINIUM SUBDIVISION AT 953 ORCUTT ROA D (CITYVIEW LAUREL CREEK ) RECOMMENDATIO N Adopt a resolution : 1.Accepting the public improvements for the Orcutt Road frontage of Tract 2707 ; and 2.Accepting a majority of the public improvements for Sacramento Drive of Tract 2707 ; an d 3.Releasing the securities for Orcutt Road and Sacramento Drive, and collecting a new securit y to guarantee completion of the remaining public improvements for Sacramento Drive ; an d • 4 . Authorizing the Director of Public Works to accept the remaining Sacramento Drive publi c improvements and to release the remaining Sacramento Drive security once completed . DISCUSSIO N Backgroun d The tentative subdivision map for Tract 2707 (TR 151-03) was approved by City Council o n November 15, 2005, by Resolution No . 9748 (2005 Series), which authorized creation of a 23-lo t subdivision for the purpose of creating 178 residential condominium units . (See Attachment 1 fo r vicinity map and Attachment 2 for site plan .) The final map was approved by City Council o n September 18, 2007, by Resolution No . 9928 (2007 Series). Mitigation Measure TR/mm-4 in the Four Creeks Environmental Impact Report, of which Trac t 2707 is a part of, required widening of Orcutt Road to four lanes from Broad Street to the Unio n Pacific Railroad tracks near Laurel Lane . Most of the widening occurred along the frontage of Trac t 2707, but a portion of it occurred along the frontage of a piece of property to the west referred to a s the Creekston property . The subdivider of Tract 2707 entered into a reimbursement agreemen t approved by Council on October 2, 2007, to do the widening along the Creekston frontage . Th e subdivider submitted separate improvement plans, securities, and record drawings for that work . The subdivider completed that work and the Orcutt Road frontage improvements along th e Creekston property were accepted by City Council on June 1, 2010 . The subdivider has completed the Orcutt Road frontage improvements for Tract 2707 and most o f the improvements to Sacramento Drive . The subdivider has requested that the City accept the publi c improvements and release the securities guaranteeing completion of the improvements . • C2-1 FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR ORCUTT ROA D FRONTAGE AND SACRAMENTO DRIVE FOR TRACT 2707 Page 2 Accepting the Public Improvements for the Orcutt Road Frontage of Tract 270 7 The public improvements along the Tract 2707 Orcutt Road frontage include street widening, raise d median, curb, gutter, sidewalk and multi-use path, street lights, water services, fire hydrants , reclaimed water main, fiber optic line, storm drain head walls, storm drain lines and inlets, and a bus pullout with shelter . All of the Orcutt Road frontage improvements have been completed to the satisfaction of the City . However, the subdivider is still required to dedicate an easement for the bus pullout on Orcutt Road . Accepting a Majority of the Public Improvements for Sacramento Drive of Tract 270 7 The public improvements for Sacramento Drive of Tract 2707 include extending Sacramento Driv e from its previous terminus south of Tract 2707 to Orcutt Road, constructing a bridge ove r Alrita-Carla Creek, curb, gutter, sidewalk, driveways, street lights, storm drain lines, water main , reclaimed water main, sewer main, and fiber optic line . The street lights along Sacramento Drive have been installed and are working, but they are no t wired per City standards . The subdivider is using a temporary service point and wiring for thes e lights . Therefore, the City is not accepting the street lights along Sacramento Drive at this time . Cost for electrical service and maintenance of the street lights along Sacramento Drive shall be th e responsibility of the subdivider until such time as the street lights are accepted by the City . Furthermore, in lieu of the City standard driveway on the west side of Sacramento Drive, th e subdivider installed temporary asphalt sidewalk and asphalt berm . For general location of the futur e driveway on the west side of Sacramento, see Attachment 2 . The subdivider will remove th e temporary improvements and install permanent City standard improvements upon development o f the housing units on the west side of Sacramento Drive . The cost to maintain these temporar y improvements shall be the responsibility of the subdivider until such time as City standar d permanent improvements are constructed and accepted . The subdivider is still required to dedicate an easement for a portion of Sacramento Drive and th e bridge abutments that are outside the current right-of-way . Maintenance of the creeks within Tract 2707 shall be the responsibility of the subdivider or hi s assigns . Releasing Securities for Orcutt and Sacramento, and Collecting New Security for Sacrament o The total estimated construction cost for the Tract 2707 Orcutt Road and Sacramento Drive publi c improvements is $1,285,740 . A security in the amount of $128,600, or 10 percent of the estimate d construction cost, will be sufficient to guarantee completion of the remaining improvements o n Sacramento Drive . The $128,600 security will also serve as the guarantee that the subdivider wil l remedy any defects in the improvements arising from faulty workmanship or materials or defectiv e construction of said improvements occurring within 12 months after acceptance of th e improvements in accordance with Sections 66499 .7 and 66499 .9 of the Government Code of th e State of California . T:1Council Agenda Reports\2 01 212 01 2-01-1 7\C2-Tract 2707 Cityview Laurel Creek (Walter-Hannula-Dostalek)\E-Council Agenda Report .docx • • • C2-2 • • FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR ORCUTT ROAD FRONTAGE AND SACRAMENTO DRIVE FOR TRACT 2707 Page 3 Once the subdivider has completed the record drawings for Orcutt Road and Sacramento Drive , submitted the $128,600 security to guarantee completion of the remaining Sacramento Driv e improvements and to warranty all of the improvements for one year after acceptance, and submitte d the Certificate of Deposit(s) to guarantee completion of the Orcutt Road and Sacramento Driv e easements in an amount approved by the Director of Public Works, then the $1,285,740 securit y will be released. The City is still retaining two additional securities to guarantee the completion of on-site public an d private improvements east and west of Sacramento Drive . The on-site work has not yet bee n completed . The draft resolution (Attachment 3) also authorizes the Public Works Director to accept th e remaining Sacramento Drive public improvements and to release the remaining Sacramento Driv e security on behalf of the City Council once the work is completed to the satisfaction of the Cit y Engineer . CONCURRENCE S The Community Development Director and Utilities Director concur with the recommended action . FISCAL IMPAC T Typical maintenance and operation of public facilities will be required for the street and utilit y improvements . NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Lui s Obispo as follows : SECTION 1 .The City Council hereby accepts the Orcutt Road frontage improvement s for Tract 2707 . SECTION 2 . With the exception of the street lights along Sacramento Drive and th e temporary asphalt berm and sidewalk on the west side of Sacramento Drive, the City Counci l hereby accepts the Sacramento Drive public improvements for Tract 2707 . SECTION 3 .The Faithful Performance security in the amount of $1,285,74 0 guaranteeing completion of the Orcutt Road and Sacramento Drive public improvements may b e released upon submittal of the following items : 1.Approved record drawings for Orcutt Road and Sacramento Drive ; and 2.A $128,600 security to guarantee completion of the remaining Sacramento Driv e improvements and to warranty all of the improvements for one year after acceptance ; and 3.Certificate of Deposit(s) to guarantee completion of the Orcutt Road and Sacrament o Drive easements in an amount approved by the Director of Public Works . SECTION 5 .The Director of Public Works is hereby authorized to accept the remainin g Sacramento Drive public improvements and to release the remaining Sacramento Driv e securities on behalf of the City Council once the work is completed to the satisfaction of the Cit y Engineer . SECTION 6 .The security guaranteeing the workmanship and materials may be release d by the Director of Public Works upon the successful completion of the 12 month warranty tim e period from the date of acceptance of the improvements .
