FIRE STATION HEADQUARTERS (NEUMANN/95-19B - 30 min.) Consideration of awarding a contract for construction of the new Fire Station Headquarters. • RECOMMENDATION: By motion, 1) award a construction contract in the amount of $1,865,865 to Maino Construction of San Luis Obispo for base bid for "Headquarters Fire Station, Specification No. 95-19B;" and, 2)Accept alternate bids 1, 2, 3 and 4 totalling $307,146 for a project bid total of $2,173,011. *NEUMANN FINAL ACTION. IN THE COUNCIL CHAMBER. 2 1II1ImIgg Will city � Meeting Date: May 9, 1995 Intl c>I o san tut s OBISPO COUNCIL AGENDA REPORT Item Number: 1 FROM: Bob Neumann, Fire Chief& SUBJECT: Headquarters Fire Station Specification No. 95-19B CAO RECOND4ENDATIONS By motion, 1) Award a construction contract in the amount of$1,865,865 to Maino Construction of San Luis Obispo for base bid for "Headquarters Fire Station, Specification No. 95-19B". 2) Accept alternate bids 1, 2, 3 and 4 totalling $307,146 for a project bid total of$2,173,011. DISCUSSION On March 21, 1995, the Council approved plans and specifications for the Headquarters Fire Station project and 'authorized staff to advertise for bids on a construction contract. Public Works opened bids on May 2, 1995, at 2:15 p.m., and Maino Construction of San Luis Obispo submitted the low base bid of$1,865,865 and alternate bids of$307,146 for a total amount of$2,173,011. The bids appear reasonable and appropriate according to the following information: Number of Bidders: 7 Next Low Bid Total: 2,207,015 High Bid Total: 21486,000 The bid documents incorporated the following four bid alternates: Alternate 1 - Construction of all off-site improvements including revisions to existing traffic signal ($154,947). Alternate 2 - Construction of the 3-story training tower ($113,375). Alternate 3 - Construction of concrete pad surrounding the Training Tower ($20,486) for increased wearability and durability of surface in lieu of asphalt pavement. Alternate 4 - Provide and install an automatic-gate operation system for site security ($18,338). FISCAL IMPACT On February 28, 1995, staff reported to the Council that the Headquarters Fire Station project, based on the Engineer's cost estimate, was overbudget by $672,900. Upon bid opening, staff is pleased to report that the successful apparent low bidder is considerably below the Engineer's estimate allowing a reduction of$217,900 from the amount reported in February. city of San Luis OBlspo COUNCIL AGENDA REPO-RT-- Staff can now more accurately predict, based on actual demolition work completed and incorporating the low bid, that $455,000 is the amount of additional funding necessary to be added to the original 1989 estimate of$2,706,800. This incorporates an 8% contingency factor of$185,000 bringing the total predicted project cost to.$3,161,700. The following table reflects the actual differences between the Engineer's cost estimate and the low bidder's response for.the construction phase of the project. Summary of Headquarters Fire Station Costs Contract Agreement AGREEMENT THIS CONTRACT AGREEMENT (the "Agreement") is made and entered into this day of , 19 by and between the City of San Luis Obispo (the "City") , and (Complete one of the following) : a. Corporation: Maino Construction Company. Inc (Insert corporation name) a corporation organized and existing under the laws of the State of California (Insert name of state) b. Partnership: (Insert name of partnership) C. Individual: (Insert name of individual) doing business as (Insert dba name) (the "Contractor") . In consideration of the mutual covenants, conditions, promises and agreements herein contained, the City and Contractor agree as follows: SECTION 1 - SCOPE OF WORK: Contractor agrees to furnish all tools, equipment, apparatus, facilities, labor, materials, transportation and utility services and incidentals necessary to fully perform and complete, in a workmanlike manner, and in strict accordance with the Contract Documents (as defined in Section 15 below) , including without limitation the drawings and specifications included therein, the work (the "Work") of: Main Fire Station No. 1 Specification No. 95-19B It is understood and agreed that such tools, equipment, apparatus, facilities, labor, materials, transportation and utility services and incidentals shall be furnished, and the Work performed and completed, as required in such drawings and specifications, under the direction and supervision of, and subject to the approval of, the City and the City's duly authorized representatives. 25 /-3 Contract Agreement SECTION 2 - TIME OF COMPLETION: Contractor hereby agrees to commence the Work within ten (10) calendar days from the date of Contractor's receipt of the City's "Notice to Proceed", and to diligently prosecute the same to completion within three hundred and four (304) calendar days (per Addendum 103, dated 4/27/95) after such date, except as adjusted by any subsequent change order. Time is of the essence in this Agreement. SECTION 3 - CONTRACT PRICE: The City will pay Contractor in current funds as full consideration for the full and complete performance of this Agreement the sum of Two million. one hundred and seventy-three thousand and eleven and no/100 Dollars ($2, 173, 011. 00) based on the following breakdown of bid results per the Bid Form: Base bid: +One million, eight hundred and sixty-five thousand. eight hundred and sixty-five and no/100 Dollars ($18865,865.00) Additive Alternate No. i- Off-site Improvements +One hundred and fifty-four thousand nine hundred and forty-seven and no/100 Dollars ($154,947.00) . Additive Alternate No. 2- Training Tower +One hundred and thirteen thousand, three hundred and seventy-five and no/100 Dollars ($113,375.00) . Additive Alternate No. 3- Concrete Pad surrounding Training Tower +Twenty thousand, four hundred and eighty-six and no/100 Dollars ($20,486.00) . Additive Alternate No. 4- Automatic Gate Operators and Equipment +Eighteen thousand, three hundred and thirty-eight and no/100 Dollars ($18,338.00) . subject to subsequent contract change order(s) , for furnishing all materials and for doing all the Work contemplated under this Agreement; for all loss or damages arising out of the nature of the Work, or from the action of the elements, or from any unforeseen difficulties or obstructions which may arise or be 26 ,r� Contract Agreement encountered in the prosecution of the Work, until the Work is accepted by the City; for all expenses incurred by or in consequences of the suspension or discontinuance of the Work; and for well and faithfully completing the Work, the whole thereof, in the manner and in accordance with the Contract Documents therefore and the requirements of the City under them. SECTION 4 - BONDS• Prior to execution of this Agreement, Contractor shall obtain a Performance Bond and Payment Bond, each in the form included in the Contract Documents. SECTION 5 - DELAYS• If, after the Work has been substantially completed, full completion thereof is materially delayed through no fault of Contractor and the City so certifies, in its sole discretion, the City shall, without terminating this Agreement, make payment of the balance due for that portion of the Work completed and accepted. Such payment shall be made under the terms and conditions governing final payment, except that it shall not constitute a waiver of any claims by the City. SECTION 6 - INSURANCE• Contractor shall maintain general liability, automobile liability and builder's risk insurance for the duration of this Agreement in accordance with the Insurance Requirements Division. Contractor shall furnish the City with such Certificates of Insurance as are required under the Insurance Requirements Division. SECTION 7 - WORKER'S COMPENSATION AND EMPLOYER'S LIABILITY By my signature hereunder, as Contractor, I certify that I am aware of the provisions of Section 3700 of the Labor Code which requires every employer to be insured against liability for worker's compensation or to undertake self-insurance in accordance with the provisions of that code, and I will comply with such provisions before commencing the performance of the Work under this Agreement. Contractor shall furnish the City with a certificate evidencing Worker's Compensation Insurance with limits as established by the State of California, and Employer's liability in amount specified in the Insurance Requirements Division. 27 Contract Agreement SECTION 8 - CHANGE ORDERS: It is agreed that the City's Fire Chief is authorized to execute change orders necessary to the prosecution of the Work. SECTION 9 - .EXTRA WORK: Contractor hereby agrees that it will not proceed with any extra work unless it has been authorized in writing to do so by the Fire Chief prior to the commencement of said extra work. SECTION 10 - PREVAILING WAGES: Contractor hereby agrees that Contractor and any subcontractor under it shall pay not less than the general prevailing rates of wages, as determined by the Director of the Department of Industrial Relations, to all workers employed in the execution of" this Agreement and the performance of the Work, and shall submit to the City certified copies of the payroll records for all such workers upon request. Contractor assumes all responsibility for such payments and shall indemnify and hold the City harmless from any and all claims made by the State of California, the Department of Industrial Relations, any subcontractor, any worker or any other third party with regard thereto. Contractor shall post a copy of the prevailing rate of per diem wages applicable to the Work at the job site upon the commencement of, and throughout the continuation of, the Work. SECTION 11 - GUARANTEE FOR WORK: Contractor hereby agrees that it will post a Guarantee of Work in the form included in the Contract Documents after final inspection of the Work by the City and the completion of required corrections and/or repairs. Such Guarantee of Work shall guarantee Contractor's workmanship and materials for a period of one year from the date of recording of the Notice of Completion and Acceptance .by the City. SECTION 12 - RELEASE: Upon payment of undisputed amounts under this Agreement, Contractor shall execute a Release in the form included in the Contract Documents. Such Release shall not apply to disputed contract claims in amounts specifically excluded by Contractor from the operation of the Release. 28 Contract Agreement SECTION 13 - BINDING AGREEMENT ASSIGNMENT: The parties do for themselves, their heirs, executors, administrators, successors and assigns, agree to the full performance of all of the provisions herein contained. Contractor may not, either voluntarily or by action of law, assign any obligation assumed by Contractor hereunder- without the prior written consent of the City. SECTION_ 14 - ATTORNEY'S FEES: In any legal action or proceeding arising out of or related to this Agreement or the Contract Documents, the prevailing party shall recover, in addition to all other relief, its reasonable attorney's fees and court costs. SECTION 15 - CONTRACT DOCUMENTS: The full, complete and exclusive agreement between the parties hereto shall consist of the following identified documents (the "Contract Documents" Notice Inviting Formal Bids, Instructions to Bidders, Information Available to Bidders, Bid Form, Designation of Subcontractors, Non-Collusion Affidavit, Bidder's Bond, this Agreement, Performance Bond, Payment Bond, Maintenance Bond, Insurance, Guarantee of Work, Release, General Conditions, Specifications, Soils Report, and attached supplemental information, drawings, any addenda, and any change orders, field orders or directives issued pursuant to and in accordance with this Agreement. 29 P7 Contract Agreement IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day and year first above written.
