CAO RECOMMENDATIONS: By motion: 1) award a contract to R. Baker Inc. in the amount of$167,752.00 for "Storm Drain Improvement Project: Lizzie - Johnson to Wilding, Specification No. 95-39- 2) authorize the CAO to execute the contract 3) appropriate $188,400 in FEMA/OES reimbursement revenue to the project account 4) appropriate$12,600 from the general fund unappropriated balance to the project account DISCUSSION: When the Lizzie Street storm drain plugged up during the March storms, water broke out of the existing concrete box culvert and damaged driveways and utilities. Water also flooded a residence on Fixlini Street, which has flooded in other storms as well. The existing box culvert needs to be replaced and relocated because it is damaged and the City has no drainage easement to allow for routine cleaning or repair where the culvert runs under private property or is overlaid with improvements. Storm response crews blocked the channel at the culvert entrance above Wilding Lane and diverted water into the street. The Army Corps of Engineers considers this kind of blockage illegal, and the engineering staff has notified the Corps of the emergency diversion. The engineering staff immediately prepared plans for a project to bypass the existing storm drain for the length of Lizzie Street and reconnect at Johnson Avenue. The CAO authorized staff to advertise for bids on a construction contract to be awarded by the Council. Some area residents are concerned about loss of water flow through a portion of the.natural channel just below Wilding Lane. To alleviate this concern, the plans provide for water from a natural spring to run through this channel and include a pipe at the storm drain entrance which will carry most flows into the original channel. Large storm flows will be diverted to the new system to avoid flooding downstream. . FISCAL IMPACT-: Contract Amount $167,752 -Contingencies 33.248 $201,000 The estimated contingencies amount is unusually high because this is an emergency repair with many potential complications. There is no existing appropriation for this project. The Federal Emergency Management Agency(FEMA)will reimburse the City 75 percent of project expenses. Likewise, the state Office of Emergency Services (OES)will reimburse the City 18.75 percent of project expenses. The remainder will have to come from the general fund unappropriated balance. WITNESSETH: That the Owner and the Contractor for the consideration stated herein agree as follows: ARTICLE 1, SCOPE OF WORK: The Contractor shall perform everything required to be performed, shall provide and furnish all of the labor, materials, necessary tools, expendable equipment, and all utility and transportation services required to complete all the work of construction of: Storm Drain Replacement Proiect: Lizzie St - Johnson to Wildine Snecilication No 95-z9 in strict accordance with the plans and specifications therefor, including any and all Addenda, adopted by the Owner, in strict compliance with the Contract Documents hereinafter enumerated. It is agreed that said labor,materials,tools,equipment,and services shall be furnished and said work performed and completed under the direction and supervision and subject to the approval of the Owner or its authorized representatives. ARTICLE II, CONTRACT PRICE: The owner shall pay the Contractor as full consideration for the faithful performance of this Contract,subject to any additions or deductions as provided in the Contract Documents,the contract prices as follows: Approximate Unit Item Quantity Item with Unit Price Written in Words Price Total L 760 42" RCP storm drain for the unit price of one $138.00 $104,880.00 hundred thirty-eight dollars and no cents per lineal foot. 2. 75 24" RCP storm drain for the unit price of $88.00 $6,600.00 eighty-eight dollars and no cents per lineal foot. 3. 20 18" RCP storm drain for the unit price of sixty- $65.00 $1,300.00 five dollars and no cents per lineal foot. 4. 5 Storm drain manhole (including connection of $2,160.00 $10,800.00 all storm drains) for the unit price of two thousand one hundred sixty dollars and no cents each 5. 3 Catch basin (including connection of all storm $5,725.00 $17,175.00 drains) for the unit price of five thousand seven hundred twenty-five dollars and no cents each. - 1 - C-�-y Approximate Unit Item Quantity Item with Unit Price Written in Words Price Total 22. 1 Comply with OSHA for the lump sum price of $890.00 $890.00 eight hundred ninety dollars and no cents. 23. 1 Establish lines and grades for the lump sum $2,000.00 $2,000.00 price of two thousand dollars and no cents. TOTAL: $167,752.00 Payments are to be made to the Contractor in accordance with and subject to the provisions embodied in the documents made a part of this Contract: Should any dispute arise respecting the true value of any work omitted, or of any extra work which the Contractor may be required to do, or respecting the size of any payment to the Contractor, during the performance of this Contract, said dispute shall be decided by the Owner and its decision shall be final, and conclusive. ARTICLE III, COMPONENT PARTS OF THIS CONTRACT: The Contract consists of the following documents, all of which are as fully a part thereof as if herein set out in full, if not attached, as if hereto attached: 1. Notice to Contractors and Information for Bidders. 2. Standard Specifications, Special Provisions and Engineering Standards. 3. Accepted Proposal 4. Public Contract Code Section 10285.1 Statement and 10162 Questionnaire. 5. Noncollusion Declaration. 6. Plans. 7. List of Subcontractors. 8. Agreement and Bonds. 9. Insurance Requirements and Forms. ARTICLE IV. It is further expressly agreed by and between the parties hereto that should there be any conflict between the terms of this instrument and the bid or proposal of said Contractor, then this instrument shall control and nothing herein shall be considered as an acceptance of the said terms of said proposal conflicting herewith.
