Beverly Ensing opposed plans to spend $50,000 on a consultant for traffic calming on Chorro. P.C.2. Lise Haines requested modification of the traffic table on Chorro, the removal of pylons and expressed concerns about the cost of the traffic table solution. P.C.3. Jeff Wagner stated the traffic table on Chorro was not severe enough to slow vehicles and objected to the skateboard/rollerblade ban in the downtown. P.C.4. Sheldon Smith stated the traffic table on Chorro was ineffective and ugly and requested time with the Council to discuss the issue. Council study session to be set for 7/25/95 (consensus). P.C.5. FINAL ACTION: Approved (5-0). ► C-2 SALINAS WATER RIGHTS PERMIT MODIFICATION (MOSS/1104) Consideration of modifying the City of San Luis Obispo's Water Rights Permit (5882) for the Salinas Reservoir. • RECOMMENDATION: By motion, approve Stipulated Agreement for Permit 5881 of the U.S. Army Corps of Engineers and Permit 5882 of the City of San Luis Obispo. FINAL ACTION: Approved (5-0). ► C-3 LOCAL AGENCY/STATE MASTER AGREEMENT SUPPLEMENT (McCLUSKEY/93-44) Consideration of a supplement the local Agency/State Master Agreement for Federal Aid projects for "Bridge Replacement Project - Santa Rosa Street at San Luis Obispo Creek," Specification No. 93-44. • RECOMMENDATION: Adopt resolution approving Program Supplement No. 014 to the Local Agency/State Master Agreement for Federal Aid Projects No. 05-5016. FINAL ACTION: Resolution No. 8434 adopted (5-0). ► C-4 PROPERTY ACQUISITION - 972 NIPOMO STREET (McCLUSKEY/168) Consideration of the purchase of the property known as 972 Nipomo Street, APN 002-412-002, from Development Services, Inc. in the amount of $225,000; funding to be provided by the parking fund. • RECOMMENDATION: By motion, approve and authorize the Mayor to execute the contract. FINAL ACTION: Approved A-10-95-CC (5-0). 2 Council Agenda t Wednesday, July 5, 1995 ` ► C-5 BIA ADMINISTRATOR CONTRACT (SLATE/471) Consideration of approving a contract of employment between the City and Deborah J. Holley, Business Improvement Association Administrator, for the period July 10, 1995 through July 10, 1996. ♦ RECOMMENDATION: Adopt resolution approving employment contract. FINAL ACTION. Resolution No. 8435 adopted, BIA Board of Directors to look at health benefits (5- 0). ► C-6 DELINQUENT SOLID WASTE ACCOUNTS (MOSS/142) Consideration of authorizing the San Luis Obispo County Assessor to assess the amounts due to San Luis Garbage Company on delinquent accounts for provision of solid waste collection and disposal services. ♦ RECOMMENDATION: Adopt resolution authorizing collection of delinquent solid waste collection and disposal accounts. FINAL ACTION. Resolution No. 8436 adopted (5-0). ► C-7 ELKS LANE BRIDGE REPLACEMENT (McCLUSKEY/L-10H) Consideration of plans and specifications for "Bridge Replacement and Street Reconstruction Project; Elks Lane, City Plan No. L-10H," estimated to cost $696,000 including contingencies with $469,000 reimbursement available from a federal highway Bridge Replacement and Rehabilitation grant. (Plans and specifications are available in the Council Office for review.) ♦ RECOMMENDATION: By motion: 1) approve plans and specifications; 2) authorize staff to advertise for bids; 3) authorize the CAO to award the construction contract if no additional appropriations are needed at time of the award; and, 4) appropriate an additional $480,300 in grant revenue and an additional $397,300 for project expense. FINAL ACTION. Approved (5-0). ► C-8 PRESCHOOL PROGRAM (LeSAGE/812) Consideration of a preschool program at the Santa Rosa Recreation Center. ♦ RECOMMENDATION: By motion, approve selection of Parent Cooperative Preschool applicant to become the new preschool provider, and adopt resolution approving the lease agreement and authorizing Mayor to execute. FINAL ACTION. Vice Mayor Romero said that the County no longer supported the new Regional Transit funding formula which would be coming before the Board of Supervisors in October. Vice Mayor Romero to represent the City Council at that meeting (general consent). Comm. 2. Mayor Settle told Council he had looked over the County's Energy Element and suggested that staff look at it. City Administrative Officer Dunn said that it had been referred to the Community Development Director for analysis. Comm. 3. Council Member Roalman asked Council if they would be interested in reviewing the Parking Fund at a future meeting. No decision was reached. BUSINESS ITEMS ► 3. PUBLIC SAFETY STUDIES A. POLICE DEPARTMENT REVIEW (GARDINER/732 - 30 min.) Consideration of a management review of the Police Department by the Commission on Peace Officers Standards and Training (POST). ♦ RECOMMENDATION: Review POST management study and approve implementation of study as modified by the recommendation of staff. 6 Council Agenda Wednesday, July 5, 1995 FINAL ACTION: CAO recommendation adopted, including overstaffing (5-0). B. FIRE DEPARTMENT REVIEW (NEUMANN/722 - 30 min.) Consideration of a management study of the Fire Department by Hunt Research Corporation. ♦ RECOMMENDATION: By motion, receive study and direct staff to pursue implementation as modified by the recommendation of staff. FINAL ACTION. CAO recommendation approved (5-0). ► 4. SALINAS RESERVOIR TRANSFER AGREEMENTS (MOSS/1104 - 30 min.) Consideration of approving the Salinas Reservoir Expansion Project ownership transfer agreements. ♦ RECOMMENDATION: By motion, approve: 1) Salinas Reservoir Ownership Transfer agreement; 2) Salinas Reservoir Operation and Maintenance Agreement; and 3)Joint Powers agreement between Zone 17 of the San Luis Obispo County Flood Control and Water Conservation District and the County of San Luis Obispo for operation of the Santa Margarita Lake Regional Park and Natural Area. FINAL ACTION: After testimony and discussion, continued to 8/15/95 (5-0). ► S. STATE WATER PROJECT EASEMENTS (MOSS/1124 - 15 min.) Consideration of a request by the State Department of Water Resources (DWR) necessary for the Coastal Branch of the State Water Project. ♦ RECOMMENDATION: 1) Adopt resolution granting a permanent pipeline and access road easement and a temporary construction easement on City property located on Fox Hollow Road near the base of Cuesta Grade (Police Firing Range), and 2) adopt resolution granting a permanent access road easement using an existing roadway crossing City property located on Stenner Creek Road. FINAL ACTION: 1) Resolution No. 8440 adopted (3-2, AS43R voting no) and, 2) Resolution No. 8441 adopted (3-2, AS/BR voting no). ► 6. RECORDS MANAGEMENT PROGRAM (GLADWELU155 - 15 min.) Consideration of adopting a Records Management Program. • RECOMMENDATION: By motion, adopt Records Management Program and manual for the City of San Luis Obispo. FINAL ACTION: Approved (5-0). A. Consideration of approving the Salinas Reservoir Expansion Project ownership transfer agreements. * RECOMMENDATION: By motion, approve: 1) Salinas Reservoir Ownership Transfer agreement; 2) Salinas Reservoir Operation and Maintenance Agreement; and 3) Joint Powers agreement between Zone 17 of the San Luis Obispo County Flood Control and Water Conservation District and the County of San Luis Obispo for operation of the Santa Margarita Lake Regional Park and Natural Area. 6 Council Agenda Wednesday, July 5, 1995 ► 5. Consideration of a request by the State Department of Water Resources (DWR) necessary for the Coastal Branch of the State Water Project. ♦ RECOMMENDATION: 1) Adopt resolution granting a permanent pipeline and access road easemeNt and a temporary construction easement on City property located on Fox Hollow Road near the base of Cuesta Grade (Police Firing Range), and 2) adopt resolution granting a permanent access road easement using an existing roadway crossing City property located on Stenner Creek Road. ► 6. RECORDS MANAGEMENT PROGRAM (GLADWELL/155 - 15 min.)
