DISCUSSION: The Parks and Recreation Department received three applications in response to the Request for Qualifications. A review committee, consisting of two local preschool professionals and one Little Rec'ers parent, ,reviewed all three applications and interviewed each applicant. After the interview process, the review committee recommended that the Parent Cooperative Preschool proposed by Janet Murphy and Vicki Phillips be awarded the contract to provide a preschool program at the Santa Rosa Street Recreation Center. The review committtee's recommendation was based on the applicants' ability to meet the requirements of the Request for Qualifications and maintain high parent participation in the school; the applicants' education and background in child care; and the originality of a Parent Cooperative program,which is not currently offered as a child care option in San Luis Obispo. The Parent Cooperative Preschool is also a non-profit program that meets the required standards of the Request for Qualifications. The contract between the City of San Luis Obispo and the Cooperative Preschool, set forth in Attachment#2, is a standard lease agreement for one year. The rental fees will be waived for the first year: On the annual anniversary commencement date monthly based rent will be adjusted on the contract's anniversary date to 5% of the provider's annual gross income. Gross income will be based on the previous yearis earnings. C�-I i►u���bN��IIIIII��hj I�.atY of San t. _.3 OBISpo 0j;% COUNCIL AGENDA REPORT Based on the contract, the Cooperative Preschool agrees to: • Provide community-based child care year-round for children ages 3 to 5 years old • Adhere to Community Care Licensing, Title XXII Regulations • Adhere to City Fire Occupancy Limits Keep the premises in clean and sanitary conditions • Provide verification of required levels of insurance (see Attachment #2, Exhibit A) Based on the contract, the City of San Luis Obispo agrees to: • Waive the rental fees for the first year • Provide daily janitorial service • Provide all utilities, except telephone service If Council adopts this resolution and approves the recommendation, the attached lease agreement will be signed, and the program will begin August 1, 1995. CONCURRENCES: Staff concurs with the recommendation of the Parks and Recreation Department that Council adopt this resolution. FISCAL IMPACT: Selecting an outside provider is the most cost effective solution to providing the type of high quality program that participants want. ATTACHMENTS: 1. (1995 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING THE LEASE AGREEMENT BETWEEN THE COOPERATIVE PARENT PRESCHOOL PROVIDER AND THE CITY OF SAN LUIS OBISPO AS SET FORTH IN ATTACHMENT #2. WHEREAS, the Parks and Recreation Department wishes to expand the availability of preschool age child care programs, and WHEREAS,the current program, "Little Rec'ers", being a half day program does not meet the need for full day child care, and WHEREAS,the most cost effective method of offering the service is the rental of the Little Refers Room at the Santa Rosa Street Recreation Center to a qualified, non-profit child care provider, and WHEREAS, after reviewing the qualifications of several potential child care providers, Janet Murphy and Vicki Phillips, were found to be the most qualified. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO AS FOLLOWS: 1. The City Council hereby approves the lease agreement attached, as Attachment #2; and 2. The City Council hereby authorizes the Mayor to sign the lease agreement on behalf.of the City of San Luis Obispo. We represent many local families who are extremely eager to see such a facility established. We feel that given the opportunity we could provide a unique experience that is not currently available for the children and parents of our community. Unfortunately we have just learned of the availability of the little Rec'ers facility. Therefore this application, due to time constraints, is a very general proposal which we hope will not hinder our opportunity to be considered for facility use. We are devoted, dedicated parents and child developmentalists with a strong desire to see a parent cooperative flourish in San Luis Obispo. Our vision would be a program where parents work together under the guidance of a professional to develop a program to benefit the children. Cooperative preschools are unique in offering education to both parents and children. We believe that children will develop and individuate when provided an environment that is developmentally appropriate and stimulating. Given hands on activities and a broad spectrum of experiences, they will flourish. Parents also benefit from sharing similar concerns and successes with other parents, and gain insight into their own children. Once again this is a quick synopsis of a very complex program that we envision. We hope we will be given the opportunity to develop and present it in a more thorough fashion by being chosen as a candidate for facility use. Parents would be required do the following: A Two or three days class participation. B. Attend parent meeting. C. Participate in workdays (school maintenance and improvement). D. Participate in fund-raisers. We initially propose to run a MWF 4-5 year old class and a TTH 3-4 year old class. Curriculum We offer a developmental program that is designed to meet the needs of young children ages 3 to five years. There are periods of time set aside for both child selected activities and teacher directed experiences. Our director provides materials and activities that are age and developmentally appropriate. Daily experiences include: 1. Fantasy and play 2. Creative expression 3. Language development 4. Parents are welcome and encouraged to attend all meetings and may request to be included on the agenda Vacancies in the board are filled by majority vote of the membership. The Teacher/Director has primary responbdity for planning and implementing the children's educational pros= ADMISSION POLICIES- Age-children may enroll in our program once they have traced 3 years of age and are out of diapers and a spot is available. Physichms Report-Immunization card Health History Consent to treat forms Cooperative contract GUIDELINES FOR STAFF&PARTICIPATING PARENTS- It is our goal to see that the children learn to socialize and become independent. We want them to have fico and to learn to feel good about themselves. Please keep this in mind when you are working with the children and when you are helping them through difficult situations. 3 Additionally,please note that when it is your working day at the preschool,you are considered part of the staff Your primary qty is to supervise the children. Rest socializing with other parents and focus your attention on the activities of the childrm 1. Pmvnb will be responsible for providing snack for the entire class approximately once a month. For difficult situations,request help from the Teacher/Director. 9. Encourage children to try new experiences,but don't force them. Respect a child's occasional need to just sat and do nothing. He/she may need time to think,daydream or observe. 10. Agate the positive. State suggestions or directions in positive form. Say, "You need to ride your tricycle on the path."Rather than, "Don't ride your hire in the sand. " 11. Allow for choice whenever feasible,but give the children a choice only when you intend to leave the situation up to than. For example,if you are directing children to an activity,say, "It is time for a snacks," not"Do you want to have a snack now 7" 12. Your voice is a teaching tool. Use words and a tone of voice which will help the children feel confident and reaswued. Speak firmly,don't shout. Instead of yelling across a play yard,move nearer to the person to whom you are speaking. 13. When speaking to a child,get down to his/her level physically. 14. Require quiet only when a specific occasion demands it. 17. Encourage the children to appreciate nature. Killing bugs,digging in plants and picking flowers is discouraged. -8'ID q PARENT RESPONSIBIIIT]ES Each firmly(mother and/or father)is responsible for: 1. Two or three participation days a month A A calendar which shows all the worimg parents and available substitutes will be available prior to the beginning of each month Contact your class representative regarding requests to fit your personal schedule. Make your requests before the next month's calendar has been prepared. B. All working parents are to arrive at school twenty minutes early so that the teacher/director will have time to fi mliarize you with her plans for the day. Working parents are to remain at school until all cleanup duties are completed and confirmed by the teacher/director. This generally takes 20 to 30 minutes. C. All parents are required to work on their assigned days unless they obtain a replacemem. Failure to report for a participation day is a serious offense; it puts our license at risk because we may not meet our required adult to child ratio. Therefore,feulure to report for your assigned work day results in a$20 fee and an additional work day. Continuous no-shows may result in expulsion from the school. D. If you know ahead of time that you will be unable to work on your scheduled day(including the night before),arrange a replacement for yourself. Do not call the substitute. The substitute is to be used for last mimrte emergencies. E. For each school day there is one assigned substitute. The substitute is to be used only for last minute illness or other emergency situation. Call the substitute as early in the morning as possible. F. If you need to use the substitute,or if you have found another parent to replace you on your assigned day,you also need to arrange a day when you can work for him/her as repayment,or pay$15,whichever is mudraUy agreed upon• G. When you are the assigned substitute,be prepared to work Make all childcare arrangements in advance. if you cannot work on your assigned substitute day,it is your responsibility to find another member to take your place. K When two children frc®the same fitmily are enrolled in the school,the parent will work the full required number of days for each child. 2. ATTENDANCE AT PARENT MEETINGS A. There will be parent, staff and educational meetings throughout the school year. Our meetings are essential to the operation of our school and,consequently,are mandatory. They are business meetings. Therefore,with the exception of nursing babies,children are not allowed. B. A mandatory orientation meeting is held before school begins. C. If you aro unable to attend a mooting,you aro to read and sign the minutes that you will find posted at the school You may also substitute attendance at a board meeting for attendance at a parent meeting. Parents are always welcome at the board meetings. - s 3. SCHOOL MAINTENANCE by holding one on going job and completing a minimum of eight hours of worm during the year. We attempt to males these jobs"equal"in tenrhs of the amount of time and energy required to accomplish them. Each job is essential to the maintenance and smooth operation of the school. We rely on each other to do our share and to complete our jobs in a timely and satisfactory manner. B. Group Project days Several"group project days"will be scheduled throughout the school year. On these days, groups of people work together on maintenance projects. A total of eight hours of your participation at one or more of those days is mandatory. If you are unable to attend any of these scheduled days, you may substitute this requirement by working on a school project at some other time. With September's tuition,you are required to make a$80 deposit on your maintenance hours. This check will be held(not deposited)by the treasurer. Once you have completed your maintenance hours,your I►win be rauuwjd to ynu. If rm are unable to accomplish your eight hours of maintenance,your check will be deposited into the school's account. 4. PARTICPATING IN VARIOUS FUND RAISING ACTIVIT ES The school sponsors fund raising activities in order to: i. Keep tuition as low as possible 2. Publicize the school 3. Purdmw new equipment or meet spatial financial needs Each firmly is required to contribute equal time and effort to support fiord raising activities or be assessed an appropriate fee per event. The selection of fimd raising activities will be determined by the current members of the school. Lessor or such other person(s)as I eaaor may appoint sball have the exclusive control and management of the Common Areas and shall have the right, from time to time,to modify,amend and enforce said rules and regulations. Lessor shall not be responsible to Lessee for the non-compliance with said rules and regulations by other lessees, their agents, employees and invitees of the Recreation Center. n^� _ ♦/ 2.5 Common Ares-Changes: Lessor shall have the right,in Lessor's sole discretion, from time to time: (a) To make changes to the Building interior and exterior and Common Areas,including,without limitation,changes in the location, siva, shape,number, and appearance thereof, including but not limited to the lobbies, windows, stairways, air shafts, elevators, escalators, restrooms. driveways, entrances, parking spaces, parking areas,loading and unloading areas,ingress,egress, direction of traffic,decorative walls,landscaped areas and walkways;provided,however,Lessor shall at all times provide the parking facilities required by applicable law; (b) To close temporarily any of the Common Areas for maintautow purposes so long as reasonable access to the Premises remains available; (c) To designate other land and improvements outside the boundaries of the Recreation Center to be a part of the Common Areas,provided that such other land and improvements have a reasonable and functional relationship to the Recreation Center, (d) To add additional buildings and improvements to the Common Areas; (e) To use the Common Areas while engaged in making additional improvements, repairs or alterations to the Recreation Center, or any portion thereof; (f) To do and perform such other acts and make such other changes in, to or with respect to the Common Arms and the Recreation Center as Lessor may,in the exercise of sound business judgement deem to be appropriate. 3. Occupancy of the Premises is limited to 21 persons, both children and adults, at any one time. 6. Alterations, Lessee shall make no alterations to the Premises, Parking or Common Areas without Lessor's written consent All alterations, or improvements, made with or without consent in and to said Premises shall, unless otherwise provided by written agreement between the Lessor and Lessee,become the property of the Lessor and shall remain upon the Premises. 7. Breach of AgtearenL Failure of Lessee to pay rent or other charges promptly when due or comply with any other term or condition hereto or to comply with any applicable provisions of the laws of the State of California, shall at the option of the Lessor empower them to terminate this tenancy upon giving proper notice. If damage to the Premises or Recreation Center(other than normal wear)but including damage caused by Lessee making alterations to the unit,is caused by acts of neglect of the Lesse c,its employe, suppliers, shippers, customers,and invitees, the Lessor may cause such repairs to be made and Lessee shall be liable to Lessor for any reasonable expense thereby incurred. Lessee agrees to pay for all repairs, replacements, and maintenance caused by Lessee conduct or negligence or that of its employees, suppliers, shippers, customers, or invitees, and at Lessor's option such charges shall be paid immediately, 11.1 Lessor agrees to provide nightly janitorial services,including sanitizing both bathrooms and kitchen, mopping uncarpeted arras and emptying trash. Uncarpeted floor areas will also be waxed on a quarterly basis,and routine maintenance and repairs will be provided by Lessor for the Recreation Center and futures on the Premises. IL Defects or Damage. Lessee shall report any defect or natural wear pertaining to plumbing, wiring, or workmanship on the Premises, Parking or Common Areas at once. Lessee is responsible for and agrees to pay for any damage done by wind or rain caused by leaving windows open, and/or by overflow of water, or stoppage of waste pipes,or any other damage to appliances,carpeting,flooring,or the Building in general that is due to the acts of the Lessee, its employees,suppliers, shippers, customers, or invitees. 13. Lessor's Access. .13.1 Lessor and Lessor's agents shall have the right to enter the Premises at reasonable times for the purpose of inspecting the same, performing any services required of Lessor, showing the same to prospective purchasers,leaders,or lessees,taking such safety measures,erecting such scaffolding or other necessary structuress, making such alterations, repairs, improvements or additions to the Premises or to the Recreation Center as Lessor may reasonably deem necessary or desirable and the erecting, using and maintaining of utilities, services pipes and conduits through the Premises and/or other premises as long as there is no material diverse effect to Lessee's use of the Premises. Lessor may at any item place on or about the Premises or the Building any ordinary 'For Sale' signs and Lessor may at any item during the last 120 days of the term hereof place on or about the Premises any ordinary 'For Lease'signs. 13.2 All activities of Lessor pursuant to this paragraph shall be without abatement of rent,nor shall Lessor have any liability to Lessee for the same. 13.3 Lessor shall have the right to retain keys to the Premises and to unlock all doors in or upon the Premises other than to files,vaults,and safes,and in the case of emergency to enter the Premises by any reasonably appropriate means,and any such entry shall not be deemed a forceable or unlawful entry or detainer of the Premises or an eviction. Lessee waives any charges for damages or injuries or interference with Lessee's property or business in connection herein. 14. Sigrs. Lessee shall not place any sign upon the Premises or the Recreation Center without Lessor's prior written consent Under no circumstances shall Lessee place a sign on any roof of the Recreation Center. Lessee hereby agrees that Lessor shall not be liable for injury to Lessee's business or any loss of income therefrom or for las of or damage to the goods,wares,merchandise or other property of Lessee,Lessee's employees, invitees, customers, or any other person in or about the Premises or the Recreation Center,nor shall Lessor be liable for injury to the person of Lessee,Lessee's employees,agents or contractors,whether such damage or injury is caused by or results from theft,fire,steam,electricity,gas,water or air,or from the breakage,leakage, obstruction or other defects of Pipes, sprinklers,wires, appliances,plumbing,air conditioning or lighting fixtures, or from any other cause,whether said damage or injury results form conditions arising upon the Premises or upon other portions of the Recreation Center, or from other sources or places, or from new construction or the repair, alteration or improvement of any part of the Recreation Center, or of the equipment, futures or appurtenances applicable thereto,and regardless of whether the rause of such damage or injury or the means of repairing the same is inaccessible, Lessor shall not be liable for any damages arising from any acto or neglect of any other lessee, occupant or user of the Recreation Center, nor from the failure of Lessor to enforce the provisions of any other lease of any other lessee of the Recreation Center. 16. Inventory. A written inventory of the Premises and its contents will be attached for Lessee's inspection Lessee should review inventory carefully and sign it Lessee will be responsible for the condition of the Premises when vacating in accordance with the attached. For any claims related to this project, the Contractor's insurance coverage shall be primary insurance as respects the City, its officers, officials, employees, agents and volunteers. Any insurance or self-insurance maintained by the City, its officers, officials, employees, agents or volunteers shall be excess of the Contractor's insurance and shall not contribute with it. 3.
