SDMMARY 1UCOMMENDATION Either approve the use permit, sulject to conditions, or continue with direction to the applicants to apply for a variance. BACYGROOND a11 The applicants want to use a portion of a site to hold fraternity board meetings and minor recreational events (barbecues for members and families). The fraternity was established locally in 1986, and some of the members have occupi ad the majority of the apartments on the site for the past two years. Fraternity events have taken place on the Cal Poly campus and in various halls (the Monday Club, Embassy Suites), and would continue to be held off -site with approval of this use permit. This is the second application the city has received beat requests the use of a part of the site for fraternity use. The other request (1252 Foothill) was approved, but the use permit was reviewed recently because parties and other fraternity events were being held at the site, contrary to conditions prohibiting these activities. It contains 1) a house which has been divided into two living areas: one two -bedroom and one one -bedroom; 2) an apartment building containing four two -bedroom apartments; and 3) a garage for two cars and several bicvcies, with a one -bedroom apartment above it. In addition to the garage, a parking lot off Crandall Way has spaces for nine cars and one motorcycle. The Foothill streetyard contains three large trees, which were the basis for a decision several years ago, allowing the parking lot U 1484 1304 Foothill Blvd. Page 2 in the Crandall stay streetyard. The neighborhood contains fraternities, sororities, apartments, and single-family homes. The site is one block arum the Cal Poly campus. The fraternity's stated purpose isto 1) place their fraternity letters on the building; 2) hold meetings of 12 or fewer members and 3) hold wall social events. specifically barbecues on -site; holds all membership meetings, on -site. The zoning regulations set standards for fraternities for parking and residential occupancy (persons per acre). The parking requirement is 1.5 spaces per bedroom or 1 space per 3.5 occupants, whichever is greater. The occupancy allowed for group housing it. in R-1 Zone is a maximum of 40 persons per acre. The applicants are asking to use only the house as the fraternity house, with the separate apartments to he leased separately to fraternity members and non-members for residential use. It appears thatan additional space could be created on the lot by restriping the parking lot to current standards and paving a small area near the stairs to the house. It may be possible to restripe the area closest to Foothill at an angle, thereby allowing better use of the extra paving that exists. Occupancyt The zoning regulations set population density limits of 40 persons per net acre for group housing in the R-3 zone. There are not occupancy limits for apartments in the R-3 or R-a zones. The residential occupancy allowed on si"e, if the entire site is taken into account, is: .276 acres % 40 > 31 persons. The applicants ire asking to have a total of 19 persons living on site: house: 5 cccupants apartments: 12 -,cvlonts apt. over gar. 2 t upants Therefore, if the occupants of the entire site are considered, the occupancy limits are exceeded. Staff can see no meaningful way to interpret the occupancy limits to evaluate the occupancy of the house alone, as opposed to the entire. site. If the commission supports the use permit, it may chooso to place a limit on the number of persons who live at the site. Staff sees the current number (19) as reasonable for a site containing 12 bedrooms, .. considering the whole site as a fraternity. Typically, in an analysis of a fraternity request, staff evaluates the whole site for its ability to meet the parking and occupancy standards. In this case, because of its legal nonconformity, those standards could rot be met without removal of some cf the apartments: The commission could limit the occupancy to 11, to meet that D 1494 1304 Foothill Blvd. Page 5 standard' although such a limit would likely he financially infeasible. However, the parking requirement for fraternities is the greater of: 1.5 spaces per bedroom, or 1 space per I'S occupants. The 12 bedrooms would need to he reduced to s to meet the parking requirement. To approve use of the entire site for fraternity use, the commission would have to grant a variance to allow fewer parking spaces than required, and either grant a variance to allow a higher occupancy or limit the occupancy to eleven. The applicants have not applied for a variance, nor has staff suggested this avenue to them. To approve a variance requires the commission to make certain findings, inclt '+g that there are unusual circumstanceshat that apply to the such as topography, or shape, apply to othn. -ilarly-zoned lots in the vicinity. Me site is not unusual in shape or topography. Y ural feature that could he considered as a reason to warrant an exception is the existence of large trees on the site. Given that reroval of the trees would allow for construction of additiot:l parking spaces, there may be some justification to grant a variance. if the commission is not comfortable with confining the fraternity use to the house, then the commission should either deny the request or continue it to allow the applicants to apply for a variance. 4. elaker7. The fraternity has managed the site for two years, through a property ranagement "arm" created for the purpose, in that time, fraternity and non -fraternity members have lived in the various apartments, and some small meetings have been held in the house. Large meetings and other events have been held elsewhere. The commission's packets contain letters from ain others that Cal poly, the Monday Club. Embassy Suites, confirm the locations of meetings. In the two years fraternity members have occupied the site, the Planning Department has received one complaint - that a fraternitDepartment has respondedoperating to notcatlls for any andthe or other violations. 5. Alternative sites. Few, if any, sites are available in the city that can meet the standards for parking or occupancy for fraternities. Because the standards differ for apartments and t artments can meet the standards, exce afor fe tthat have land aavailable for additional parking. p In staff's view, the major issues with fraternities arise not from a lack of parking for the residentsof the fraternity or U 1484 1304 Foothill Blvd. Page 6 from the number of residents on site, but from the behavior of the residents, non-resident members, and others who attend functions it the site. The Police Department says that no problems arise from "closed" parties or events - those everts including only fraternity members. It is when the evet.`s are open to the public that they get out of hand. In staffs experience, the incompatibility problems frow fraternities come from on -site events. In this case, all major functions are proposed to be Gff-site. Unlike some other fraternities, this one has in fact held all of these events cuff -site in the past. For these reasons, staff in inclined to support the fraternity request in spite of the site's nonconforming status. 6. The current situat.on. Staff has observed that the R-3 and R-4 zones contain few, if any, sites suitable for fraternities or sororities that do rot present some compatibility issues or that conform with the current standards for density or occupancy. Lately, t" commission has attempted to address these issues by limiting the use to essentially residential. Staff believes that the city would benefit by having all "underground" fr,-ternities and sororities apply for use permits. If each organization were subject to conditions limiting its activities, a greater degree of enforcement is possible than is available through the municipal code only. It may be appropriate for the commission to take a look at the regulations in a separate study session, and offer some direction to the Creek community and staff on how to approach future applications for use permits. staff would like to be able to support the present applicants and others of like history, but this support is difficult within the present zoniig regulations. ALTERNATIVES The commission may grant the use permit allowing use of the house o,ily as the fraternity, with conditions limiting uses on site. This action would allow the members to place fraternity letters on the house, and to hold whatever events at the site that are allowed in the conditions. The commission may continue consideration, with direction to the applicants to submit a variance application asking for exceptions to the parking and residential occupancy standards. If the commission supports use of the house only as a fraternity, then staff recommends the commission: • Approve the use permit, allowing the use of the house as a fraternity, based on the following findings and subject to the following conditions: Findings, 1. The proposed use will not adversely affect the health, safety or welfare of persons living or working at the site or in "a vicinity. 2. The proposed use is appropriate at the proposed location and will be compatible with surrounding land uses. 3. The proposed use is exempt from environmental review (Class 3, Section 15303 - conversion of existing small structures from one use to another). Conditions: 1. Occupancy of the site is limited to 19 residents. 2. A minimum of 13 parking spaces shall he provided on -site. 3. The fraternity use is to be confined to the house only. The permit is for residential use only. Fraternity activities conducted from 1304 Foothill Boulevard shall be limited to meetings of the executive council and any other meetings and gatherings involving 16 or fever fraternity members and guests. 4. If a reasonable complaint is received in writing by the Community Development Department, a) The complaint shall be forwarded to the Interfraternity Council and the Planning Commission within one week of receipt for review and comment. The names of the people filing the complaint shall not be included without their consent. No meetings or other gatherings involving persons other than fraternity members living on this site are allowed between the hours of 10 p.m. and 9 a.m. A fraternity identification sign may he installed on the building in accordance with the city'$ sign regulations. However, the sign must be attached to the exterior wall of the house only. 7. The applicant shall institute and maintain a neighborhood relations program. This plan shall include at least the following elements: a) Quarterly training of all members in community relations. Dates of these training sessions shall be submitted to the Community Development Director. b) A program to inform neighbors in a timely manner of upcoming events at the fraternity or elsewhere. c) Submission of names and telephone numbers of responsible persons to the Community Development Department and to the apartment property manager and neighbors within two blocks of the apartment. Responsible persons shall be available during all events and at reasonable hours otherwise to receive slid handle complaints. Evidence of implementation of said plan shall be submitted to the Director for review within thirty days of Planning Commission action. Failure to implement said -'an will be grounds for revocation of this permit. e. Failure to comply with any of the above conditions or code requirements, or the conduct of the use so as to constitute a public nuisance or so as to cause adverse impacts on the health, safety, or welfare of persons in the vicinity of this use, is prohibited and may constitute grounds for revocation of this permit. It the commission prefers to include the entire site in the fraternity use, then staff recommends continuance with direction to the applicants to apply for a variance to allow reduced parking and to exceed occupancy standards. The neighborhood contains fraternities, sororities, apartments, and single-family homes. The site is one block from the Cal Posy campus. The remainder of the site is residential, and normal residential functions may take place there. EVALUATION 1. The density and parking do not conform with present regulations. However, all improvements on the site were done with city permits. The use, then, is considered legally non- conforming. One condition of the use permit is that the fraternity is required to provide fourteen parking spaces. The site contains eleven parking spaces and ten bicycle spaces, which is the equivalent of thirteen parking spaces. The representative has been working with city staff to develop plans to revise the parking lot to provide one more space. These plans are now completed, and kirk is expected to begin soon. The city has received no complaints about the fraternity use. Since the fraternity was approved, the city (Community Development and Police Departments) nas received no complaints about it. Fraternity members occupied the site as residents for two years prior to submitting an application for a use permit. One complaint was received during that time -that a fraternity may be operating at the site. 3. A neighborhood relations program is in effect. The fraternity submitted a neighborhood relations program by the deadline required by the use permit. A revised program, including names and telephone numbers of current representatives, in attached.
