I would have to do another inspection, since Mr. Wilkerson states that all the kombucha brewing equipment and the RO
system equipment have been removed. According to him, one unit is storage for old Whalebird stuƯ and the other is now
an art studio. You can review my report from 2022. Since they have RPs installed at the meter, they’re basically good as far
as I’m concerned. If they want to remove them, which I do not favor, then I’d need to reinspect. I thought you were on
vacation. Are you just dropping in to stir the pot? What about Tesla? When does Elon come out to reinstall the DCDA?

RE: CROSS-CONNECTION CONTROL SURVEY OF WHALEBIRD KOMBUCHA, SEPTEMBER 27, 2022
BACKGROUND: On September 27, 2022, Mr. Jake Pritzlaff emailed me asking questions about the need
to test backflow prevention assemblies located at Whalebird Kombucha, 3576 Empleo Street #1, San
Luis Obispo CA 93401. In order to respond to Mr. Pritzlaff’s email, I visited the Whalebird website. In the
course of browsing their website I saw that they have installed a “grey water catchment system” to run
the toilets in the facility. This sparked a discussion between me and Mr. Marcus Henderson of the City of
San Luis Obispo (SLO) regarding the nature of the grey water catchment system and whether or not it
presented a hazard to the City of SLO public water supply.
OBSERVATIONS: I contacted the business and set an appointment for 3:00 PM on Tuesday, September
27, 2022. I arrived at the business and was escorted through the facility by Mr. Lee Wilkerson, who is the
Engineer for Whalebird Kombucha. During the survey, I observed the pressure vacuum breakers (PVBs)
installed outside on the east wall of the building and then went inside and observed the reverse osmosis
(RO) system and the grey water catchment system for running the toilets. The catchment system utilizes
the RO leachate which is piped to an IBC tote upstairs. The tote is then plumbed to the toilets. The tote
has a connection to the potable water supply via a makeup line. This makeup line is hard-plumbed into
the tote, which is a cross-connection. The toilets have been disconnected from the potable system. Mr.
Wilkerson stated that the RO leachate is concentrated at approximately three times (3X) the levels of
anything that the RO system removes from the City of SLO potable water. This may present issues with
the quality of the leachate water. This need not constitute a potential health hazard (if the leachate
does in fact exceed safe levels of any contaminant) provided that staff and customers are advised not to
contact the leachate. The grey water catchment system meets the definition of an auxiliary water
system per County of San Luis Obispo Code section 8.30.020:
"Auxiliary water supply" means any water supply on or available to the pre mises other than
the approved public potable water supply. These auxiliary waters may include, but are not
limited to, water from another purveyor's public potable water supply or any natural source
such as a well, spring, river, stream, harbor, etc., or "used water" or "industrial fluids"
Therefore, the premises must be isolated in accordance with County of San Luis Obispo code section
8.30.030:
8.30.030 - Where protection is required.
(a)Each service connection from the public water system for supplying water to premises having
an auxiliary water supply shall be protected against backflow of water from the premises into
the public water system.
(b)Each service connection from the public water system for supplying water to premises on
which any substance is or may be handled in such a fashion as to permit entry into the water
system shall be protected against backflow of the substance from the premises into the public
system. This shall include the handling of processed waters, and waters originating from the
public water supply system which have been subject to deterioration in sanitary quality.
(c)Backflow prevention devices shall be installed on the service connection to any premises that
have cross-connections. It shall be the responsibility of the consumer to provide, test, and
maintain protective devices as required.
DIRECTIVES:
1. The PVBs installed on the east wall of the building are not installed 12 inches above all
downstream piping and outlets. The PVBs shall be replaced with reduced pressure principle (RP)
backflow prevention assemblies located just downstream of the meters.
2. The potable makeup line to the leachate tote shall be disconnected and reconfigured in such
a way as to provide an air-gap of not less than 2X the diameter of the makeup line so that at no time
during use can the potable water line contact the leachate.
3. The restrooms shall be provided with signage stating that the toilets use reclaimed water.
Staff shall be advised to avoid contact with the leachate during cleaning or maintenance of the
restrooms.

This is in regard to 3576 Empleo. I have my doubts….
If this guy is no longer the tenant, then why is he calling on behalf of the landlord? He slips at one point and says “we’re no
longer…” then switches to “they’re no longer doing food.” It doesn’t make sense. But this site had backflow prevention
assemblies all along, they had PVBs and I had them upgrade to RPs when I saw their homemade auxiliary water supply
using the RO distillate. I’m inclined to tell them to test or get shut oƯ. Thoughts?

Hi matt,
When our billing team gave Jeffery a call to get an updated number, he (or someone) apparently answered from the
number we have on file. Other than contacting him, once they are past due on their testing, lets just continue with our
enforcement process and shut them off. We now have a restoration fee to charge to customers who are
noncompliant.
You could also report the business to code enforcement, so they do an internal inspection.

I don’t know how closely either of you followed this little saga a couple of years ago, but these guys had all kinds of
weirdness in their facility, including using their RO distillate as an auxiliary water supply to feed the toilets. I ended up
requiring them to install RPs (3 of them) and even got Wilkins to comp them three of the new 975XL3 models, which I then
tested. In this process they ran afoul of City code enforcement as they’d done all kinds of unpermitted work inside the
unit. So they claimed hardship when the next year to test came around. This year the test notice was returned as
undeliverable. Kellie found a new name on the account, one JeƯery Berg. I updated and resent and that one came back.

The site is supposedly an “art studio” now, with curtains obscuring the windows, but their website is still active and shows
them at that address.

I think they’ve gone underground myself. Whatever, there are three RPs out front that need to be tested but I’m drawing a

We switched our business operations in early 2023 from primarily self-distributing to distributing through
distributors. This means from a revenue side that we make significantly less revenue as there is an additional
middle-man added. However, this in the long term is helpful to the bottom line as our own distribution efforts
were inefficient and expensive, so while revenue is much lower, expenses are much much lower.

without thinking twice about where the water came from. By investing
in a multi-source supply over the years, our community has
established a diverse water supply.
The City of San Luis Obispo's primary water supply comes from
three surface-water reservoirs: Salinas Reservoir (Santa Margarita
Lake), Whale Rock Reservoir, and Nacimiento Reservoir.
In addition to our three surface water reservoirs, recycled water also
plays an integral part in the City's Total Water Supply. Currently,
recycled water demands are about 5% of the City's annual demand;
however, this number is expected to grow.
In the past, the City utilized groundwater as a fifth water source;
however, we transitioned away from using groundwater as an
additional source in early 2015 as we began focusing efforts on
maximization of delivery from Nacimiento reservoir. That said, these
historic groundwater wells have been kept in operable, stand-by
positions in the event that they are ever needed.

Apologies I have been out of town since Thursday. We stopped producing Kombucha at our facility April 1st of
this year. Production is happening at a large copacking facility in Ventura now. Since then, it's been a long
slow process of breaking everything down and getting rid of everything. We are down to 2 of the rollup
warehouses that we still control, one of which is just storage for stuff. The first warehouse still has our big
tanks in it, which we've had trouble selling. We're working with an auctioneer now who will hopefully be able to
help with that.

Hope you're well. Just a quick update, production has fully stopped at our facility and we've been working
around the clock the last few weeks to get everything torn down. By the end of this month we hope to have all

our units except unit 1 surrendered back to our landlord. We will need to keep unit 1 for an uncertain amount
of time as storage for our large assets as we are waiting for SBA approval before we can sell them. So far they
have been frustrating to work with unfortunately so I'm not sure on timeline there.

Update on the business: On Thursday 2/16/23 we told our whole team what was going on, and started the
process of winding down the facility. Production will continue in a limited state until March 11th, at which
point we'll transition to full tear-down mode and the majority of our remaining team will be finished
working. Our PO's with the Co-packers are in and distribution agreements have been made so the
necessary components of the business are being outsourced now to the necessary parties.

I hope you're well. It's been a minute since we spoke in your office, just wanted to give you an update. We
are nearly at the contract sign phase with our two co-packers. We've had some back and forth with
product formulation this month and last month, just trying to get their output to taste right. Once those
contracts are signed we can begin the process of transitioning our manufacture over to them, although
that transition will take a bit of time.
We never heard back from your office on timeline so we're going to continue to move as quickly as we can
without putting the business in major jeopardy. We're close though.

I understand that this is a sensitive issue, you ended up with a lot to deal with, and I appreciate that you will get them tested.
There should be three assemblies out front, that’s the number that were there last year when I tested them. As I said, this
should be the last time you have to deal with them, if you’re out of the premises before November next year. As far as the other
issues that came up, the only thing I can say (which you have probably already started doing) is to be sure to research the codes
and requirements before initiating any construction. California is a highly regulated state, and there are lots of pitfalls that well-
meaning people can fall into. I don’t know if that helps any. Thanks again for getting the assemblies tested.

I remember the help you gave us with the backflow assemblies last year, I see the tone in your email and don't want you to feel
like that wasn't appreciated, because it was. I know it's not your department, and we still don't know exactly what went down,
but getting these backflow sensors tested last year cascaded into the city throwing the book at us, completely upending our
business, laying off 20 people, and spending most of 2023 so far scrambling to set up manufacturing elsewhere after being
happy making Kombucha in SLO for almost 10 years. Again, that's not your problem and I appreciate the help you've given us bu t
I hope you can understand my perspective is certainly not that the city of SLO is doing us a bunch of favors over here.
I called one of the certified backflow testers and it looks like it's not that expensive so I'll get them tested.
The letter you had sent has what looks like 3 backflow units to test. Is that correct? (3184-001, 3184-002, and 3184-003).
Currently we are occupying 3576 Empleo Street units 1 and 2. While in production, we did have units 3 and 4 as well which were
involved in production. Are any of those backflow units associated with units 3 and 4 or are they all tied into one?

Hi Nick,
Apologies I have been out of town since Thursday. We stopped producing Kombucha at our facility April 1st of
this year. Production is happening at a large copacking facility in Ventura now. Since then, it's been a long
slow process of breaking everything down and getting rid of everything. We are down to 2 of the rollup
warehouses that we still control, one of which is just storage for stuff. The first warehouse still has our big
tanks in it, which we've had trouble selling. We're working with an auctioneer now who will hopefully be able to
help with that.
Our remaining team is doing Whalerock Music Festival this weekend in Templeton, want to come by next
week? I can also meet tomorrow (Thursday) between 9-11am if that window would work for you.

Hope you're well. Just a quick update, production has fully stopped at our facility and we've been working
around the clock the last few weeks to get everything torn down. By the end of this month we hope to have all
our units except unit 1 surrendered back to our landlord. We will need to keep unit 1 for an uncertain amount
of time as storage for our large assets as we are waiting for SBA approval before we can sell them. So far they
have been frustrating to work with unfortunately so I'm not sure on timeline there.

Update on the business: On Thursday 2/16/23 we told our whole team what was going on, and started the
process of winding down the facility. Production will continue in a limited state until March 11th, at which
point we'll transition to full tear-down mode and the majority of our remaining team will be finished
working. Our PO's with the Co-packers are in and distribution agreements have been made so the
necessary components of the business are being outsourced now to the necessary parties.

contracts are signed we can begin the process of transitioning our manufacture over to them, although
that transition will take a bit of time.
We never heard back from your office on timeline so we're going to continue to move as quickly as we can
without putting the business in major jeopardy. We're close though.

I just spoke to Jake [jake@whalebirdkombucha.com | (805) 712-8442] from Whalebird Kombucha, I sent them an
IUP invoice as per the spreadsheet, however he was unsure that he needed a permit as Whalebird Kombucha is
not planning to use this location (3576 Empleo St., Suite 1) for production or manufacturing this fiscal year. He had
stated the production ceased at this location on March 31st 2023.

SUBJECT: Class I Industrial User Wastewater Discharge Permit Cancellation
Industrial User:
Your facility no longer falls under the definition of an Industrial User in the City’s Sewer Use
Ordinance. The operations in which kombucha was produced at this location has moved to a
copacker in Ventura as of March 2023. It has been verified during a pretreatment inspection
on August 9, 2023 that your facility does not pose any current or potential risk to introducing
wastewater or harmful pollutants to the Publicly Owned Treatment Works (POTW).
Therefore, an Industrial User permit is no longer required.
If any changes occur in the future in which production occurs at this facility, then it is required
that a Class I Industrial User Wastewater Discharge Permit Application be submitted prior to
discharge into the sanitary sewer or the POTW.

now using a copacker down in Ventura.
Our department will send out a permit cancellation letter and document this change in our system. Curtis,
