HomeMy WebLinkAbout10/17/1995, 1 - REQUEST FOR INCREASE IN PARKING FINES MEETING DATE: �uN�► IIIVI(IIIIII�III► IIUIII city of San lUis OBISp0wo - s COUNCIL AGENDA REPORT I NUMBER: FROM: Michael McCluskey, Public Works Directotff- Prepared by: Keith Opalewski, Parking Manager SUBJECT: Request for Increase in Parking Fines CAO RECOMMENDATION: a) Introduce an ordinance to print amending section 10.64.030 (Parking Fines) of the Municipal Code to authorize the setting of fines.for parking violations to be established by resolution. b) Adopt a resolution increasing the parking fine for Municipal Code Section 10.36.200 (Limitations on parking in a residential permit parking area) to $20 for all residential parking permit districts and rescinding Resolution 8202 (Establishing parking citation fees, penalties, surcharges, and processing), effective upon final adoption of the ordinance to increase parking fines by resolution. DISCUSSION: On June 27, 1995, Mr. Ray Nordquist, Chairman of the Residents for Quality Neighborhood (RQN); and Mr. Tom Kay and Mr. Henry Case, as Representatives for the Alta Vista Parking District, requested the City Council to consider raising the existing $10.00 parking fine for violations related to parking in a residential permit area without a permit to between $30.00 and $35.00. The request references the South Tassajara parking district as one in which a number of calls are made to solve illegal parking problems. It states restrictions against parking on lawns, parking across sidewalks, and various areas, as well as blocking of driveways is being continuously violated in the Alta Vista parking district. Additionally,parking of boats and RV's as street storage is also seen as a problem that needs to be addressed. The theory is that the $30.00 - $35.00 range of fines would be sufficient motivation to cure the above referenced problems. The request to increase parking fines appears to be directed only to fines for those vehicles found in violation of parking district restrictions, and not to raise overall parking fines for parking meter violations in the downtown area. Staff checked with Mr. Nordquist and verified that this was indeed their understanding of the request. As is standard practice in the City any item relating to a parking district, its formation, or change in rules or regulations (such as the proposed fine change) is considered only while school is in session. Therefore, action on this request was delayed with the knowledge of the requesters until Cal Poly was officially in session. Staff has researched the ability of the City to set varying parking fines with the following results: Current legislation allows the governing body of the issuing agency to set fines and penalties for parking citations issued within its jurisdiction. The City's current Municipal Code(Section 10.36.200-Limitations on parking in a residential permit parking area) is specific to residential permit parking areas. The current parking penalty for not having a residential parking permit is $10.00. This fine can be increased at the discretion of the Council and would only apply to parking permit violations occurring within established residential parking permit districts. rdVl►�►iililllllllll►►unui� �I city of San Luis OBISpo VIII " COUNCIL AGENDA REPORT EPORT Council Agenda Report Page Two Staff has researched the number of calls regarding the South Tassajara parking area with the police department and determined that calls for enforcement on 100 South Tassajara did occur on a daily basis when the parking area was first established, but now average 3-4 calls per week including weekends. Although the closure of San Luis Mountain to public access has reduced the number of people illegally parking on 100 Tassajara, the parking problem still exists which is evident by the ongoing calls. The j Police have and will continue to provide enforcement for the Tassajara residential permit area during off peak hours and weekends. A similar situation has evolved in the Alta Vista parking district regarding the need for routine enforcement. Initially when the ordinance changes governing the administration and enforcement of ! permit districts went into effect last summer, enforcement of the Cal Poly parking district was conducted on a complaint basis only, other than the first two weeks of school. Once we went to a complaint basis only format, calls from the more impacted streets (Foothill, Hathaway, Slack, and Longview) were received on a daily basis. This constant calling manifested into a standing request for daily enforcement from these residents so they would not have to call every day. As a result, we dispatched enforcement personnel on a near-daily basis, provided we had at least two enforcement personnel on-duty. This routine patrol only applied to the impacted streets, with the less affected interior streets patrolled on a j complaint basis to help reduce the amount of time spent in the area. Similar to the Tassajara area, the .I Police will continue to provide enforcement during the late evening and early morning hours. I " The more consistent enforcement has not been without some repercussions. First, the time spent enforcing the outlying residential districts reduces the time we can patrol the downtown core which impacts our management program as well as revenues from fewer citations issued. Second, the longer distances travelled have had a severe impact on the operating efficiency of our electric Cushman vehicles, especially hilly areas. In fact, we have not been able to patrol Tassajara or Poly in the late afternoon if we already had made previous trips early in the day because of low batteries on the Cushmans. This also impeded our ability to effectively patrol downtown at times because the vehicles had to be brought in earlier than desired to charge the batteries. Based on the above factors for both parking and police personnel, staff would fundamentally agree with RQN's statement that the current fine of$10 is not a sufficient deterrent for parking violators. However, staff would recommend a parking fine of$20 be established as opposed to the requested amount. Staff recommends this amount because the RQN request ($30-35) does not appear to be based on any empirical data that would support this high of fine is needed to address the problem. The other reason for the recommended amount is that it matches Poly's current fine of $20 for not having a parking permit and should serve as a sufficient deterrent to reduce illegal parking in the neighborhood. Staff feels that the issues of lawn parking, blocking of driveways and long-term parking (dead storage) can be resolved through increased enforcement of existing regulations instead of raising parking fines. Long-term parking could be addressed by increasing enforcement for the 72-hour limitation for on-street parking without moving the vehicle. Blocking driveways is currently a $20 citation and would not warrant any increase at this time. Lawn parking is a $10 citation and repeated citations for this offense should serve as a viable tool to quell this activity. Furthermore, only two residences within the Cal Poly district have had a history of lawn parking and they have been cited in the past. A more assertive patrol and citing of these few violators could solve the problem without any changes to the current fine structure. i Staff believes that the issues addressed by Misters Nordquist, Kay, and Case can also be resolved by neighborhood cooperation, one neighbor talking with another. Through increased parking fines and friendly dialogue in the neighborhood, the issues and concerns of the RQN can be resolved to everyone's satisfaction. Lacking that cooperation, the Neighborhood Services Manager can intervene in a cooperative and friendly manner providing a dialogue to educate and train existing residents for improved neighborhood coexistence. Ordinance Change The ordinance change is being submitted to simplify the process for increasing the fine for parking violations. Currently; any change to parking fines written under our Municipal Code requires a formal ordinance change to increase the fine (see Exhibit A, legislative draft). However, current law also requires we adopt the parking fines for Municipal Code and California Vehicle Code parking violations as part of the compliance program for processing parking citations as civil penalties. This was accomplished through Resolution 8202 (1993 Series-Exhibit D). The result is that we have a system i whereby we must first change the ordinance for Municipal Code parking violations and then adopt a new 1. resolution that includes all Municipal Code violations as well as Vehicle Code violations. The proposed ordinance change would streamline this process by requiring only a new resolution be adopted any time we want to increase either a Municipal Code or Vehicle Code parking violation. This one-step approach of changing fines and fees via resolution is currently used by the Utilities Department for water rate increases and associated service charges. CONCURRENCES: i The Residents for Quality Neighborhood, Neighborhood Services Manager, and Police all concur that a higher parking fine is warranted in order to better address the parking problem. FISCAL IMPACT: Based on the fact that we generate more citation revenue per hour in the downtown core vs. residential parking permit districts, we actually lose approximately $8,000 each year for our enforcement efforts. By increasing the fine to $20 we could generate an additional $9-10,000 a year based on the historical number of citations written. However, any increase in parling fines for residential parking permit areas would affect citation revenues proportionate to the amount of increase and the corresponding number of citations written. It is possible, and quite probable, there will be fewer citations written as a result of a higher fine. Therefore, the net revenue would vary. The goal of the higher fine would be to reduce the amount of time necessary to patrol the permit districts which ultimately would mean more time for enforcement in the core. From a fiscal standpoint the higher parking fine could be a win-win situation whereby the neighborhoods have a stronger deterrent for parking violators and we get enhanced J-3 ��ii��►b�i�l�llllllill" �I@�11 MY Of San WIS OBISPO MWOMM COUNCIL AGENDA REPORT Council Agenda Report Page Four enforcement in the downtown area. The higher fine could also reduce the amount of time the Police are currently devoting to enforcement of residential parking permit districts Implementation of higher parking fines would require changes to the handwritten citations used by police personnel. Printing costs for labels would be in the $300-400 range. Reprinting handwritten tickets would run approximately $2,000 for all new citations. Parking would cover the printing costs from existing resources in the current line-item budget. ALTERNATIVES: i 1. Increase parldng fine to the requested amount of$35. Increasing the parking fine to the requested amount of$35 is certainly possible. However, the desired effect of reducing illegal parking in the district could be achieved by the recommended $20 fine and still be in line with related fine rates on the adjacent campus. 2. Do not increase the fine at this time. Making no change to the current parking fine is an option, but given the level of enforcement and the concerns of the neighborhood, some increase would seem warranted to help address the issues. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: The City has implemented the provisions of AB 408 and hereby establishes the penalties for parking violations, late payment penalties, administrative fees, and other related fees for all parking violation codes set forth in Attachment 1, attached hereto and incorporated herein. I As you know we were informed at the time this district was authorized that service would be on a demand basis and as available. I can be sure that the Police Department will inform you that_ I have called in many times to report of violators of the ordinance. I am aware that the current fine is $10.00. I am also aware that the Police Department feels that it costs more than $10.00 to respond to a request. I am not aware of the Parking agency's position. It. is my opinion that the marginal cost for the Police to respond to a request is substantially less than $10.00. Keep in mind that it is officers on regular patrol or otherwise unoccupied with more serious duties that respond to a request. Thus the average cost based on time required and an annual cost for salaries, fringe benefits, transportation, etc. is meaningless. I recently observed from the putting green at Laguna Lake G.C. the activity across the street at an auto accident scene. There were at least four policemen, two police cars and a fire truck. The total cost of that accident was horendous based on an average cost. AND the City recoversizilch. As to the Parking agency's problems. They are limited in their response by the inadequacies of their equipment. The electric cars ;purchased by the City run out of power on hills. The driver's visibility is not good. I understand that there is another make of vehicle which is much more satisfactory both as to range and window area. I am not aware of the budget condition of that agency but if it is short of funds, personnel costs are not the culprit. Are fines for :parking violations a means of raising money or are they a deterrent? We do not seem to get repeaters in _ this Parking District. j�LL..,. City Council Tohn Dunn, City Manager Re: Raising Parking District -Fees and Associated Fees In recent years it has become apparent that fines for illegal parking in the neighborhoods have been so low that they do not serve as a deterrent to outsiders or even residents of parking districts. Also, few funds enter the city coffers. In fact, it is difficult to get enforcement at times, perhaps because the fines are so low the _officer may not want to write a ticket and abates the situation. At any rate, some residents are as a result reluctant to call in a complaint and we are living with some illegal cars on the. streets and in the. streetyard (lawn) . Also, regular daytime enforcement has seemed to drop to only patrol at the beginning of a school quarter. We feel that the fines should be in the $30-35 range instead of $10 which is no deterrent. We do want a user friendly situation which can be discussed. It would be relatively simple to investigate what fines are set in other communities. Those we are aware of are much higher. South Tassajara parking district has to call in regularly because of hikers parking there even in the wee small hours. A $10 fine is only considered part of the recreation cost. As we know many of these fines are never collected. An agency would be more interested in recouping a larger amount. Streetyard ( lawn) parking is continuously being violated by the same scofflaws. This is very deg=ading to neighborhoods. Also, there is parking across sidewalks and blocking driveways . Abatement (warning the resident) may be occurring here, too. Parking of boats, utility trailers, and RV' s as street storage is also a problem that needs to be addressed. We feel that increased fines will help fund city services and create a more attractive climate in the neighborhoods.
