REVIEW A TREE REMOVAL APPLICATION TO REMOVE NINE (9) TREES AT EMERSON PARK, 1341 NIPOMO STREET TREE COMMITTEE AGENDA REPORT SUBJECT: Request for the removal of nine (9) trees at Emerson Park , 1341 Nipomo Street APPLICATION NO.: TREE-0467-2026 FROM: Walter Gault, Urban Forestry Program Coordinator / City Arborist Phone Number: (805) 781-7578 Email: wgault@slocity.org RECOMMENDATION Review the proposed tree removal application for consistency with the Municipal Code Section 12.24.090(E) and provide a recommendation to the Community Development Director. 1.0 APPLICATION DESCRIPTION The City of San Luis Obispo, the property owner and applicant, has requested the removal of nine (9) trees (see Table 1 below) at Emerson Park located at 1341 Nipomo Street (Attachment A, Tree Removal Application Form). The removal request is related to the City’s Emerson Park Amenity Upgrades and Beautification Project associated with the Prop 68 State Parks Grant. The Emerson Park Amenity Upgrades and Beautification Project is one of the many Capital Improvement Projects (CIP) that were included in the City’s budget adopted by Council. Page 33 of 97 Item 5b In December of 2021, the City of San Luis Obispo was successfully awarded a California State Parks Prop 68 Grant to revitalize Emerson Park. As a part of the application requirements, the community outreach process was fulfilled as part of the Parks & Recreation Blueprint for the Future. The concept and enhancements were previously reviewed by the Parks and Recreation Commission on February 4, 2026. Details on all the upgrades to the park are included in the Project Plans (Attachment B). The trees proposed for removal and the tree protection plan have also been consolidated into a visual Site Plan (Attachment D). The applicant has proposed an 11:9 on-site compensatory replanting plan that is shown on Sheet L-7.0 of the Project Plans (Attachment B). Page 34 of 97 Item 5b 2.0 COMMITTEE PURVIEW The Tree Committee’s role is to review the removal request in accordance with the process set forth in San Luis Obispo Municipal Code (SLOMC) Chapter 12.24, specifically Section 12.24.090(F)(2) - tree removals related to ministerial development permits on parcels other than R-1 or R-2. This code section utilizes the relevant additional application requirements in subsection (D)(2) and the criteria set forth in subsection (G). 3.0 TREE REGULATIONS The City’s Tree Ordinance (Municipal Code Chapter 12.24) was adopted with the purpose of establishing a comprehensive program for installing, maintaining, and preserving trees within the City. This ordinance establishes policies, regulations, and specifications necessary to govern installation, maintenance, removal, and preservation of trees to beautify the city; to purify the air; to provide shade and wind protection; t o add environmental and economic value; and to preserve trees with historic or unusual value. Criteria for Construction Related Tree Removal Applications. SLOMC §12.24.090 subsection (F)(3) requires review by the Tree Committee using the criteria set forth in SLOMC §12.24.090(G). Applicable criteria are provided in italics below and followed by a description of the proposed tree removals as it relates to that criterion.  (G)(1). Size of Tree. The scale of the tree shall be considered, as well as the size of the tree’s canopy. Larger, more visually prominent trees may have a higher preservation priority than smaller, less visually prominent trees. The trees proposed for removal are generally not large or visually prominent.  (G)(2). Location of Tree on Private Property. The location of the tree on private property shall be considered. Trees located in a private rear yard, which are not highly visible from the public right-of-way, may have a lower preservation priority than trees with a high visual impact to the neighborhood. Most trees requested for removal are recessed inside the park or are small enough so that they do not have a high visual impact on the neighborhood except for Trees #54 and #72.  (G)(3). Species of Tree. Native trees shall have a higher preservation priority than non-native trees. Three (3) trees (#81, 82, 101) are native coast live oaks (Quercus agrifolia). The remaining six (6) trees (#54, 72, 86, 87, 88, and 102), are non-native.  (G)(4). Forestry Best Practice. The number of healthy trees that a given parcel of land will support shall be considered, and whether removal would enhance the health or survival of remaining trees. Applications that increase biodiversity of native trees and tree age distribution within a given area are preferred. The Arborist report analysis notes that trees #101 and 102 have been suppressed by the presence of other larger trees. Others have poor structure or are in poor Page 35 of 97 Item 5b condition (#54, 72, 81) and are not considered healthy (see Appendix A in Attachment C). However, the proposed removals and compensatory replanting plan places new trees in locations where they can be healthy and are not in competition for light and resources with other trees, and increases the biodiversity and tree age distribution in the park.  (G)(6). Compliance with Subsection J of This Section Regarding Compensatory Plantings. The approving authority may consider an application proposal to provide compensatory plantings in excess of required minimums in evaluating this criterion. The applicant is proposing to exceed the minimum required replanting rate of 1:1 on-site by replanting eleven (11) compensatory trees for nine (9) removals.  (G)(7). Heritage Trees. Heritage trees have the highest preservation priority. None of the trees proposed for removal are heritage trees. 4.0 ACTIONS 4.1 Recommend findings of consistency with the Tree Regulations. An action recommending approval of the proposed tree removals based on consistency will be forwarded to the Community Development Director for final action. This action may include recommendations regarding the compensatory replanting plan with size and species of tree. 4.2 Recommend findings of inconsistency with the Tree Regulations. An action recommending denial of the proposed tree removals should include findings that cite the basis for denial and should reference inconsistency with the General Plan, Tree Regulations, or other policy documents. 4.3 Continue the project to a hearing date certain, or uncertain. Ms. Benet, In response to your request for a tree inventory, impact and tree protection plan regarding proposed park renovations at Emerson Park, I have produced the following report. Assignment Produce written tree inventory, tree impact and tree p rotection report adhering to City of San Luis Obispo tree regulation standards. Report to include: o Synopsis of tree conditions. o Spreadsheet accounting of all trees within building envelope, utility installation routes or other site improvement areas. o Show location, species, diameter at standard height (dsh) of all individual trees in study area on tree site map. o Indicate which trees will be removed or impacted. o Indicate trees to be protected on site plan. o Determine and delineate tree protection zones (TPZs). o Tree protection guidelines for contractors. Summary In total, fifty-four (54) trees were listed in the inventory and tree protection plan. The proposed project is for renovation of the entire park. I have proposed the removal of nine (9) trees due to substantial construction impacts. Two (2) trees will require mitigation based on meeting the diameter size for tree replacements set by the city. The replacement ratio is typically 1:1 but the final determination will be made by the city arborist or community development director. Page 45 of 97 2 A pre-construction meeting shall be held with the project arborist and all parties involved with the project to ensure all tree protection measures are understood. All tree protection fencing, and tree protection measures shall be in place before any construction activity begins. Introduction The site is an established park with mature landscape trees, basketball court, bocce court, exercise equipment, community gardens and picnic areas. The land has been leveled, and the majority of the useable area is planted in turf. During the process of updating the park, there will be substantial changes to the amenities. While the majority of the trees in the park can be retained and protected, based on the current site improvement plan, some trees will be heavily impacted and require removal. Per the City of San Luis Obispo’s Tree Regulations Chapter 12.24, all native oak trees 10-inches in diameter and greater, and all non-native trees 20-inches in diameter or greater require approval for removal via the applicable ministerial or discretionary permit application process. Removals meeting or exceeding the size limits require mitigation on site at a ratio of 1:1. Offsite mitigation planting shall be replaced at a 2:1 ratio. Tree protection measures must be implemented before construction begins. Oversight of construction crews by the project arborist or city arborist will be required when working within or adjacent to the critical root zone (CRZ) of a protected tree. Refer to Appendix A - Tree Inventory and Tree Protection Table. See also Attachment 1– Tree inventory and Tree Protection Map for individual tree details. Methodology Tree Diameter Measurements Diameter at Standard Height (DSH) was measured at 4.5’ above ground. For multi-stem trees that divided below 4.5’, if at least 1 stem met the minimum diameter criteria for the species, I measured below the division at the narrowest point on the trunk. If it was not possible to measure below the division, I measured each stem individually, then squared the diameter of each stem. Finally, I summed the squared diameters and took the square root of the sum to get the calculated diameter of the tree. Critical Root Zone Measurements Critical Root Zones (CRZs) were determined by giving a radius of 1-foot per every inch of tree diameter. E.g., a 12-inch diameter tree would have a 12-foot CRZ radius measured from the outside of the trunk. Tree Protection Zone Measurements Generally, tree protection zone (TPZ) distances follow the distances listed for CRZs. However, if encroachments were allowed if structural roots or the health of the tree would not be compromised, TPZs were adjusted to accommodate the design. Trees with significant encroachments into CRZs were called out for on-site observations of work by the project arborist to ensure unscary damage to the tree was not caused. Page 46 of 97 3 Tree Condition Ratings All trees in the inventory were given a condition rating. The rating was based on the health, structure and presence of disease and insects. See the following definitions: 1. Dead = Severely declining or no foliage, large dead branches, decay cavities, loss of bark, roots decayed or dead. 2. Very Poor = Evidence of multiple large past failures, advanced disease, uncontrollable pest infestations or disease infection. Tree in severe decline. 3. Poor = Tree may be suppressed, drought stressed, or had at least 1 large branch failure. Disease or pest infestations may be present. Can potentially be retained with attention to mitigation pruning, cultural care changes, pest and disease control. 4. Fair = May have had minor past failures. Some pests or structural defects may be present, small deadwood. Minor to moderate drought stress present. Defects may be mitigated with pruning and pests can be controlled. 1. Good = A relatively healthy tree with minor to no structural defects with minimal to no pest observed. Defects can be mitigated with pruning and pests can be controlled. 2. Very Good = Trees that have had professional arboricultural care. No structural defects, disease or pests identified. 3. Excellent = Specimen tree with superior form, root structure and health. Tree has been regularly cared for by professional arborists over its lifetime, E.g., estate or arboretum tree. Trees Inventoried In total, I inventoried fifty-four (54) trees. According to the City of San Luis Obispo tree ordinance, Municipal Code Chapter 12.24, all trees that will potentially be impacted by construction are required to be inventoried. I inventoried all landscape trees within the project limits that measured 2 inch diameter and larger with heights of 4.5’ or greater. Only trees at or above the City’s size threshold require approval for removal. The complete inventory, including tree numbers, species, CRZ and TPZ measurements, is provided in Appendix A - Tree Inventory and Tree Protection Table. I numbered all trees in the field with pre-printed metal tags that were attached between 4 and 6 feet above ground. Tag numbers assigned were 50-103. All inventoried trees were plotted on the Tree Inventory & Tree Protection Map included as Attachment 1 of this report. Tree Removals Nine (9) trees have been recommended for removal. They are trees 54, 72, 81, 82, 86, 87, 88, 101 & 102 will require removal due to construction impacts. The majority were small diameter specimens that were below the size limit for requiring a permit or replacement. One third of the trees listed for removal were in poor condition due to disease and structural issues. The remaining two thirds were primarily in fair condition with one (1) tree listed in good condition. Appendix A - Tree Inventory and Tree Protection Table provides complete details regarding each tree. Below I have provided the primary reason for removal of each tree in the list below. Page 47 of 97 4 • 54 - Impacts from demolition and reinstall of asphalt and city sidewalk will affect approximately 80% of the critical root zone. The impacts to the roots will cause further decline to this already stressed tree. • 72 - Demolition of hardscape around tree will impact 100% of its critical roots and kill the tree. • 81 - Critical roots will be severely impacted by install of underground utilities and demolition and construction of asphalt. • 82 - Critical roots will be severely impacted by install of underground utilities and demolition and construction of asphalt. • 86 - Tree is in construction envelope for new bathroom and sidewalk. Impact too great to retain tree. • 87 - Tree in footprint of new sidewalk. Impact too great to retain tree. • 88 - Tree in footprint of new sidewalk. Impact too great to retain tree. • 101 - Tree is in conflict with proposed perimeter fencing. • 102 - Tree is in conflict with proposed perimeter fencing. Tree Replacements Trees 54 and 101 are at or above the size limits that require mitigation. Tree 54 is a 28” diameter non- native Brazilian Pepper and Tree 101 is a 10” diameter native coast live oak. In addition to the new trees included in your landscape plan, more trees may need to be replaced to compensate for the removals I have recommended. Typically, the ratio for replacement is 1:1. If additional mitigation trees are required, the exact number of trees to be replaced shall be determined by the city’s community development director. Impacted Trees There were several trees within this project that will be impacted to some degree. Whereas minor impacts are tolerable, impacts of over 25% to the critical root zone or CRZ can cause stress on the trees. Trees with high percentage impacts to their CRZs were 52,53,68,69,70,71,73,74 and 90-97. This site is unique in that some of the impacts are simply caused from the removal of existing landscape vegetation around the trees. A tree listed in this inventory that has all of the landscaping removed in its CRZ may have an impact percentage rating of up to 60%. However, the actual damage caused by removal of the plant material, if completed by hand, will likely be nominal. Hand removal of small plants is less invasive than the use of a mini excavator or rototiller and will not significantly disturb critical roots. Trees in this category are 68-71, 73 & 74. Page 48 of 97 5 Another example of high impact percentage rating with lower actual impact is where decomposed granite (DG) is being replenished or newly installed. In this case the CRZ could have a rating of 50% but if the DG is hand removed and replacement DG is not compacted by a machine, the actual damage to roots will be low. Finally, trees 52 & 53 have higher potential for root damage because hardscape is proposed for removal within their CRZs. The assessed impacts to critical roots are 50%. However, if the work is completed with hand operated jackhammers and the debris are removed by hand, as I have prescribed, the impact to critical roots will be much lower. The final design will actually provide more favorable root space for the trees to grow into. In both instances, I have allowed for the encroachment into the CRZs but with special instructions to be followed. They include hand grubbing of plant material, no tilling or machine use, hand demolition of hardscape and finally hand planting of new landscape material within the CRZ of trees. Additionally, I am requiring oversight be provided by the project arborist when construction crews are performing work in the critical root zone of trees. Oversight of construction crews will be absolutely essential to preserving critical roots and ultimately, to the success of the trees when the project is complete. Tree Protection Requirements Critical Root Zones were determined by giving a radius of 1-foot per every inch of tree diameter. E.g., a 12-inch diameter tree would have a 12-foot CRZ radius measured from the outside of the trunk. Distances for CRZs and TPZs are listed in the Tree Inventory & Tree Protection Table included in Appendix A. Trees requiring arborist supervision are also called out in Appendix A. TPZ fencing and or trunk protection shall be provided for all trees listed for tree protection in the inventory provided in Appendix A. All TPZ fencing shall be set according to specifications listed in Appendix A. Delineations and distances are also shown on the Tree Inventory and Tree Protection Map provided as Attachment 1. Tree protection signs shall be placed on the TPZ fencing and be spaced 10 feet apart. Signs shall be weatherproof, and state, “Tree Protection Zone – Do Not Enter.” The signs shall also include the project arborist’s phone number. Signs shall remain in place until completion of the project. See Appendix B – Tree Protection Diagrams - Diagrams 1 & 3 for further detail. Where it was not feasible to have tree protection fencing installed due to construction access needs, tree protection signs marking the TPZ area shall be used. No construction or ground disturbance shall be allowed inside the fenced TPZ without the project arborist’s permission and/or oversite. If you are unsure whether an activity is allowed, refer to Appendix C - Tree Protection Requirements – Quick Reference List and contact the project arborist, Rodney Thurman, at 805 234 8760. Tree Specific Protection Measures The majority of the trees on site will be retained and protected. It is critical that all tree protection measures be installed and maintained. Tree protection fencing, tree protection zone signage and trunk protection are required to be in place for the duration of the construction project and shall be installed before starting any ground disturbing activities. Page 49 of 97 6 Do not remove any tree protection fencing, signage or enter the TPZ without approval of the project arborist. Refer to Attachment 1 – Sheet TPP-1 -Tree Inventory and Tree Protection Plan Map for delineation if TPZ areas and “call outs” for all tree protection measures. Trees requiring TPZ fencing are 55-68, 73-80, 83,85,89,90,99,100 and 103. Tree Protection Fencing shall be installed according to the TPZ distances prescribed in Appendix A – Tree Inventory & Tree Protection Table. The fencing shall be 4 feet tall and made of orange, high density, polyethylene with 3.5” x 1.5” openings. It shall be installed on steel posts 8 feet on center and tightly stretched to prevent sagging. See Appendix B - Tree Protection Diagrams - Diagram 1 – Tree Protection Fencing. There were several location within the project where it was not feasible to fence a TPZ. In that case tree protection signage marking the perimeter of the specific TPS was prescribed. The following trees require TPZ signage but no TPZ fencing. 52,53,70,71 and 90-97. Trees requiring trunk protection are 50-53, 57-71 and 90-97. See Tree Protection Notes in Appendix A for this requirement. Trunk protection shall be installed by placing 2x4’s against the trunk and securing them with zip-ties or wire. Do not anchor wood or wire directly to trunk. See Appendix B - Tree Protection Diagrams – Diagram 2 for further instruction. Construction Oversite by Project Arborist Trees 52,53,62,68-71,73-75,78,79 and 89-97 will have significant encroachments into their CRZs and will require all construction activities be monitored by the project arborist. The project arborist will provide guidance to the crews to ensure that the least amount of disturbance to the trees is caused. If a tree is listed for oversight no work shall occur without the project arborist being present. Refer to Appendix A- Tree Inventory and Tree Protection Table for instructions. Refer to Attachment 1 – Sheet TPP-1 -Tree Inventory and Tree Protection Plan Map for tree locations. Pre-Construction Meeting Prior to any construction or ground disturbing activities, the project arborist shall meet with all parties involved with the construction of the park to review tree protection measures. Any new contractors brought on site shall also meet with the Project Arborist to ensure they are aware of all tree protection measures. Conclusion Eighty-four (84) percent of trees on site have been listed for retention and protections. Only nine (9) trees have been recommended for removal. The majority the removals were small diameter specimens, in poor to fair condition, that were below the size limit for requiring a permit or replacement. When the project is complete, the gain of trees from the installation of new landscape and mitigation plantings will exceed the loss of the removals. Page 50 of 97 7 Oversight of construction crews by the project arborist will be extremely important to ensure the protection and long term survival of trees that will have encroachment into their critical root zones. If all tree protection measures are implemented and construction crews are overseen by the project arborist as directed by this report, I do not anticipate any tree loss beyond those listed for removal. Page 94 of 97 51 Appendix C - Tree Protection Requirements - Quick Reference List 1. Tree Protection During Construction - Tree protection shall be provided during the entire time construction activities occur. A Tree Protection Zone (TPZ) shall be established and maintained to ensure protected roots remain undisturbed. 2. Tree Protection Fencing - Tree protection fencing is required to be in place for the duration of the construction project and shall be installed before starting any ground disturbing activities. Do not remove any tree protection fencing or enter the TPZ without approval of the project arborist. The fencing shall delineate and protect the tree protection zone. The fencing shall be 4 feet tall and made of orange, high density, polyethylene with 3.5” x 1.5” openings. It shall be installed on steel posts 8 feet on center and tightly stretched to prevent sagging. See Appendix B - Tree Protection Diagrams - Diagram 1 – Tree Protection Fencing. 3. Trunk Protection - Tree protection fencing is required See Appendix B - Tree Protection Diagrams - Diagram 2 – Trunk Protection. 4. Tree Protection Signage - Weatherproof, tree protection signs stating “Tree Protection Zone – Do Not Enter” shall be placed on the fencing and be spaced 10 feet apart. Signs shall remain in place until completion of the project. See Appendix B - Tree Protection Diagrams - Diagram 1 – Tree Protection Fencing. 5. Pre-Construction Meeting - A meeting with all contractors involved in the project shall occur with the project arborist before beginning construction activities. Any new contractors brought on site shall also meet or communicate with the project arborist to ensure they are aware of tree protection measures. 6. Preparing Tree Protection Zone - If construction occurs during the months of June through November, the TPZ’s shall be irrigated to a depth of 12 inches before construction begins. This will ensure the trees are properly hydrated. Additional irrigations during “heatwaves” may be recommended by the project arborist. 7. Root Protection - No grading, trenching, paving or any other soil disturbance shall occur within or adjacent to the TPZ of the tree without permission and supervision by the project arborist. No trenching or excavation for footings, foundations, utilities or roadways shall occur within or adjacent to the TPZ without first, hand trenching the location and exposing roots. If possible, conduit or other utilities shall be “fished” below roots larger than 1-inch diameter. Any roots 1-inch diameter or larger that are approved for pruning shall be hand cut with a clean pruning saw or Sawzall. Once roots are hand cut, machinery can remove the severed roots. Cutting any roots 1-inch diameter or larger requires supervision by the project arborist. Page 95 of 97 52 8. Root Pruning - If the project arborist determines that a root over 1-inch diameter needs to be cut, it shall be cut by hand with a pruning saw or reciprocating saw “Sawzall”. After cutting a root, the area shall be backfilled as soon as possible with moist soil or covered with wet burlap until backfill can be completed. Burlap shall be kept wet the entire time it is in use for cut-root protection. 9. Dumping, Cleanout or Storage of Materials - No construction materials, soils, or debris shall be stored in the TPZ. No concrete, plaster, paint or chemical washout shall be allowed within the TPZ or Critical Root Zone (CRZ). 10. Monitoring - An initial inspection shall be completed by the project arborist prior to commencement of construction activities to ensure that all tree protection measures have been put in place. Weekly inspections of the TPZ and associated fencing shall also be completed by the project arborist until construction is complete. Any root pruning, excavation, grading or filling within 5 feet of the TPZ shall be monitored by the project arborist. 11.
