SUBJECT: MODIFICATION TO MARSH STREET CONTRACT
We would request consideration of a contract modification on the Marsh Street Project which
would replace the 17 stamped concrete crosswalks with thermoplastic crosswalks. In addition,
we would like to consider an add-on contract item to expend the money saved by applying
paving blankets on adjacent downtown streets.

Mr. McCluskey will be prepared to respond to the City Council's questions on the executed
Marsh Street contract and the effect of any potential modification.

Re: The Marsh St. construction project
I would like to start out by saying the Telegram-Tribune printed
a very informative article on this subject and opened my eyes on
the type of back door politics that go on in this city.
As citizen of this town I strongly appose the changes to the
original design. This city does have a adopted plan for the
downtown area that was the result of many hours of planing and
multiple meetings. This simply can not be overturned ,by a rushed
council meeting. Up until now I thought our Mayor and Vice-Mayor
had a clear vision on .the direction of our city and did not think
they could be easily persuaded by a contractor who has everything
to gain and leave the city with a unfinished project. If this is
such a good idea, why wasn't it proposed early in the project when
there was still time to research the proposed plastic products.
With the high volume of traffic on Marsh, this product may not last
two years. The only one to gain by making this change would be Mr.
Madonna. He makes and places the asphalt were his profit margin is
higher, he saves time and finishes the job early and he eliminates
a long lasting product for our city. I have been through this
traffic nightmare many times and we deserve what we were promised
and what we paid for. If these changes were to go through, Mr. Pink
would be in the green, the city in the red and our mayor and vice-
mayor down the drain.
This is not a good way for Mr. Madonna to save his name,
especially after his last job downtown.

Alex Madonna called to request that the City Council not take up the Marsh Street proposal
that he has made in view of the responses in the Telegram-Tribune he read from the BIA
and Council- He indicated that he will proceed with digging up the 2,600 square feet of
roadway as per contract.

Dear Councilmembers,
The topic of this letter is the Marsh Street project. Based upon a report in
the T & T it appears that you may consider modifying the contract for the
project. As a downtown business owner I have felt all the negative
impacts of the construction and am eagerly awaiting the end of
construction. To this end I had chosen to be silent about the project and
just wait for its completion so that we could go forward. The thought of
opening up the contract sends chills down my spine, yet I am not satisfied
with the project at all. The finished project is very important to our
downtown, it's style and quality along with the Copeland center will
define and set the standard for the downtown for many years to come.
The issue of the change in the design of the crosswalks is very important.
To change and go with plastic tape would be a major mistake in that it
sets a much lower standard for the project. The change in materials and
clear definition of the crosswalks creates a subtle but clear environment
of pedestrian priority as well as setting a tone of "quality" for the area.
After talking to members of our community with special needs it is also
clear that the issue of texture and ease of use is also real. The
crosswalks should have at least a relatively smooth center strip for
strollers, wheel chairs, canes, high heels, etc. but please do not even
consider going only to plastic strips. The subtle difference between
strips and a change in pavement will have a major impact on the perceived
quality of the project and of the town.
In looking at the quality of the project I hope the council takes notice of
the poor quality of the concrete work in general. I would hope that each
member of the council takes a personal look at the project before the city
signs off on the project. Many, if not most, of the small sections of
sidewalk that cover where the water laterals were hooked up are covered

with graffiti. There is some graffiti, foot prints and poor texture areas
(some caused by the obvious brushing or scraping to remove graffiti) on
most of the new bulb-outs. These sidewalk areas already look "old and
patched" and should not be accepted. A contrast can be found by looking at
the same style sidewalk which was poured on a Thursday afternoon (same
environment and same problems) in front of the new Victoria's Secret.
Before any of the concrete was poured it was suggested to the project
engineer that a guard be posted on any concrete that could be marked
because the problem was very foreseeable. On a least several occasions I
know that this was not done or a least that the guard was not visible.
A third problem is a design one that has to do with safety. The planter
that is in front of Juice Club is on the upstream traffic side of the
crosswalk and is high enough to obstruct a drivers view of children that
approach the street. This is similar to the design on Monterey Street but
was not changed to reflect the needs of a one-way street.
It is unthinkable to think of construction continuing on into the Christmas
season. To do that would likely spell the end for some business's. It is
also not justifiable to accept a low standard from such a major and
important defining project in our downtown.

SUBJECT: MARSH STREET( CONTRACT
I am unable to be in attendance Tuesday, but am giving you the.courtesy of a letter so you
will know where I stand on the Marsh Street contract, which has been added to the agenda.
First, I believe it has been inappropriately added to the agenda, as the addition is not in
adherence to the City Council's own Policies and Procedures. Therefore, I would ask the
Mayor and the Vice Mayor to remove the item from the agenda.
Secondly, on the substance of the matter, I believe the Marsh Street Improvement Contract
was fully and appropriately considered by the City Council in our several past discussions
of it. I believe the incised concrete crosswalks will add to pedestrian safety and the
aesthetics of the downtown, and that the present contract must be upheld.
Third, I believe that the matter of an individual Council Member being able to place an
item on the agenda, currently scheduled for November 21st, is important enough to be
discussed by the full Council. I respectfully request your continuance of this matter to the
meeting of December 5th.

Re: Modification to Marsh Street Contract
We have recently become aware of a proposed contract modification
that would eliminate the installation of 17 stamped concrete
crosswalks as part of the Marsh Street Improvement Project.
Our board would like to go on record as strenuously opposing this
modification for the following reasons:
• The change would diminish the overall beauty, quality, integrity
and unique appearance of the finished- project.
• Any change in the project at this time would infuriate the
Downtown merchants as well as other members of the community.
• The changes would not be consistent with the intent of the
Downtown Conceptual Plan.
• The stamped crosswalks were designed to increase the safety and
comfort level of pedestrians and provide for an overall traffic
calming effect.
• if properly installed, stamped crosswalks should easily
accommodate handicapped travelers.
• Issues which now appear to be special considerations .should have
been incorporated into the design aspect of the project and not be
presented near the completion of the project.
• As more structured parking is developed outside the Downtown
"loop," well-delineated pedestrian connections to the business core
