Fraser, Engineering Assistant SUBJECT: Public Hearing to Consider the Formation of Underground District 12 (Jennifer /Osos Street at SPRR) CAO RECOMMENDATIONS: Give Final Passage to Ordinance No. 1289 amending Section 13.12.040 of the Municipal Code to establish Underground District 12. DISCUSSION: The Council Passed to Print Ordinance No. 1289 amending Section 13.12.040 of the municipal code to establish Underground District 12 (Jennifer /Osos Street at SPRR) at a Public Hearing held on November 21, 1995. Council must now consider final passage. Per Section 13.12.030, "Underground Utility Districts- Hearing - Declaration ", of the Municipal Code, the City Clerk is to notify all affected property owners and utilities by mail at least 30 days prior to the date of the Public Hearing. The Clerk was not notified of this project in time to comply with the 30 day requirement for the November 21 st Public Hearing. Therefore, in order to comply with the Municipal Code requirement, it is necessary to also schedule the final passage of this ordinance as a Public Hearing allowing the proper notification of all affected property owners and utilities (only utilities were notified since no private property owners are affected by this district). Notification was mailed to affected parties on November 30, 1995. This is 33 days in advance of the scheduled January 2nd Public Hearing. Adopt resolution approving the proposed revised priority list for underground districts. Direct staff to proceed with District 12. 2.) Pass to print the ordinance to amend Section 13.12.040 of the municipal code to establish Underground District 12. DISCUSSION: The City currently has'a CIP project to build a bicycle /pedestrian bridge over the railroad at Jennifer street adjacent to the train depot in the area know as "Railroad Square ". The existing overhead utilities conflict with the proposed location of the bridge and will need to be relocated before construction of the bridge begins. The most familiar means of achieving relocation would involve relocating existing poles a distance away from the bridge and /or raising the poles and wires above the bridge to obtain the required clearances. During the City's Architectural Review of the bridge project, the commission recommended that the overhead utilities be relocated underground and /or placed in a conduit on the bridge to improve the aesthetic appearance of the railroad depot area. The Bridge project does not have adequate funds to underground or conceal utilities, however, there are PUC Rule 20A funds available through the utility companies to accomplish this task. Since 1965, the City has been actively engaged in undergrounding overhead utility lines using 20A funds. To date eleven districts have been completed. In the past, conversion projects have followed a preferred project list adopted by the City Council. This project list has been revised in the past by the Council in an effort to permit undergrounding to take place in conjunction with improvement projects such as street widenings. The latest revision occurred in 1985 when Council adopted Resolution #5853 which reprioritized the list to allow the undergrounding of Madonna and Higuera Streets to coincide with a widening project. The conceptual priority list is as follows: 1. Downtown 2 Major entryways and traffic corridors 3 Streets scheduled for widening 4 Area with large new developments 5 Areas adjacent to above locations and which have particularly unsightly overhead utilities. This conceptual list became a preferred projects list ( Attachment C,Current Priority List), and was established with an emphasis on "traffic corridors" and not necessarily "entryways" into the City. City Or San 1UIS OBISPO COUNCIL AGENDA REPORT The "Railroad Square" area is an established historic district as well as an "entryway" to the city for train travelers. With the addition of Amtrak's San Diegan Extension, the volume of tourists and travelers using this access point is likely to increase. The "Railroad Square" area is not on the current list of preferred projects, however, staff believes it is in line with the City's policy in converting areas that are entryways and adjacent to downtown and have unsightly overhead utilities. Staff concurs with the ARC recommendation and believes it would be prudent to underground the unsightly overhead wires at this time to facilitate the construction of the pedestrian bridge rather than just merely moving the poles to the side and /or raising the wires. A proposed project list (Attachment A, Revised Priority List) is submitted which establishes Osos /Jennifer Street as top priority and slides the remaining projects down the list. The Santa Rosa/ Foothill district which was top priority will now be second priority, however this shift down in priority will not delay the timing of this project as there are sufficient 20A funds available to also do this project. Remaining projects will be pursued as sufficient 20A funds are accumulated. The process for formation* of a utility district shall be In accordance with Chapter 13.12, "Underground Utilities" of the Municipal Code. Upon adoption of the revised project list (attached resolution) and Council's authorization for staff to proceed with the formation of Underground District 12, council shall pass to print the ordinance establishing Underground District 12. A public hearing will be called to determine the necessity for the removal of the overhead utilities. The City Clerk will notify all affected property owners and utilities at least 30 days prior to the date of the hearing. If after the hearing Council determines that the district is necessary, then Council shall give final passage to the ordinance declaring the area an underground utility district. The ordinance will include a description of the district and shall fix the time by which all overhead utilities must be removed. In this case the time is fixed for June 30, 1996 in an effort to coordinate with the construction of the bridge project next summer. ALTERNATIVE: Require utility companies to relocate overhead out of the way of the new public facility at their expense which will not remove the unsightly wires and poles but will simply relocate poles to the side and /or raise wires above the bridge to achieve the required clearances. FISCAL IMPACT: The City receives approximately $200,000 /year in underground conversion funds and can draw on funds as much as 5 years in advance. As of April of this year, the City had accumulated $837,864. Staff estimates $50,000 for the conversion of the proposed District 12 project. Please see the attached revised ordinance and exhibit. This modification will allow the pole on the easterly side of Jennifer Street to be moved 4' to 5' east, thus removing it from the proposed bike path and relocating it into a proposed planted area still within the ROW. This pole serves several customers along the back of the lots. Removal of this pole outside of the ROW would require Pac Bell to relocate the pole on to private property to enable them to continue serving these lots. It is staffs intention to not involve the residents with the creation of this underground district. The District boundaries were drawn to eliminate the wires crossing SPRR without involving the service to the adjacent residents. WHEREAS, the City of San Luis Obispo wants to improve the image and appearance of. the City by placing all overhead utilities (for electricity, telephone and Cable TV) underground in various highly visible land use zones; and WHEREAS, the City's adopted management policies focus on major entryways, streets scheduled for widening and large new developments as prime locations for placing overhead utilities underground; and WHEREAS, the "Railroad Square" area is a highly visible land use zone as well as a gateway to the City for train travelers WHEREAS, the City has a CIP project to build a pedestrian/ bicycle bridge over the railroad track within the Jennifer /Osos.street right -of- way; and WHEREAS, the existing overhead utilities will need to be relocated to facilitate the proposed bridge design; and WHEREAS, the City's ARC recommends that unsightly overhead utilities be concealed as part of this project to improve the aesthetics of the historic district and, WHEREAS, staff recommends conversion to underground utilities along aforementioned portion of Jennifer /Osos Street, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1.
