Kenny, Supervising Civil Engineer SUBJECT: Final Map Approval for Tract No. 2084, a commercial condominium conversion subdivision at 3523 S. Higuera (Wm. Portzel, Subd.) CAO RECOMMENDATION: Adopt resolution approving the final map for Tract No. 2084 BACKGROUND: Tract No. 2084 was tentatively approved on Dec 3, 1991 per Resolution No. 7059 (1991 Series). It is a resubdivision of lot 7 of Tract 703 All onsite and offsite public and private improvements were constructed several years ago. Therefore, no subdivision agreement is required. The subdivider has complied with the applicable conditions of the tentative map for this tract. The final map has been checked and found to be in substantial conformance with the tentative map. CC & R's have been approved for the tract, which include provisions for maintaining landscaping, common utilities and other prescribed map conditions. The CC & R's will be recorded with the final map. FISCAL IMPACT: None. (1996 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING THE FINAL MAP FOR TRACT NO. 2084 (Portzel, Subdivider) WHEREAS, the City Council made certain findings concerning Tract 2084 as contained in Resolution No. 7059 (1991 Series), and WHEREAS, all conditions required per Resolution No. 7059 (1991 Series) for Tract No. 2084 have been met. NOW THEREFORE BE IT RESOLVED that final map approval is hereby granted for Tract No. 2084. COMMUNITYDEYE OPMENTAPP PUBLICSERWW APPROVAL— / RESOLUTION NO. 7059 (1991 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO GRANTING APPROVAL OF TENTATIVE TRACT NO. 2084 LOCATED AT 3523 SOUTH HIGUERA STREET-"—'--- BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Findings. That this counc'1, after consideration of the tentative map of Tract nd the Planning Commission's recommendations, staff recommendations, and reports thereof, makes the following findings: 1. The design of the tentative map and proposed improvements are consistent with the general plan and specific plan for Higuera Commerce Park. 2. The site is physically suited for the type and density of development allowed in the C -S -SP zone. 3. The design of the tentative map and the proposed improvements are not likely to cause serious health problems, substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat. 4. The design of the subdivision or the type of improvement will not conflict with easements for access through, or use of property within, the proposed subdivision. 5. The Community Development Director has determined that proposed subdivision is exempt from environmental review. SECTION 2. Conditions. The approval of the tentative map for Tract 2084 be subject to the following conditions: 1. The subdivider shall submit a final map for,.apprc�zzl and recordation. Y ,bCc:r 2. The final map shall note a blanket easement over the common lot area, except under the structures, fiar,.underground public utilities serving the site, to thIgbl jproval of the City Engineer and affected utility agen'cie's'.(..- 3. The subdivider shall establish covenants, conditions; and restrictions.•for the regulation of land use control of nuisances and architectural control of the building and facilities. There shall be no change in city - regulated provisions of the CC &R's without prior approval of the Community Development Director. 5. The subdivider shall include the following provisions in the CC &R's for the tract: a. The property owners' association shall be created to enforce the CC &R's and provide for professional, perpetual maintenance of common areas, including, but not limited to, the driveway, parking lot, landscaping, sewer, utilities, and building exteriors. b. The right shall be granted to the city to maintain common areas if the property owners' association fails to do so and to assess said association for expenses incurred. C. All parking spaces provided on the site shall be available for use by all of the individual owners.
