DISCUSSION Data S— uummary Project Address: 791 Orcutt Rd Applicant/Property Owner: Marilyn Stickler Representative: John Mitchell Zoning: Manufacturing (M) General Plan: Services and Manufacturing Environmental Status: The Director made an declaration on October 13, 1995. Project Action Deadline: None; legislative act. Background initial determination to prepare a negative The Council introduced this ordinance, as recommended by staff and the Planning Commission, at its December 5th hearing. To better insure the integration and compatibility of development on the two adjacent parcels, the applicant is requesting that the property at 791 Orcutt Road be rezoned to have the same designation as the bordering property along Broad Street. Please refer to the attached vicinity map. The new zoning designation will become effective 30 days after final passage of the ordinance. Significant Impacts The City Council has adopted the initial study of environmental impact (ER 122 -95) which concludes that a Negative Declaration will be filed for the project. Attached: Ordinance No. 1290, as introduced Vicinity Map SUMMARY ORDINANCE NO. 1290 (1995 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO TO AMEND THE OFFICIAL ZONE MAP FROM M TO C -S -S FOR PROPERTY LOCATED AT 791 ORCUTT ROAD (File Number: R 122 -95) On December 5, 1995, the City Council voted 5 to 0 to introduce Ordinance No. 1290, which approves a proposal to rezone a 4 acre site, located southeast of the intersection of Orcutt Road and Broad Street, from Manufacturing (M) to Service - Commercial Special Consideration (C -S -S). The rezoning is being requested to better insure the integration and. compatibility of development on this and the adjacent parcel which the applicant also owns. The ordinance determines that there will be no significant adverse environmental impacts as a result of amending the zoning map. The Council must vote again to approve the rezoning before it can take effect. That action is scheduled for January 4, 1995, at a regular meeting of the City Council to begin at 7:00 p.m. in the Council Chamber at City Hall, 990 Palm Street. C. 07-3 ORDINANCE NO. 1290 (1995 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE ZONING MAP TO CHANGE PROPERTY FROM M TO C -S -S AT 791 ORCUTT ROAD (File Number: R 122 -95) WHEREAS, the Planning Commission conducted a public hearing on november 8, 1995 and recommended approval of an amendment to the City's Zoning Map; and WHEREAS, the City Council conducted a public hearing on, December 5, 1995 and has considered testimony of other interested parties, the records of the Planning Commission hearing and action, and the evaluation and recommendation of staff; and WHEREAS, the City Council finds that the proposed amendment is consistent with the General Plan; and WHEREAS, the City Council has considered the draft Negative Declaration of environmental impact as prepared by staff and reviewed by the Planning Commission; and BE IT ORDAINED by the Council of the City of San Luis Obispo as follows; SECTION 1. The City Council finds and determines that the project's Negative Declaration adequately addresses the potential significant environmental impacts of the proposed zoning map amendment, and reflects the independent judgement of the City Council. The Council hereby adopts said Negative Declaration. SECTION 2. The Council approves application No. R 122 -95, thereby amending the Official Zoning Map designation for the site from Manufacturing (hO to Service- Commercial Special Consideration (C -S -S), as shown on and described by attached Exhibit A. SECTION 3. The Special Consideration zoning is hereby established on this site to x'-7'7 ensure that development adequately addresses traffic, circulation, creek preservation, and downstream drainage impacts. SECTION 4. Administrative use permit approval is required for any use proposed on a property with a Special Consideration zoning, unless a master list of permitted uses is adopted as part of the rezoning. The master list of allowed and conditionally allowed uses for this site is attached as Exhibit B. SECTION 5. A summary of this ordinance, together with the names of Council members voting for and against, shall be published at least five (5) days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in this City. This ordinance shall go into effect at the expiration of thirty (30) days after its final passage. MASTER LIST OF ALLOWED AND CONDMONALLY ALLOWED USES 791 ORCUTT ROAD R 122-95 To minimize adverse impacts on wildlife resulting from human activity near the creek: 1. No outdoor speakers or amplified music is allowed in conjunction with any use established. 2. Outdoor activities such as sales, storage, dining, repair, or play areas shall be limited in size and oriented away from the creek, subject to administrative use permit approval. 2.
